CONTRACTOR QUESTIONS AND GOVERNMENT RESPONSES
Q1. The Bid Schedule has a Reimbursement for Performance and Payment Bonds Premium Bid Item (1001, 2001 & 3001) for each year. Each year has a quantity of 3 jobs (9 total for the project). Is this correct?
R1. Performance and Payment Bonds will be required at the task order level. Each task order that is issued against the contract will include the applicable Performance and Payment Bonds Premium Bid Item. Section 00800-02 Payment for Performance and Payment Bonds has been revised to provide clarification.
Q2. The Bid Schedule has a Mobilization and Demobilization Bid Item (1101, 2101 & 3101) for each year.
Each year has a quantity of 3 each (9 total for the project). Is this correct?
R2. For Bid Items 1101, 2101, and 3101, the quantity of 3 (three) is the maximum number of task orders that the U.S. Army Corps of Engineers can issue each year. It is possible that there may be less than 3 (three) issued.
Section 00800-16 Mobilization and Demobilization has been added to provide clarification.
Q3. Please confirm that offerors’ bid bonds should be based on the total amount of each CLIN, and is not limited to the base bid (year 1). Similarly, please confirm that Payment & Performance Bonds shall be provided at the Task Order level, based on the value of the overall task order.
R3. Bid bonds are required to be based on the total amount of the contract (All Bid Schedule Items included in Year 1, 2, and 3). Payment and Performance Bonds will be required at the task order level. Each task order that is issued against the contract will include the applicable Performance and Payment Bonds Premium Bid Item. Section 00800- 02 Payment for Performance and Payment Bonds has been revised to provide clarification.
Q4. Reference FAR 52.216-19, Order Limitations. The order limitations prohibit task orders exceeding $30,000,000.00, as well as a combination of task orders exceeding $30,000,000.00, or a series of orders within a 30-day period exceeding the $30,000,000.00 threshold. Given that the Government’s estimated cost range ($25M to $100M) exceeds the $30,000,000.00, please confirm that it is anticipated that the Order Limitations do not restrict overall spend during the contract period?
R4. As specified in FAR 52.216-19, the U.S. Army Corps of Engineers will not issue any orders exceeding $30,000,000.00, a combination of task orders exceeding $30,000,000.00 or a series of orders with a 30-day period exceeding $30,000,000.00. The Order Limitations do not restrict overall spend during the contract period.
Q5. Bid Form, Items 1001, 2001, 3001: Please confirm that the unit price bid bonds are anticipated to be used for the issuance of three task orders every year.
R5. For Bid Items 1001, 2001, and 3001, the quantity of 3 (three) is the maximum number of task orders that the U.S. Army Corps of Engineers can issue each year. There is no guarantee that 3 (three) task orders will be issued. It is possible that there may be less than 3 (three) issued.
Q6. Bid Form, Items 1101, 2101, 3101: Please confirm that three mobilizations/demobilizations are anticipated to be used for the issuance of three task orders every year.
R6. For Bid Items 1101, 2101, and 3101, the quantity of 3 (three) is the maximum number of task orders that the U.S. Army Corps of Engineers can issue each year. There is no guarantee that 3 (three) task orders will be issued. It is possible that there may be less than 3 (three) issued. Section 00800-16 Mobilization and Demobilization has been added to provide clarification.
Q7. Solicitation Document – Bid Item List. Bid Items 1001, 2001, 3001 Reimbursement for Performance and Payment Bonds indicates a quantity of 3 each, there is only one period of performance for each year of the contract, why is a quantity more than 1 provided?
R7. The Period of Performance specified in the solicitation is only for the overall term of the Requirements contract.
Each individual Task Order issued will include a specific Period of Performance for the dredging required under the Task Order. Please reference FAR 52.211-10 included in the solicitation.
Q8. Solicitation Document – Bid Item List. Bid Items 1101, 2101, 3101 Mobilization and Demobilization indicates a quantity of 3 each, is it the Corps intention to provide multiple tasks throughout the period of performance requiring the need to have multiple locations working at the same time which would be the reason for the quantity provided or will there be the need to have multiple mobilizations and demobilizations on and off of the project site during each period of performance?
As indicated in Section 35 20 23, Paragraph 1.3, the “Dredging shall start at Acceptance Section 31 (upstream) and proceed to Acceptance Section 1 (downstream). This order of work shall not deviate from year to year of this contract.” The Government is not going to require mobilizations in multiple locations at the same time.
