PART 1 GENERAL

1.1 SUMMARY

This section addresses the general requirements applicable to the performance of the work under this contract. These requirements are in addition to those specified in other sections of the contract.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having an "G" designation are for information only. When used, a designation following the "G" designation identifies the office

SD-01 Preconstruction Submittals

Propelling Unit Agreement; G, RO

The written agreement between the Contractor and the lessor documenting the requirement for required towboat or propelling unit to be on site within the specified time limit shall be provided to the Contracting Officer or their designated representative prior to mobilization of any floating plant to the work site.

Temporary Mooring Facilities; G, RO

The Contractor shall submit any proposed plans for development of temporary moorings to the Contracting Officer or their designated representative. Moorings shall be designed in accordance with the requirements herein.

Construction Site Plan; G, RO

Access Plan; G, RO

The Contractor shall submit an access plan for Government lock operating personnel to the Contracting Officer or their designated representative.

Plan of Action, Withdrawal of Equipment and Floating Plant; G, RO

The Contractor shall prepare and submit a Plan of Action for withdrawal of equipment and floating plant in accordance with paragraph "Plan of Action, Withdrawal of Equipment and Floating Plant."

The Contractor shall develop and submit a plan for operation of small water craft within the area of the dam.

1.4 CONTRACTOR RESPONSIBILITIES

1.4.1 General

Responsibilities of the Contractor include, but shall not be limited to, all planning, programming, administration, coordination, and management to ensure that all work is performed in accordance with all laws, SECTION 01 35 00.00 08 Page 4 regulations, codes or directives. The Contractor shall be responsible for ensuring that the work performed meets or exceeds the requirements of the contract. The Contractor shall perform all related Contractor administrative services necessary to perform the work, such as quality control, contractor financial control, and maintenance of accurate and complete records and files. The Contractor shall also be responsible for establishing and executing programs required to ensure that all work is performed in strict accordance with all health, safety and environmental laws, regulations, codes and directives, to protect the general public, as well as Contractor and Government employees.

1.4.2 Licenses and Permits

The Contractor shall be responsible for complying with all state or local contractor licensing or registration laws and permit requirements. The Contractor shall be responsible for furnishing qualified personnel for work which requires specialized registration or training.

1.5 DRAWINGS

1.5.1 Contract Drawings

The contract drawings provided reflect the work to be performed under this contract. In accordance with Section 00 70 00 CONDITIONS OF THE CONTRACT, DFARS 252.236-7001 CONTRACT DRAWINGS AND SPECIFICATIONS, the Contractor shall check all drawings immediately upon receipt, and verify the figures, dimensions, and representation of the work. The Contractor shall compare all drawings and verify the figures before laying out the work. Dimensions marked on drawings shall, in general, be followed. Use of scaled measurements shall not be allowed. The Contractor shall promptly notify the Contracting Officer or their designated representative of any discrepancies, and shall be responsible for any errors which might have been avoided by complying with this paragraph. Any omissions from the contract drawings, specifications or incorrect description of details of the work which are manifestly necessary to carry out the intent of the contract drawings and specifications, or which are customarily performed, shall not relieve the Contractor from performing such omitted or incorrectly described details of work, but shall be performed as if fully and correctly set forth and described in the contract drawings and specifications. Unless otherwise noted, dimensions and elevations, and other features shown on contract drawings are generally based on site surveys and measurements, and As-Built drawings. The Government cannot guarantee the accuracy of the dimensions, elevations, and features shown on the contract drawings which are based on the reference drawings, and it shall be the responsibility of the Contractor to verify all elevations and the dimensions shown by measurements in the field, at no additional cost to the Government.

1.5.2 Government-Furnished Material Drawings

The Government-furnished material drawings included in the folio of contract drawings are the as-awarded contract drawings for the purchase of the Government-furnished lift gates and associated components identified in Section 01 73 19.00 08 GOVERNMENT-FURNISHED PROPERTY. To the best knowledge of the Government, the Government-furnished material drawings reflect the as-fabricated condition of the items. The Government cannot guarantee the accuracy of the dimensions and features shown on the reference drawings, and it shall be the responsibility of the Contractor to verify all dimensions shown by measurements in the field, at no

SECTION 01 35 00.00 08 Page 5 additional cost to the Government. The Contracting Officer or their designated representative shall be notified of any discrepancies prior to commencing work.

