5.3 DETAILED SUBMISSION REQUIREMENTS AND EVALUATION CRITERIA FOR THE
TECHNICAL PROPOSAL.
a. The Offeror is required to propose a specific project team including key subcontractors for evaluation in response to this Request for Proposals. For purposes of this procurement, the terms “key subcontractors” are used to refer only to the prospective subcontractors whose qualifications, experience, and past performance will be evaluated by the Government as part of the source selection process. For reasons of efficiency, not all of the subcontractors critical to successful post-award contract performance have been included in this group. In order to streamline the proposal submission and evaluation process, please limit your submission to the information specifically requested.
Information pertaining to other subcontractors not designated as “key” by the Government will be considered excess and will not be evaluated.
b. For the purposes of this procurement, a key subcontractor is defined as any subcontractor performing “key” major work elements for which capability information is required to be submitted for evaluation as part of the Offeror’s technical proposal. The Government has designated the following major work elements as “key”:
--Design firm --Potable water system construction effort; and --Any subcontract greater than $1,000,000.
d. The Offeror’s attention is directed to the clause in Section 00800 titled “Key Personnel, Subcontractors, and Outside Associates or Consultants”. In accordance with this clause, any post-award changes to the key subcontractors in the accepted proposal will require contracting officer approval.
e. Preface – Prime Contractor/Key Subcontractor Introduction.
(1). Provide a brief introduction narrative. Identify and provide the name, DUNS number, address, and a brief description of the role and authority of each firm that will be involved in performance of this contract at the prime contractor and key subcontractor level. If the proposed prime contractor is a Joint Venture or teaming arrangement (i.e. mentor protégé), describe the relationship, role, and authority (to include management authority) of each firm.
(Note: If a proposed firm has branch offices, provide information for each individual branch office that will perform work under the contract with its own workforce.) List the major work elements to be self-performed by the offeror’s in-house work force, the major work elements to be performed by each key subcontractor, and any other major work to be subcontracted to other contractors. The submission is limited to two pages.
SECTION 00111 FACTOR 1
Tab 1 of the Technical Proposal: Factor 1 – Concept Design/Technical Approach.
(Five (5) pages maximum for Technical Narrative and one (1) page (NTE 11”x17”) for Project Schedule – excluding special formatting and other restrictions)
1. General.
a. The information provided under this tab will be used in conjunction with the evaluation of the offeror’s and proposed key subcontractor(s)’ design and construction approach and method to design-build a potable water system at Dugway Proving Ground, UT in sufficient detail to clearly demonstrate (1) the offeror’s understanding of the principal components of work described in the project specifications and drawings and (2) the offeror’s understanding of the site and other conditions that could impact schedule.
2. Technical Narrative.
a. Describe in general terms how the offeror will approach the design of the requirement, including identification of the technologies to be used. If more than one Architect-Engineer design firm will be involved in the project, clearly distinguish the roles of each. Also address any design effort that will be performed “in-house” by the prime contractor. Describe the roles and planned interaction between the independent technical reviewers and various contractor and government personnel.
b. Describe in general terms the proposed methods and techniques to execute the construction to include phasing and use of key subcontractor(s). The narrative to include at a minimum: 1) site prep, 2) demolition, 3) utilities, 4) construction work discipline sequencings, 5) site work, 6) waste disposal, and 7) clean-up. The Government is especially interested in how the offeror will keep the plant in service providing water during construction.
c. Describe in general terms the offeror’s conceptual design. The narrative shall cover all features of the offeror’s unique design and construction solutions. Identify the technology that will be used. The narrative should not be a recital of any Government provided specifications but should demonstrate how the offeror’s technical approach will result in additional quality and value to the Government. The elements covered must reinforce each other and be self-explanatory in presenting your technical approach. Identify any betterments included in the offer, i.e., those items, materials, equipment or processes that exceed the minimum requirements in the contract specifications, and discuss how these betterments increase value to the Government. Provide catalog cuts or other documentation necessary to clearly indicate the quality of the proposed betterments. The offeror shall make a statement that their design complies with the most current regulations, standards, codes, and Design Requirements.