Q9. The wage rates provided in the Solicitation Document differ from common classifications utilized in the local area of the contract performance. We also believe some classifications are missing from the wages provided, specifically as it relates to the work performed at the Victory Hollow Disposal Site. Can the wage rates be reviewed and modified to include the appropriate classifications for the local area?
R9. Wage Determination PA170004, dated 09/08/17 has been incorporated into the solicitation and is applicable to the work at Victory Hollow.
Q10. Since this is an indefinite delivery contract in which specified task orders will be provided for performance of the work, what is the expected duration of the task orders and approximate quantities for each order? How is the duration and quantity of each of the task order determined?
R10. The actual duration and quantity of each task order is not known at this time.
Q11. How are weather delays to be dealt with pertaining to each individual task order? We have not been able to find any weather days listed in the specifications. How will weather related delays be addressed for each task order assigned?
R11. Weather delays will be determined on an individual task order basis. Sections 00800-14 Inclement Weather and Holiday Work and 00800-15 Time Extensions for Unusually Severe Weather have been added to clarify.
Q12. There are no liquated damages indicated in the contract besides from the unloading criteria for “other contractor’s material” and the solicitation indicates that liquidated damages will be assigned per task order.
What is the magnitude of the liquidated damages that we could have per task order? How is it determined?
The Sureties being requested to provided bonding for this project require knowledge of their exposure pertaining to liquidated damages at a minimum of a per day of delay cost.
R12. Liquidated damages in the amount of $1,000/day have been specified in FAR Clause 52.211-12.
Q13. What are the prevailing wages for the work performed at the Victory Hollow site?
R13. Wage Determination PA170004, dated 09/08/17 has been incorporated into the solicitation and is applicable to
Q14. Will the prevailing wage rates applicable at the bid date apply for each of the three option years of the contract? If not, if revised wage rate determinations are incorporated into the contract after the bid date will the contractor have the opportunity to amend their contract price to reflect those changes?
R14. Please reference FAR Clauses 52.222-30-Construction Wage Rate Requirements-Price Adjustment (None or Separately Specified Method) incorporated into the solicitation.
Q15. It is in the shared interest of industry and the Government to ensure the most amount of navigational dredging can occur per dollar. There are a significant number of technical questions outstanding that will impact pricing adversely. In order to provide the most competitive and accurate estimate possible, offeror requests an extension of 7 business days from the current bid opening date of 9/15/2017 to 9/26/2017. Any extension less than this amount of time will likely result in materially higher pricing to the Government. This provides three full business days for the successful offeror and USACE to work together to get to an award notice.
R15. There will be no extension to the time and date set for receipt of bids.
Q16. A two (2) week extension to the current bid due date of 9/15/17 is requested to allow for a more detailed evaluation of key pricing components of the IFB.
R16. There will be no extension to the time and date set for receipt of bids.
Q17. Can the USACE please provide clarification as to how task orders will be utilized for the execution of works under this contract? Typically we would expect that a Task Order Based Contract would be a SATOC (Single Award – Task Order Contract) or MATOC (Multiple Award - Task Order Contract) contract vehicle.
R17. This is an Indefinite Delivery Requirements Contract and only one award will be made to a single awardee.
Q18. Can the USACE please clarify what the associated Liquidated Damages will be for season / task order?
R18. Liquidated damages in the amount of $1,000/day have been specified in FAR Clause 52.211-12.
Q19. The bid schedule lists 3 x Mobilization/Demobilization and 3 x P&P Bonds Reimbursement for each year, resulting in a total of 9 each for the 3-year period. Q: Should these yearly items have a quantity of 1 each?
R19. The quantity of 3 (three) is the maximum number of task orders that the U.S. Army Corps of Engineers can issue each year. It is possible that there may be less than 3 (three) issued.
Q20. The wage rates listed in the documents differ from what is customary on other USCAE projects in the area. Some classifications such as common laborer, dozer operator, and roller operator are not listed. Can the local CAWP rates used on other Corps projects at Charleroi be substituted for the posted wages?
R20. Wage Determination PA170004, dated 09/08/17 has been incorporated into the solicitation and is applicable to
Q21. There is a quantity of three mobilizations for each dredging year. Should this be a quantity of one mobilization for each dredging year for a total of 3 each for all of the dredging?
