Section C - Descriptions and Specifications

PART 1-GENERAL INFORMATION

1.1 INTRODUCTION

The requirements are to (1) restore the natural plant habitat, following soil remediation activities in accordance with the goals and objectives identified in the Fort Ord Habitat Restoration Plan for Site 39 Inland Ranges, Former Fort Ord, California, and (2) to conduct habitat monitoring on Former Fort Ord following MEC remediation activities as specified in the Protocol for Conducting Vegetation Monitoring in Compliance with the Installation-Wide Multispecies Habitat Management Plan at Former Fort Ord, and Wetland Monitoring and Restoration Plan for Munitions and Contaminated Soil Remedial Activities at Former Fort Ord.

1.2 BACKGROUND

General - With the closure of the Former Fort Ord environmental services are required for remedial actions related to the cleanup and closure. An Indefinite Delivery/Indefinite Quantities (ID/IQ) contract is considered the optimal process to address these requirements.

The Former Fort Ord is in the remedial action phase of the CERCLA remediation process. Fort Ord was placed on the Superfund list in February 1990 and investigation and cleanup actions have been ongoing since. To comply with the Final Biological Opinion (BO) issued by the U.S.

Fish and Wildlife Service (USFWS) in 1993, the U.S. Army published an Installation-Wide Multispecies Habitat Management Plan (HMP) for Fort Ord initially in February 1994 (AR# BW-0491), and a revised HMP in April 1997 (AR# BW-1787). A programmatic BO (PBO) has been issued by USFWS in 2017 (AR# BW-2747A). The HMP and the PBO require the Army to implement and report on mitigation measures that are designed to minimize impacts to special-status species during Army pre-disposal, disposal, and reuse actions. Pre-disposal actions include the investigation and remediation of Munitions and Explosives of Concern (MEC), and contaminated soil excavation.

The Army is required to restore the natural habitat that is affected as a result of conducting the remedial action. The Army has developed a Record of Decision (ROD) outlining the requirements for the base-wide project to meet requirements of the HMP. The project requires habitat restoration and monitoring activities necessary when soil remediation activities affect the natural habitat. The Contractor shall be responsible for all aspects of the work to achieve regulatory acceptance of work completed, and compliance with the HMP and programmatic BO guidance.

The Army is also required to conduct baseline and follow up habitat monitoring of native plant communities and wetlands that may be impacted by the Army remedial actions to address munitions cleanup which includes mastication and/or burning of maritime chaparral, and subsequent surface and limited subsurface munitions removals within designated Habitat Reserve areas. The Army has issued a Protocol for Conducting Vegetation Monitoring (AR# BW-2454A), Revisions of Protocol for Conducting Vegetation Monitoring (AR# BW-2745), and Addendum to Revisions of Survey Protocol for HMP Annual Plants (AR# BW-2745.3), as well as a Wetland Monitoring and Restoration Plan (AR# BW- 2453) that specify the monitoring requirements necessary to comply with the HMP. The purpose of the monitoring is to ensure that the habitat recovers or is on a projection to recover to the baseline condition following remedial actions.

After logging into the SAM account, the Contractor will select ‘Entity Registration’ and then select ‘Service Contract Reporting’. SAM will display the entities which have service contracts and meet the reporting criteria. Next, select ‘View by Entity’ to see the service contracts for each entity, then select ‘Add’ for the service contract against which a Service Contract Report is to be created. The Contractor will then be taken automatically to the Complete Service Contract Report page. SAM automatically retrieves and displays the contract information.

The required information to be entered is:

a. Total Amount Invoiced: Total dollar amount invoiced for services performed during the previous Government fiscal year under the contract (this amount should include the prime and any subcontract amount).

b. Prime Contractor Hours Expended: Prime Contractor direct labor hours expended on the services performed during the previous Government fiscal year. The amount you enter is automatically divided by 2,080 to calculate a Full Time Employee (FTE) equivalent, displayed under the Prime Contractor Hours Expended as a Prime Contractor FTEs.

c. Tier 1 Subcontractor Information: Report any required Tier 1 subcontractor information by selecting the ‘Add Tier 1 Subcontract Information’ button.

Click ‘Submit’ once the report is completed. This saves the report and returns the user to the ‘Select Service Contract’ page where another report can be created, or an existing report can be edited.

Any previously completed report can be edited as frequently as necessary until the end of the reporting period by selecting ‘View/Edit’ for the selected report.

Reporting must be completed annually by October 31 for each service performed under applicable services contracts during the preceding Government fiscal year (October 1- September 30).

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 30 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons.
