GENERAL REQUIREMENTS

PART 1 GENERAL

1.1 REFERENCES

The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

U.S. ARMY CORPS OF ENGINEERS (USACE)

EM 385-1-1 (2014) Safety and Health Requirements Manual

1.2 GENERAL INTENTION

a. Contractor shall completely prepare site for future facilities construction, including furnish labor and materials and perform work to complete the Wetlands Mitigation contract package scope in accordance with the drawings and specifications.

b. Visits to the site by Bidders shall be made only by appointment with the USACE Contracting Officer.

c. Offices of HDR Inc., as Architect-Engineers, will render certain technical services during construction. Such services shall be considered as advisory to the Government and shall not be construed as expressing or implying a contractual act of the Government without affirmations by Contracting Officer.

d. Before placement and installation of work subject to tests by testing laboratory retained by the Government, if required, the Contractor shall notify the Contracting Officer in sufficient time to enable testing laboratory personnel to be present at the site in time for proper taking and testing of specimens and field inspection. Such prior notice shall be not less than three (3) work days unless otherwise designated by the Contracting Officer.

e. All employees of general contractor and subcontractors shall comply with Contractor’s Security Plan, be identified by project and employer, and restricted from unauthorized access.

f. Prior to commencing work, general contractor shall provide proof that a

OSHA designated “competent person” (CP) (29 CFR 1926.20(b)(2) will maintain a presence at the work site whenever the general or subcontractors are present.

g. Training

1. S employees of general contractor or subcontractors shall have completed the 10-hour or 30-hour OSHA Construction Safety course.

Employees shall be trained in accordance with EM 385-1-1.

2. Submit OSHA training record for all employees before the start of work.

1.3 SPECIFICATIONS AND DRAWINGS FOR CONTRACTOR

a. Hard-copy prints of specifications and drawings may be made by the Contractor, at Contractor's expense.

1.4 CONSTRUCTION SECURITY REQUIREMENTS

a. See Section 01 35 53 CONSTRUCTION SECURITY.

1.5 FIRE SAFETY

a. See Section 01 35 26 SAFETY REQUIREMENTS.

1.6 OPERATIONS AND STORAGE AREAS

a. The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Contractor shall hold and save the Government, its officers and agents, free and harmless from liability of any nature occasioned by the Contractor's performance.

b. Temporary buildings (e.g., storage sheds, shops, offices) and utilities may be erected by the Contractor only with the approval of the Contracting Officer and shall be built with labor and materials furnished by the Contractor without expense to the Government. The temporary buildings and utilities shall remain the property of the Contractor and shall be removed by the Contractor at its expense upon completion of the work. With the written consent of the Contracting Officer, the buildings and utilities may be abandoned and need not be removed.

c. The Contractor shall, under regulations prescribed by the Contracting

Officer, use only established roadways, or use temporary roadways constructed by the Contractor when and as authorized by the Contracting Officer. When materials are transported in prosecuting the work, vehicles shall not be loaded beyond the loading capacity recommended by the manufacturer of the vehicle or prescribed by any Federal, State, or local law or regulation. When it is necessary to cross curbs or sidewalks, the Contractor shall protect them from damage. The Contractor shall repair or pay for the repair of any damaged curbs, sidewalks, or roads.

d. Working space and space available for storing materials shall be as determined by the Contracting Officer.

e. Workmen are subject to rules of the Facility applicable to their conduct.

f. Do not store materials and equipment in other than assigned areas, as approved by the Contracting Officer.

g. Construction Fence: Before construction operations begin, Contractor shall provide all construction fence as shown in drawings and specified in Specification 01 50 00.

j. Abandoned Lines: No known need for abandoning utilities. Full removal on project footprint.

k. To minimize interference of construction activities, comply with the following:

(1) Keep roads, walks and entrances to grounds, clear of construction materials, debris and standing construction equipment and vehicles.

(2) Method and scheduling of required cutting, altering and removal of existing roads, walks and entrances must be approved by the Contracting Officer.

l. Coordinate the work for this contract with other construction operations as directed by the Contracting Officer. This includes the scheduling of traffic and the use of roadways, as specified in Article, USE OF ROADWAYS.

m. The Contractor has the responsibility of following all Federal, State, and municipal laws, codes, and regulations, including obtaining necessary permits, including those from the Bay Area Air Quality Management District (BAAQMD). Refer to FAR clause 52.236-7, "Permits and Responsibilities," which is included in General Conditions. In addition, the Contractor is responsible for obtaining a City of Alameda encroachment permit to enable access across non-public land. The application is located at this URL:

n. California Least Tern Breeding Season: Construction activity will be limited each year during breeding season from approximately April 1 through approximately August 15. Work activities scheduled during these times shall be approved by the Contracting Officer. For any potential construction work to be considered during this period, the work must be shown to stay below 55 decibels at all times, as measured from the least tern colony. See drawings for the location of the least tern colony.

