PART 1 GENERAL

1.1 SUMMARY

This section addresses the general requirements applicable to the performance of the work under this contract. These requirements are in addition to those specified in other sections of the contract.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having an "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Propelling Unit Agreement; G, RO

The written agreement between the Contractor and the lessor documenting the requirement for required towboat or propelling unit to be on site within the specified time limit shall be provided to the Contracting Officer or designated representative prior to mobilization of any floating plant to the work site.

Temporary Mooring Facilities; G, RO

The Contractor shall submit any proposed plans for development of temporary moorings to the Contracting Officer or designated representative. Moorings shall be designed in accordance with the requirements herein.

Plan of Action, Withdrawal of Equipment and Floating Plant; G, RO

The Contractor shall prepare and submit a Plan of Action for withdrawal of equipment and floating plant in accordance with paragraph "Plan of Action, Withdrawal of Equipment and Floating Plant."

The contractor shall develop and submit a plan for any proposed temporary works. Temporary works shall include such items as drilled shafts, anchor bolts installed in the existing apron, or any other such items installed for the sole purpose of supporting contractor's work effort. Plan must include sufficient detail to show how temporary work will not adversely affect existing structures, and must include means of removal following project completion.

1.4 CONTRACTOR RESPONSIBILITIES

1.4.1 General

Responsibilities of the Contractor include, but shall not be limited to, all planning, programming, administration, coordination, and management to ensure that all work is performed in accordance with all laws, regulations, codes or directives. The Contractor shall be responsible for ensuring that the work performed meets or exceeds the requirements of the contract. The Contractor shall perform all related Contractor administrative services necessary to perform the work, such as quality control, contractor financial control, and maintenance of accurate and complete records and files. The Contractor shall also be responsible for establishing and executing programs required to ensure that all work is performed in strict accordance with all health, safety and environmental laws, regulations, codes and directives, to protect the general public, as well as Contractor and Government employees.

1.4.2 Licenses and Permits

The Contractor shall be responsible for complying with all state or local contractor licensing or registration laws and permit requirements. The Contractor shall be responsible for furnishing qualified personnel for work which requires specialized registration or training.

1.5 DRAWINGS

1.5.1 Contract Drawings

The contract drawings provided reflect the work to be performed under this contract. In accordance with Section 00 70 00 CONDITIONS OF THE CONTRACT, DFARS 252.236-7001 CONTRACT DRAWINGS AND SPECIFICATIONS, the Contractor shall check all drawings immediately upon receipt, and verify the figures, dimensions, and representation of the work. The Contractor shall compare all drawings and verify the figures before laying out the work. Dimensions marked on drawings shall, in general, be followed. Use of scaled measurements shall not be allowed. The Contractor shall promptly notify the Contracting Officer or designated representative of any discrepancies, and shall be responsible for any errors which might have been avoided by complying with this paragraph. Any omissions from the contract drawings, specifications, or incorrect description of details of the work which are manifestly necessary to carry out the intent of the contract drawings and specifications, or which are customarily performed, shall not relieve the Contractor from performing such omitted or incorrectly described details of work, but shall be performed as if fully and correctly set forth and described in the contract drawings and specifications. Unless otherwise noted, dimensions and elevations, and other features shown on contract drawings are generally based on site surveys and measurements, and As-Built drawings. The Government cannot guarantee the accuracy of the dimensions, elevations, and features shown on the contract drawings which are based on the reference drawings, and it shall be the responsibility of the Contractor to verify all elevations and the dimensions shown by measurements in the field, at no additional cost to the Government.

1.5.2 Reference Drawings

The reference drawings included in the folio of contract drawings show original construction conditions of the original construction and the existing facilities and structures shown on the drawings. To the best knowledge of the Government, the reference drawings reflect the original work incorporated into this project, and do not reflect changes or new work since the date of the drawing. Unless otherwise noted, dimensions and elevations, and other features shown on reference drawings are generally based on As-Built conditions. Where known variations in actual construction occur between that shown on the reference drawings and that existing, it will be noted on the drawings or within the specifications, as practical. The Government cannot guarantee the accuracy of the dimensions, elevations, and features shown on the reference drawings, and it shall be the responsibility of the Contractor to verify all elevations and the dimensions shown by measurements in the field, at no additional cost to the Government. The Contracting Officer or designated representative shall be notified of any discrepancies prior to commencing work. It is noted that some of the As-Built conditions reflected by the reference drawings have since been modified. Such modifications to the As-Built conditions are described within the sections of these specifications where applicable.