1.5.3 Reference Drawings

The reference drawings included in the folio of contract drawings show original construction conditions of the original construction and the existing facilities and structures shown on the drawings. To the best knowledge of the Government, the reference drawings reflect the original work incorporated into this project, and do not reflect changes or new work since the date of the drawing. Unless otherwise noted, dimensions and elevations, and other features shown on reference drawings are generally based on As-Built conditions. Where known variations in actual construction occur between that shown on the reference drawings and that existing, it will be noted on the drawings or within the specifications, as practical. The Government cannot guarantee the accuracy of the dimensions, elevations, and features shown on the reference drawings, and it shall be the responsibility of the Contractor to verify all elevations and the dimensions shown by measurements in the field, at no additional cost to the Government. The Contracting Officer or their designated representative shall be notified of any discrepancies prior to commencing work. It is noted that some of the As-Built conditions reflected by the reference drawings have since been modified. Such modifications to the As-Built conditions are described within the sections of these specifications where applicable.

1.5.4 CONSTRUCTION SITE PLAN

Prior to the start of work, submit a site plan showing the locations and dimensions of temporary facilities (including layouts and details, equipment and material storage area, and access and haul routes, avenues of ingress/egress to the work area). Indicate if the use of a supplemental or other staging area is desired. Show locations of safety and construction fences, site trailers, construction entrances, trash dumpsters, temporary sanitary facilities, and worker parking areas. All areas must be limited to the Government provided lands as shown on the Drawings.

1.6 WORK UNDER OTHER CONTRACTS

Attention is directed to the fact that other Contractors may be employed by the Government at or in the vicinity of the work covered by these specifications. It is noted that the information provided is for the Contractor's information, and no attempt has been made to list all the work activities required under those contracts. Unless specified otherwise, all Contractors shall have equal rights to the use of access roads and other areas which are not identified on the Contract Drawings as work areas or laydown areas for specific contractors, so far as practicable, and the Contractor employed under this contract shall cooperate with other Contractors so that the work may be performed with maximum efficiency. Should a disagreement occur between Contractors as to the use of facilities or in other matters, the decision of the Contracting Officer or their designated representative shall govern. See also Section 00 73 00 SUPPLEMENTARY CONDITIONS, clause WORK UNDER OTHER CONTRACTS. See also paragraph Protection of Existing Roads and Property.

1.6.1 Dam Gate Installation

A contract for installation of new lift gates Nos. 1, 2, and 3 was awarded in July 2017 with completion anticipated in October 2020 early 2021 . Work under the gate installation contract is similar to the work under this contract and will require use of the bulkhead units. As a result, the bulkhead units will not be available for use under this contract until November March 1, 2020 2021 .

1.7 WORK AREAS AND RESTRICTIONS

1.7.1 General

The work under this contract shall be performed at Montgomery Locks and Dams, Ohio River, Beaver County, Pennsylvania. The Montgomery facility is located 31.7 river miles downstream of the point in Pittsburgh. Dual lock chambers are located at the left bank of the channel. Access to the dam is made from the dam abutment on the right bank and from the locks on the left bank.

1.7.2 Work Areas

The work areas under this contract shall be adjacent to the upper guard wall. As required by Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.236-10 OPERATIONS AND STORAGE AREAS, all operations of the Contractor shall be confined to areas shown on the drawings required to accomplish the work under this contract and as authorized and approved by the Contracting Officer or their designated representative. All work areas shall be coordinated with the Contracting Officer or their designated representative prior to commencement of work. The Contractor shall submit an access plan for Government lock operating personnel to the Contracting Officer or their designated representative.

1.7.3 Access Plan

The Contractor shall prepare a plan to address maintaining access to existing facilities and temporary access as required for construction of the various features of work. The plan shall address all requirements or conditions given in paragraphs Work Areas, CONTRACTOR'S FLOATING PLANT, OPERATION OF FACILITIES, CONDITIONS OF WORK, POOL LEVELS, and DISCHARGES, herein.

1.7.4 Access to Project Site

The Montgomery Dam may be accessed from the right abutment of the dam and the left bank at the locks. An area at the locks, as shown, will be reserved for Contractor parking, field offices, laydown, and storage. The Contractor will be provided parking areas as designated by the Contracting Officer or their designated representative. Access onto floating plant may be made from the lock walls, but will be closely coordinated with the Contracting Officer or their designated representative. The most direct access to the dam may be from the river. The Contractor shall investigate and arrange for all personnel access to the floating plant.

