QUESTIONS AND ANSWERS
Q1. Can the USACE provide an excel file of the bid form for the Charleroi River Chamber Contract?
A1. An Excel file of the bid form has been posted to FBO along with Amendment 0001.
Q2. Ref: Section 00700, 52.219-9, Alternate I. The Alternate allows the Contracting Officer to request a Small Business Subcontracting Plan prior to contract award – which then becomes a part of the resultant contract. What small business utilization goals are we are trying to meet? Are they truly “best effort” type goals or is there a penalty for failure to meet those goals?
A2. Please read the text of FAR Clauses 52.219-8 and 52.219-9 Alt I in their entirety. In an Invitation for Bid (IFB) solicitation, the bidder is expected to comply with both clauses and the U.S. policy of maximizing opportunities for small business in federal contracts. No goals are included in the solicitation. The apparent low bidder (if other than small business) will be requested by the Contracting Officer to submit a Subcontracting Plan tailored to the contract itself. The Plan should be developed with consideration to planned subcontracting and other potential work that could be subcontracted. The proposed Plan should be logical and reasonable, yet challenging, and comply with the FAR clauses. All 11 statutory assurances of clause 52.219- 9(d)(1-11) will need to be included as well as those in 52.219-9(e)(1-6). The plan will be reviewed by the Contracting Officer, the District Deputy for Small Business and the Small Business Administration (SBA) Procurement Center Representative (PCR) for acceptability prior to contract award.
Q3. Ref: Section 00800, 52.211-10. Is the term “current contract completion date” as used throughout this clause the same date (i.e. 1110 calendar days following NTP), or does that date change after each option is awarded? Can you shed clarity on required completion dates under the earliest start and latest start scenario for each option?
A3. The current contract completion date will change after each option is awarded. Extensions will be added to the current completion date at the time the Awardable Option is awarded.
Clause 52.211-10 has been revised with this amendment.
Q4. Ref: Section 00800, 00800-5. We think that the latest date (assuming no change orders) the contractor would be mobilized for this contract is 840 days after 31 March 2021 (or in July 2023). Is this correct? This, of course, does not include the 1 year warranty period.
A4. That is correct. The latest completion date, assuming no changes, would be 840 calendar days after acknowledgement of NTP for the latest Option 5 exercise date of 31 March 2021.
Q5. Plan Sheets A19/CB69 and A19/CB70 provide details for cofferbox seals that include embedded beams, a vertical seal beam, seal concrete, grout sock, and a seal beam plate.
What bid item or items is this work paid under?
A5. Construction of the items listed is to be paid under bid items 0008 and 1007. Removal of the items listed is to be paid under bid items 2021 and 3020.
Q6. What is required from the new contractor with respect to environmental protection requirements during the overlap period when J.B. Fay remains on site for monoliths 22 through 27?
Under 1.3.1 there is a statement that the (new) contractor shall have an approved Environmental Field Technician Compliance Representative (EFTCR) on site at all times that work is in progress including the period that the M22 through M27 contractor is responsible for environmental compliance at the batch plant and Victory Hollow site. This statement makes reference to both the batch plant and Victory Hollow. However, the contract bid items sheet lists bid items 0058 and 1039 which cover environmental costs for the Victory Hollow site only during the base contract and Option 1 respectively. Options 2 through 5 on the bid sheet list environmental compliance items both at the batch plant and at Victory Hollow, as bid items 2004, 2064, 3004, 3058, 4004, 4087, 5004 and 5090. Based on the bid sheet and description of the options, it seems the intent is to have the contractor’s EFTCR monitor activities at Victory Hollow only.
However, at Section 01 11 13.00 08 page 7, there is a listing of contract line items that lists the batch plant site for the base contract and option 1 as follows:
0010 (BASE CONTRACT) ENVIRONMENTAL COMPLIANCE MEASUREMENTS,
SAMPLING, TESTING AND REPORTING, CONCRETE BATCHPLANT 36
MONTHS
1010 (AWARDABLE OPTION ONE) ENVIRONMENTAL COMPLIANCE
MEASUREMENTS, SAMPLING, TESTING AND REPORTING, CONCRETE BATCH
PLANT 24 MONTHS
This adds to the confusion about the contractor’s environmental protection expectations at the batch plant during the contract overlap period. So here are two questions:
a. Is the M1 through M21 contractor to have the EFTCR monitor activities at both the batch plant and Victory Hollow, or only at Victory Hollow during the contract overlap period?
b. Given that the EFTCR is to function under the oversight of the Environmental
Senior Compliance Representative (ESCR) and seek advice of the ESCR, is it correct to assume that the ESCR must be in place and providing oversight throughout the contract overlap period at some level of involvement?