Contract drawings are provided within the reference drawings for a project that may be on going during construction of the Secant Wall. These drawings are solely for the Contractor's reference and it is the responsibility of the Contractor to coordinate with the Contracting Officer or designated representative pertaining to work areas.

1.5.3 Construction Site Plan

Prior to the start of work, submit a site plan showing the locations and dimensions of temporary facilities (including layouts and details, equipment and material storage area, and access and haul routes, avenues of ingress/egress to the work area). Indicate if the use of a supplemental or other staging area is desired. Show locations of safety and construction fences, site trailers, construction entrances, trash dumpsters, temporary sanitary facilities, and worker parking areas. All areas must be limited to the Government provided lands as shown on the Drawings.

1.5.4 Existing Condition Photographs

The existing condition photographs depict features during construction.

Photographs are solely for the Contractor's reference and do not indicate any work to be performed under this contract.

1.6 WORK AREAS AND RESTRICTIONS

1.6.1 Work Areas

The work areas under this contract is shown in the drawings. As required by Section 00 70 00 CONDITIONS OF THE CONTRACT , FAR 52.236-10 OPERATIONS AND STORAGE AREAS, all operations of the Contractor shall be confined to areas shown on the drawings required to accomplish the work under this contract and as authorized and approved by the Contracting Officer or designated representative. All work areas shall be coordinated with the Contracting Officer or designated representative prior to commencement of work. The Contractor shall submit an Access Plan for Government operating personnel to the Contracting Officer or designated representative.

Temporary works may extend into the contracting mooring area, with the approval of the Contracting Officer or designated representative.

Contractor shall submit a Temporary Works Plan for any and all proposed temporary works.

1.6.2 Hauling Materials and Equipment

1.6.2.1 General

The Contractor's traffic on roads selected for hauling material to and from the site shall interfere as little as possible with public traffic.

The Contractor shall investigate the adequacy of existing roads and the allowable load limit on these roads. The Contractor shall be responsible for all damage to existing roads and property occasioned by any of his operations. When intending to transport any heavy loads on roadways, the Contractor shall investigate all weight limits for the roads he intends to use and shall secure any required bond(s) from the respective owner(s).

The Contractor shall document the existing condition of the roadways that he will be using, with the owners thereof. In the past, video recordings of the original roadway conditions have provided satisfactory

Prior to beginning any construction, the Contractor shall videorecord on a format acceptable to the Contracting Officer or designated representative all existing structures including, but not limited to, local roads, public and private property, and any other areas as directed by the Contracting Officer. The owners of such roadways and other property should be present at the time of the documentation. An unedited copy of all video recordings shall be given to the owners and the Contracting Officer or designated representative within 5 calendar days after documentation. All damage to transportation facilities, public or private property, or utilities caused by the Contractor's operations shall be repaired to the satisfaction of the Contracting Officer or designated representative at no additional cost to the Government. Any damage to the roadways, caused by the Contractor's operations, shall be repaired in kind by the Contractor and at his own expense. Roads shall be kept clear of all debris generated by the Contractor's operations. Roads shall be cleaned of any spillage. Upon completion of all work requiring use of the local roads, the roadways shall be restored to their preconstruction condition by cleaning and or reconstruction of damaged drainage facilities, base courses, and pavements as necessary. Repairs shall be made in the same manner as the original construction. No separate payment will be made for maintaining and restoring the condition of the roads, and all costs in connection therewith shall be considered as incidental to performance of the work.

1.6.2.2 Hauling Permits

The Contractor shall be responsible for acquiring all necessary oversized hauling permits and general hauling permits for any equipment or debris transported via roadways, as required. No heavy hauling on public roads will be permitted until all permits and bonds have been obtained as required. All costs associated with securing these permits shall be borne by the Contractor.