R21. The quantity of 3 (three) is the maximum number of task orders that the U.S. Army Corps of Engineers can issue each year. It is possible that there may be less than 3 (three) issued.
Q22. There is a quantity of 3 jobs for the Performance and Payment Bond for each dredging year. Should this be a quantity of one bond for each dredging year for a total of 3 each for all of the dredging?
R22. Performance and Payment Bonds will be required at the task order level. Each task order that is issued against the contract will include the applicable Performance and Payment Bonds Premium Bid Item. Section 00800-02 Payment for Performance and Payment Bonds has been revised to provide clarification.
Q23. The sureties provide quotes to the contractors based on a certain percentage of the total bid. The USACE pays by bond invoice and no more than what was bid for the performance and payment item. How do the contractors bid the performance bond items when we do not know if the bid items will be awarded in three equal portions for each dredging year? Please provide clarification on how this bid item will be paid.
R23. A unit cost of $250,000, a total of $750,000 has been added to Bid Items 1001, 2001, and 3001 for bidding purposes only. The Contractors shall be reimbursed the actual bond costs only, as established by evidence of full payment to the surety. Section 00800-2 has been revised to remove the “not-to-exceed language.”
Q24. We were unable to find any weather days listed in the specifications. How will weather related delays be addressed?
R24. Weather delays will be determined on an individual task order basis. Sections 00800-14 Inclement Weather and Holiday Work and 00800-15 Time Extensions for Unusually Severe Weather have been added to clarify
Q25. How are task order quantities and durations determined?
R25. The actual duration and quantity of each task order is not known at this time. Quantity ordered under each individual task order will be dependent upon funding received by the U.S. Army Corps of Engineers.
Q26. Please consider providing an amount per day for liquidated damages prior to the bid. The contractors and their sureties need to know what their exposure is for schedule delays. An up-to amount per day would be better than leaving the contractors and their sureties speculating on their exposure.
Q26. Liquidated damages in the amount of $1,000/day have been specified in FAR Clause 52.211-12.
Q27. Please confirm that for each year, the quantity of material sent to the drying area is included in the excavation/disposal item (i.e. for year 1, the 64,000 CY of material dried out is included in the 300,000 CY dredged).
R27. Yes. The quantity of material required to go to the Sediment Dewatering Area is included in the Removal and Satisfactory Disposal of Excavated Material quantity.
Q28. Please confirm that the aggregate placement bid items (units of SY) is to include 3” thick placement. To provide clarity to the bidders, should the pay item be CY of material placed?
R28. Yes, quantities are for a 3” placement, per specifications. For ease of measurement and verification, the SY measure shall remain in place.
Q29. Specification Section 01 35 00, 1.14.2 references a paragraph titled “Suspension of Construction” in its last line. We do not find that reference, please clarify.
R29. The last line of Paragraph 1.14.2 has been eliminated.
Q30. Please provide survey data in .xyz format.
R30. Survey data in xyz format are being provided as part of the Amendment.
Q31. Please provide the construction drawings in AutoCAD format.
R31. Electronic CAD files will not be provided prior to bid opening. CAD files will be provided after contract award.
Q32. Specification Section 01 74 19, 3.8: Will materials delivered by Other Contractors be in a form suitable for direct transfer and deposit in the upland disposal area? Will Other Contractors be required to dewater sediments and size concrete and other solid materials prior to delivery to Victory Hollow?
R32. The other contractors are to properly size their concrete rubble prior to delivery. However, there is no requirement for the other contractors to dewater the excavated material prior to delivery. See revised specification section 01 74 19, Paragraph 3.9.2, for details of the contract requirements related to the handling of the other contractors material.
Q.33 Specification Section 25 20 23, 3.5.1 shows a quantity of 0 cy for acceptance section AS-6, but sheet 83- 44 shows areas above 13.2 feet pool depth. Please clarify.
R33. There is no required dredging quantity in AS-6, however, a very small quantity of allowable dredging quantity exists. The estimated quantities shown in tabular form in Section 35 20 23 of the Specs will be revised to show this minor quantity (1CY). See Revised Specification Section 25 20 23 provided as part of this amendmentt.
Q34. Dredging Plans 83-44 through 83-57: Please clarify the expected dredging activity required within the green bands shown on the drawings.
