1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 Project Description

The Project will replace the aging and structurally deficient wooden fueling pier with a concrete fuel pier, fender piles, and mooring dolphins to service a JNB-22 barge. The combined length of the pier and dolphin is approximately 870 feet. The Pier will include one (1) 10-inch diameter schedule 40 carbon steel fuel pipe and two (2) fuel loading arms with associated spill containment. The work includes demolition of the existing fuel pier, site work, electrical power and controls, fire alarm and suppression systems, plumbing, and a containment drainage system. The project will also include turning basin dredging and related dredging disposal.

The project will also include a new government MOGAS (regular unleaded gasoline), diesel, and biodiesel refueling station to replace existing refueling facilities. Work will include new tanks, pumps, pavements, piping, canopy, automatic level control and gauging/metering system, emergency stop stations, and electrical systems. It will include an automatic tank gauging (ATG) system capable of inventory management, tank level and statistical leak detection. Existing Gasoline (MRR) and Bio Diesel (BDI) tanks and related equipment, service island, and related canopy structure will be demolished as a part of the project. A spill retention basin will also be constructed as part of this project.

SECTION 01 11 00 Page 1

1.2.2 Location

The work is located at the Joint Base Langley-Eustis, VA, approximately as indicated. The exact location will be shown by the Contracting Officer.

1.3 EXISTING WORK

In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:"

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.

1.4 LOCATION OF UNDERGROUND UTILITIES

Obtain digging permits prior to start of excavation, and comply with installation requirements for locating and marking underground utilities.

Verify existing utility locations indicated on contract drawings within area of work.

A coordinated and approved Work Clearance Request is required prior to any excavation activities. The Contractor shall submit a request to the Project Inspector 14 days prior to the start of excavation work. All requests must be initiated no later than Thursday of any week to be inserted into the Work Clearance approval process for the following week.

The Contractor will be notified to attend a Work Clearance scheduling meeting. At the Work Clearance meeting, the Contractor will receive an AF Form 103, instructions for completing the form, and a date and time for utilities to be marked. The Contractor shall not commence excavation prior to obtaining an approved AF Form 103. After all respective utilities have been marked and verified by the Project Inspector, the Contractor shall return the original AF Form 103 to his/her respective Project Inspector for coordination and signature by the Chief of Engineering. No digging or excavation shall begin before the Chief of Engineering signs the AF Form 103. After the Chief of Engineering signs the AF Form 103, the Project Inspector will return it to the Contractor.

Then, and only then, shall the Contractor commence excavation. The Contractor shall maintain all utility markings for the duration of the contract. Contractor shall maintain original version of the AF Form 103 for the duration of excavation work at the particular site. Ensure all applicable parties have coordinated on the form prior to excavation. For Miss Utility, use the Ticket Information Exchange (TIE) number or actual technician signature as evidence of coordination. The AF Form 103 clearance shall not be allowed to expire. The Contractor shall revalidate/resubmit the AF Form 103 within seven days prior to the expiration date if it is anticipated or known that the duration of excavation will exceed the 30-day limitation.

Contractor shall be responsible for obtaining all necessary digging permits and pay costs associated with the permit which may be necessary to accomplish the work.

SECTION 01 11 00 Page 2

1.4.1 Miss Utility

Contractor shall contact Miss Utility (1-800-552-7001) at least 48 hours prior to excavation to identify non-Air Force-owned underground utilities (cable TV, Bell Atlantic and Virginia Power, etc.). Notices to Miss Utility are good for 15 working days; after that period, Contractor shall renew the notice. Indicate renewals on the AF Form 103 as applicable.

Miss Utility is open 24 hours, seven days a week. Calls after 1700, before 0700, on weekends and on holidays are accepted for emergencies only. Holidays include New Year's Day, Martin Luther King Day, President's Day, Memorial Day, Independence Day, Labor Day, Veteran's Day, Thanksgiving Day, Day after Thanksgiving and Christmas Day. After 48 hours, Contractor should contact Miss Utility to confirm that clearance/marking operations have been completed. The Contractor must wait an additional 24 hours if any operators or contract locators have not responded to the Ticket Information Exchange (TIE) system request within the first 48 hours.