A6. The EFTCR for the Victory Hollow Site is included in the applicable bid items for
ENVIRONMENTAL COMPLIANCE MEASUREMENTS, SAMPLING, TESTING AND
REPORTING, VICTORY HOLLOW SITE and the EFTCR for the batch plant is included in the applicable bid items for ENVIRONMENTAL COMPLIANCE MEASUREMENTS, SAMPLING, TESTING AND REPORTING, CONCRETE BATCH PLANT. A new bid item (ENVIRONMENTAL FIELD TECHNICIAN COMPLIANCE REPRESENTATIVE) has been added to the Base Contract and each Option by Amendment 0001 for the EFTCR responsible for environmental monitoring of the overall construction.
Q7. In Options 2, 3 and Option 4, Bid Items 2049, 3042, 4038, 4039 & 4045-4049 do not have “Produce & Deliver Concrete” Bid Items. Please clarify where the cost for producing & delivering these concrete items are to be included in the bid form.
A7. Based on the Corps construction schedule, for Options 2 and 3, concrete for drilled shafts, tremie concrete, and non-cofferbox sheet pile support system (to be added by Amendment 0001) only may be produced by the M-22 to M-27 contractor, if the options are awarded prior to completion of that contract. In this case only the Deliver and Place Concrete payment items (2037, 2048, 2075 (Am 1), 3030, and 3041) will be used. If Options 2 and 3 are not awarded during the contract period for the M-22 to M-27 contract, this concrete will be produced by the River Chamber Completion (RCC) contractor, and the Produce concrete items (2036, 2047, 2074 (Am1), 3029, and 3040), and associated material items will be used to pay for the contractor-produced concrete. Concrete for Bid Items 2049, 3042, 4038, 4039 & 4045-4049 will be produced by the RCC contractor regardless of time of award of the Options, so these items include production, transportation, and placement. See also section 01 22 00.00 10 MEASUREMENT AND PAYMENT, paragraph Concrete Production, Delivery and Placement as revised by Amendment 0001.
Q8. Drawing A19/CB55 “Typical Upper Waler & Struct Connnection” refers to Note 6;
however, Note 6 does not exist on the drawing. Please clarify.
A8. Drawing A19/CB55 has been revised to include Note 6. The revised drawing is included in Amendment 0001.
Q9. Please confirm that the cost of materials for producing and delivering concrete in the Base Bid & Option 1 from the M22-M27 Monolith Contractor will be borne by the M22- M27 Monolith Contractor.
A9. All batch plant concrete for the Base Contract and Awardable Option 1 will be considered to be Government-furnished, which will include all costs of labor, equipment, and materials to produce the concrete and deliver it to the end of the fixed conveyor at the Stub Wall. The RCC contractor will not be responsible for any cost of labor, equipment or materials for producing this concrete and delivering it to the Stub Wall. This may also apply to batch plant tremie concrete for drilled shafts, tremie concrete, and non-cofferbox sheet pile support system for Awardable Options 2 and 3, depending on the time of award for these options.
Q10. Please provide points of contact for all the concrete materials utilized at the batch plant under the M-22 to M-27 contract.
A10. Specific points of contact are irrelevant as they are likely to change. However, phone numbers for all potential sources are included in the respective tables at the end of specification section 03 30 00.50 08, and materials that have been previously used and approved are annotated with asterisks.
Q11. Please clarify which concrete mix design will be used for BI #4038 Dental Concrete.
A11. The mix design for BI #4038 Dental Concrete is PennDOT Class AAA Ready-mix concrete. Specification Section 03 30 00.51 08, Table C has been revised and included in Amendment 0001.
Q12. Project Solicitation Section 00800: Special Contract Requirements. Clause 52.211-10 lists various scenarios for the start dates and completion dates of the options. There is a very wide range of possible start and completion dates given for each option. For example, if Option 1 is exercised, the contract completion date could be calendar day 1170 (1110 for base contract + 60 for Option 1) or as late as calendar day 1830 (1110 for base contract + 720 days for Option 1). Using this same logic for the other options the earliest completion of the project would be 2400 calendar days from NTP (1110 + 60 + 240 + 30 + 660 + 300) or as late as 4620 calendar days from NTP (1110 + 720 + 660 + 540 + 750 + 840). The difference between the late finish and the early finish is 2220 calendar days or 6.1 years. This wide range of possible start and finish dates creates serious risk for the Contractors and their bonding companies. This risk would include significant material, equipment, and labor escalations, and extended overhead at a minimum. Please consider revising this section to include milestone dates for each option to allow the contractors firm durations to base their bid on.
A12. The completion extension are not cumulative, but are based on either extension by adding a fixed number of days to the contract duration or adding a fixed number of days after the Option Notice to Proceed date. Clause 52.211-10 has been revised with this amendment.