1.6.3 Laydown, Storage and Parking Areas

An area at the site, as shown, will be reserved for Contractor parking, field offices, laydown, and storage. Storage areas at the site will be limited to areas identified in the contract and as required for performance of the work under this contract. No other areas will be made available at the project for storage of equipment and materials. Unless otherwise specified, storage will not be permitted on service bridges, bulkheads, decks and similar structures. All such work and storage areas and adjacent facilities shall be protected from damage by the Contractor's operations. Any damage caused by the Contractor's operations shall be repaired to the satisfaction of the Contracting Officer or designated representative at the Contractor's expense. The Contractor's use of such storage areas shall not interfere with operation of the facilities.

Access onto floating plant may be made from the lock walls, but must be closely coordinated with the Contracting Officer or designated representative. The most direct access to the lock walls may be from the river. The Contractor shall investigate and arrange for all personnel access to the floating plant.

Other Contractors may be present at the site which may limit the available laydown or storage areas. Approval by the Contracting Officer or designated representative is required prior to placing any items within the laydown or storage areas. Due to multiple Contractors working at once, the Contracting Officer or designated officer may require temporary

SECTION 01 35 00.00 08 Page 8 relocation of items within these locations.

1.6.4 Access to Project Site

The Contractor will be permitted to cross the miter gates to access the River Wall. Construction loads on the miter gate walkways and grating/planking on the Land, Middle, and River Walls must not exceed 100 pounds per square foot. Larger loads may be acceptable pending the Government's review and approval.

1.6.5 Public Use

The Contractor's attention is directed to the fact that the work to be performed may be located in areas heavily used for recreational activities by the public. It shall be the responsibility of the Contractor to provide the controls necessary to prevent any interference by the public to his operations. The Government will cooperate with the Contractor in keeping the work areas clear so that the work may be performed with efficiency. The Contractor shall schedule his work to provide for these restrictions and all costs resulting therefrom shall be considered incidental to the costs of performing the work.

1.6.6 Utilities

Unless otherwise specified, the Government will not make any utilities or services available to the Contractor; and the Contractor shall be responsible for furnishing all utilities and services required for performance of the work under this contract.

1.6.7 Other Contractors

The Contractor is alerted to the fact that other contractors may be employed by the Government or local interests at, or in the vicinity of the site. See also Section 00 73 00 SUPPLEMENTARY CONDITIONS, clause WORK

UNDER OTHER CONTRACTS.

1.6.7.1 Government Work at Locks

The Government will be performing work in the Landward Lock Chamber for construction of maintenance projects of the lock. This work is anticipated to be performed in August 2021 through November 2021. Although the Government work will not directly impact the Contractor's work on the Secant Pile Wall, the work will require closing of the Landward Lock Chamber and utilization of the smaller Riverward Chamber by all river traffic. This may restrict the Contractor's access to the lock chamber for transportation between the Upper and Lower Pools. This work performed by the Government will result closures of the Landward Lock Chamber which may also have impact on river traffic passing through the lock.

1.7 FEDERAL HOLIDAYS

The ten Federal holidays observed are:

When one of the above designated holidays falls on a Sunday, the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work shall be scheduled around the above listed Federal holidays except as specified herein or as approved by the Contracting Officer or designated representative.

1.8 EXISTING SURVEY CONTROLS

1.8.1 Project Alignment

All new work to be constructed under this contract shall be constructed level, plumb, and accurately from survey control points established by the Contractor as necessary to construct all work within the proper alignment.

The Contractor shall verify the elevations and positions of the Corps of Engineers survey controls before using them to layout the work under this contract, and shall notify the Contracting Officer or designated representative of any discrepancies prior to commencing work.

1.9 CONTRACTOR'S FLOATING PLANT

1.9.1 General

Floating plant, and the operation of such plant, shall comply with the requirements of EM 385-1-1 , Section 19. Floating plant which is not being used in the performance of the work shall be secured in a manner that does not interfere with navigation on the river. Emergency plans for removing or securing floating plant and evacuating personnel in the event of severe weather shall be prepared in accordance with EM 385-1-1 , Section 19.A.03.

