The purpose of this amendment for Indefinite Delivery Indefinite Quantity (IDIQ) for Dam Maintenance and Repairs is to incorporate Tab 6 of the Technical Proposal for Past Performance Information; and to replace the Pricing Scedule in it's entirety w ith the revised Pricing Schedule for Task Orders 1 through 6.

The proposal due date of September 8, 2011, 1:00 pm local time and place remains unchanged.

Tab 6 of the Technical Proposal: Factor 3 – Past Performance.

1. General.

a. The information provided under this tab will be used in conjunction with the evaluation of the relevant past performance record of the offeror and proposed key subcontractors. Information other than that supplied by the offeror under this tab may be utilized by the Government in its evaluation of past performance.

b. The more similarities an example project has with the prospective contract, the greater the degree of relevancy.

The Source Selection Authority shall determine the relevance of similar past performance information.

2. Prime Contractor/Key Subcontractor Past Performance.

a. Offerors are to provide past performance evaluation information on the example projects submitted under the Experience and Capability factor (e.g. Construction Contractor Appraisal Support System (CCASS), questionnaire, similar performance evaluation, or other performance evaluations completed previously).

b. If an official written performance rating or evaluation is not available for the prime or a proposed key subcontractor, then send a copy of the completed* example “Project Information Form” to the reference along with a past performance questionnaire and a cover letter (see sample formats provided below). The cover letter must request that the reference return both the Project Information Form and the completed questionnaire to the Government no later than the date set for receipt of proposals. Provide the name and phone number of the person who was furnished a copy of the modified Project Information Form and the questionnaire.

[*Note: In order to protect sensitive source selection information, the copy of the Project Information Form that is sent to the references may be modified. The information can be limited to the information provided in block one through four of the Form.]

c. Provide the following additional information for each of the example projects submitted under the Experience and Capability factor.

(1). Compliance with Socio-Economic Requirements: (only applies to contract awarded by a federal agency.)

Address the contractor’s compliance with the requirements of FAR 52.219-8, currently titled “Utilization of Small Business Concerns” by listing the percentage participated by each small business concern category.

(2). Safety Record: Detailed information pertaining to reportable injuries with lost workdays or fatalities on this project. For contracts with reportable injuries (lost workdays or fatalities), also include the total number of hours worked under the contract. Provide frequency rate.

(3). Performance Problems: Describe any performance problems on this project about which a customer may make adverse remarks. Describe actions taken to correct any performance shortcomings. Describe any pending, on-going, or completed litigation. If no performance problems, provide a statement to this effect.

(4). Quality Awards: Any quality awards received for this project by a proposed team member.

(5). Contract Prices: Original and the final contract price. If different, provide brief explanation.

(6). Completion Dates: Original and the final completion date. If different, provide a brief explanation.

d. Formatting and Other Restrictions.

Start the information for each example project on a new page. There is not a page limitation for this submission.

e. Evaluation Criteria.

(1). The Government will evaluate past performance information to assess the level of performance risk associated with the offeror’s likelihood of success in performing the requirements stated in the solicitation. The currency and relevance of the information (as determined by the Government), the source of the information, context of the data, and general trends in the contractor’s performance may be considered.

(2). This comparative risk assessment of past performance information is separate from the responsibility determination required under FAR Subpart 9.1.

(3). The Government will evaluate the information submitted by the offeror pertaining to recent, relevant contracts.

The Government may also use data obtained from other sources, including automated databases and questionnaires.

References other than those identified by the offeror may be contacted by the Government. The Government may take into consideration the offeror’s performance of contracts with the agency; other Federal, State, and local government activities; and commercial concerns.

(4). In general, example projects that the Government did not consider relevant for the purposes of evaluating experience will not be considered relevant for the purposes of evaluating past performance.

(5). For the purpose of the past performance evaluation, offerors shall be defined as business arrangements and relationships, such as Joint Venture participants, teaming partners, and subcontractor(s). The past performance record of each firm in the business arrangement may be evaluated by the Government.