1.4.2 Markings

a. Prior to commencing any excavation, the Contractor must inspect the site for clear evidence of unmarked facilities. If evidence of such facilities is present, the excavator must notify the notification center and wait an additional three hours for the facilities to be marked.

b. The Contractor may choose to wait 72 hours and begin work after that time if there is no evidence that any underground facilities remain unmarked. However, it is recommended that Contractors contact the TIE system and confirm the status of underground facilities before they commence work.

c. After the markings have been made, Contractors are required to maintain a minimum clearance of two feet between a marked, underground utility line and the cutting edge of any power-operated excavating equipment. If excavation is required within two feet of any marking, it shall be performed very carefully with hand tools in accordance with Virginia Code Section 56-265.24.

d. If, during the course of excavation, a utility line has been exposed, before backfilling, the Contractor must inspect these facilities to ascertain if the facilities have been damaged. If damage of any kind is discovered or suspected, it is the Contractor's responsibility to immediately notify the utility owner directly. The Contractor must NOT attempt to repair damaged facilities.

e. Maintain any paint marks or stakes indicating underground utilities/lines as required during the duration of work or thirty calendar days from date of approved AF Form 103 (whichever is earlier). Note that Miss Utility clearance expires after fifteen working days.

1.4.3 Notification Prior to Excavation

Notify the Contracting Officer at least 48 hours prior to starting excavation work.

SECTION 01 11 00 Page 3

1.5 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "Default: (Fixed Price Construction)." In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the Project Site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

c. All awards or extensions for time shall be at the sole discretion of the Contraction Officer or their representative.

1.5.1 Schedule

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather-dependent activities.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS

BASED ON (5) DAY WORK WEEK

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

10 9 8 6 7 7 9 6 5 5 6 9

1.5.2 Records

Upon acknowledgment of the Notice to Proceed and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day.

1.5.3 Impacted Days

The number of actual adverse weather days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day in each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in the schedule of monthly anticipated adverse weather delays, above, the contracting officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Contract Clauses entitled "Default (Fixed Price Construction)."

SECTION 01 11 00 Page 4

1.6 COOPERATION WITH USING AGENCY AND OTHER CONTRACTORS

During the period of this contract, other contracts may be in force for the construction of other features of work on or adjacent to the site of work being accomplished under this contract. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other Contractors.

Should there be any conflicts between these limits, it shall be brought to the attention of the Contracting Officer (CO) and the CO's decision shall be final. Also, prior to completion of work under this contract, members of the Using Agency may be performing work or occupying facilities on or adjacent to the area. The Contractor shall arrange his plant and shall schedule and perform this work so as to effectively cooperate with all other Contractors and Government agencies.

1.7 HISTORICAL AND ARCHEOLOGICAL FINDS

Federal legislation provides for the protection, preservation, and collection of scientific, prehistoric, historical, and archeological data, including relics and specimens which might otherwise be lost due to alteration of the terrain or building features as a result of any Federal construction project. Should the Contractor, or any of the Contractor's employees, or parties operating or associated with the Contractor, in the performance of this contract discover evidence of possible scientific, prehistoric, historical, or archeological data, the Contractor shall immediately cease work at that location, avoid further disturbance, and notify the Contracting Officer, giving the location and nature of the findings. The Contractor shall forward written confirmation to the Contracting Officer as directed. The Contractor shall exercise care so as not to disturb or damage artifacts or fossils uncovered during excavation operations, and shall provide such cooperation and assistance as may be necessary to preserve the findings for removal or other disposition. Any person who, without permission, injures, destroys, excavates, appropriates, or removes any historical or prehistoric artifact, object of antiquity, or archeological resource on the public lands of the United States is subject to arrest and penalty of law. Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance or changes in the work, or both. If such delays or changes are ordered, an equitable adjustment will be made in the contract in accordance with the applicable clauses of the contract.

1.8 SALVAGE MATERIAL AND EQUIPMENT

Items designated by the Contracting Officer to be salvaged remain the property of the Government. This includes the marine loading arms.

Segregate, itemize, deliver and off-load the salvaged property at the Government-designated storage area shown on drawing G-006.

Provide a salvage plan, listing material and equipment to be salvaged, and their storage location. Maintain property control records for material or equipment designated as salvage. Use a system of property control that is approved by the Contracting Officer. Store and protect salvaged materials and equipment until disposition by the Contracting Officer.

