1 None Do bidders need to do anything with Attachment 01 – Past Performance Questionnaire?
a. Do bidders need to send this form to their past performance agencies/companies to complete and return to the MICC?
b. If yes, this attachment states that the forms must be returned no later than 15 days after receipt of request or March 18, 2020, whichever occurs first. However, it also states that the form should be returned not later than the proposal due date and time.
Could you clarify which one of these dates is correct?
Yes bidders need to send this form to their past performance agencies/companies to complete and return to the MICC?
Bidders may return Attachment 01 – Past Performance Questionnaire not later than the proposal due date and time.
See Amendment 0001 for revisions as applicable.
2 None What is the historical annual spend on these services by the MICC?
The previous contract W91247-16-D-0006 was awarded at $24,592,571.99. This contract information can be found on the government point of entry SAM.Beta.gov
3 None Would the MICC be willing to accept the final proposals via email?

Submitted Question Government Answer
5 None We are trying to determine the level of effort involved in seeking NACI clearances. Could the government provide further clarification on when/which employees and instructors will be waived and which employees must have NACI checks per: PWS 1.6.6.1.1 All personnel hired are required to possess and maintain a favorably adjudicated National Agency Check with Inquiries (NACI) investigation as a condition of employment.
Any waiver of the requirement for a favorably adjudicated NACI shall be coordinated with and approved/disapproved by the COR
All personnel hired require a NACI. The government will sponsor the employees for a NACI if the employee does not already have an adjudicated NACI reflected in JPAS. On a case by case bases an contractor that is pending final adjudication of a NACI may be placed on a Memorandum for Record signed by the COR covering a temporary time period to allow for final adjudication. The COR will engage the FORSCOM G-2 security division for any threat assessment before an employee is placed on a temporary waived time period.
6 None Regarding proposal evaluation. The use of a LPTA evaluation criteria does not seem to be in alignment with new guidelines for LPTA procurements outlined in Section 880 of the FY2019 NDAA. Could the government provide further justification for their use of a LPTA evaluation process in soliciting a knowledge-based professional services contract?
In accordance with Federal Acquisition Regulation (FAR) 15.101-2 (a) and Defense Federal Acquisition Regulation (DFARS) 215.101-2-70(a)(1), the Contracting Officer documented the contract file describing the circumstances justifying the use of LPTA source selection process. The documentation addressed the factors in the solicitation. IAW DFARS 215.101-2-70(a)(1), LPTA is the appropriate source selection process for the acquisition of Language and Culture Services
7 None The statement above the heading “ADDENDUM TO 52.212-2” on page 100 seem to be included in error.
That is not a statement.
8 None PWS paragraph 1.6.4. - Is the Government prohibiting the Contractor from scheduling its employees as it sees fit, or is the Government informing the Contractor it will not pay for or allow the billing of OT or CT.
Yes. The contract type is a D- Delivery to which task orders will be cut. The task orders will identify the needed support as scheduled by the government.
No OT or CT shall be approved and or invoiced by the Contractor. Contractor personnel shall not exceed a 40 hour work week; flexible work schedule may be considered. See PWS paragraph 1.6.4
9 None PWS paragraph 1.6.6.1.1 - Who will bear the costs associated with the NACI?
This Cost is fully burdened by the contractor. The government will sponsor contract employees for a NACI. If the NACI is not adjudicated in JPAS, the government will not bear any additional cost
10 None PWS paragraph 1.6.6.1.3 - Is CNAC-I simply a typo?
Yes this is a typo.

Submitted Question Government Answer
11 PWS paragraph 1.6.6.3 - Does the term “exclusive” prohibit the Contractor from maintaining copies of the same records, excluding any confidential and sensitive info, of course?
The contractor may maintain copies of the same records. These records shall exclude all confidential and sensitive info.
12 PWS paragraph 1.6.14.1.6. - It would be impossible to get a turned-in ID to the COR at Bragg for anyone not working on Bragg and is also dependent on the availability of the COR, which is outside the Contractor's control. Is the Government’s intention to have proof of the ID collection communicated to the COR within one hour (for example, a photo of the collected ID sent via email)?
See Amendment 0001 for revisions as applicable
13 PWS paragraph 2.2. - Very few sections mention an ACOR. Is this to be interpreted such that the ACOR is only authorized involvement in those specific activities, or is the ACOR authorized to act on behalf of the COR in all or additional instances?
The ACOR is only authorized involvement in those specific activities. The Contracting Officer's Representative (COR). Shall be appointed at award and has the authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. See PWS paragraph 2.1.11.
14 PWS paragraph 3.3. - How is the Government defining “utilities?”
Utilities mean useful features, or something useful to the facility as provided by the GOV to the Contractor for their use in performing tasks outlined in this PWS.
15 PWS paragraph 3.5.1 - Authentic texts are required to be used in instruction per 1.1.1.
and are typically integrated into most, if not all, lesson plans. Is it the Government’s intention to require the Contractor to seek KO approval for each and every lesson utilizing authentic texts?
No, it is NOT the intent of the government to seek the approval for the KO for each lesson’s utilization of authentic text. The COR or a government designated employee (as identified in the task order) may review any course material for the inclusion of authentic material.
16 PWS paragraph 4.1. - Is the Contractor required to provide A/V and VTT equipment required for virtual training per 1. and 5.1?
No, the contractor will NOT be required to provide A/V and VTT equipment required for virtual training per 1. and 5.1.
17 PWS paragraph 5.2.2. - ACO is not defined. Is this supposed to be ACOR?
18 PWS paragraph 5.3.1.2. - Many units do not have a designated or trained CLPM. What are the Contractor’s responsibilities when this is the case?
The government agencies are required to appoint a CLPM in writing. If there is an instance where there is NOT a current CLPM appointed by the command the contractor will coordinate with the next level CLPM at the higher command and or coordinate directly with the COR.

