The following, together with any attachments, is submitted as An Individual Subcontracting Plan to comply with the requirements of Federal Acquisition Regulations, SUBPART 19.7 and the statutory requirements of Public Laws 95-507, 99-661 (Section 1207), 100-180 (Section 806), 100-656, 105-135 and 106-50. The plan provides comprehensive responses to the commitment of the clause entitled, “Small Business Subcontracting Plan (FAR 52.219-9).

Contractor Name corporate policy on any project is to engage in small business participation unless dictated by a specific contractual requirement. Therefore, solicitation and award requirements to all small business (SB) concerns (including ANCs and Indian Tribes), self-certified small disadvantaged business (SDB) concerns, women-owned small business (WOSB) concerns, Historically Underutilized Business Zone (HUBZone) certified businesses, veteran-owned small business (VOSB) concerns and service-disabled veteran-owned small business (SDVOSB) concerns will be given the maximum extent practicable and consistent with efficient contract performance for this contractual obligation. In developing the subcontracting goals for this plan, it was determined the type of work to be accomplished within the duration of the contract, the technical competence of vendors necessary to accomplish the goals of the district, and the availability of local, capable subcontractors that were experienced in providing services for the USACE- Concord District and the requirements stated in the solicitation.

Additionally, as the total contract amount will depend upon the specific set of proposal Options awarded to Contractor Name, subcontracted proportions will be adjusted as necessary and/or possible to achieve the required small business participation.

The following goals are proposed for the total contract including all option periods/offers.

3. The following principal products and/or services will be subcontracted under this contract:

4. The following method was used to develop the above subcontracting goals. Include a statement explaining how the products and services to be subcontracted were established, how the areas to be subcontracted to SB, SDB, WOSB, HUBZone, VOSB, SDVOSB concerns, ANCs and Indian Tribes were determined, and how their capabilities were determined. (See FAR 19.704(a)(4))

5. A description of the method used to identify potential sources for solicitation purposes;

FAR 19.704(a)(5) Contractor Name utilized many resources such as our corporate database, previous project bidder’s lists, SAM (System Award Management), and the SBA’s solicitation board, SUB-Net to find additional resources as well as local and nationwide business organizations. Furthermore, POC for the Company since her appointment as Contractor Name Small/Diversity Business Liaison/list tile of POC, attends a variety of Small Business Opportunity Fairs hosted by federal agencies and other minority associations to invite SB’s as prospective subcontractors to contact her for additional procurement opportunities.

Name of person will be the designated Subcontracting Plan Administrator and will be responsible for administering Contractor Name. The plan administrator is responsible for the development, preparation, execution and monitoring performance relative to contractual subcontracting requirements contained in this plan, but not limited to the following activities:

a. Developing and maintaining bidder’s lists of SB, HUBZone, WOSB, SDB, VOSB and SDVOSB, concerns from all possible sources.

b. Ensuring that procurement packages are structured to permit SB, HUBZone, WOSB, SDB, VOSB and SDVOSB concerns to participate to the maximum extent possible.

c. Assuring inclusion of SB, HUBZone, WOSB, SDB, VOSB and SDVOSB concerns in all solicitations for products or services which they are capable of providing.

d. Reviewing solicitations to remove statements, clauses, etc., which may tend to restrict or prohibit SB, HUBZone, WOSB, SDB, VOSB, and SDVOSB participation.

e. Ensuring periodic rotation of potential subcontractors on bidder’s lists.

f. Ensuring that the bid proposal review board documents its reasons for not selecting low bids submitted by SB, HUBZone, WOSB, SDB, VOSB, and SDVOSB concerns.

g. Ensuring the establishment and maintenance of records of solicitations and subcontract award activity.

h. Attending or arranging for attendance of company counselors at Business Opportunity Workshops, Minority Business Enterprise Seminars, Trade Fairs, Industry Days, networking etc.

i. Conducting or arranging for conduct of motivational training for purchasing personnel pursuant to the intent of P.L. 95-507. Done in conjunction with Industry Day events for particular projects.

j. Monitoring attainment of proposed goals.

k. Preparing and submitting required periodic subcontracting reports.

l. Coordinating contractor’s activities during the conduct of compliance reviews by Federal agencies.

m. Coordinating the conduct of contractor’s activities involving its small and small disadvantaged business subcontracting program.

n. Other Duties:

8. The following efforts are taken to assure that SB, HUBZone, SDB, WOSB VOSB and SDVOSB concerns will have an equitable opportunity to compete for subcontracts. These-efforts include, but are not limited to, the following activities:

a. Outreach ventures completed, ongoing or planned: (list Outreach Events)

b. Sources will be requested from the Dynamic Small Business Search available through the System Award Management (SAM) website at http://www.sam.gov http://dsbs.sba.gov/dsbs/dsp_dsbs.cfm and SBA SUB-Net System.

c. The following internal efforts Small Business Liaison Person/Subcontracting

Administrator will be made to guide and encourage project managers who procure the project:

(i) Workshops, seminars and training programs are conducted to include reviewing our corporate SBC subcontracting manual.

(ii) Activities are monitored to evaluate compliance with this subcontracting plan.