1.7.5 Hauling Materials and Equipment

1.7.5.1 General

The Contractor's traffic on roads selected for hauling material to and

SECTION 01 35 00.00 08 Page 7 from the site shall interfere as little as possible with public traffic.

The Contractor shall investigate the adequacy of existing roads and the allowable load limit on these roads. The Contractor shall be responsible for all damage to existing roads and property occasioned by any of his operations. When intending to transport any heavy loads on roadways, the Contractor shall investigate all weight limits for the roads he intends to use and shall secure any required bond(s) from the respective owner(s).

The Contractor shall document the existing condition of the roadways that he will be using, with the owners thereof. In the past, video recordings of the original roadway conditions have provided satisfactory documentation. Prior to beginning any construction, the Contractor shall video record on a format acceptable to the Contracting Officer or their designated representative all existing structures including, but not limited to, local roads, public and private property, and any other areas as directed by the Contracting Officer or their designated representative. The owners of such roadways and other property should be present at the time of the documentation. An unedited copy of all video recordings shall be given to the owners and the Contracting officer or their designated representative within five calendar days after documentation. All damage to transportation facilities, public or private property, or utilities caused by the Contractor's operations shall be repaired to the satisfaction of the Contracting Officer or their designated representative at no additional cost to the Government. Any damage to the roadways, caused by the Contractor's operations, shall be repaired in kind by the Contractor and at his own expense. Roads shall be kept clear of all debris generated by the Contractor's operations. Roads shall be cleaned of any spillage. Upon completion of all work requiring use of the local roads, the roadways shall be restored to their preconstruction condition by cleaning and or reconstruction of damaged drainage facilities, base courses, and pavements as necessary. Repairs shall be made in the same manner as the original construction. No separate payment will be made for maintaining and restoring the condition of the roads, and all costs in connection therewith shall be considered as incidental to performance of the work.

1.7.5.2 Hauling Permits

The Contractor shall be responsible for acquiring all necessary oversized hauling permits and general hauling permits for any equipment or debris transported via roadways, as required. No heavy hauling on public roads will be permitted until all permits and bonds have been obtained as required. All costs associated with securing these permits shall be borne by the Contractor.

1.7.5.3 Laydown, Storage and Parking Area

Laydown, storage and parking areas will be provided in an area located on the locks esplanade. The contractor may arrange for other areas as approved by the Contracting Officer or their designated representative.

Laydown, storage or parking will not be permitted in the area located on the right dam abutment.

There are currently occupied storage areas located on the locks esplanade, as shown on plans, consisting of items associated with other Government work. These areas shall not be disturbed without the approval of the Contracting Officer or their designated representative. Additionally, there is potential for another Government Contractor to be concurrently on site for pickup and transport of these items. The Contractor shall coordinate work in this area closely with Contracting Officer or their

SECTION 01 35 00.00 08 Page 8 designated representative to avoid conflict.

1.7.5.4 Utilities

The Contractor shall be responsible for coordination of all existing utilities with the work and for providing utilities for construction purposes. Utilities shall be coordinated in accordance with Section

01 50 00.10 UTILITY COORDINATION.

1.7.6 Other Contractors

The Contractor is alerted to the fact that other contractors may be employed by the Government or local interests at, or in the vicinity of the site. See also Section 00 73 00 SUPPLEMENTARY CONDITIONS, clause WORK

UNDER OTHER CONTRACTS.

1.8 FEDERAL HOLIDAYS

The ten Federal holidays observed are:

New Year's Day (January 1st) Martin Luther King Day (3rd Monday in January) President's Day (3rd Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4th) Labor Day (1st Monday in September) Columbus Day (2nd Monday in October) Veterans Day (November 11th) Thanksgiving Day (4th Thursday in November) Christmas Day (December 25th)

When one of the above designated holidays falls on a Sunday, the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work shall be scheduled around the above listed Federal holidays except as specified herein or as approved by the Contracting Officer or their designated representative.

1.9 EXISTING SURVEY CONTROLS

Corps of Engineer survey controls are located on the top of lock walls.

These control points are shown on the drawings provided.