R34. The expected dredging activity indicated by the green color bands shown on the drawings is allowable dredging.
Q35. Bid Form, Items 1103, 2103, 3103: Please confirm that the basis for the quantities of these items represent only a portion of the dredge totals.
R35. The quantities for these items are included in the Removal and Satisfactory Disposal of Excavated Material quantity.
Q36. Considering the possibility of an extensive amount of repairs or replacement needed to the current bulkhead at the Victory Hollow Disposal Site, please consider adding a bid item for this work, especially considering the dredge work will be task ordered.
R36. No additional bid items will be added.
Q37. Per Section 35 20 23 Dredge of the specifications, there is a requirement for a 5 years of experience for the operation of a computerized global positioning system (GPS) bucket dredge. While there are local individuals with land based GPS budget excavation work, there is limited experience in the marine environment on a budget dredge. Please consider allowing land based GPS bucket excavation experience to be credited towards the 5 year experience criteria as required by the specifications.
R37. Yes, land based GPS bucket excavation experience will be considered towards the 5 year experience criteria.
See Revised Specification Section 35 20 23 paragraph 1.8 provided as part of this amendment.
Q38. Would the Corps considering allowing the use of the upland disposal area at the Victory Hollow Disposal Site for the drying of dredge material if concerns over water dropping onto the haul road can be minimized? Considering there is approximately 1.15 million CY of wet dredged material to be removed over the contact performance time of 3 years there is significant risk given the moisture content restrictions and lack of space in the dewatering area to be able adequately determine the amount of drying time the material needs before it can be placed in the upland fill area as permanent fill. The currently designed dewatering area can only hold 15,000 CY to 20,000 CY of dredged material depending on how much silt is in the dredged material. Please consider revising the specification to allow the wet material to be hauled to the upland disposal area where there is considerably more space to manipulate it for drying and eventual compaction purposes for the final fill.
R38. The only area available to use for dewatering of dredge material is the Sediment Dewatering Area. No additional areas will be allowed.
Q39. Outside contractor-generated material, stipulating a 3 day return of each barge based upon arrival time, i.e. anytime during a 24 hour period or during daylight operating periods?
R39. Barges will be dropped off Monday-Friday, 7am-5pm. Barges shall be unloaded and returned 3 days from the time that they were dropped off. Weekends will not be included in the 3 day return period. See revised Specification Section 01 74 19, Paragraph 3.8.
Q40. Will outside contractor material be subject to the same environmental window periods?
R40. No. The specifications have been revised to clarify that other contractor material is not subject to any environmental windows and may be delivered year round. See Revised Specification Section 01 74 19 paragraph
3.8 provided as part of this amendment for details.
Q41. Can off-road dump trucks operate over the rail bridge without tarping the load, but with tailgates?
R41. See Section 01 74 19, Paragraph 3.5 for haul truck requirements.
Q42. Given the scope of work consists of very few definable features of work/phases, will the Government consider accepting the work schedule in a format that may not be compatible or transportable to the Government network?
R42. No, the Contractor’s schedule needs to comply with the specifications.
Q43. Can the Government provide detail of the type of material (i.e.; size and composition) to be disposed of that is generated by other contractors?
R43. See Section 01 74 19, Paragraph 3.8 and 3.9.2 for information on other contractor material.
Q44. Will any of the material generated by others require decanting?
R44. Material delivered by other contractors may require dewatering. The quantity for this material is accounted for in the Material Required to go to Sediment Dewatering Area line items.
Q45. Can the Government provide a detailed schedule for each option year identifying the timing and quantity of the material generated by others?
R45. Quantity of material is defined in the Bid Schedule. Timing of material deliveries is not known at this time as it is subject to the other contractor’s work schedules.
Q46. Will the contractor be provided with barge charts in order to calculate tonnage for the barges containing material from other contractors?
R46. This will be addressed during the execution of the dredging contract as required to verify the tonnage of offloading and disposal.
Q47. Please explain the chain of custody for the barges containing material generated by others with regards to mooring, lighting, general liability and condition of barges.
R47. The Contractor shall be responsible for all aspects of maintaining the barges while in their possession, except the barge owner i.e. other contractor shall be responsible for manning the pumps as indicated in Section 01 74 19, Paragraph 3.8.
Q48. Regarding the 3 days the contractor has to offload a barge of material generated by others, do those include weekends or weekdays only?