1.7 ALTERATIONS

a. Survey: Before any work is started, the Contractor shall make a thorough survey with the Contracting Officer of areas in which alterations occur and areas which are anticipated routes of access. The survey shall be signed by both the Contractor and the Contracting Officer and then submitted to the Contracting Officer. This report shall include:

(1) Existing conditions and areas not required to be altered.

(2) Existence and conditions of items required by construction documents to be either reused or relocated, or both.

(3) Shall note any discrepancies between drawings and existing conditions at site.

(4) Shall designate areas for working space, materials storage and routes of access to areas where alterations occur and which have been agreed upon by Contractor and Contracting Officer.

1.8 SUPERVISION BY THE CONTRACTOR

The following requirements, in addition to those contained in the Contract Clause entitled SUPERINTENDENCE BY CONTRACTOR, shall be met by the Contractor.

a. The project superintendent or approved alternate shall maintain a physical presence at the project site at all times and be responsible for all construction and related activities at the site, except as otherwise acceptable to the Contracting Officer.

b. Failure to comply with these requirements shall be deemed as cause for a non-compensatory stoppage and suspension of work until the deficiency is remedied.

1.9 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

b. The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

c. Upon issuance of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. Refer to ER 415-1-15.

1.10 WORKING HOURS

The regular 8-hour work day must be from 7:30 AM to 4:00 PM with 30 minutes for lunch. Contractor operations are permitted between 7:30 AM to 7:00 PM

Monday through Friday, and 8:00 AM through 5:00 PM Saturdays and Sundays.

However, Contractor operations must be in compliance with the requirements of Section 01 57 19, TEMPORARY ENVIRONMENTAL CONTROLS. Regular work days must be Monday through Friday, excluding the observance of Federal holidays.

Work outside regular working hours requires Contracting Officer approval.

Make application fifteen (15) calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, and type of work to be performed. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work must be lighted in a manner approved by the Contracting Officer.

1.11 TERMINOLOGY

The identified terms and phrases used in the plans and specifications are interpreted as listed in the following:

GENERAL CONDITIONS - All references to the General Conditions shall be replaced with the "Contract Clauses" or "Conditions of the Contract," respectively.

OWNER - Any reference throughout this specification to "Owner" should be understood as a reference to "The Government."

Any reference throughout the contract documents to "VA" or "Department of Veterans Affairs" or "Station", where specific coordination or instruction from the Department of Veterans Affairs is intended or implied, the communication shall be coordinated with, and approved by, the Contracting Officer.

Any reference throughout the contract documents to "VA Contracting Officer" or "VA Resident Engineer" or "Resident Engineer" should be understood as a reference to "Contracting Officer".

Any reference throughout the contract documents to "Agency Representative" should be understood as a reference to "Contracting Officer".

Any reference throughout the contract documents to Contracting Officer Technical Representative (COTR) should be understood as a reference to "Contracting Officer".

Any reference throughout the contract documents to "Architect," "Architect-Engineer," or "Design Team" where specific coordination is intended or implied, the communication shall be coordinated with and approved by the Contracting Officer.

1.12 DISPOSAL AND RETENTION

Materials and equipment accruing from work removed and from demolition of buildings or structures, or parts thereof, shall be disposed of as follows:

a. Reserved items: No Reserved items.

b. Items not reserved shall become property of the Contractor and be removed by the Contractor.

c. PCB Transformers and Capacitors: The Contractor shall be responsible for disposal of the Polychlorinated Biphenyl (PCB) transformers and capacitors. The transformers and capacitors shall be taken out of service and handled in accordance with the procedures of the Environmental Protection Agency (EPA) and the Department of Transportation (DOT) as outlined in Code of Federal Regulation (CFR), Titled 40 and 49 respectively. The EPA's Toxic Substance Control Act (TSCA) Compliance Program Policy Nos. 6-PCB-6 and 6-PCB-7 also apply.

Upon removal of PCB transformers and capacitors for disposal, the "originator" copy of the Uniform Hazardous Waste Manifest (EPA Form 8700-22), along with the Uniform Hazardous Waste Manifest Continuation Sheet (EPA Form 8700-22A) shall be returned to the Contracting Officer who will annotate the contract file.