1.9.1 Project Alignment

All new work to be constructed under this contract shall be constructed level, plumb, and accurately from the control points established by the Government and/or additional survey controls established by the Contractor as necessary to construct all work within the proper alignment. The Contractor shall verify the elevations and positions of the Corps of Engineers survey controls before using them to layout the work under this contract, and shall notify the Contracting Officer or their designated representative of any discrepancies prior to commencing work. The Contractor shall utilize existing project monuments shown on the contract drawings to establish any additional control points for this work. The Contractor shall not use any monuments that are outside the Government's project limits to establish additional control points.

1.10 RESTRICTIONS TO RIVER TRAFFIC FOR CONSTRUCTION

Unless specifically authorized or directed, no interruption of traffic through the lock chambers or their approaches will be permitted.

1.11 CONTRACTOR'S FLOATING PLANT

1.11.1 General

Floating plant, and the operation of such plant, shall comply with the requirements of EM 385-1-1 , Section 19. Floating plant which is not being used in the performance of the work shall be secured in a manner that does not interfere with navigation on the river. Emergency plans for removing or securing floating plant and evacuating personnel in the event of severe weather shall be prepared in accordance with EM 385-1-1 , Section 19.A.03.

The Contractor shall provide personnel as necessary to adjust moorings to provide for fluctuations of pool level. A propelling unit capable of moving the floating plant must be available at all times. If the Contractor chooses to have a leased towboat or propelling unit off-site, the plant must be capable of being on-site within 4-hours notice. The written propelling unit agreement between the Contractor and the lessor documenting this requirement shall be provided to the Contracting Officer or their designated representative prior to mobilization of any floating plant. The agreement shall also include documentation that the propelling unit operator currently possesses a U.S. Coast Guard "Operator of Uninspected Towing Vessels" license. The Contractor shall be fully responsible for selection of floating plant which is suitable for the performance of the work under this contract. Contractor's floating plant shall operate only within the areas of work shown on the drawings, unless such areas are modified with the approval of the Contracting Officer or their designated representative.

1.11.2 Equipment Requirements

The Contractor shall select floating plant and towboats and propelling units of a size and capacity suitable for performance of the work under this contract. Towboats and propelling units shall have sufficient horsepower capacity to control the floating plant used, considering the size and draft of the plant, for the expected river velocities and wind conditions. The Contractor shall submit a plan of all floating plant, floating plant based equipment (i.e. cranes, derricks), temporary operating systems (i.e. generators, compressors, welding machines, etc.), and other appurtenant features which he will have present during the contract period. The Contractor shall use sketches, diagrams, and narratives to indicate location of all floating plant-equipment. The Contractor shall use manufacture catalog information or other suitable data to describe the specific equipment to be used. The Contractor shall also indicate the methods and procedures that will be used to deliver materials, supplies and equipment via floating plant.

1.11.3 Signal Lights and Markers

The Contractor shall display signal lights and conduct his operations in accordance with the General Regulations of the Coast Guard, as set forth in COMDTINST M16672.2D or 33 CFR 81 Appendix A (International) and 33 CFR 84 through 33 CFR 89 (inland) as applicable. The Contractor shall be required to furnish and install all buoys, lights, signs, and other safety devices as required by Coast Guard rules and regulations. All equipment and devices shall be Coast Guard approved.

1.11.4 Maintenance of Floating Plant

The Contractor shall maintain all floating plant equipment in good working condition throughout the contract period.

1.11.5 Mooring of Floating Plant

The Contractor shall be responsible for all mooring of floating plant.

When not in use, the Contractor's floating plant shall be securely moored.

The Contractor shall also be solely responsible for providing personnel in order to adjust mooring lines as required by the prevailing river conditions.

Floating plant may remain downstream of the dam during non-working time with consideration of the exceptions noted in paragraphs "Operation of Dam Gates during Contract Work," and "Withdrawal of Equipment and Floating Plant," herein. Without exception, all floating plant and equipment shall be removed from any position downstream of the dam when the total dam gate openings exceed 40 feet.

Floating plant may be moored to the riverward face of the upstream river wall when the upper gage is below 16.0 as shown on Drawing C-1150 However, this plant must be completely removed and secured at an off site location that is no closer than one mile from the site, by the time the upper pool river gauge reaches 20.0.

Withdrawal or relocation of floating plant shall be completed within four hours of any notice from the Contracting Officer or their designated representative or Lockmaster.