d. Discussion of any anticipated major difficulties and problem areas, along with potential recommended approaches for their resolution or betterments. “Betterments” are the offeror’s opportunity for design and construction creativity that exceeds the minimum requirements stated in the Specifications. “Betterments” are defined as portions of the proposal where features, components, or systems add to or enhance the requirements of the solicitation or improves the final product. The offeror shall provide supporting narrative to show how the Government will benefit from each innovation and identify a price for each betterment proposed, as well as separate drawings identifying betterments. Pricing of contractor proposed betterments shall be provided in the Price Volume.
3. Project Schedule.
a. The thoroughness and logic of construction activity (broken down to the “Feature of Work” level) will be critical to the success of this project. The importance of the construction schedule is highlighted by certain critical project factors; project climate, and weather sensitive work.
b. The offeror shall develop a simple proposed construction schedule in the form of a bar/GANTT chart relating to the technical approach for construction of the project. The proposed schedule shall indicate the durations of all major elements of work beginning with the notice to proceed on the base contract items and indicating calendar days to completion of all options (i.e. contract close-out). The schedule shall indicate sequences proposed to accomplish each work element and appropriate interdependencies between various work elements. The schedule shall be as complete, reasonable, and realistic as possible, demonstrating the offeror’s ability to propose a schedule that identifies all major elements of work for this project, meets the Government’s requirements, and is obtainable. For the purposes of the proposal submittal, assume a Notice to Proceed (NTP) for design date of 1 March 2010.
Also assume that all options will be exercised at the end of the timeframe specified in the solicitation for their exercise (see Pricing Schedule Notes).
4. Offeror’s Statement of Compliance with 10 U.S.C. 2858, if applicable
a. In accordance with 10 U.S.C. 2858, funds appropriated for military construction (including Base Realignment And Closure (BRAC)-funded and Family Housing-funded MILCON) may not be expended for additional costs involved in expediting a construction project without Secretarial level approval. Therefore, if the offeror proposes a completion period of lesser duration than the performance period on the SF 1442, a compliance statement completed by the offeror and duly executed with an original signature by an official authorized to bind the company must be included in the technical proposal. If a contract is awarded to an offeror proposing a completion period of lesser duration than the performance period specified on the SF 1442 included in the solicitation, that shorter performance period will be incorporated into and made a part of the resulting contract.
(1) If the offeror is proposing a completion period of lesser duration than the performance period stated on the SF 1442, a statement of compliance with 10 U.S.C. 2858 must be included in the technical proposal under this tab.
(2) The above compliance statement must be completed by the offeror and duly executed with an original signature by an official authorized to bind the company.
b. Special Formatting and Other Restrictions – compliance statement must be completed by the offeror and duly executed with an original signature by an official authorized to bind the company.
OFFEROR’S STATEMENT OF COMPLIANCE WITH 10 U.S.C. 2858
[Insert name of the offeror] hereby proposes that the period of performance for all design and construction is _____ calendar days from Notice to Proceed, inclusive of Government review periods and Government phasing requirements specified.
[Insert name of the offeror] hereby states that the offer of this performance period is at no additional cost to the Government over the performance period specified on the SF 1442. Specifically, the shortened performance period will not be achieved by the use of overtime, multiple shifts, or additional personnel nor does it include expedited materials handling/shipping costs.
I understand that making a false, fictitious, or fraudulent statement may subject me to prosecution under Title 18, United States Code, Section 1001.
SIGNATURE OF COMPANY OFFICIAL
(End of Compliance Statement)
5. Evaluation Criteria.
(a) The Government will evaluate the soundness and workability of the offeror’s approach and method to design and construct a Potable Water System, avoid problems, and mitigate difficulties/challenges. As part of its evaluation, the Government will consider whether the offeror’s approach appears reasonable, realistic, achievable, and reflects logical sequencing and progression of activities.
(b) The greater the narrative demonstrates knowledge and understanding based on the specifications, drawings, site, and other conditions; the higher the evaluation rating.