1.13 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES,

AND IMPROVEMENTS (FAR CLAUSE 52.236-9)

a. The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the

careless operation of equipment, or by workmen, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.

b. The Contractor shall protect from damage all existing improvements and utilities at or near the work site and on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

c. Refer to Section 01 57 19, TEMPORARY ENVIRONMENTAL CONTROLS, for additional requirements on protecting vegetation, soils and the environment. Refer to Articles, "Alterations", "Restoration", and "Operations and Storage Areas" for additional instructions concerning repair of damage to structures and site improvements.

d. Refer to FAR clause 52.236-7, "Permits and Responsibilities," which is included in General Conditions. A National Pollutant Discharge Elimination System (NPDES) permit is required for this project. The Contractor is considered an "operator" under the permit and has extensive responsibility for compliance with permit requirements. The apparent low bidder, contractor and affected subcontractors shall furnish all information and certifications that are required to comply with the permit process and permit requirements. Many of the permit requirements will be satisfied by completing construction as shown and specified. Some requirements involve the Contractor's method of operations and operations planning and the Contractor is responsible for employing best management practices. The affected activities often include, but are not limited to the following:

(1) Designating areas for equipment maintenance and repair;

(2) Providing waste receptacles at convenient locations and provide regular collection of wastes;

(3) Locating equipment wash down areas on site, and provide appropriate control of wash-waters;

(4) Providing protected storage areas for chemicals, paints, solvents, fertilizers, and other potentially toxic materials; and

(5) Providing adequately maintained sanitary facilities.

1.14 RESTORATION

a. Remove, cut, alter, replace, patch and repair existing work as necessary to install new work. Except as otherwise shown or specified, do not cut, alter or remove any structural work, and do not disturb any ducts, plumbing, steam, gas, or electric work without approval of the Contracting Officer. Existing work to be altered or extended and that is found to be defective in any way, shall be reported to the

Contracting Officer before it is disturbed. Materials and workmanship used in restoring work, shall conform in type and quality to that of original existing construction, except as otherwise shown or specified.

b. At Contractor's own expense, Contractor shall immediately restore to service and repair any damage caused by Contractor's workmen.

c. Expense of repairs to such utilities and systems not shown on drawings or locations of which are unknown will be covered by adjustment to contract time and price in accordance with clause entitled "CHANGES" (FAR 52.243-4) and "DIFFERING SITE CONDITIONS" (FAR 52.236-2).

1.15 PHYSICAL DATA

a. Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(1) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by Civil and Geotechnical Engineers.

b. Subsurface conditions in the area have been investigated by core borings and test pits. Logs of subsurface exploration are shown diagrammatically on drawings.

c. A copy of the soil report will be made available for inspection by bidders upon request to the Contracting Officer.

d. Government does not guarantee that other materials will not be encountered nor that proportions, conditions or character of several materials will not vary from those indicated by explorations. Bidders are expected to examine site of work and logs of borings; and, after investigation, decide for themselves character of materials and make their bids accordingly.

1.16 PROFESSIONAL SURVEYING SERVICES

A State of California-registered professional land surveyor or registered civil engineer whose services are retained and paid for by the Contractor shall perform services specified herein and in other specification sections.

The Contractor shall certify that the land surveyor or civil engineer is not one who is a regular employee of the Contractor, and that the land surveyor or civil engineer has no financial interest in this contract.

1.17 LAYOUT OF WORK

a. The Contractor shall lay out the work as indicated on the drawings, and shall be responsible for all measurements in connection with the layout. The Contractor shall furnish, at Contractor's own expense, all stakes, templates, platforms, equipment, tools, materials, and labor required to lay out any part of the work. The Contractor shall be responsible for executing the work to the lines and grades that may be established or indicated by the Contracting Officer. The Contractor shall also be responsible for maintaining and preserving all stakes and

other marks. If such marks are destroyed by the Contractor or through Contractor's negligence before their removal is authorized, the Contracting Officer may replace them and deduct the expense of the replacement from any amounts due or to become due to the Contractor.

b. Following completion of general mass excavation and before any other permanent work is performed, establish and plainly mark (through use of appropriate batter boards or other means) sufficient additional survey control points or system of points as may be necessary to assure proper alignment, orientation, and grade of all major features of work.

c. Whenever changes from contract drawings are made in line or grading requiring certificates, record such changes on a reproducible drawing bearing the registered land surveyor or registered civil engineer seal, and forward these drawings upon completion of work to Contracting Officer.

d. Upon completion of the work, the Contractor shall furnish the

Contracting Officer, electronic drawings at the scale of the contract drawings, showing the finished grade on the grid developed for constructing the work. These drawings shall bear the seal of the registered land surveyor or registered civil engineer.

e. The Contractor shall perform the surveying and layout work of this and other articles and specifications in accordance with the provisions of Article "Professional Surveying Services".