1.11.6 Suspension of River Traffic and Construction

1.11.6.1 Withdrawal of Equipment and Floating Plant

All floating plant shall be withdrawn from a gate bay when the projected total operational gate opening is forecasted to reach 35 feet or greater.

Once the total operational gate opening reaches 35 feet, floating plant may temporarily moor to the outside of the Lower Guard Wall directly below the spillway as long as the total gate opening is not projected to reach above 39 feet. This must be closely coordinated with the Lockmaster. If the total operational gate opening is forecasted to reach 40 feet or greater, the equipment shall be relocated to the outside face of the upstream river wall or to the Contractor's off-site mooring location. The decision of whether the Contractor's plant may be moored to the upstream River Wall will be determined on the basis of the projected upstream pool level. When the upstream pool level reaches an elevation of 686.00 (U/S Gage = 16), the Contractor shall begin preparations to move the floating plant. If the upstream pool level is expected to reach an El. of 690.0 (U/S Gage = 20) then mooring of the plant at the off-site location will be required. The Contractor shall monitor the prevailing river conditions at the project site, referring to the upstream project river gauge, river forecasts issued by the National Weather Services, and the Corps of Engineers River Forecast System, and shall determine when to withdraw equipment and floating plant. Projected dam gate operations shall be coordinated with the Lockmaster and Contracting Officer or their designated representative. The withdrawal of equipment and floating plant shall ultimately be the Contractor's decision and will not be directed by the Government. It shall be the Contractor's responsibility to determine

SECTION 01 35 00.00 08 Page 11 the time necessary to make a complete and safe withdrawal of equipment and floating plant with due consideration given to the location of mooring area; amount of equipment; size of the floating plant, and capacity of towboats and propelling units to operate safely and efficiently at the expected river velocities. All floating plant and equipment shall remain securely moored during the period that gate openings exceeds 40 feet or when the pool is at or above the specified level. The Contractor shall also be responsible for providing personnel during the suspension to adjust mooring lines as required by the prevailing river conditions. The Contractor shall resume all work, and remobilize equipment and floating plant from its moored location when gate openings at the dam fall below 35 feet. The Contractor shall submit a Plan of Action for withdrawal of equipment and floating plant. The plan shall be submitted for the Government's review prior to the start of work. The Contractor is advised that the plan must be submitted and accepted or no work at the site will be allowed.

1.11.6.2 Plan of Action, Withdrawal of Equipment and Floating Plant

The Contractor shall prepare and submit a Plan of Action for withdrawal of equipment and floating plant. The plan shall detail the procedures for withdrawal of equipment and floating plant in the event that suspension of river traffic and work is imminent. The Plan of Action shall include but is not limited to the following information:

- Procedure(s) For Monitoring River Conditions Including River Levels, Discharges, And Velocities

- Mooring Location(s)

- Monument River Condition Which Affect Notification Actions

- Monument River Conditions Which Affect Withdraw

- Sequence and Duration of Withdraw

- Procedures for Care of Moored Floating Plant and Equipment

- Monument River Conditions Affecting Remobilization

- Sequence and Duration of Remobilization

The Plan of Action shall include a listing of key Contractor's Points of Contact and telephone numbers. The Plan of Action shall include the withdrawal of any subcontractor's equipment and floating plant. The Contractor's Plan of Action shall be consistent with the applicable requirements for Emergency Planning as described in EM 385-1-1 . All key Contractor personnel including superintendents, foremen, safety officers, and QC personnel shall be given a copy of the Plan of Action and shall be thoroughly familiar with their duties under this plan. Subcontractors shall also be thoroughly familiar with their responsibilities and duties under the plan.

1.11.6.3 Compensation and Extension of Contract Period, Suspension of Work

The Contractor's withdrawal of equipment and floating plant shall not be construed as a direction on the part of the Government or Contracting Officer or their designated representative, under the provisions of Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.242-14 SUSPENSION OF WORK, which shall not apply to this work condition. No compensation will be made to the Contractor for withdrawal of this equipment nor will any delay costs be made for the period during which work cannot be accomplished.

The contract period will be extended for the withdrawal of floating plant and equipment under this paragraph for unusual high water events in

SECTION 01 35 00.00 08 Page 12 accordance with the Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.249-10 DEFAULT (FIXED-PRICE CONSTRUCTION). In order for the Contracting Officer or their designated representative to award a time extension under this paragraph, the following conditions must be satisfied.

a. The high water events experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the high water events anticipated for the project location during any given month.

b. The unusual high water events must actually cause a delay to the completion of the project. This delay must be beyond the control and without the fault or negligence of the Contractor.