The Contractor shall provide personnel as necessary to adjust moorings to provide for fluctuations of pool level. A propelling unit capable of moving the floating plant must be available at all times. If the Contractor chooses to have a leased towboat or propelling unit off-site, the plant must be capable of being on-site within 4-hours notice. The written propelling unit agreement between the Contractor and the lessor documenting this requirement shall be provided to the Contracting Officer or designated representative prior to mobilization of any floating plant.

The agreement shall also include documentation that the propelling unit operator currently possesses a U.S. Coast Guard "Operator of Uninspected Towing Vessels" license. The Contractor shall be fully responsible for selection of floating plant which is suitable for the performance of the work under this contract. Contractor's floating plant shall operate only within the areas of work shown on the drawings, unless such areas are modified with the approval of the Contracting Officer or designated representative.

1.9.2 Equipment Requirements

The Contractor shall select floating plant and towboats and propelling units of a size and capacity suitable for performance of the work under this contract. Towboats and propelling units shall have sufficient horsepower capacity to control the floating plant used, considering the size and draft of the plant, for the expected river velocities and wind conditions. A minimum size of towboat shall be 1,000 horsepower. The

Contractor shall submit a plan of all floating plant, floating plant based equipment (i.e. cranes, derricks), temporary operating systems (i.e.

generators, compressors, welding machines, etc.), and other appurtenant features which he will have present during the contract period. The Contractor shall use sketches, diagrams, and narratives to indicate location of all floating plant-equipment. The Contractor shall use manufacture catalog information or other suitable data to describe the specific equipment to be used. The Contractor shall also indicate the methods and procedures that will be used to deliver materials, supplies and equipment via floating plant.

All floating plants regulated by the United States Coast Guard (USCG) shall have required USCG documentation that is current before being placed in service. A copy shall be posted in a public area aboard the vessel.

All dredges and quarter boats not subject to USCG inspection and certification, or not having a current ABS classification shall be inspected in the working mode annually by a marine surveyor accredited by the National Association of Marine Surveyors (NAMS) or the Society of Accredited Marine Surveyors (SAMS) having at least five years experience in commercial marine plant and equipment.

All other floating plants shall be inspected before being placed in use, and at least annually, by a qualified person in accordance with EM 385-1-1 Section 19, Paragraph A.01

All officers and crew aboard a floating plant shall be in possession of a current, valid USCG license.

1.9.3 Signal Lights and Markers

The Contractor shall display signal lights and conduct his operations in accordance with the General Regulations of the Coast Guard, as set forth in COMDTINST M16672.2D or 33 CFR 81 Appendix A (International) and 33 CFR 84 through 33 CFR 89 (inland) as applicable. The Contractor shall be required to furnish and install all buoys, lights, signs, and other safety devices as required by Coast Guard rules and regulations. All equipment and devices shall be Coast Guard approved.

1.9.4 Maintenance of Floating Plant

The Contractor shall maintain all floating plant equipment in good working condition throughout the contract period.

1.9.5 Mooring of Floating Plant

The Contractor shall be responsible for all mooring of floating plant.

When not in use, the Contractor's floating plant shall be securely moored.

The Contractor shall also be solely responsible for providing personnel in order to adjust mooring lines as required by the prevailing river conditions.

Floating plant may remain downstream of the dam during non-working time with consideration of the exceptions noted in paragraphs "Operation of Dam Gates during Contract Work," and "Withdrawal of Equipment and Floating Plant," herein. Without exception, all floating plant and equipment shall be removed from any position downstream of the dam when the total dam gate openings exceed 40 feet.

Development of plans for any proposed mooring shall be prepared under the direction of, or directly by, a Registered Professional Engineer(s) licensed within the United States. Any required investigations (i.e. soil and rock mechanics, rock depth) shall be the responsibility of the Contractor, and all costs for such investigation shall be borne by the Contractor.

Any temporary moorings constructed by the Contractor shall be completely removed at the completion of the project. The maximum allowable load that the Contractor may place on the existing concrete apron is 50 kips per 10'-0"x10'-0" area. All attachments and forces applied to the concrete apron shall be included within the Temporary Mooring Facilities Plan.

1.9.6 Suspension of River Traffic and Construction

1.9.6.1 Withdrawal of Equipment and Floating Plant

All floating plant shall be withdrawn from a gate bay when the projected total operational gate opening is forecasted to reach 35 feet or greater.