Q13. Specification 26 90 00.00 08, paragraph 2.2.1 states “The control consoles shall be government furnished contractor installed…”
a. These consoles are not listed under any of the sections that state “Government Furnished Equipment”.
b. I am unclear if this is CS1 and CS4 which are titled “Control Console” or if this is Winsted Prestige Consoles as shown on drawing A29/281. Or neither, or both? Nothing on the drawings seems to indicate that any of these are government furnished.
c. There are several sections, for example, 2.2.3.2, that state “the consoles/tables shall each have an illuminated red target “mushroom head” emergency stop button… It is unclear if this item would be included with the government provided console, or if the contractor must retrofit the console with this equipment. This is only one example of equipment to be included with the consoles. There are other sections. Please clarify.
d. If any consoles are government provided, we assume these are being purchased under a separate contract. AIG would be interested in bidding on these consoles. Please consider AIG when this purchase request is issued.
e. If possible, please respond to me immediately and informally regarding these consoles. These components would be a major portion of the System Integration bid if they need to be included, and it would be burdensome to not start working on the bid until after July 7th when the amendment for questions and clarifications is being issued.
A13. The control consoles are not Government furnished and shall be provided by the contractor.
In Spec Section 26 90 00.00 08, 2.2.1 General, the first sentence “The Control Consoles shall be Government furnished Contractor installed to be located as shown on the drawings” has been deleted. This revision is included in Amendment 0001.
Q14. Drawing A19/CB22 Note 11 states that the seal for M-8 will be built inside Monolith M-7; however, the king pile and single sheet shown on other similar details, (see attached Drawing A19/CB25 clouded portion), is missing. Please clarify the seal detail @ M-7.
A14. Drawing A19/CB25 shows Stage 1 of the construction sequence. King piles and sheet piles associated with the seal should not be shown at this stage. Drawing A19/CB25 has been revised and is included in Amendment 0001.

Refer to specification sections 01 35 00.00 08 SPECIAL PROCEDURES and 01 74 19.10 08 OPERATION OF VICTORY HOLLOW SITE for restrictions related to the rail crossing.
Q46. Given the complex analysis associated with a bidding a project of this size and duration, we respectfully request a 4-week extension to the bid date.
A46. The time and date specified for receipt of bids is not extended.
Q47. Spec section 015720.00 10 Environmental Protection, paragraph 1.11.6, b. states that the Environmental Field Technician “be onsite whenever the contractor is working”, However the bid items are only related to environmental monitoring at either Victory Hollow or the Batch Plant both of which are turned over to the Contactor at different times. Where are the costs for the full time environmental monitoring of construction to be carried?
A47. See response to question 6.
Q48. Bid Item 0069 Bridge Modifications: The technical specifications refer to sheet 037- LCH-99/13 (in the reference drawings) for design loading. Note 6 on 037-LCH-99/13 says “See Reference Drawings R1 and R2 for details of the existing bridge and approach span.”

Q50. Ref: Volume 1, Section 03 05 00.00 08, GOVERNMENT FURNISHED CONCRETE
DURING CONTRACT OVERLAP PERIOD WITH MONOLITHS M-22 TO M-27
CONTRACT, Clause 1.6.4.
This clause provides for additional hours of operation for the batch plant that can be requested from the Contracting Officer. Under what circumstances will such requests be approved? Is this just a matter of scheduling ahead of time or are there other criteria to be met?
Once the M-22 to M-27 Contractor has demobilized will we have greater flexibility in scheduling hours of operation of the batch plant?
A50. Circumstances that would permit a request for additional hours of operation at the batch plant pertain to larger tremie placements that, by their quantity, will require more than 8 hours to complete. Placement schedules will be provided one week in advance and coordinated with the other contractor. Once the batch plant is transferred to the River Chamber Completion Contractor (RCCC), the RCCC with have total control over the hours of operation.
Q51. Solicitation, Offer, and Award – Bid Date
a. We request that the bid date of Monday, August 3, 2015 be moved from Monday until a Friday. The complexity of the project requires questions and discussions with vendors and subcontractors regarding their quotes which are made difficult with a bid date immediately after a weekend.
b. We request that the bid date be extended until Friday, August 14, 2015 to allow more time to evaluate the complexity of the project and an award schedule extending over a five year period.
A51. The time and date specified for receipt of bids is not extended.
Q52. Subject: Solicitation Sec 00100-7 Award. The referenced section states that “Award will be made as a whole to on bidder”, but what is the basis for award? Is the award based on the Total Base Contract plus Awardable Options, on the Base Contract, or on some other combination of Base Contract and Awardable Options?