The following schedule of monthly anticipated high water events is based on historic information for a similar project in the vicinity of the work location and will constitute the base line for monthly high water time evaluations. The Contractor's progress schedule must reflect these anticipated adverse high water event delays in all weather dependent activities. See also paragraph SEQUENCE OF WORK AND RESTRICTIONS, subparagraph Restrictions on Work at Montgomery Dam.

Upon acknowledgment of the Notice to Proceed and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of high water events and resultant impact to normally scheduled work. Actual high water event delay days must prevent work on critical activities for 50 percent or more on the Contractor's scheduled work day.

The number of actual high water event delay days shall include days impacted by actual high water events, calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual high water event delay days exceeds the number of days specified, the Contracting Officer or their designated representative will convert any qualifying delays to work days, giving full consideration for equivalent normal water level work days, and issue a modification in accordance with the clause entitled, "Default (Fixed-Price Construction)".

1.11.7 Operation of Small Water Craft

The Contractor shall develop, prepare and submit a small water craft operations plan addressing the operation of small water craft within the "Restricted Area" of the Montgomery Locks and Dam. The plan shall address safe operations of small water craft and shall include; maximum river stages, maximum river flows, horsepower requirements, training, and any other items necessary to address all the hazards associated with navigating in the "Restricted Area" of the dams.

1.12 RESTRICTIONS TO RIVER TRAFFIC FOR CONSTRUCTION

Unless specifically authorized or directed, no interruption of traffic through the lock chambers or their approaches will be permitted.

1.13 PROTECTION AND MAINTENANCE OF ROAD TRAFFIC

During construction the Contractor shall maintain and protect traffic on

SECTION 01 35 00.00 08 Page 13 all affected roads during the construction period except as otherwise specifically directed by the Contracting Officer or their designated representative. The traveling public shall be protected from damage to person and property. The Contractor shall submit his proposed traffic control plan for approval.

1.14 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.236-7 PERMITS AND RESPONSIBILITIES. However, if, in the judgment of the Contracting Officer or their designated representative, any part of the permanent work performed by the Contractor is damaged by flood or earthquake, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor shall make the repairs as ordered by the Contracting Officer or their designated representative and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer or their designated representative, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to the Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.243-4 CHANGES, will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer or their designated representative at the Contractor's expense, regardless of the cause of such damage.

1.15 PROTECTION OF UTILITIES

Utilities shall be protected as specified in Section 01 50 00.10 UTILITY COORDINATION, paragraph "Protection of Utilities".

1.16 INSPECTIONS AND ACCEPTANCE OF WORK

Not withstanding other provisions of this contract, all materials and work to be performed under this contract shall be inspected and accepted by the Contracting Officer or their designated representative. Inspections and acceptance will be performed on phases of the work, before the next definable sequential phase of work commences, OR may be performed at the completion of all of the work, as determined appropriate by the Contracting Officer or their designated representative. The Contracting Officer or their designated representative shall be the individual(s) solely authorized to reject materials, disapprove or approve any work in progress, or order or direct any revision or change to the plans and specifications as presently shown and stated.

1.16.1 Access to Work

The Contractor shall provide access to all areas of work for inspection by the Government. The Contractor shall maintain suitable land based access to allow Government inspectors access to the areas of work. The Contractor shall also provide access for Government by boat, transporting Government inspectors to the various areas of work.

1.17 OPERATION OF GOVERNMENT FACILITY

The Montgomery Locks and Dam facility shall remain in operation at all times. The Contractor shall perform his work in a manner which will not interfere with the operation of the facilities and the duties of Government personnel. Particular care shall be taken during all operations under this contract to prevent damage to any operating equipment or facilities at the project. The Contractor shall take all necessary precautions to ensure the safety of the workers in accordance with the applicable provisions of EM 385-1-1 . Contractor operations shall be performed in such a manner to ensure that project personnel, navigation industry personnel and the public are protected at all times.

1.18 CONDITIONS OF WORK

1.18.1 Montgomery Locks and Dam, Hours of Operation

Montgomery Locks and Dam operates 24 hours per day, seven days per week.