1.9 SUBCONTRACTS AND WORK COORDINATION

Contract Clauses "SUBCONTRACTS," "PERMITS AND RESPONSIBILITIES," and "MATERIAL AND WORKMANSHIP" are supplemented as follows:

SECTION 01 11 00 Page 5

a. Divisions or sections of specifications are not intended to control the Contractor in dividing the work among subcontractor, or to limit work performed by any trade.

b. Contractor shall be responsible for coordination of the work of the trades, subcontractors, and materials.

c. The Government or its representative will not undertake to settle any difference between the Contractor and Contractor's subcontractors, or between subcontractors.

d. The Government reserves the right to refuse to permit employment on the work or require dismissal from the work of any subcontractor who, by reason of previous unsatisfactory work on Corps of Engineers projects, or for any other reason is considered by the Contracting Officer to be incompetent or otherwise objectionable.

1.10 CONSTRUCTION MANPOWER AND EQUIPMENT REPORT

The Contractor shall submit executed CENAO Form 987, Construction Manpower and Equipment Report daily. The report shall include manpower and equipment for the general and subcontractors. Forms are available from the Contracting Officer.

1.11 PROFIT

1.11.1 Weighted Guidelines

Weighted guidelines method of determining profit shall be used on any equitable adjustment change order or modification issued under this contract. The profit factors shall be as follows:

Factor Rate Weight Value

Degree of Risk 20

Relative difficulty of work 15

Size of Job 15

Period of performance 15

Contractor's investment 05

Assistance by Government 05

Subcontracting 25

1.11.2 Value

Based on the circumstances of each procurement action, each of the above factors shall be weighted from 0.03 to 0.12 as indicated below. The value shall be obtained by multiplying the rate by the weight. The value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement.

SECTION 01 11 00 Page 6

1.11.2.1 Degree of Risk

Where the work involves no risk or the degree of risk is very small, the weighting should be 0.03; as the degree of risk increases, the weighting should be increased up to a maximum of 0.12. Lump sum items will have, generally, a higher weighted value than the unit price items for which quantities are provided. Other things to consider: The portion of the work to be done by subcontractors, nature of work, where work is to be performed, reasonableness of negotiated costs, amount of labor included in costs, and whether the negotiation is before or after performance of work.

1.11.2.2 Relative Difficulty of Work

If the work is most difficult and complex, the weighting should be 0.12 and should be proportionately reduced to 0.03 on the simplest of jobs.

This factor is tied in to some extent with the degree of risk. Some things to consider: The nature of the work, by whom it is to be done, where, and what is the time schedule.

1.11.2.3 Size of Job

All work not in excess of $100,000 shall be weighted at 0.12. Work estimated between $100,000 and $5,000,000 shall be proportionately weighted from 0.12 to 0.05.

1.11.2.4 Periods of Performance

Jobs in excess of 24 months are to be weighted at 0.12. Jobs of lesser duration are to be proportionately weighted to a minimum of 0.03 for jobs not to exceed 30 days. No weight where additional time not required.

1.11.2.5 Contractor's Investment

To be weighted from 0.03 to 0.12 on the basis of below average, average, and above average. Things to consider: Amount of subcontracting, mobilization payment item, Government furnished property, equipment and facilities, and expediting assistance.

1.11.2.6 Assistance by Government

To be weighted from 0.12 to 0.03 on the basis of average to above average. Things to consider: Use of Government-owned property, equipment and facilities, and expediting assistance.

1.11.2.7 Subcontracting

To be weighted inversely proportional to the amount of subcontracting.

Where 80 percent or more of the work is to be subcontracted, the weighting is to be 0.03 and such weighting proportionately increased to 0.12 where all the work is performed by the Contractor's own forces.

Waste Disposal Act, as amended (42 USC 6901 ET SEQ); the Archaeological and Historic Preser-vation Act, as amended (16 USC Sec 469, ET SEQ), and the Virginia Solid Waste Management Regulations (9VAC20-81).