See Amendment 0001 for revisions as applicable.
19 PWS paragraph 5.4.1.6. - If the location only has the local NEC, is the Contractor required to create an additional LAN?
No, the contractor is NOT responsible to create an additional LAN
20 PWS paragraph 5.4.1.5.4. - Assessment development can take DLIFLC months if not years to develop, depending on the complexity and depth of the assessment. Producing a proficiency assessment in 10 days is unrealistic if not impossible without further specifications.
If no DLIFLC ODA exists for a certain language the COR will work with the contractor to develop an assessment that allows both the student and the instructor to understand the current level of the student and their needs for the training session.
21 Would the government consider extending the due date for the proposal? The solicitation was significantly delayed from the anticipated release date, and the current prosed timeline is rather aggressive for proper evaluation, compilation, and submission of competitive proposals for small businesses.
See GOV response as provided on question (4) four.
22 We are trying to determine the level of effort involved in seeking NACI clearances.
See GOV response as provided on question (5) five.
23 Regarding proposal evaluation.
See GOV response as provided on question (6) six.
24 Is Key Personnel (Program Manager and Academic Coordinator) considered to be part of ITEM NO 0002 (Page 3 of the Solicitation) for pricing purposes?
For pricing purposes the GOV expects contractors to include Program Manager and Academic Coordinator as part of ITEM NO 0002.
Contractors pricing however is dependent on each company structure.

In this current RFP, the requirement for accreditation has been removed. Has this removal been approved by the DLIFLC Commandant per section 4-9?
Would the awardee be required to obtain accreditation post-award?
Yes the removal is approved by the DLIFLC Commandant per section 4-9.
No the awardee will NOT be required to obtain accreditation post-award
27 The Wage Determination for only the JBLM location was provided. Can the Government provide the Wage Determinations for the other performance locations?

28 Learned Professional status of staff - Are Language Instructors under this RFP considered to be exempt from requirements of the SCA if the contractor is accredited by a regional or nation accrediting body per Department of Labor guidance Fact Sheet #17D: Exemption for Professional Employees Under the Fair Labor Standards Act (FLSA) https://www.dol.gov/sites/dolgov/files/WHD/l egacy/files/fs17d_professional.pdf?
See GOV response as provided on question 26.
29 Give the number of POIs required, will the Government consider increasing the page limit to 50?
30 Are computers for curriculum development or non-classroom work provided to the instructors?
No computers are provided by the GOV for curriculum development or non-classroom work
31 Per 1.6.6.4 and 1.6.6.5, Is the contractor required to have a Facility Clearance at time of award? If so, will the Government provide a DD-254?
The contractor is NOT required to have a Facility Clearance. DD-254 is NOT applicable to this contract.
32 The Past Performance requirement states that any provided Past Performance must be of at least $6,000,000 annually. Would the Government consider lowering this to $3,000,000.
The GOV has changed to $3,000,000.
33 Could the Government clarify the wording in the Pricing Schedule for CLINs 0003, 0004, 0005-are these based on a monthly price or a per day unit price? The CLIN structure in SF 1449 is based on days, not months.
SF 1449 CLINs 0003, 0004, 0005-are based on a per day unit price. Attachment 03_Staffing Matrix as completed by the contractor shall ensure CLINs 0003, 0004, 0005-are based on a per day unit price

See GOV response as provided on question 32
43 INTENTIONALLY LEFT BLANK
44 Does the government require that each past performance example have a value of $6M annually or is that a cumulative amount for all past performance?
See GOV response as provided on question 32.
45 If this is a requirement for each past performance reference to be a minimum of $6M annually, will the government consider removing this requirement to allow for more open competition?
46 There are a limited number of language and culture services contracts that meet this requirement. Additionally, considering this is set aside for small business with a $12M cap, this would mean that a qualified small business primes would have 50% of their revenue attribute to one contract.
The GOV acknowledges this statement

The Government will conduct an in-depth evaluation of all recent performance information provided to determine if it is the same or similar in nature, size, and complexity to the services/products being procured under this RFP. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. Relevant experience information that fails this condition will not be evaluated.
The Government reserves the right to obtain past performance data from other sources than those identified by the offeror in evaluating past performance. Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offerors. Proposals that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