R48. The specifications have been revised to indicate that workdays for receipt of barges shall be Monday-Friday, 7am-5pm. Further, weekends will not be included in the 3 day return period. See Revised Specification Section 01 74 19 paragraph 3.8 provided as part of this.
Q49. Given the contractor has 3 days to offload a barge containing material generated by others, how many days does the other contractor have to remove the empty barges from the fleet at the Victory Hollow site?
R49. The specification has been revised to indicate that the owner of the barge shall have 2 days (excluding weekends) to retrieve the barge once it has been unloaded and notification has been made to the Government. See Revised Specification Section 01 74 19 paragraph 3.8 provided as part of this amendment.
Q50. Given the high delay penalty ($5,000/day) for offloading barge material generated by others, can the other contractor(s) or the Government provide more advanced notice than 5 days prior to receiving loaded barges?
R50. The 5 day notice shall remain unchanged; however, the Government will attempt to provide additional notice if possible.
Q51. How does the Government intend to address force majeure days relating to offloading barges generated by others?
R51. See response to question #11 concerning weather delays.
Q52. Please explain the contractor’s responsibility and liability for underwater river crossings not relocated prior to dredging
R52. Requirements are stated in Section 01 35 00, Paragraph 1.6.5.
Q53. Ownership of many abandoned river crossings may not be obtainable please explain how the contractor is to proceed dredging activities in this instance. Furthermore, if an unclaimed/unmarked/unidentified line is encountered or even breached how will the extraction and/or environmental cleanup be addressed contractually?
R53. The Government continues to refine information regarding known crossings and as additional information is obtained, it can be included with issued task orders for the areas to be dredged. If an unclaimed/unmarked/unidentified line is encountered, notify the Contracting Officer immediately. If a line is encountered, regardless if known or unknown, reference Specification Section 01 35 00, Paragraph 1.6.5. Regarding extraction and environmental cleanup, the scope of this contract does not include extraction, however, specification section 01 57 20, paragraphs 1.6 and 1.7., in general, discuss the Contractor’s responsibilities with regard to environmental protection and an environmental protection plan.
Q54. A listing of known river crossings is provided along with a disclaimer regarding completeness/accuracy of the data. How far back in time does the listing reflect?
R54. Some of the data goes back as far as 1901 and some is more recent.
Q55. Please confirm that all non-hazardous dredge material has to be placed at the Victory Hollow disposal site.
R55. Yes, all non-hazardous dredge material shall be placed in the Upland Fill Placement Area at Victory Hollow.
Q56. There is currently material in the dewatering area at Victory Hollow that was placed by another contractor.
a. Will this material be moved to the upland disposal area before this contract is awarded?
b. If the intent is for this material to become part of the dredging contract, please confirm the quantity currently in the dewatering area?
c. If the intent is for this material to become part of the dredging contract, is this quantity included in the bid quantity listed?
R56. All material currently in the dewatering site will be removed by others prior to the Contractor taking possession of the Victory Hollow offloading and disposal area.
Q57. The Technical Specifications identify the existence of a currently valid NPDES Permit and approved Erosion and Sediment Control Plan(s) for the site – are there any other permits (federal or state) associated with the facility that are either currently in place or that have expired?
R57. There are no other additional permits.
Q58. If improvements are required of the existing bulkhead should we assume the contractor be responsible for related permitting requirements? Are there aspects of this work that would be within ACOE jurisdiction in a manner that would obviate any related permitting requirements?
R58. The specifications have been revised to clarify that the Contractor will be responsible for obtaining any permits required to perform modifications to the existing Off-Loading Facility. See Revised Specification Section 01 74 19 paragraph 1.3.5 provided as part of this amendment.
Q59. Is the Environmental Senior Compliance Representative required to be on site on a full time basis or may these responsibilities be met on an as-needed basis from the Representative’s normal office of work?
R59. The specifications have been revised to indicate that the Environmental Senior Compliance Representative does not need to be onsite full-time. See Revised Specification Section 01 57 20, paragraph 1.9.4 provided as part of this amendment.
Q60. The Technical Specifications identify the need for the Environmental Field Technician Compliance Representative to be on site whenever the contractor is working – will this need apply during times of the day when dredging operations are ongoing but there is not concurrent sediment off-loading, dewatering, or upland placement work underway?