1.18.2 Contractor's Work Hours

There will be no restrictions imposed on Contractor's work hours for this project.

1.18.3 Coordination with Lock Operations

The Contractor shall perform all work in a manner that will not interfere with the duties of the lock personnel. Particular care shall be taken during all operations under this contract to prevent damage to any operating equipment or facilities at the project. The Contractor shall continuously maintain safe access to all areas of the lock project for lock operating personnel, during every phase of the work, unless otherwise directed by the Contracting Officer or their designated representative.

1.18.3.1 Restrictions to River Traffic for Delivery of Products

No interruption of traffic through the lock chambers or their approaches will be permitted. The Contractor will not be permitted any priority lockage privileges for delivery of the equipment, materials or supplies.

1.18.3.2 Installation and Removal of Dam Bulkhead

The dam bulkhead must be in place for work within the gate bay. The Contractor will not be permitted to place equipment or personnel downstream of the existing gate or perform any work on the existing gates until the bulkhead is in place. Work may be performed on the tops of the dam piers without the dam bulkhead in place. The project bulkhead used for dewatering dam bays is formed of three structural units that are stacked vertically on top of one another to form the closure. Government personnel will conduct all operations necessary to install and remove the bulkhead in a gate bay. In general, installation of the complete bulkhead takes approximately 2 to 4 hours. It is brought to the Contractors attention that once the bulkhead is installed, there will be extensive leakage in the form of spray at the joints between the individual units, and along the side seals. Leakage may occur along more than 50% of the length of the joints. The Contractor shall be responsible for furnishing and installing any tarps, sheeting, neoprene seals, or other materials that are necessary to control this leakage and keep it from the affecting the Contractor's work. The Contractor's construction schedule, submitted

SECTION 01 35 00.00 08 Page 15 in accordance with Section 01 32 01.00 08 PROJECT SCHEDULE BAR CHART, shall show the time periods that the bulkhead will be required. The Government may use the bulkhead temporarily during periods in which the Contractor does not require it. Any such Government use will be coordinated through the Contracting Officer or their designated representative. The Contractor shall give a 14 calendar day written notice to the Contracting Officer or their designated representative as to when the bulkheads will need to be placed and 14 calendar days written notice when they will require removal. Bulkheads will be set and removed from each bay only once during the contract unless otherwise approved by the Contracting Officer or their designated representative.

1.18.4 Government Service Crane and Bulkhead Hoist

The Contractor will not be permitted to use the Government's service crane or bulkhead hoist for any purposes under this contract. The Contractor shall provide all necessary cranes for lifting equipment.

1.18.5 Dam Gate Operating Schedule

The dam gate operating schedules attached at the end of this section are applicable for governing gate movements by the Government at Montgomery Locks and Dam for the operating conditions during the period of this contract. This schedule will be the basis for minimizing the effect of flow through the dam on the work at the site and maintaining customary river stages above the dam. The schedule GATE 3 OUT OF SERVICE will be in effect for the track repair at Gate 3, the schedule GATE 9 CLOSED, GATES 8 AND 10 RESTRICTED will be in effect for the replacement of Gate 9, and the schedule GATE 10 CLOSED will be in effect for replacement of Gate 10.

1.18.6 Operation of Dam Gates During Contract Work

All dam gates, except the one being replaced, shall be operable at all times during the contract period.

The Contractor should review the plan for replacement of the gates with the gate schedules provided, along with the hydrographs, rating curves, and duration curves to determine the influence that river conditions may have during the on site portion of the work under this contract.

It is noted that work within any particular bay can proceed without operating the gates in adjacent bays up to a total operational gate opening of 35 feet. If forecasted river conditions indicate additional total operational gate opening beyond 35 feet will be required, one of the gates in the adjacent bays would be opened. The Contractor's floating plant must be withdrawn from the gate bays and moored before gate operations occur in adjacent bays. See paragraph Withdrawal of Equipment and Floating Plant for additional details. As total operational gate opening approaches 35 feet, close coordination with the Lockmaster is required. The Contracting Officer or their designated representative may instruct the Contractor to move the floating plant before a total operational gate opening of 35 feet if the Lockmaster determines it necessary to maintain the safety of the project site. No additional gate operations will be conducted in support of any other work, unless specifically authorized by the Contracting Officer or their designated representative. The Contracting Officer or their designated representative will have sole authority to review all requested modifications to dam gate operations, and to what degree to accommodate active contract work. The Contractor may request in writing temporary

SECTION 01 35 00.00 08 Page 16 adjustments to gate operations to accommodate active work, but such requests shall be given to the Contracting Officer or their designated representative a minimum of 30 calendar days in advance of the requested change. Approval of such changes shall rest with the Contracting Officer who's decision shall be final. Implementation of any approved modifications to the gate operations on the date(s) requested shall be subject to river conditions, and may be delayed or altered as necessary to accommodate the prevailing river (flow) conditions and shall not be considered as a basis of a change condition. All gate operations shall be performed by Government personnel.