(6). The evaluation may take into consideration the offeror’s quality of workmanship; adherence to contract schedule; effectiveness of management, including the subcontracting aspect; compliance with labor standard;

compliance with safety standards; commitment to customer satisfaction; and business relationship.

(7). For Federal contracts, the evaluation will also include the offeror’s history of compliance with the requirements of FAR 52.219-8, currently titled “Utilization of Small Business Concerns”.

(8). The evaluation may take into account the number and severity of problems, the demonstrated effectiveness of corrective actions taken, and the overall work record.

(9). In the case of an offeror without a record of recent, relevant past performance (and for which there is also no recent, relevant past performance information for its predecessor companies or subcontractors), or for whom information on past performance is not available or cannot be verified, the offeror will not be evaluated favorably or unfavorably on past performance. For the purpose of this procurement, an “Adequate” rating is considered to be a neutral rating that is neither favorable nor unfavorable. Notwithstanding the above, the Government is not precluded from making award to a higher-priced offeror with a favorable past performance record over a lower-priced offeror with a neutral past performance rating.

THE PAST PERFORMANCE QUESTIONNAIRE

Handwritten completion of this questionnaire is acceptable, if legible.

Please include evaluation of contractor's performance based solely on the performance for which the contractor was/is liable. Do not let factors beyond the control of the contractor, which have resulted in performance delays or other problems bias the evaluation of the contractor's performance.

The following is a definition of the scoring system used:

Excellent (EX): Performance meets contractual requirements and exceeds many to the Owner’s benefit.

The contractual performance of the element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor were highly effective.

Very Good (VG): Performance meets contractual requirements and exceeds some to the Owner’s benefit.

The contractual performance of the element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

Satisfactory (S): Performance meets contractual requirements. The contractual performance of the area being assessed contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

Marginal (M): Performance does not meet some contractual requirements. The contractual performance of the element being assessed evaluated reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.

Unsatisfactory (U): Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element being assessed contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

3. Key Subcontractor Commitment and Authorization Letters.

a. Provide a letter of commitment and authorization from each proposed key subcontractor that:

(1) States the business concern’s intent to work on this project in the proposed specified capacity if the offeror is awarded the contract; and

Failure of a key subcontractor to provide authorization for the Government to discuss their past performance record with the offeror will not be considered a proposal deficiency. However, the Government will not be able to discuss in detail any past performance problems with the offeror.

Tab 4 of the Technical Volume: Factor 4 – Key Personnel.

a. The information provided under this tab will be used in conjunction with the evaluation of the duties, responsibilities, experience, and the past performance record of the key personnel. The resumes and example projects will provide the primary basis for the Government’s evaluation of the key personnel’s experience.

b. The more similarities the key personnel’s example project has with the prospective contract, the greater degree of relevancy.

c. Please note that the minimum qualifications specified in Section 01 45 04 for the On-Site Project superintendent and On-Site Project Manager and On-Site Construction Quality Control (CQC) System Manager, and the minimum qualifications for the On-Site Safety and Health Officer in Sections 01 50 05, and 01 35 29 must be met and will be verified by the Contracting Officer prior to issuance of the notice to proceed.

2. Key Personnel Resumes and Example Projects Demonstrating Experience.

a. For each proposed position, submit a resume of the person proposed for each of the key personnel positions identified by the Government. Submit the resume of only one person for each key position (e.g., do not submit alternates), with the following exception. When there is more than one work site and different people will be performing the duties at the different work sites, submit a resume for each such person. If the same person is being proposed for more than one key position (where allowed), submit a resume for that person for each proposed position.

b. The resume must clearly substantiate with data that can be verified provide specific, detailed employment data.

Your attention is specifically directed to the minimum qualification criteria for the following key positions:

--On-Site Project Manager: Demonstrate five years experience as a project manager on construction projects with similar construction features as this project (i.e. of comparable complexity and physical size) that have been completed, or are substantially completed.

--Construction On-Site Project Superintendent: Demonstrate five years experience as a construction site project superintendent on construction projects with similar construction features as this project (i.e. of comparable complexity and physical size) that have been completed, or are substantially completed.

--Contractor Quality Control System Manager: Demonstrate meeting Section 01 45 04.00 10 requirements.