R60. No. The specifications have been revised to indicate that the EFTCR does not need to be on the dredge, but shall be onsite at Victory Hollow during any sediment off-loading, dewatering, or upland placement work. See Revised Specification Section 01 57 20 paragraph 1.9.5 provided as part of this amendment.
Q61. River Pool 3 between locks and dams 3 and 4 includes a significant number of marinas with floating docks, and privately owned equipment type facilities. Please confirm that it is the offerors responsibility to coordinate with each individual owner to remove their docks and equipment in order to dredge those areas of river, as required.
R61. In the event that there are affected facilities in the dredge area, the Government will work with the Contractor and the affected facility owner as required to coordinate the work.
Q62. Specification Section 01 74 19, 3.8 states “Barges may be delivered to the off-loading facility at any time during the contract.” Does this include the time that dredging is not permitted from 1 April through 1 July?
R62. Yes. The specifications have been revised to clarify that the barges may be delivered year round. Further, additional details on the barge delivery have been revised. See Revised Specification Section 01 74 19 paragraph
3.8 provided as part of Amendment No. 0001 for details.
Q63. Plan Sheet 99-51 shows an outline of the sediment dewatering area. However, during the recent site visit, it is apparent that the western portion of the site already has material stockpiled. Will the entire dewatering area footprint be cleared by others prior to the start of this contract?
R63. All material currently in the dewatering site will be removed by others, prior to the Contractor taking possession of the Victory Hollow offloading and disposal area.
Q64. Plan Sheet 99-51, Note 7 refers to the outlet energy dissipater but the plan view does not indicate the location of this feature. Please show the location and a detail for the dissipater.
R64. The note indicated has been removed from the drawing. See revised drawing 99-51-A provided as part of this amendment.
Q65. Specification Sections 01 71 23, 3.4 and 01 74 19, 3.15.2 require before and after surveys of the sediment dewatering area. Since the timing and volume of material deliveries to the dewatering area are random and the footprint of accumulated sediment is likely to vary significantly, it is difficult to anticipate the number or extent of surveys that will be required. Offeror recommends adding a bid item providing compensation for these surveys on a crew-hour or other comparable basis.
R65. The survey is incidental to the placing of material into the Sediment Dewatering Area, which is dependent of the Contractor’s means and methods. The survey is required to verify quantities for payment purposes. No separate payment item will be provided.
Q66. Plan Sheets 83-42 through 83-57: In those instances where crossing are noted to have been removed, are there any special dredging precautions that are required of the contractor?
R66. The specifications have been revised to clarify precautions to be taken. See Revised Specification Section 01 35 00, paragraph 1.6.5 provided as part of Amendment No. 0001 for details.
Q67. Specification 01 74 19, 3.9.1 contains the restriction that excavated material cannot be transported to the Upland Fill Placement Area until it is deemed to be liquid free per paint filter test. Also, the Contracting Officer approves all material sent to the Sediment Dewatering Area. Is it intent of USACE that a paint filter test be performed on each truckload of sediment prior to the KO’s decision as to whether the material is sufficiently dry to transport to the Fill Area or too wet and sent to the Dewatering Area? Please clarify the process to be used, the Contractor’s role in this decision-making, and the expected turn-around times for the KO’s (or his or her designee’s) determination.
R67. The specifications have been revised to provide the clarification requested. See Revised Specification Section 01 74 19, paragraph 3.9.1 provided as part of Amendment No. 0001 for details.
Q68. Specification 01 57 20, 3.2.3.1: The monitoring requirement tables include reporting of a measured flow twice per month. Considering the outfall discharges are intermittent and there do not appear to be any flow measurement devices built into the existing sediment basin/outfall systems, please clarify the required methodology for obtaining these flow measurements.
R68. The flows are based on monthly elevation tables. The tables and sample calculations will be provided to the Contractor after award.
Q69. Specification 01 57 20, 3.2.3.1: The monitoring requirement tables include reporting of various chemical parameters twice per month. May we assume these are grab samples from the sediment basin pool rather than during a discharge event?
R69. If there is no discharge, then there are no chemical properties that need reporting. No grab samples are to be taken from the ponds.
Q70. Plan Sheet 99-52: Please clarify the intended use of Stockpile Areas 1 and 2.
R70. The drawing has been revised to provide the clarification requested. See revised drawing 99-52-A provided as part of this amendment.