(c) Offerors proposing betterments will receive higher evaluation ratings if the proposed betterments are considered by the Government to be desirable and to add significant value to the project. The betterment will be evaluated to determine if the creative ideas of the offeror enhance the overall design and function of the project compared to the minimum criteria established in the specifications.
(d) The design approach specifically developed for this project will be evaluated for its soundness and workability.
Considerations will also include the proposed roles and interaction between the Architect-Engineer (A-E) firm(s), any proposed in-house designer, Independent Technical Reviewers, various contractor, and government personnel.
(e) Technical merit for scheduling will be based on the degree to which the proposed methods, materials, and equipment satisfy functional and operational requirements and exceed minimum acceptable quality. Proposed schedule and approach that clearly reflect an understanding of the complexity of this project will be evaluated more favorably. Schedule and approach demonstrating professionalism and thoroughness will be evaluated more favorably. In addition, proposed schedules that reasonably demonstrate the ability to reduce the 540 day completion period from initial notice to proceed through completion of construction of all options will be evaluated more favorably.
(f) 10 U.S.C. 2858 requires Agency head approval to expedite the completion date of a contract funded by a Military Construction Appropriations Act, if additional costs are involved. This approval authority may not be re-delegated.
The Contracting Officer may approve an expedited completion date only if no additional costs are involved. For the purposes of this solicitation, if an offeror proposed a shorter schedule than that required by the Government, and did not submit the lowest priced offer, the price premium will be presumed to be attributable to the shortened schedule, unless the offeror has clearly stated in the offer that no price premiums were included in the offer that are directly attributable to the shortened schedule. If the offeror proposed a shorter schedule and failed to complete the statement that the offer included no additional costs attributable to the shortened schedule, the Government may determine that the offer is ineligible for award. The Government is under no obligation to open discussions with the offeror pertaining to the shortened schedule; nor is the Government obligated to request or obtain Secretarial level approval to expedite the contract completion date.
(g) Offerors may receive an enhanced technical rating for proposing a schedule which offers early project completion and turnover, provided that (i) the period of time by which the schedule has been shortened is meaningful; and (ii) the shortened schedule appears reasonable, realistic, and achievable without the use of overtime, multiple shifts, additional personnel or expedited materials handling/shipping costs.
(h) If an offer is accepted which proposed a shorter schedule than that required by the Government, that proposed schedule will be incorporated into and become a binding part of the resultant contract. Additionally, any assessment of liquidated damages would be based on the shortened schedule accepted by the Government.
(i) Offerors will receive a rating of no lower than “Marginal”, as long as the offeror has made a reasonable attempt to respond to the proposal submission requirements. Notwithstanding the above, an offeror who fails to provide the requested information for evaluation will receive an “Unacceptable” rating.
SECTION 00111 FACTOR 2
Tab 2 of the Technical Proposal: Factor 2 – Management Approach.
(Five (5) pages maximum – excluding special formatting and other restrictions)

Start the information for each example project on a new page. There is not a page limitation for the example project submission.
1. General.
a. The information provided under this tab will be used in conjunction with the evaluation of the experience and capability of the offeror and proposed key subcontractors. The resumes and example projects will provide the primary basis for the Government’s evaluation of their qualifications and experience.
2. Prime Contractor/Key Subcontractor Example Projects Demonstrating Experience and Capability.
a. The offeror is required to submit, using the below project information form, to submit projects within the past seven (7) years. At least one (1) with no more than two (2) “example projects” for each of the below capability areas that demonstrate the prime’s and/or subcontractor’s experience and capability to successfully complete the example project. Multiple projects can demonstrate a experience and capability or an example project can demonstrate multiple experiences and capabilities.