Once the total operational gate opening reaches 35 feet, floating plant may temporarily moor to the outside of the Lower Guard Wall directly below the spillway as long as the total gate opening is not projected to reach above 39 feet. This must be closely coordinated with the Lockmaster. If the total operational gate opening is forecasted to reach 40 feet or greater, the equipment shall be relocated to the outside face of the upstream river wall or to the Contractor's off-site mooring location. The decision of whether the Contractor's plant may be moored to the upstream River Wall will be determined on the basis of the projected upstream pool level. When the upstream pool level reaches an elevation of 686.0 feet (U/S Gage = 16 FT), the Contractor shall begin preparations to move the floating plant. If the upstream pool level is expected to reach an El. of

690.0 feet (U/S Gage = 20 FT) then mooring of the plant at the off-site location will be required. The Contractor shall monitor the prevailing river conditions at the project site, referring to the upstream project river gage, river forecasts issued by the National Weather Service, and the Corps of Engineers River Forecast System, and shall determine when to

SECTION 01 35 00.00 08 Page 12 withdraw equipment and floating plant. Projected dam gate operations shall be coordinated with the Lockmaster and Contracting Officer or their designated representative. The withdrawal of equipment and floating plant shall ultimately be the Contractor's decision and will not be directed by the Government. It shall be the Contractor's responsibility to determine the time necessary to make a complete and safe withdrawal of equipment and floating plant with due consideration given to the location of mooring area; amount of equipment; size of the floating plant, and capacity of towboats and propelling units to operate safely and efficiently at the expected river velocities. All floating plant and equipment shall remain securely moored during the period that gate openings exceeds 40 feet or when the pool is at or above the specified level. The Contractor shall also be responsible for providing personnel during the suspension to adjust mooring lines as required by the prevailing river conditions.

1.9.6.2 Plan of Action, Withdrawal of Equipment and Floating Plant

The Contractor shall prepare and submit a Plan of Action for withdrawal of equipment and floating plant. The plan shall detail the procedures for withdrawal of equipment and floating plant in the event that suspension of river traffic and work is imminent. The Plan of Action shall include but is not limited to the following information:

- Procedure(s) For Monitoring River Conditions Including River Levels, Discharges, And Velocities

- Mooring Location(s)

- Monument River Condition Which Affect Notification Actions

- Monument River Conditions Which Affect Withdraw

- Sequence and Duration of Withdraw

- Procedures for Care of Moored Floating Plant and Equipment

- Monument River Conditions Affecting Remobilization

- Sequence and Duration of Remobilization

The Plan of Action shall include a listing of key Contractor's Points of Contact and telephone numbers. The Plan of Action shall include the withdrawal of any subcontractor's equipment and floating plant. The Contractor's Plan of Action shall be consistent with the applicable requirements for Emergency Planning as described in EM 385-1-1 . All key Contractor personnel including superintendents, foremen, safety officers, and QC personnel shall be given a copy of the Plan of Action and shall be thoroughly familiar with their duties under this plan. Subcontractors shall also be thoroughly familiar with their responsibilities and duties under the plan.

1.9.6.3 Compensation and Extension of Contract Period, Suspension of Work

The withdrawal of floating plant and equipment is considered an incidental condition of work dictated by the nature of the work site. The Contractor's withdrawal of equipment and floating plant shall not be construed as a direction on the part of the Government or Contracting Officer or designated representative, under the provisions of Section

00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.242-14 SUSPENSION OF WORK,

which shall not apply to this work condition. No compensation will be made to the Contractor for withdrawal of this equipment nor will any delay costs be made for the period during which work cannot be accomplished. In accordance with Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.249-10 DEFAULT (FIXED PRICE CONSTRUCTION), the contract period will be extended equitably for the withdrawal of floating plant and equipment.

1.9.7 Operation of Small Water Craft

Operators of small water craft must have a Boating Safety Education Certificate issued for a course approved by the National Association of State Boating Law Administrators (NASBLA). The Contractor shall develop, prepare and submit a small water craft operations plan addressing the operation of small water craft within the "Restricted Area" of the Montgomery Lock(s) and Dam. The plan shall address safe operations of small water craft and shall include; maximum river stages, maximum river flows, horsepower requirements, training, and any other items necessary to address all the hazards associated with navigating in the "Restricted Area" of the dams.