Q71. Plan Sheet 99-52: Please clarify the intended use of the two stockpile areas for chipped materials and stockpile relocation.
R71. The drawing has been revised to provide the clarification requested. See revised drawing 99-52-A
Q72. Is it the intent to perform all Upland Disposal Area clearing during the initial contract year?
R72. No it is not the Government’s intent to perform all clearing in the base year. See response to Question 73 concerning placement of material into the site. Also see the unit price list which contains a clearing quantity listed for each contract year – item numbers 1204, 2204, and 3204.
Q73. Is it the intent to fill the Upland Disposal Area evenly to a target elevation or begin depositing material downslope in the cleared area to the finished grade and work toward the south?
R73. The specifications have been revised to clarify that the intent is to fill the lower areas first, and raise the area as uniformly as possible while maintaining proper drainage of the entire site in accordance with PADEP Best Management Practices. See Revised Specification Section 01 74 19, Paragraph 1.4
Q74. Plan Sheet 99-55, Note 8 refers to the specifications for requirements for turf reinforcement mat. We do not find a reference for that item in the specifications. Please clarify.
R74. The specifications have been revised to provide details of the turf reinforcement mat. See Specification Section 31 32 11 which was added as part of Amendment No. 0001 for details.
Q75. Plan Sheet 99-53: Several call-outs indicate the beginning of benches with gutters. Are the benches with gutters to the north of those call-outs or toward the south?
R75. All benches begin at a high point and slope down longitudinally for drainage. There are two types of benches as shown on Sheet 99-55; one with a gutter and one without. The callouts labeled “Begin Bench w/Gutter” provide the location where the bench with gutter begins (and the bench without gutter ends) and continues downslope until it reaches the applicable bench outlet.
Q76. Specification 32 92 19, 2.2: Please confirm that “topsoil” is un-amended dredged material meeting the requirements of the paragraph with no fertilizers, organic matter, or other additives.
R76. Yes, topsoil shall be appropriate dredged material or any existing topsoil located at the Upland Fill Placement Area.
Q77. Please confirm the ending river station at Locks and Dam 4. Plan Sheet 83-57 shows about 932+50, the Acceptance Section Table in Specification Section 35 20 23, 3.5.1 says 930+20.
R77. The drawings and specifications have been revised to indicate that the ending station is 912+00.
See Amendment drawings 83-56-A and 83-57-A and revised table in Specification Section 35 20 23,
3.5.1 both of which are provided as part of this amendment.
Q78. Does each year’s dredging quantity correspond with specific Acceptance Sections in the table of Specification Section 35 20 23, 3.5.1?
R78. No, not necessarily.
Q79. Specification Section 01 74 19, 3.15.10: Please confirm that the basis of measurement for aggregate for haul roads is per 3” lift (Section 3.4.2) per square yard.
R79. Yes, quantities are for a 3” placement, per specifications. For ease of measurement and verification, the SY measure shall remain in place.
Q80. Please confirm the contractor is only responsible for dredging the 150’ channel, thus excluding any docks, mooring structures and overhead obstructions from river loading/offloading facilities. Please refer to stations 900+00 through 880+00.
R80. This is not accurate. The Contractor is responsible for dredging the 300’ channel and side slopes as detailed in the contract plans. The Government will work with the contractor and any affected facility owners as required to coordinate the dredging.
Q81. Can the Site Safety and Health Officers have other duties/responsibilities?
R81. As indicated in Section 01 35 26, paragraph 1.6.1.2, “The Contractor Quality Control Manager can be the SSHO on this project.”
Q82. Under Volume 1 of 2, Section 01 74 19, 1.4, SD-07 – Is the cost for the landfill tipping fees for the general debris removal included in our scope of work or will it be addressed under a modification to the contract?
R82. All costs associated with general debris removal shall be included in the line item for General Debris Disposal as listed on the Bid Schedule.
Q83. “The Contractor shall be responsible for off-loading other contractor's material starting 3 months after notice to proceed (NTP).” Q: This leaves insufficient time to get all necessary submittals approved and any Off-Loading Facility repairs/upgrades completed. How will this be addressed if the site is not prepared to receive and off-load other contractor’s material?
R83. Specification Section 01 74 19 paragraph 3.8 has been revised to indicate that the Contractor shall be ready to accept off-loading of other contractor's material no later than 6 months after notice to proceed (NTP). See revised Spec Section 01 74 19 provided as part of this amendment.