The Contractor shall collect all solid wastes generated during the performance of the contract in a container/area provided by the Contractor and approved by the Contracting Officer. The Contrac-tor shall provide appropriate containers for the collection and segregation of solid wastes, recycla-bles and C&D debris generated directly and indirectly by work under this Contract. The Contrac-tor is prohibited from using base dumpsters or other government owned/leased waste receptacles for the disposal of any solid wastes. All solid wastes shall be reclaimed, recycled or disposed of prior to completion of work on LAFB.

As proof of proper disposition of solid wastes, the Contractor shall provide legible weight receipts for solid waste disposed and materials recycled bearing the name, address, and phone number of the receiving facilities for every load of materials delivered. The weight ticket shall detail the type of material, weight of the material in pounds or tons, the date of the transaction, and a signature from a representative of the receiving facility. Receipts shall be submitted to the Contracting Of-ficer within ten calendar days after the transaction.

Under no circumstances will any solid waste or hazardous materials be left at LAFB at the end of the project. Before the project is turned over to the government, the Contractor will remove all solid wastes and hazardous materials from the installation. Those items include but are not limited to dirt piles, concrete piles, asphalt piles and rubbish piles. No materials will be left for the future use of the government UNLESS instructed to do so in writing by the government. This is to include the before mentioned items and also regular or touch-up paint, plaster, solvents, etc. If it is determined that the Contractor left materials behind, services may be terminated and/or a penalty payment to include the cost of disposal of the material by the government may be withheld from the project payment.

NOTE: Hazardous materials are different from hazardous wastes so be careful not to confuse the two. Hazardous Wastes will not be removed from the installation without the 633 CES Hazardous Waste Managers signing the Hazardous Waste Manifest. The LAFB Hazardous Waste Managers can be contacted at 757-764-1133 if needed.

1.1.1.2. CONSTRUCTION/DEMOLITION DEBRIS DIVERSION:

As good stewards of the environment, the government is committed to diverting its waste away from landfills to the greatest extent possible. Federal requirements require diversion of at least 50% of non-hazardous construction and demolition waste from disposal in landfills where markets or on-site recycling opportunities exist. This can be done through recycling, reusing (when di-rected by the government), manufacturer take-back programs and donating construction and dem-olition debris materials. The Contractor shall recycle all construction/demolition debris to the maximum extent possible. The Contractor shall make every effort to recycle materials such as but not limited to concrete (including concrete with rebar), brick, asphalt, all metals, wood, roofing materials, wallboard, ceiling tiles, etc. Specific areas on the site shall be designated for collection of recyclable and reusable materials. With prior coordination through the CO and 633 CES/CEIE, the Contractor may take scrap metals to the Langley AFB scrap metal yard for recycling. 1.1.1.2.1 CONSTRUCTION WASTE MANAGEMENT PLAN

Develop and implement a waste management program. Take a pro-active, responsible role in the management of construction and demolition waste and require all subcontractors, vendors, and suppliers to participate in the effort. The Environmental Manager, as specified in Section 01 57 23 Temporary Environmental Controls, is responsible for instructing workers and overseeing and documenting results of the Waste Management Plan for the project. Construction and demolition waste includes products of demolition or removal, excess or unusable construction materials, packaging materials for construction products, and other materials generated during the construc-tion process but not incorporated into the work. In the management of waste, consider the availa-bility of viable markets, the condition of the material, the ability to provide the material in suita-ble condition and in a quantity acceptable to available markets, and time constraints imposed by

Section 01 12 00 Page 4 internal project completion mandates. Implement any special programs involving rebates or simi-lar incentives related to recycling of waste. Revenues or other savings obtained for salvage, or recycling accrue to the Contractor. Appropriately permit firms and facilities used for recycling, reuse, and disposal for the intended use to the extent required by federal, state, and local regula-tions. Also, provide on-site instruction of appropriate separation, handling, recycling, salvage, reuse, and return methods to be used by all parties at the appropriate stages of the project.