-- At least one example project demonstrating the offeror’s design-build project management experience and capability as a prime contractor on a construction project of similar type and scope;
--At least one example project demonstrating the Architect-Engineer experience and capability to design a similar potable water system; and
--At least one example project demonstrating the experience and capability of the firm(s) that will be performing the potable water system construction effort; and
--At least one example project demonstrating the experience and capability of the firm(s) that will be performing greater than $1,000,000 worth of construction effort.
b. Example projects submitted to demonstrate a firm’s experience and capability must be relevant to the work that the firm will be performing under the prospective contract (e.g. If offeror is proposing contractor ABC to perform the mechanical work, the submitted mechanical experience and capability example project shall demonstrate contractor ABC’s capability experience). The offeror should explain how the work performed by the proposed firm in the example project is relevant to the proposed acquisition.
c. Do not submit design projects which have not been completed. Do not submit construction projects that are not either complete or substantially complete. (For this purpose, “substantially complete” means that only punch list items remain for project acceptance or that the majority of the elements of the project have been turned over to the customer for beneficial occupancy.) If a design-build project is being used by an A-E to demonstrate their design capability, the design portion of the contract must be complete in order for it to be considered.
d. Provide a summary matrix that indicates which submitted example project(s) demonstrates the experience(s) and capability(ies) of which firm (i.e. prime, subcontractor) will perform the capability area identified in paragraph a above. The matrix may include other project information, (e.g. key subcontractor, brief summary how it demonstrates capability area, how it is relevant to the capability area, etc.).
e. Special Formatting and Other Restrictions:
(1) Use the “Project Information Form” format located below for submitting the example projects. Use of an alternate format could result in a lower rating if all of the specified information is not provided. (Note: Do not submit a group of related jobs as one project unless all of the work was done under the same contract, or for indefinite delivery contracts, under one task order.)
(2) The Summary Matrix is limited to one page (NTE 11” x 17”).
3. Prime Contractor/Key Subcontractor Corporate Resumes.
a. The offeror is required to submit a corporate resume for it self and each of the proposed key subcontractors.
b. The purpose of the corporate resume is to provide information that will substantiate that the prime and firm to which the work will be subcontracted has the resources necessary for successful performance in the area they are proposed to perform.
c. In the event of a contractor that is part of a large, multi-segmented business concern, the information provided should directly pertain to the specific segment of the business concern (i.e., the division, group, unit, etc.) that will perform work under the prospective contract with its own workforce. Information pertaining to the business concern in general or to other offices or locations of the firm which will not be self-performing work under the prospective contract with their in-house personnel or affiliates should not be submitted.
d. A standard format for the corporate resume is not specified. However, the Government is interested in information such as the following:
--Contractor name, office address, and telephone number for the office that will be performing work under the prospective contract.
--Type of business organization; date organized; date and state of incorporation, if applicable.
--Number of personnel on the present payroll in the following categories: partners, officers, other key, remainder.
--Number of permanent personnel on the present payroll.
--Equipment owned (relevant to the work to be performed).
--Total value of work in past six years exclusive of Joint Venture; Average annual gross income for the past six years.
--Largest job in past six years (contract amount, date completed, description, owner).
--Largest job ever completed (contract amount, date completed, description, owner).
--Type of work in which firm specializes
--How long the firm has been performing work similar to what they would be performing on the current acquisition.
--Relevant specialized experience.
--Relevant certifications, etc.
e. Formatting and Other Restrictions.
The submission for each contractor is limited to three 8-1/2” x 11” pages.
4. Evaluation Criteria
(1) The Government will evaluate the demonstrated recent relevant experience of the offeror’s proposed team (prime and key subcontractor(s)) on “example” projects of similar scope, project type, physical size, complexity, that have a logical connection with the requirements of this acquisition, and/or duration to this project. The examples of projects that most closely resemble the project identified in this solicitation will receive higher consideration.
(2) The more recent the project, the greater the consideration given.
(3) Prime contractor’s prior teaming experience on relevant example projects with key subcontractors proposed for this project is advantageous for evaluation purposes.
(4) The Government realizes that the offeror may not be able to demonstrate relevant experience with all or most of the construction features of the current project on one example project; therefore, the Government will assess the team’s experience based on the cumulative experience gained on relevant example projects.