1.10 RESTRICTIONS TO RIVER TRAFFIC FOR CONSTRUCTION

Unless specifically authorized or directed, no interruption of traffic through the lock chambers or their approaches will be permitted. The Contractor will not be given any privileges for priority lockage under the conditions of this contract, unless specifically authorized by the Contracting Officer or designated representative.

1.10.1 General

The Contractor's attention is directed to the fact that the lock and dam facility has two lock chambers at Montgomery Lock and Dam. Either Chamber will not be allowed to be taken out of operation and no interruption of commercial traffic through the chamber or its approaches will be permitted during the performance of this contract.

1.10.2 Requests for Lockage Through Main or River Chamber

The Government recognizes that the Contractor may need to lock through the the River Chamber, however, these lockages must be fully coordinated with the Lockmaster and kept to an absolute minimum to ensure there are no delays to commercial river traffic. All lockages must be subject to the following:

a. The Government retains the right to determine the order and priority of lockages at the sole discretion of the Lockmaster. The Government reserves the right to supercede and delay any requested lockage for any reason (such as increased commercial river traffic, maintenance, equipment failure, emergencies etc.) at the sole discretion of the Government. The Contractor is advised that these delays will not be subject to Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.233-1 DISPUTES, and shall not be considered as direction from the Contracting Officer or designated representative.

These delays will not result in any additional time extensions or payment of any delay costs, nor shall they be the basis of any claim against the Government.

b. The Contractor is not permitted to use the Main or River Chamber for staging of equipment.

c. All requests for lockages must be coordinated with the Lockmaster in accordance with the following provisions:

1) Upon approval of an estimated date and estimated time for a proposed lockage, the Contractor must be ready to perform the requested lockage. The Contractor is advised that the Government

SECTION 01 35 00.00 08 Page 14 will not be liable in the event the Chamber is not available at the requested date and time, and that any resulting delay will not be subject to Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.233-1 DISPUTES, and will not result in any additional time extensions or payment of any delay costs, nor shall they be the basis of any claim against the Government.

2) The Contractor must configure his floating plant, work operations and all equipment to allow safe, uninterrupted lockage through the Chamber in such a manner that no delays to the normal lockage time period will be incurred.

3) The Contractor is advised that the request for lockage may be delayed or postponed indefinitely due to unexpected conditions such as high water, lock breakdowns, or unanticipated maintenance demands, etc.

4) Requests for lockages that do not meet these criteria will not be approved. Requests for unscheduled lockages due to anticipated flooding or other emergency will considered on a case by case basis. Lockages or other interference with river traffic due to any situation which endangers human life will be permitted as the circumstances warrant. Movement of floating plant in the approaches to the locks must at all times be fully coordinated with the Lockmaster and Contracting Officer or designated representative, but shall not delay river traffic through the active chamber.

1.11 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.236-7 PERMITS AND RESPONSIBILITIES. However, if, in the judgment of the Contracting Officer or designated representative, any part of the permanent work performed by the Contractor is damaged by flood or earthquake, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor shall make the repairs as ordered by the Contracting Officer or designated representative and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer or designated representative, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to the Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.243-4 CHANGES, will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer or designated representative at the Contractor's expense, regardless of the cause of such damage.

1.12 PROTECTION OF UTILITIES

Notwithstanding the Section 00 73 00 SUPPLEMENTARY CONDITIONS, paragraph "PROTECTION OF UTILITIES", and Section 00 70 00 CONDITIONS OF THE

CONTRACT, FAR 52.236-9 PROTECTION OF EXISTING VEGETATION, STRUCTURES,

EQUIPMENT, UTILITIES, AND IMPROVEMENTS, the Contractor shall locate and clearly identify all underground and above ground utility lines, wires, SECTION 01 35 00.00 08 Page 15 cables, pipes, poles, support lines, and culverts, within the Contractor's work area. The Contractor shall contact the Pennsylvania One Call System at telephone (800) 242-1776 at least three days prior to beginning any Construction activity and comply with all applicable provisions of the PA Underground Utility Line Protection Act, PA Act 287. The Contractor shall be responsible for any costs for the Pennsylvania One Call System. Any damage to utilities caused by the Contractor's actions shall be repaired by him at no additional expense to the Government. The Contractor shall store materials and equipment in a manner that does not interfere with utility company services or utility company access to the facilities. The Contractor shall relocate any equipment or stockpiles, at no additional cost to the Government, that interfere with utility company operations, emergency repairs, or standard maintenance services.