1.18 AS-BUILT DRAWINGS

a. The contractor shall maintain two full size sets of as-built drawings which will be kept current during construction of the project, to include all contract changes, modifications and clarifications.

b. All variations shall be shown in the same general detail as used in the contract drawings. To ensure compliance, as-built drawings shall be made available for the Contracting Officer's review, as often as requested.

c. Contractor shall deliver hard-copy As-Built and electronic Record

Drawings to the Contracting Officer as outlined in Section 01 78 00.

d. Paragraphs a, b, & c shall also apply to all shop drawings.

1.19 USE OF ROADWAYS

a. For hauling, use only established/designated routes and roads on VA property and, when authorized by the Contracting Officer, such temporary roads which are necessary in the performance of contract work. Temporary roads shall be constructed by the Contractor at Contractor's expense.

1.20 TEMPORARY TOILETS

a. Specific requirements described in EM 385-1-1.

1.21 AVAILABILITY AND USE OF UTILITY SERVICES

a. The Contractor is responsible for providing all necessary utilities to perform their work.

1.22 GOVERNMENT-FURNISHED PROPERTY

a. There is no government-furnished property associated with the scope of this project.

1.23 HISTORIC PRESERVATION

a. There are no anticipated historic preservation requirements associated with the scope of this project. Where the Contractor or any of the Contractor's employees, prior to, or during the construction work, are advised of, or discover any possible archeological, historical and/or cultural resources, the Contractor shall immediately notify the Contracting Officer verbally, and then with a written follow up within 24 hours.

Suspected items shall be preserved undisturbed, where they are discovered until further direction is received from the Contracting Officer.

1.2 DEFINITIONS

Action Level (AL)

A concentration designated in 29 CFR part 1910 for a specific substance, calculated as an eight (8)-hour time-weighted average, which initiates certain required activities such as exposure monitoring and medical surveillance.

Competent Person (CP)

The CP is a person designated in writing, who, through training, knowledge and experience, is capable of identifying, evaluating, and addressing existing and predictable hazards in the working environment or working conditions that are dangerous to personnel, and who has authorization to take prompt corrective measures with regards to such hazards.

Competent Person, Confined Space

The CP, Confined Space, is a person meeting the competent person requirements as defined EM 385-1-1 Appendix Q, with thorough knowledge of OSHA’s Confined Space Standard, 29 CFR 1910.146, and designated in writing to be responsible for the immediate supervision, implementation and monitoring of the confined space program, who through training, knowledge and experience in confined space entry is capable of identifying, evaluating and addressing existing and potential confined space hazards and, who has the authority to take prompt corrective measures with regard to such hazards.

Competent Person, Cranes and Rigging

The CP, Cranes and Rigging, as defined in EM 385-1-1 Appendix Q, is a person meeting the competent person requirements, who has been designated in writing to be responsible for the immediate supervision, implementation and monitoring of the Crane and Rigging Program, who through training, knowledge and experience in crane and rigging is capable of identifying, evaluating and addressing existing and potential hazards and, who has the authority to take prompt corrective measures with regard to such hazards.

A CP, Excavation/Trenching, is a person meeting the competent person requirements as defined in EM 385-1-1 Appendix Q and 29 CFR 1926, who has been designated in writing to be responsible for the immediate supervision, implementation and monitoring of the excavation/trenching program, who through training, knowledge and experience in excavation/trenching is capable of identifying, evaluating and addressing existing and potential hazards and, who has the authority to take prompt corrective measures with regard to such hazards.

Competent Person, Fall Protection

The CP, Fall Protection, is a person meeting the competent person requirements as defined in EM 385-1-1 Appendix Q and in accordance with ASSE/SAFE Z359.0, who has been designated in writing by the employer to be responsible for immediate supervising, implementing and monitoring of the fall protection program, who through training, knowledge and experience in fall protection and rescue systems and equipment, is capable of identifying, evaluating and addressing existing and potential fall hazards and, who has the authority to take prompt corrective measures with regard to such hazards.