1.18.7 Warning Signs, Lights and Buoys

The Contractor shall be required to furnish and install all buoys, lights, signs, and other safety devices as required by Coast Guard rules and regulations. All equipment and devices shall be Coast Guard approved.

1.18.8 Contractor Coordination and Scheduling

In accordance with Section 01 32 01.00 08 PROJECT SCHEDULE BAR CHART, the Contractor shall submit a project schedule for his work to the Contracting Officer or their designated representative. All necessary adjustments in the Contractor's work schedule shall be coordinated and approved by the Contracting Officer or their designated representative.

1.19 PLACEMENT AND REMOVAL OF EMERGENCY BULKHEAD UNITS FOR PAINTING

The Government will move two bulkhead units at a time from the bulkhead storage area to permit painting of the other unit. The removed bulkhead units will be placed in a gate bay of the dam. The Government will also raise the bulkhead unit being painted to permit the Contractor to place blocking to support the bulkhead unit above the surface of the bulkhead supports in the storage area. Each bulkhead unit weighs approximately

17.2 tons. The Contractor shall furnish all blocking required to support the bulkhead unit. Blocking shall be placed in a manner to avoid compressing the rubber seals. Government personnel will conduct all operations necessary to install and remove the bulkhead in a bulkhead storage area. In general, installation of the complete bulkhead takes approximately 2 to 4 hours. The Contractor's construction schedule, submitted in accordance with Section 01 32 17 CONSTRUCTION PROGRESS SCHEDULE, shall show the time periods that the bulkhead will be required.

The Government may use the bulkhead temporarily during periods in which the Contractor does not require it. Any such Government use will be coordinated through the Contracting Officer or their designated representative. The Contractor shall give a 14 day written notice to the Contracting Officer or their designated representative as to when the bulkheads will need to be placed and 14 calendar days written notice when they will require removal. Each bulkhead unit will be set and removed only once during the contract unless otherwise approved by the Contracting Officer or their designated representative.

1.20 EMERGENCY USE OF BULKHEAD UNITS

The Contractor's attention is directed to the fact that, should a situation occur which would require use of the bulkhead at another gate bay, the Contractor will be directed take one of the following actions within four hours after notice by the Contracting Officer or their designated representative, depending on the status of gate installation:

a. If the original lift gate is in place on the gate sill with end trucks in place, The Contractor shall remove all equipment and materials that would be affected by removal of the bulkhead from the gate bay. However, items which would not be affected may remain in place provided they do not interfere with removal of the bulkhead units. No work will be permitted downstream of the existing lift gate.

b. If the new lift gate is in place on the gate sill with end trucks in place, The Contractor shall remove all equipment and materials that would be affected by removal of the bulkhead from the gate bay.

However, items which would not be affected may remain in place provided they do not interfere with removal of the bulkhead units.

Floating plant may remain in place downstream of the new gate and work which does not directly impact the gate may continue.

c. If no gate is in place, or if the gate body is not secured to the end trucks in the gate recesses, the Contract shall remove the gate body and end trucks, if present, and remove all equipment, scaffolding, and other materials from the gate bay and remove floating plant from the dam, as directed. Equipment and materials shall be removed to the extent necessary to permit the Government to install concrete gravity blocks on the gate sill downstream of the bulkhead, however, support items which do not interfere with this placement may remain in place. The Government will not be responsible for any damage to materials and equipment in the gate bay in the event they are not removed by the Contractor in a timely manner.

Payment for removal and replacement of equipment and materials to permit removal of the bulkhead units and installation of the concrete gravity blocks, if necessary, and removal and replacement of floating plant will be made as specified in Section 00 70 00 CONDITIONS OF THE CONTRACT, FAR 52.243-4 CHANGES.