--Project Scheduler: In addition to demonstrating meeting Section 01 32 01.00 requirements, demonstrate one year experience with NAS schedules utilizing primavera software on construction projects with similar construction features as this project (i.e. of comparable complexity and physical size that have been completed, or are substantially completed.

c. The Government is especially interested in the experience of the proposed key personnel in the same capacity on relevant projects, as demonstrated by the example projects on their resumes. The greater the similarities between the example project and the prospective contract, the more relevant the example project will be considered. The greater the number of relevant experience years, the more favorable the rating.

d. Formatting and Other Restrictions.

(1). Begin each resume on a new page. The submission is limited to five 8-1/2” x 11” pages per resume.

(2). A sample format has been provided to illustrate the level of detail desired by the Government. Use of a different format could result in a lower rating if all of the requested information is not provided.

(3). If the proposed person received letters of appreciation, commendation, recommendation, etc., either during contract performance or in conjunction with the acceptance of the projects described in Block 3 of the resume (Relevant Projects), attach copies. The letters are not included in the page limitation. Note: The Government is not requesting the individual to submit letters written after the fact for the purpose of this procurement.

c. Evaluation Criteria.

a. The Government will evaluate the proposed key personnel’s duties and responsibilities for its soundness and workability. Consideration will include the amount of time(s) the key personnel will be at the construction site.

b. The Government will evaluate the offeror’s key personnel relevant experience. The more recent, and the greater the extent and relevance, of the key personnel’s experience, the higher the rating assigned. Key personnel with previous experience in the same capacity on prior relevant completed or substantially completed project are advantageous for evaluation purposes. Generally, projects that are not substantially complete will be given less consideration than projects which are either complete or substantially complete; however, for very large contracts spanning several years, the Government will determine whether sufficient progress has been made for the key personnel to have gained creditable relevant experience.

c. Failure of a key personnel to provide authorization for the Government to discuss their past performance record with the offeror will not be considered a proposal deficiency. However, the Government will not be able to discuss in detail any past performance problems with the offeror.

a. All offerors, regardless of business size or status, are to address this factor.

b. Do not furnish a Small Business Subcontracting Plan as part of your technical proposal, either in lieu of or in addition to the information described below. When required as part of your offer, the Subcontracting Plan is to be provided in the Price Proposal volume.

2. Proposed Small Business Participation.

a. Address the proposed participation of Small Business Concerns (SBCs) in the performance of work under the prospective contract. Include the following information:

(1) The extent of proposed participation of SBCs in terms of the total value of the contract (dollars and percentage).

(2) Specific identification by name of the proposed SBCs;

(3) Extent of offeror’s commitment to use the specifically identified SBCs;

(4) The offeror’s teaming arrangement with the specifically identified SBCs (e.g., Joint Venture participant or subcontractor); and

(5) The complexity and variety of the work the specifically identified SBCs will perform.

Important Note: This submission includes the offeror’s proposed utilization of all small business concerns, irrespective of their classification into other subgroups (e.g., veteran-owned SBCs; service-disabled veteran-owned SBCs, HUBZone SBCs, Small Disadvantaged Business concerns; woman-owned SBCs, etc.) and whether or not participation is at the prime or subcontract level.

However, use of an alternate format could result in a lower rating if detailed specific information relevant to this procurement is not provided.

c. Evaluation Criteria.

(1). The Government will evaluate the extent of proposed participation by small business concerns as measured by dollar value and/or percentage of work. Considerations will include whether or not the technical proposal specifically identifies the proposed participants by name, the extent of the commitment to use the identified participants (i.e., whether or not there are enforceable agreements in place), and the complexity and variety of work the named participants would perform under the prospective contract.

(2). An offeror not in full compliance with the submission requirement will receive a rating no lower than “Marginal”, as long as the offeror has made a reasonable attempt to respond to the proposal submission requirements. Notwithstanding the above, an offeror who fails to provide any information for evaluation will receive an “Unacceptable” rating.

(3). Subcontracting plans will not be utilized by the Government in the technical evaluation for this factor, Socio- Economic Considerations.