(5) Generally, projects performed by an office of a team member that will not be performing work on this project with its own workforce will be given less consideration than projects performed by the office that will be performing work on this project with its own workforce.
(6) The information provided in the prime contractor’s corporate resumes will be evaluated to determine if the prime contractor has the resources necessary for successful performance. If there are proposed key subcontractors, the information provided in the subcontractors’ corporate resumes will be evaluated to determine if the proposed subcontractors have the resources necessary for successful performance of the subcontracted work.
(7) Failure of the offeror to demonstrate relevant experience for itself and/or for any proposed key subcontractor will result in an “Unacceptable” rating for this factor.
(8) The following will be considered advantageous:
-- Prime contractor and key subcontractor teaming experience on similar potable water systems -- Prior experience on government construction projects.

d. e. Evaluation Criteria.
(1). The Government will evaluate past performance information to assess the level of performance risk associated with the offeror’s likelihood of success in performing the requirements stated in the solicitation. The currency and relevance of the information (as determined by the Government), the source of the information, context of the data, and general trends in the contractor’s performance may be considered.
(2). This comparative risk assessment of past performance information is separate from the responsibility determination required under FAR Subpart 9.1.
(3). The Government will evaluate the information submitted by the offeror pertaining to recent, relevant contracts.
The Government may also use data obtained from other sources, including automated databases and questionnaires.
References other than those identified by the offeror may be contacted by the Government. The Government may take into consideration the offeror’s performance of contracts with the agency; other Federal, State, and local government activities; and commercial concerns.
(4). In general, example projects that the Government did not consider relevant for the purposes of evaluating experience will not be considered relevant for the purposes of evaluating past performance.
(5). For the purpose of the past performance evaluation, offerors shall be defined as business arrangements and relationships, such as Joint Venture participants, teaming partners, and key subcontractor(s). The past performance record of each firm in the business arrangement may be evaluated by the Government.
(6). The evaluation may take into consideration the offeror’s quality of workmanship; adherence to contract schedule; effectiveness of management, including the subcontracting aspect; compliance with labor standard;
compliance with safety standards; commitment to customer satisfaction; and business relationship.
(7). The evaluation may take into account the number and severity of problems, the demonstrated effectiveness of corrective actions taken, and the overall work record.
(8). In the case of an offeror without a record of recent, relevant past performance (and for which there is also no recent, relevant past performance information for its predecessor companies or key subcontractors), or for whom information on past performance is not available or cannot be verified, the offeror will not be evaluated favorably or unfavorably on past performance. For the purpose of this procurement, an “Adequate” rating is considered to be a neutral rating that is neither favorable nor unfavorable. Notwithstanding the above, the Government is not precluded from making award to a higher-priced offeror with a favorable past performance record over a lower-priced offeror with a neutral past performance rating.

INSTRUCTIONS TO THE REFERENCE FOR COMPLETING
THE PAST PERFORMANCE QUESTIONNAIRE
Handwritten completion of this questionnaire is acceptable, if legible.
Please include evaluation of contractor's performance based solely on the performance for which the contractor was/is liable. Do not let factors beyond the control of the contractor, which have resulted in performance delays or other problems bias the evaluation of the contractor's performance.
The following is a definition of the scoring system used:
Excellent (EX): Performance meets contractual requirements and exceeds many to the Owner’s benefit.
The contractual performance of the element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor were highly effective.
Very Good (VG): Performance meets contractual requirements and exceeds some to the Owner’s benefit.
The contractual performance of the element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
Satisfactory (S): Performance meets contractual requirements. The contractual performance of the area being assessed contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
Marginal (M): Performance does not meet some contractual requirements. The contractual performance of the element being assessed evaluated reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.
Unsatisfactory (U): Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element being assessed contains serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
In completing the questionnaire please check the box corresponding to your rating, or "N/A" if you are unable to provide an evaluation for any area.
Please provide clear and concise narrative explanations (both positive and negative) for your answers.
This is especially important for any rating above or below “satisfactory”. If more space is needed than is provided, you may attach additional sheets