Q84. “Failure to off-load the barges within 3 days will result in the Contractor being charged an amount of $5,000 per day of delay.” Q: Does this include weekends and holidays?
R84. The specifications have been revised to clarify that workdays for receipt of barges shall be Monday-Friday, 7am-5pm. Further, that weekends will not be included in the 3 day return period. See Revised Specification Section 01 74 19 paragraph 3.8 provided as part of this amendment.
Q85. “Concrete rubble which is suspected of contamination by petroleum products or other materials, and/or is larger than six inches in size in any dimension, and/or contains protruding metal (protruding more than .25 inches or more), shall be sent back on the barge that delivered it.” Q: Rejecting this material after it has been off-loaded from the barges unnecessarily impacts the off-loading operation and is very costly. Can the material be inspected and rejected prior to being off-loaded from the barge?
R85. Yes, it is the intent that the Contractor perform the evaluation prior to offloading the material.
Q86. “No fill shall be placed upon a frozen, muddy, or excessively wet surface, nor shall snow, ice, or frozen material be incorporated within the fill. Q: This effectively shortens the dredging work window to July 2 to mid-December (or whenever that winter starts in earnest). How will off-loading of other contractors’ barges be handled during periods when no material is allowed to be placed within the fill? Is the $5,000 per day of delay not applicable during these periods?
R86. It will be up to the Contractor to properly manage their efforts at the site to properly place dredged material.
Common techniques used in cold weather include stripping off snow/ice, stripping a lift of fill to get down below a frozen surface, stockpiling materials for a warmer day, and quickly getting offloaded material into place before it has a chance to sit and freeze, etc. Most of the dredged material should be free draining sands and gravels, which is more favorable for winter placement than moisture-sensitive silts and clays. The $5,000 per day delay will not be enforced in instances that are deemed to be outside the control of the Contractor.
Q87. The Government reserves the right to utilize another plant in any of the work areas during the contract period.” Q: Does this statement mean that the Government can reduce the scope of work given in the bid schedule? What is the Government’s intent regarding this statement?
R87. The intent is to allow another plant to operate in the area in case emergency dredging is required due to a flood event, etc.
Q88. Consider eliminating the 5 year experience requirement on operating computerized positioning systems on page 3 of Section 35 20 23 Dredging. People with this level of experience on bucket dredges will be difficult to find in the local area. There are people available in the area that have experience operating GPS machine controlled equipment on land but not on a bucket dredge.
R88. The specifications been revised to indicate that land based GPS bucket excavation experience will be considered towards the 5 year experience criteria. See Revised Specification Section 35 20 23, paragraph 1.8
Q89. To dredge and place 1.15 million CY of wet dredged material in three years is a significant task given the moisture content restrictions and lack of space in the dewatering area. The dewatering area can only hold 15,000 CY to 20,000 CY of dredged material depending on how much silt is in the spoil. There have been cases in past contracts where the material has had to sit for months before being dry enough to haul up to the disposal area. For this contract the successful contractor cannot afford to wait any significant time for drying to make the schedule. Please consider revising the specification to allow the wet material to be hauled up the hill where there is considerably more space to manipulate it for drying. In particular, allow dripping water and some minor spillage of material to fall on the haul roads. The spillage and dripping is likely to occur when climbing the hills, not when crossing over the railroad and public road. The trucks will be going so slow over the narrow railroad bridge to prevent their mirrors from being torn off to spill anything on the bridge or road below. Normal haul road maintenance will take care of the spillage.
R89. The only area available to use for dewatering of dredge material is the Sediment Dewatering Area. No additional areas will be allowed.
Requirements for haul trucks will not be changed from what is specified in Section 01 74 19, Paragraph 3.5.
Q90. If some of the dredged material is determined suitable for commercial use can it be transported to a commercial facility for processing and reuse?
R90. No. All non-hazardous dredge material shall be placed in the Upland Fill Placement Area at Victory Hollow.
R91. Are there any permit restrictions to adding lime or cement to the wet dredged spoils for drying purposes?
Q91. Adding lime or cement to the wet dredged spoils for drying purposes will not be permitted.
Q92. Would the USACE consider adding a bid item for bulkhead repair or replacement since the existing one is in disrepair?
R92. No additional bid items will be added.