1.13 INSPECTIONS AND ACCEPTANCE OF WORK

Not withstanding other provisions of this contract, all materials and work to be performed under this contract shall be inspected and accepted by the Contracting Officer or designated representative . Inspections and acceptance will be performed on phases of the work, before the next definable sequential phase of work commences, OR may be performed at the completion of all of the work, as determined appropriate by the Contracting Officer or designated representative. The Contracting Officer or designated representative shall be the individual(s) solely authorized to reject materials, disapprove or approve any work in progress, or order or direct any revision or change to the plans and specifications as presently shown and stated.

1.13.1 Access to Work

The Contractor shall provide access to all areas of work for inspection by the Government. The Contractor shall maintain suitable land based access to allow Government inspectors access to the areas of work. The Contractor shall also provide access for Government by boat, transporting Government inspectors to the various areas of work.

1.14 OPERATION OF GOVERNMENT FACILITY

The Montgomery Lock and Dam facility shall remain in operation at all times. The Contractor shall perform his work in a manner which will not interfere with the operation of the facilities and the duties of Government personnel. Particular care shall be taken during all operations under this contract to prevent damage to any operating equipment or facilities at the project. The Contractor shall take all necessary precautions to ensure the safety of the workers in accordance with the applicable provisions of EM 385-1-1 . Contractor operations shall be performed in such a manner to ensure that project personnel, navigation industry personnel and the public are protected at all times.

1.14.1 Montgomery Locks and Dam, Hours of Operation

Montgomery Locks and Dam operates 24 hours per day, seven days per week.

1.14.2 Contractor's Work Hours

Contractor work hours will be restricted to 6 days a week, 12 hours per day.

1.14.3 Coordination with Project Operations

The Contractor shall perform all work in a manner that will not interfere with the duties of the Government operations personnel. Particular care shall be taken during all operations under this contract to prevent damage to any operating equipment or facilities at the project. The Contractor shall continuously maintain safe access to all areas of the project for operating personnel, during every phase of the work, unless otherwise directed by the Contracting Officer or designated representative.

1.14.3.1 Dam Gate Operating Schedule

The dam gate operating schedule attached at the end of this section are applicable for governing gate movements by the Government at Montgomery Locks and Dam for the operating conditions during the period of this contract. This schedule will be the basis for minimizing the effect of flow through the dam on the work at the site and maintaining customary river stages above the dam. The schedule GATE BAYS 1 AND 9 OUT OF SERVICE, GATES 2, 8 and 10 RESTRICTED, ONE WEIR IS OUT will be in effect for the length of this contract.

1.14.3.2 Operation of Dam Gates During Contract Work

The Contractor shall not impede dam gate operation during the entire contract period. Additional construction projects may occur concurrently with this contract, which may limit dam gate operations.

The Contractor should review the Contract Drawings with the gate schedule provided, along with the hydrographs, rating curves, and duration curves to determine the influence that river conditions may have during the on site portion of the work under this contract.

The Contractor's floating plant must be withdrawn from the gate bays and moored before gate operations occur in adjacent bays. See paragraph Withdrawal of Equipment and Floating Plant for additional details. As total operational gate opening approaches 35 feet, close coordination with the Lockmaster is required. The Contracting Officer or their designated representative may instruct the Contractor to move the floating plant before a total operational gate opening of 35 feet if the Lockmaster determines it necessary to maintain the safety of the project site. No additional gate operations will be conducted in support of any other work, unless specifically authorized by the Contracting Officer or designated representative. The Contracting Officer or designated representative will have sole authority to review all requested modifications to dam gate operations, and to what degree to accommodate active contract work. The Contractor may request in writing an alternate gate schedule if river current is negatively affecting quality of work. Such requests shall be given to the Contracting Officer or their designated representative and minimum of 30 calendar days in advance of the requested change. Approval of such changes shall rest with the Contracting Officer or designated representative who's decision shall be final. Implementation of any approved modifications to the gate operations on the date(s) requested shall be subject to river conditions, and may be delayed or altered as necessary to accommodate the prevailing river flow conditions and shall not be considered as a basis of a change condition. All gate operations shall be performed by Government personnel.