The Construction Waste Management Plan shall be submitted to the Contracting Officer within 30 days of notice to proceed and shall demonstrate how to meet the project waste diversion goals. Also, include the following in the plan:

a. Name of individuals on the Contractor's staff responsible for waste prevention and management.

b. Actions that will be taken to reduce solid waste generation, including coordination with subcontractors to ensure awareness and participation.

c. Description of the regular meetings to be held to address waste management.

d. Description of the specific approaches to be used in recycling/reuse of the various ma-terials generated, including the areas on site and equipment to be used for processing, sorting, and temporary storage of wastes.

e. Characterization, including estimated types and quantities, of the waste to be gener-ated.

f. Name of landfill and/or incinerator to be used and the estimated costs for use, assuming that there would be no salvage or recycling on the project.

g. Identification of local and regional reuse programs, including non-profit organizations such as schools, local housing agencies, and organizations that accept used materials such as materials exchange networks. Include the name, location, and phone number for each reuse facility to be used, and provide a copy of the permit or license for each facility.

h. List of specific waste materials that will be salvaged for resale, salvaged and reused on the current project, salvaged and stored for reuse on a future project, or recycled. Identify the recycling facilities by name, location, and phone number, including a copy of the per-mit or license for each facility.

i. Identification of materials that cannot be recycled/reused with an explanation or justifi-cation, to be approved by the Contracting Officer.

j. Description of the means by which any waste materials identified in item (h) above will be protected from contamination.

k. Description of the means of transportation of the recyclable materials (whether materi-als will be site-separated and self-hauled to designated centers, or whether mixed materi-als will be collected by a waste hauler and removed from the site).

l. Anticipated net cost savings determined by subtracting Contractor program manage-ment costs and the cost of disposal from the revenue generated by sale of the materials and the incineration and/or landfill cost avoidance.

Revise and resubmit Plan as required by the Contracting Officer. Approval of Contractor's Plan will not relieve the Contractor of responsibility for compliance with applicable environmental regulations or meeting project cumulative waste diversion requirement. Distribute copies of the

Section 01 12 00 Page 5

Waste Management Plan to each subcontractor, the Quality Control Manager, and the Contract-ing Officer.

1.1.1.2.2 COLLECTION

Separate, store, protect, and handle at the site identified recyclable and salvageable waste prod-ucts in a manner that maximizes recyclability and salvagability of identified materials. Provide the necessary containers, bins and storage areas to facilitate effective waste management and clearly and appropriately identify them. Provide materials for barriers and enclosures around re-cyclable material storage areas which are nonhazardous and recyclable or reusable. Locate out of the way of construction traffic. Provide adequate space for pick-up and delivery and conven-ience to subcontractors. Recycling and waste bin areas are to be kept neat and clean, and handle recyclable materials to prevent contamination of materials from incompatible products and mate-rials. Clean contaminated materials prior to placing in collection containers. Use cleaning materi-als that are nonhazardous and biodegradable. Handle hazardous waste and hazardous materials in accordance with applicable regulations and coordinate with other portions of this Section.

Waste materials may be collected by source separation or by co-mingling methods. Other pro-posed methods may be used when approved by the Contracting Officer. Control accumulation of waste materials and trash. Recycle or dispose of collected materials off-site at intervals approved by the Contracting Officer and in compliance with waste management procedures.

1.1.1.2.3 RECYCLING AND DISPOSAL REPORTING: The Contractor shall report on a quarterly basis the tonnage of the items recycled and the amounts disposed of by landfill and amounts disposed of by regular or waste-to-energy incineration to the Project Manager, the Con-tracting Officer, and 633 CES Environmental Element (633 CES/CEIE) by the 5th day of each quarter (Jan, Apr, Jul, Oct) during the period of performance. This report will be for the previous quarter. The report shall list the title of the project, the project number, the Contractor’s company name and point-of-contact, phone number, the type items (i.e. concrete, concrete with rebar, as-phalt, brick, scrap metals, wood, wallboard, etc.) and the tonnage of those items recycled. For all items that could not be recycled, the Contractor will provide a brief reason as to why the items could not be recycled.

For items disposed of, one total tonnage can be given for items landfilled and one total tonnage for items incinerated (specify waste incinerator or waste-to-energy incinerator) instead of reporting disposal figures for the various items. For items that cannot be accurately measured, estimates will be sufficient. Use the form at Attachment 1 (Construction/Demolition Debris Recycling and Reporting) to report this information to the Contracting Officer, Project Manager, and to 633

CES/CEIE.

To send it to 633 CES/CEIE, email it to 633cescea@us.af.mil or mail it to:
