The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-

(c) The amount of the bid guarantee shall be _____20___ percent of the bid price or $3,000,000.00, whichever is less.-

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

Section 00 22 11 - Proposal Submission Requirements, Evaluation Criteria and Basis of Award for One Step Design-Build Selection

SECTION 00 22 11

PROPOSAL SUBMISSION REQUIREMENTS EVALUATION CRITERIA AND BASIS OF AWARD

BEST VALUE

(SINGLE AWARD)

1.0 OVERVIEW

In this Best Value trade-off selection procedure, interested firms or joint venture entities (referred to as ”offerors”) submit performance capability proposals, demonstrating their capability to successfully execute the construction contract (as defined in the 65% complete design released with this solicitation) resulting from this solicitation. The Government will evaluate the performance capability proposals in accordance with the criteria described herein. Following the completion of the 100% design estimated to be completed in June 2013, the 100% plans and specifications will be provided, by amendment, to all Offerors who provided proposals in response to this solicitation. All Offerors who submit a timely performance capability proposal in response to this solicitation will be invited to submit a price proposal to construct the work defined on the 100% complete construction plans and specifications. Not withstanding any provision to the contrary in the SF1442 included in this Solicitation, offerors providing less than 120 calendar days after the date to be set for receipt of the price proposal for Government acceptance will not be considered and will be rejected.

Offerors may submit revisions to their original performance capability proposals based on the information contained in the 100% complete design documents, provided that (1) the offeror, upon submission of its price proposal, notifies the contracting officer in writing that it has revised its performance capability proposal, and (2) the offeror clearly marks (for example, through use of “Tracked Changes”) all revisions/changes in the Revised Performance Capability Proposal that differ from the original Performance Capability Proposal previously submitted. If the offeror fails to satisfy these two (2) requirements, it expressly agrees that it will be bound by its original performance capability proposal.

The 65% complete design package is provided with this solicitation as a means to define the major features of work and coordination requirements. The 65% complete design package is therefore included for reference only for the purpose of an offeror developing the performance capability proposal. Offerors are cautioned that the design will continue to be refined, and the construction requirements may continue to evolve, until the 100% complete construction documents are released by amendment estimated in June 2013. Award of the construction project is projected to be completed by 30 September 2013.

2.0 BASIS OF AWARD

2.1 The Contracting Officer will award a firm fixed-price contract to that responsible Offeror whose proposal the Source Selection Authority has determined conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, considering all non-price factors described herein, and price. All evaluation factors, other than price, when combined, are considered significantly more important than price, however, the contract award shall not exceed the magnitude of construction project, hereafter the “cost limitation,” described in Section 00 21 00 of the Solicitation for this project. The intent of this solicitation is to obtain the best proposal within the cost limitation. There is no obligation to approach or match the cost limitation in the offer. After the Government individually evaluates and rates each proposal, the Contracting Officer/Source Selection Authority will compare proposals to determine which proposal represents the best value. The Government reserves the right to accept other than the lowest priced offer or to reject all offers. The Government will not award a contract to an Offeror whose proposal contains a deficiency, as defined in FAR 15.001, or if the Government’s assessment of any evaluation factor of any proposal results in a rating of “unacceptable.” If there is a lower priced, conforming offer(s), the Contracting Officer/Source Selection Authority must determine that the added value of a more expensive proposal (within the cost limitation) would justify award to that offeror.

3.0 GENERAL INSTRUCTIONS

3.1. Any legally organized Offeror may submit a proposal. To qualify for receipt of the solicitation amendment containing the 100% complete plans and specifications and the opportunity to submit a price proposal and compete for award, an offeror must timely submit a performance capability proposal. The performance capability proposal will be evaluated by the Government to determine the extent that it demonstrates capability and expertise as outlined herein.

3.2. Submit all performance capability proposal narrative and/or technical information in a tabbed, three-ring binder. Note that the Government will not evaluate any material that exceeds the page limits, (where indicated). THE PERFORMANCE CAPABILITY PROPOSAL INFORMATION SHALL NOT

INCLUDE PRICING.

3.3 Do not submit any materials not required by this solicitation (such as company brochures, etc).

3.4 Offerors shall submit their proposal packages to US Army Corps of Engineers, Norfolk District at the address shown in Block 7 of the Standard Form 1442. Proposals must be received in Norfolk District not later than the time and date specified in Block 13 of Standard Form 1442. Specific instructions for the receipt of the price proposal (and revised performance capability/technical proposal information as applicable) will be issued with the amendment releasing the 100% complete construction plans and specifications.

3.5 The Government is not liable for any costs incurred by the Offerors submitting an offer in response to this solicitation. As noted elsewhere in this Solicitation, this procurement is subject to the terms of FAR Clause 52.232-18, “Availability of Funds.”

3.6 Format Requirements: Submit one (1) original plus four (4) copies of the performance capability/technical proposal. In addition to the hardcopy proposals, submit five electronic, non-editable copies on CD ROM. The original hardcopy proposal must be clearly marked “Original” and the original signatures must be in blue ink. Copies of the proposal must also be clearly marked as “COPY XX of XX”. Proposal organization in the three ring binder, by Tab, is mandatory. No materials may be included by reference.

A page printed on two sides will be counted as two pages, where page limits apply. Pages containing text shall be submitted on 8 ½ x 11 inch paper. Each page shall be single spaced with a minimum 12 point font and one inch margins all around.

In addition to the completed questionnaires, the Offeror (and all key subcontractors as identified above) shall provide information with respect to past projects, within the last five (5) years, in which they have been issued a SHOW CAUSE or CURE NOTICE or a MARGINAL, POOR, UNACCEPTABLE, or UNSATISFACTORY performance appraisal. The Offeror shall provide detailed description for the matter and an explanation of why the NOTICE or appraisal was issued. If no such notices or ratings have been received, the Offeror shall include that statement in the proposal.

5.1.2. EVALUATION CRITERIA

5.1.2.1. The Government will perform a performance confidence assessment of the offeror’s probability of successfully meeting the contract requirements, considering the degree of success of the proposed team's recent (well under way or completed no longer than 5 years preceding the date of this solicitation), relevant experience. See explanation of “well underway” and relevancy under the Factor “Specialized Experience”. The Government will assess the past performance on projects submitted under the Specialized Experience Factor and reserves the right to conduct telephone interviews with points of contact identified in the proposal, and/or to review other recent projects rated in CCASS, review and/or contact offeror furnished references, or to review personal knowledge.

5.1.2.2. The Government will first assess and rate the relevancy of recent projects accomplished by the offeror to the scope of this contract for overall application to the performance confidence assessment ratings described hereinafter. The projects will reflect those submitted under the Specialized Experience Factor. This rating is not a separate proposal rating but is only used in developing the overall past performance confidence assessment rating assigned to the Past Performance Factor. The past performance relevancy ratings are described below:

(a) Very Relevant: Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires

(b) Relevant: Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

(c) Somewhat Relevant: Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

(d) Not Relevant: Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

5.1.2.3. The Government will next consider how well the offeror performed on the contracts. The Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor performance. With respect to relevancy and currency, past performance on projects with more relevance and which are more current will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment rating than past performance on projects of lesser relevance or completed longer ago. If any firm has multiple functions or divisions, The Government will only evaluate past performance of the division or unit submitting the offer. Owners/references may be asked to comment on items such as quality of construction, timeliness, management of the work, subcontractor management, including timely payment to subs or suppliers, safety, relations between owner and contractor, level of support for such things as as-built documentation, O&M manuals, training, correcting construction errors, warranty work, etc. The Government also places a higher value on projects, which document successful outcomes and are supported by outside source confirmation. The Government also places a higher value on projects, which provided particularly difficult or unique challenges and the innovative methods the contractor used to resolve problems successfully. The rating for this factor will be expressed as a degree of confidence in the offeror’s ability to successfully accomplish the contract requirements. The rating system used for the performance confidence assessment is described below.

5.1.2.4. Each Offeror will be rated on the team’s performance. A firm (prime or key subcontractor) may not establish past performance based on the past performance of its proposed key personnel (as defined in paragraph 5.3.1.7.3), apart from that of the entity. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror may not be evaluated favorably or unfavorably. The performance confidence assessment will be considered “Unknown Confidence”.

5.1.3. Performance Confidence Assessment (Overall) Rating System:

5.1.3.1. Unknown Confidence: No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

5.1.3.2. Substantial Confidence: Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

5.1.3.3. Satisfactory Confidence: Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

5.1.3.4. Limited Confidence: Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

5.1.3.5. No Confidence: Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

5.2. TAB C – FACTOR 2 - SPECIALIZED EXPERIENCE

5.2.1. SUBMISSION REQUIREMENTS:

5.2.1.1 The prime contractor and all “key subcontractors” (as defined at 5.1.1.1) shall each demonstrate recent, relevant experience on similar projects, using the form entitled “Construction – Specialized Experience” (see Attachment 3 to this section). Offerors may include contracts with private concerns, local and state governments, or the federal government that are similar to the requirements of this Solicitation.

5.2.1.2 If the offeror is a joint venture, the proposal shall describe the role that each firm in the joint venture will play in executing the project. Also, the proposal shall specifically identify any key subcontractor(s) and describe the role that the key subcontractor(s) will play in executing the contract.

5.2.1.3 The Government will consider only projects that are well underway or completed within the five

(5) years preceding the date of this Solicitation. “Well underway” shall be defined as at least 50% construction progress completed.

5.2.1.4 If any firm included in the proposal, either as a joint venture partner, prime contractor, or key subcontractor has multiple divisions, units, or functions, then the Government will consider only project examples performed by the division, unit, or function submitting the offer or by the team member.

5.2.1.5 The proposal shall include no less than three (3) or more than five (5) example projects performed by the prime contractor and no less than three (3) or more than five (5) example projects performed by each key subcontractor(s), as relevant to their proposed role on the project as described in

5.2.1.2. The Government will consider only the first five (5) projects submitted for the prime contractor and only the first five (5) projects submitted for any key subcontractor. If the prime contractor or any key subcontractor(s) is a joint venture, then only five (5) projects may be submitted for the joint venture.

5.2.1.6 The projects submitted shall demonstrate the necessary specialized experience for work at Arlington National Cemetery or equivalent or similar commercial or institutional settings. This work is characterized as having the following qualities:

a. Projects at national historic landmarks, national military cemeteries, large commercial cemeteries, or other large cemeteries operated by government or non-profit organizations; or

b. Projects involving the construction of new national landmarks or culturally significant structures or developments; or

c. Projects involving significant grading and landscaping, including decorative or commemorative stonework.

5.2.2 EVALUATION CRITERIA:

5.2.2.1 The Government will evaluate the extent to which the example projects submitted in the proposal demonstrate recent experience of the prime contractor and key subcontractor(s). To be considered recent, relevant experience, the projects should be similar in type, scope, complexity, and magnitude (as discussed more fully below) to the requirements of this Solicitation.

5.2.2.2 For a submitted project to be considered “similar in type” it should include project features similar to those stated in any of the subparagraphs of paragraph 5.2.1.6.

5.2.2.3 For a submitted project to be considered “similar in scope” it should include at least fifteen acres of significant earthmoving, extensive landscaping, and include some decorative or commemorative stonework.

5.2.2.4 For a submitted project to be considered “similar in complexity” it should demonstrate the requirements identified in at least one of the following paragraphs a, or b, or c below; and it must demonstrate the requirements in paragraph d below.

a. A requirement that it should be constructed or has been constructed within a constrained site.

A constrained site is defined as a site with very limited and controlled physical access and restricted and/or limited laydown space. A constrained site would require the prime contractor to exercise sufficient control of construction operations to facilitate progress while maintaining the normal construction requirements for access, workers and materials, and laydown areas; or

b. A requirement that it should be constructed or has been constructed in and/or adjacent to an active client operation. This requirement is described as work completed within an active military installation, publically visited monument or structure, or other similar aspects of project sites which are directly adjacent to or surrounded by activities or normal operations which cannot be stopped or eliminated during construction; or

c. A requirement that it should be constructed or has been constructed in manner that was carefully phased and planned so the work would minimize environmental impacts. This requirement can be characterized by a project that required work activities to be phased and planned to avoid impacts to the natural environment (e.g. existing vegetation, stream beds) as well as work sites which had the potential to contain cultural resources which must be preserved if encountered; and

d. A requirement that the construction should involve very high quality final products, ie., monument/memorial level quality.

5.2.2.5 For a submitted project to be considered “similar in magnitude” the total value of the submitted project should be at least $50,000,000, even if the value of the specific work performed by a proposed prime contractor or subcontractor was less than $50,000,000.

5.2.2.6 In addition, the Government will evaluate the submitted projects (performed by either the prime contractor or any key subcontractor) to determine the extent to which they demonstrate experience in the installation of pre-placed burial crypts.

5.2.2.7 The Government will consider only recent projects. “Recent” projects shall include only projects that were well underway (as defined at 5.2.1.3) or completed within the five (5) years preceding the date of this Solicitation.