1.14.3.3 Installation of Flashboards

The Contractor shall provide and install flashboards to prevent the upstream current flowing over the fixed crest dam closest to the anticipated work and lock chambers. For location of holes intended to accept the flashboard system, refer to the reference drawings. Cleaning of flashboard holes from river debris may be required prior to flashboard installation. The flashboard system must have a height of 4'-0", +/- 3", from the top of the fixed crest dam to the top of the flashboard system.

The flashboard system must be capable of withstanding typical hydrostatic forces for the height of the flashboard system and shall comply with the latest edition of applicable codes such as, but not limited to, ASCE, AISC, IBC, and NDS. The contractor shall submit calculations and sketches for the flashboard systems. After the contract has been completed, the Government will assume ownership of the flashboard system.

1.14.3.4 Contractor Coordination and Scheduling

In accordance with Section 01 32 01.00 08 PROJECT SCHEDULE BAR CHART, the Contractor shall submit a project schedule for his work to the Contracting Officer or their designated representative. All necessary adjustments in the Contractor's work schedule shall be coordinated and approved by the Contracting Officer or designated representative.

1.14.3.5 Warning Signs, Lights and Buoys

The Contractor shall be required to furnish and install all buoys, lights, signs, and other safety devices as required by Coast Guard rules and regulations. All equipment and devices shall be Coast Guard approved.

1.14.4 Temporary Work Stoppages

The Contractor may be required to stop work for short periods of time for safety purposes or to avoid interference with operation of the project by the Government. Possible reasons for such temporary work stoppages include, but are not limited to, the following:

a. During high water due to weather.

b. For any emergency or maintenance situation that may occur during the construction period.

c. Other unforeseen events that may require work stoppage.

The Contractor shall consider such temporary work stoppages in scheduling his work at the site.

1.15 SAFETY AND HEALTH REQUIREMENTS

Safety and Health Requirements shall conform to Section 01 35 26.00 08 GOVERNMENTAL SAFETY REQUIREMENTS, EM 385-1-1 , and the requirements of the Occupational Safety and Health Administration. Where provisions of EM 385-1-1 vary with OSHA requirements, the more stringent requirements shall be applied.

1.16 POOL LEVELS

The normal upstream pool level at Montgomery Locks and Dam is El. 682.0 FT(U/S gage reading = 12.0 FT). The normal pool level downstream of the

SECTION 01 35 00.00 08 Page 18 dam is El. 664.5 FT (D/S gage reading = 12.0 FT). The Contractor shall refer to the DISCHARGE-DURATION and STAGE-DISCHARGE curves presented in the drawings for determining the percentage of time for which this river level is equaled or exceeded.

1.16.1 Hydrographs and Stage-Duration Curves

Historical stage hydrographs between 1995 and 2020 are provided in the drawings. The hydrographs show typical seasonal upper and lower pool levels for the Ohio River at Montgomery Locks and Dam. The Discharge-Duration curves are given in the drawings. The duration for particular pool stages can be determined by obtaining the relevant pool stage for that pool from the appropriate Stage-Discharge curve for use with the Discharge-Duration curve for that pool.

1.17 SCAFFOLDING

The Contractor shall furnish, erect, maintain, and finally remove all necessary scaffolding required for the performance of the work under this contract. Scaffolding shall be erected and maintained in accordance with the scaffolding requirements of EM 385-1-1 . Necessary safety equipment and apparatus shall be provided to adequately protect all personnel employed by the Contractor against the hazards of falling and drowning and any other hazards encountered during the prosecution of the work. The scaffolding shall be adequate to permit proper performance of the work and permit inspection by Government inspectors.