Competent Person, Scaffolding

The CP, Scaffolding, is a person meeting the competent person requirements in EM 385-1-1 Appendix Q, and designated in writing by the employer to be responsible for immediate supervising, implementing and monitoring of the scaffolding program. The CP for Scaffolding has enough training, knowledge and experience in scaffolding to correctly identify, evaluate and address existing and potential hazards and also has the authority to take prompt corrective measures with regard to these hazards.

CP qualifications must be documented and include experience on the specific scaffolding systems/types being used, assessment of the base material that the scaffold will be erected upon, load calculations for materials and personnel, and erection and dismantling. The CP for scaffolding must have a documented, minimum of 8-hours of scaffold training to include training on the specific type of scaffold being used (e.g. mast-climbing, adjustable, tubular frame), in accordance with EM 385-1-1 Section 22.B.02.

Competent Person (CP) Trainer

A competent person trainer as defined in EM 385-1-1 Appendix Q, who is qualified in the material presented, and who possesses a working knowledge of applicable technical regulations, standards, equipment and systems related to the subject matter on which they are training Competent Persons. A competent person trainer must be familiar with the typical hazards and the equipment used in the industry they are instructing. The training provided by the competent person trainer must be appropriate to that specific industry. The competent person trainer must evaluate the knowledge and skills of the competent persons as part of the training process.

High Risk Activities

High Risk Activities are activities that involve work at heights, crane and rigging, excavations and trenching, scaffolding, electrical work, and confined space entry.

High Visibility Accident

A High Visibility Accident is any mishap which may generate publicity or high visibility.

Load Handling Equipment (LHE)

LHE is a term used to describe cranes, hoists and all other hoisting equipment (hoisting equipment means equipment, including crane, derricks, hoists and power operated equipment used with rigging to raise, lower or horizontally move a load).

Medical Treatment

Medical Treatment is treatment administered by a physician or by registered professional personnel under the standing orders of a physician. Medical treatment does not include first aid treatment even though provided by a physician or registered personnel.

Near Miss

A Near Miss is a mishap resulting in no personal injury and zero property damage, but given a shift in time or position, damage or injury may have occurred (e.g., a worker falls off a scaffold and is not injured; a crane swings around to move the load and narrowly misses a parked vehicle).

Operating Envelope

The Operating Envelope is the area surrounding any crane or load handling equipment. Inside this "envelope" is the crane, the operator, riggers and crane walkers, other personnel involved in the operation, rigging gear between the hook, the load, the crane's supporting structure (i.e.

ground or rail), the load's rigging path, the lift and rigging procedure.

Qualified Person (QP)

The QP is a person designated in writing, who, by possession of a recognized degree, certificate, or professional standing, or extensive knowledge, training, and experience, has successfully demonstrated their ability to solve or resolve problems related to the subject matter, the work, or the project.

Qualified Person, Fall Protection (QP for FP)

A QP for FP is a person meeting the requirements of EM 385-1-1 Appendix Q, and ASSE/SAFE Z359.0, with a recognized degree or professional certificate and with extensive knowledge, training and experience in the fall protection and rescue field who is capable of designing, analyzing, evaluating and specifying fall protection and rescue systems.

Recordable Injuries or Illnesses

Recordable Injuries or Illnesses are any work-related injury or illness that results in:

Death, regardless of the time between the injury and death, or the length of the illness;

a. Days away from work (any time lost after day of injury/illness onset);

b. Restricted work;

c. Transfer to another job;

d. Medical treatment beyond first aid;

e. Loss of consciousness; or

f. A significant injury or illness diagnosed by a physician or other licensed health care professional, even if it did not result in (a) through (f) above.

Government Property and Equipment

Interpret "USACE/VA" property and equipment specified in USACE EM 385-1-1 as Government property and equipment.

Load Handling Equipment (LHE) Accident or Load Handling Equipment Mishap

LHE accident occurs when any one or more of the eight elements in the operating envelope fails to perform correctly during operation, including operation during maintenance or testing resulting in personnel injury or death;

material or equipment damage; dropped load; derailment;

two-blocking; overload; or collision, including unplanned contact between the load, crane, or other objects. A dropped load, derailment, two-blocking, overload and collision are considered accidents, even though no material damage or injury occurs. A component failure (e.g., motor burnout, gear tooth failure, bearing failure) is not considered an accident solely due to material or equipment damage unless the component failure results in damage to other components (e.g., dropped boom, dropped load, or roll over). Document any mishap using the Crane High Hazard working group mishap reporting form.

1.3 SUBMITTALS

Government approval/acceptance is required for submittals with a "G" designation; submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government.