5.2.2.8 The Government will evaluate submitted projects involving contracts with private concerns, local and state governments, or the federal government.

5.2.2.9 Joint Venture partners shall each demonstrate experience commensurate with their role on this project or explain in a short supplemental narrative (no longer than one page maximum) how their experience qualifies them for their role on this project.

5.2.2.10 The Government reserves the right to verify the experience record of cited projects by reviewing the Corps of Engineers Construction Contractor Appraisal Support System (CCASS), other DOD or Government appraisal systems, or to interview owners or references. The Government may check any or all cited references to verify supplied information.

5.2.2.11 The experience of key personnel (as defined in paragraph 5.3.1.7.3) standing alone will not be considered by the Government for purposes of meeting the Solicitation’s minimum requirements for specialized experience of an offeror.

5.3. TAB D – FACTOR 3 - TECHNICAL APPROACH

5.3.1 SUBMISSION REQUIREMENTS:

5.3.1.1 Provide a clear but concise description of the offeror’s technical approach to executing the project requirements addressing the matters identified below.

5.3.1.2 Documentation submitted under TAB D that exceeds twenty (20) pages will not be considered by the Government. The page limit does not include resumes submitted for key personnel identified below.

5.3.1.3 Organization:

5.3.1.3.1 Describe what firms are included as part of the offeror’s team, their resources, and how their resources will be utilized, their roles and responsibilities, and any contractual arrangements that have been established.

5.3.1.3.2 If the offeror is a joint venture, clearly describe any teaming or joint venture arrangements, including a clear description of each firm’s roles and responsibilities on the project.

5.3.1.3.3 Include a simple organizational chart, illustrating the organization, highlighting the proposed quality control group(s).

5.3.1.3.4 Present a matrix of responsibilities for each firm in executing the key work breakdown structure activities of the project, including construction activities for each major feature (i.e., site work, concrete, stonework, and landscaping).

5.3.1.3.5 Describe the proposed management structure for the team, how the construction process will be managed, and the authorities and the delegations of authority within the team.

5.3.1.3.6 Include a project key personnel organization chart that clearly depicts the key positions and the names of the personnel, their firm affiliations and their job locations, their job/position title within the organization. The project key personnel organization chart shall be consistent with the corporate organization chart and the list of key personnel to be provided (see 5.3.1.7.3).

5.3.1.4 Collaborative Approach:

5.3.1.4.1 Describe the approach to collaborate and achieve coordination within the team and with the Corps of Engineers during the construction activities.

5.3.1.4.2 Describe the role and interaction of the Government Quality Assurance team with the construction team during construction.

5.3.1.4.3 Discuss the approach to avoid interruptions or impacts to ongoing Cemetery operations, public visitation of the Cemetery, and working adjacent to Joint Base Myer-Henderson Hall.

5.3.1.5 Planning and Scheduling:

5.3.1.5.1 Describe the time control capabilities and systems to be used to plan construction activities and how the schedule will be used to manage construction progress.

5.3.1.5.2 Discuss internal procedures for handling delays to minimize time growth or ”schedule creep.”

As part of the contract requirements, the offeror awarded the contract must submit a formal construction schedule for approval; accordingly, the Government must evaluate the offeror’s planning and scheduling capabilities.

5.3.1.5.3 Discuss how Government furnished materials will be tracked and managed.

5.3.1.6 Quality Control:

5.3.1.6.1 The Government is looking for ways to ensure a quality finished product, suitable for the environment and the intended purpose, while managing labor and other resource and site constraints in an effort to reduce costs and achieve an aggressive schedule.

5.3.1.6.2 This project will contain many features of work typical in the construction industry, but their application at Arlington National Cemetery can be nothing short of flawless to provide an acceptable end product for our Nation. This focus on quality and finish necessitates the Government to evaluate the technical approach proposed to ensure that from the first construction fence placed to the last tree planted, the required quality levels have been planned into not only the work product but also the work process. The requirements in the plans and specifications, which will be included in an amendment to the Solicitation, will be exceptionally prescriptive by intent and design to ensure monumental quality construction in the final product. The monumental quality, or “near perfect” final products, that must be achieved must be commensurate with the solemn function these features will serve in honoring deceased service members and their families as their final resting places.

5.3.1.6.3 Given the environment in which this project is to be constructed, the contractor’s technical approach to delivering the requisite level of quality will be paramount to the success of this project.