A52. Award will be based on the total Base plus all Awardable Options. Please reference FAR provision 52.217-5 “Evaluation of Options (Jul 1990)” included in Section 00100 of the solicitation. It states, “Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).”
Q53. Subject: 52.228-1 Bid Guarantee and 00100-5 Bid Bond Requirements. These two sections state that the penal sum of the bid bond “… shall be 20% of the bid amount...”
What is the “bid amount”, the Total Base Contract plus Awardable Options or some other value?
A53. The bid amount/price is the total Base contract plus all Awardable Options.
Q54. Subject: Escalation. Due to the long duration of the project (potentially 7.5 years), the uncertainty of the contract amount and details due to the Awardable Options, and the uncertainty of the future award of the Awardable Options, we request that an allowance and method for paying for escalation of materials, fuel, and labor be considered. The pricing of the awardable options, therefore the award of the project, will be heavily weighted on a bidder’s evaluation of the amount and risk of escalation on the cost of performing the work at a date further in the future then is asked of us on any other contract. We feel that the USACE would receive better prices with more competition if the USACE bore the risk of inflation or at least a portion of the inflation above a certain point.
A54. No escalation percentages for labor and materials will be provided. This is a business judgment that bidders must make. To the extent that an underlying concern of this question is the contract's duration, please see the answers to Questions 12, 145, and 151, which address the calculation of the option periods.
Q55. Subject: Pre Excavation – Awardable Options 1 -3. Based on drawing A19/CB1 the pre-dredged surface elevation is 711.00. Based on drawings A83/15-A83/19 the only area to be pre-dredged for the installation of the middle wall is the area for the base contract. It appears as though the area for Options 1-3 were overlooked or were they completed in the current contract that JB Fay has. Please advise.
A55. Pre-excavation downstream of station 2+55A for monolith construction is not required, as the alluvium elevation in this area is currently at approximate EL 711.00 +/-.
Q56. Please provide the USACE quantity calculations for all lump sum items.
A56. Quantity calculations will not be provided.
Q57. In which Bid Item should we include the costs associated with the Non-Cofferbox Sheet Pile Support System (Spec. Section 31 63 41.00 14)?
A57. See bid items 2025 through 2028.
Q58. The quantities for Rock Excavation (Bid Items Nos. 0023, 1019, 2033, 3026), suggest that the proposed rock sockets are over 41 feet deep, which seems excessive. Please confirm the quantities and units for these bid items and indicate where in the bid documents this information is provided. Also, please indicate what criteria we are to use, and how we are to determine adequate depth of rock socket during construction.
A58. The bid item quantities and units are correct. Shaft Final Tip Elevations are provided in the Middle Wall Drilled Shaft Reinforcement Schedule shown on contract drawing A20/D6.
Q59. Specification Section 03.05.00.00.08 Part 1 Paragraph 1 lists the concrete that will be produced and delivered to this contract by the M-22 to M-27 Monolith Contractor. There are similar bid items within this contract. Is it the USACE’s plan to have options awardable to that contract as well as similar bid items, (such as Bid Items 2037, 2047, 3029 and 3040), in this contract? Please clarify.
A59. Due to uncertainties in the schedule overlap, drilled shaft concrete and tremie concrete for Options 2 and 3 are listed as being furnished by the M-22 to M-27 contractor. Therefore, Items 2037, 2048, 3030, and 3041 are included for delivery and placement of the concrete. However, if placement of this tremie concrete and/or drilled shaft concrete occurs after completion of the M-22 to M-27 contract, the River Chamber Completion contractor will be required to also produce the concrete and deliver it to the end of the fixed conveyor. Items 2036, 2047, 3029 and 3040 are included for production of this concrete. This is also addressed in Section 01 22 00.00 10 MEASUREMENT AND PAYMENT, paragraph Concrete Production, Delivery and Placement, subparagraph Payment as revised by Amendment 0001. To the extent that an underlying concern of this question is the contract's duration, please see the answers to Questions 12, 145, and 151, which address the calculation of the option periods.
Q60. Ref: Solicitation. The Contract Documents do not indicate an escalation clause. Does the Government intend to include an escalation clause for materials, fuel, and/or labor given the long duration of this project, relative volatility in commodity prices in recent times, and the variability on award/completion dates for the Options?
A60. No escalation percentages for labor and materials will be provided. This is a business judgment that bidders must make.
Q61.Ref: Solicitation - Form 1442. Does the Government intend to check box 29 on Form 1442?
A61. Yes, the Government will check Box 29 on the SF 1442 at time of award.
Q62. Ref: Clauses 52.211-5001, 52.216-1 and Section 01 22 00.00 10. Clause 52.216-1 indicates the Government contemplates award as a Firm Fixed Price.