(ii) Small and SDB concern source lists, guides and other data identifying SB, HUBZone, SDB, WOSB, VOSB and SDVOSB concerns will be maintained and utilized by project managers in soliciting subcontractors.

d. Additional Efforts:

9. Contractor Name agrees that the clause 52.219-8 entitled “Utilization of Small Business Concerns” and 52.219-9 entitled “Small Business Subcontracting Plan” will be included in all subcontracts which offer further subcontracting opportunities, and all subcontractors, except SB concerns, who receive subcontracts in excess of $700,000 ($1,500,000 for Construction) will be required to adopt and comply with subcontracting plan similar to this one. Such plans will be reviewed by comparing them with the provisions of P.L. 95-507 and assuring that all minimum requirements of an acceptable subcontracting plan have been satisfied. The acceptability of percentage targets shall be determined on a case-by-case basis depending on the supplies/services involved, the availability of potential small and small disadvantaged http://www.sam.gov/ http://dsbs.sba.gov/dsbs/dsp_dsbs.cfm subcontractors, and prior experience. Once approved and implemented, plans will be monitored through the submission of periodic reports, and/or, as time and availability of funds permit, periodic visits to subcontracting program progress.

10. Contractor Name and all 1st tier subcontractors applicable agrees and be required to submit such periodic reports for this contract to Small Business Liaison Person/Subcontracting Administrator and cooperate in any studies or surveys as may be required by the contracting agency or the Small Business Administration in order to determine the extent of compliance by the bidder (contractor) with the subcontracting plan and with clause entitled “Utilization of Small Business Concerns and Small Disadvantaged Business Concerns” contained in the contract. As required by P.L. 95-507, Section 211, Contractor Name shall submit the data utilizing the Electronic Subcontracting Reporting System (eSRS) with respect to the “Subcontracting Report for Individual Contracts”, (ISR-294), and “Summary Subcontract Report” (SSR-295). Regardless of the effective date of this contract, the reports shall be submitted for the entire life of the contract on the following dates:

Contractor Name will require each subcontractor with a subcontracting plan to provide the prime contract number and its own DUNS number, and the e-mail address of the Government or contractor official responsible for acknowledging or rejecting the reports, to its subcontractors with subcontracting plans.

11. Contractor Name will maintain to demonstrate the procedures adopted to comply with the requirements and goals in the subcontracting plan. These records will include, but not be limited to, the following:

a. Source lists, guides and other data identifying SB, HUBZone, SDB, WOSB, VOSB and SDVOSB concerns.

b. Organizations contacted to locate SB, HUBZone, SDB, WOSB, VOSB and

SDVOSB concerns.

c. On a contract-by-contract basis, records on all subcontract solicitations over

$150,000, indicating for each solicitation (1) whether SB concerns were solicited, and if not, why not; (2) whether HUBZone concerns were solicited, and if not, why not; and (3) whether SDB concerns were solicited, and if not, why not; and

(4) whether WOSB concerns were solicited, and if not, why not; and (5) whether VOSB or SDVOSB concerns were solicited, and if not, why not; and (6) reasons for the failure of solicited SB, HUBZone, SDB, WOSB and VOSB concerns to receive the subcontract award.

d. Records to support other outreach efforts, e.g., contacts with Minority and Small

Business Trade Associations, business development organizations, and attendance at small and small disadvantaged business procurement conferences and trade fairs.

e. Records to support internal guidance and encouragement provided to buyers through (1) workshops, seminars, training programs, incentive awards, and (2) monitoring of activities to evaluate compliance; and

f. On a contract-by-contract basis, records to support subcontract award data including the name, address, and business size of each subcontractor. (This item is not required on a contract-by-contract basis for company or division-wide commercial plans.)

12. Assurances that Contractor Name will make a good faith effort to acquire articles, equipment, supplies, services, or materials, or obtain the performance of construction work from the small business concerns that it used in preparing the bid or proposal, in the same or greater scope, amount, and quality used in preparing and submitting the bid or proposal. Responding to a request for a quote does not constitute use in preparing a bid or proposal. The Offeror used a small business concern in preparing the bid or proposal if--

(i) Contractor Name identifies the small business concern as a subcontractor in the bid or proposal or associated small business subcontracting plan, to furnish certain supplies or perform a portion of the subcontract; or

(ii) Contractor Name used the small business concern's pricing or cost information or technical expertise in preparing the bid or proposal, where there is written evidence of an intent or understanding that the small business concern will be awarded a subcontract for the related work if the Offeror is awarded the contract.

13. Contractor Name will provide the Contracting Officer with written explanation if it fails to acquire products/services/materials/etc. from firms identified in its SBSP.

This written explanation will be submitted to the Contracting Officer within 30 days of contract completion.

14. Contractor Name will not prohibit subcontractors from discussing with the

Contracting Officer any material contract matters, including payment issues and failure to be used as promised by the prime.

15. Assurances that Contractor Name will pay its small business subcontractors on time and in accordance with the terms and conditions of the subcontract and notify the contracting officer if the offeror pays a reduced or an untimely payment to the small business subcontractor.
