3.8 REIMBURSEMENT FOR NATURAL GAS SYSTEM ADJUSTMENTS

At selected locations on the project, it is anticipated that the facilities of the Equitable Gas Company or Columbia Gas Company (Gas Company) located within the street rights of way or recorded easements, may require “adjustments” including, but not limited to, interruption, disconnection, temporary service, repair, replacement or relocation, to enable the installation of the sewer pipe and appurtenances.

The uncertain nature of the location, depth, condition, material and age of the Gas Company’s facilities potentially encountered preclude development of a comprehensive scope of work.

The Gas Company’s policies require that their own personnel or subcontracted forces perform any required adjustments on their distribution facilities.

For adjustments needed to allow the sewer construction work to proceed, the Gas Company may require partial or full reimbursement by the Contractor.

This item provides a means for the Contractor to reimburse the Gas Company for these adjustments. Upon completion of the work by the Gas Company’s forces, they will provide an invoice to the Contractor for the adjustments made, and the Contractor shall be required to reimburse the Gas Company in a timely manner. Upon providing proof of payment to the Gas Company, the Contractor shall be entitled for reimbursement of that payment under this item. The Contractor shall be aware that Gas Company may require an

Section 32 30 10.10 Page 4 agreement and/or deposit in advance of their work as assurance of receiving payment.

Utilization of this item shall be in conjunction with the Gas Company’s field representative(s) and the Contracting Officer, and the Contractor. A minimum of 30 working days in advance of proposed excavation work, the Contractor shall identify the Gas Company’s facilities that may conflict with the proposed sewer installation and require adjustments. The need for adjustments shall be jointly discussed by all parties and approved by the Contracting Officer. If a potential conflict is identified, than the need for additional investigations shall be identified and the use of items in the contract intended for such purpose shall be proposed. The items in the contract intended for use in field locating existing underground utilities includes CCTV pipe inspection, and test pits with two different depth ranges.

Due to the interrelated nature of the relocations, the Contracting Officer may authorize the Contractor to assist the Gas Company’s forces by providing test pits, excavation, disposal, backfill or restoration in conjunction with the adjustments. In these instances, the Contractor will be reimbursed in accordance with applicable bid items.

Under certain circumstances, the Gas Company may elect to replace portions of their facilities at their own expense. In these cases, there shall be no reimbursement due to the Contractor under this item by the Government.

Similarly, if the Gas Company’s facilities encountered in the work area are found to be leaking during excavation for the sewer pipe installation, then work should be suspended immediately and the Gas Company notified under guidelines for reporting a gas emergency.

The Contractor shall be aware that use of this item requires substantial coordination and advance planning as well as cooperation with the Gas Company and/or their subcontractors. The Gas Company’s need to maintain service to their customers, particularly in cold weather, may require the Contractor to adjust or delay the work to coincide with the Gas Company’s ability to arrange for the necessary adjustments to clear the trench zone for excavation. These aspects shall be considered as incidental to the work and no additional compensation shall be warranted.

The contractor shall coordinate a meeting soon after the Pre-Construction Conference to include the utility companies and Government so an open line of communication can be developed and the primary points of contact for all parties can be established. Among the criteria to be discussed will be what work the utility company may elect to replace at their own expense while the trench is excavated for the storm sewer pipe for this feature of work and how the Contractor will be reimbursed by the utility company for this feature of work.

3.8.1 Gas Emergency

If service line(s) encountered in the work area are found to be leaking during the course of construction activities, then work should be suspended immediately and the Gas Company notified under guidelines for reporting a gas emergency.

3.9 REIMBURSEMENT FOR WATER SYSTEM ADJUSTMENTS

Section 32 30 10.10 Page 5

At selected locations on the project, it is anticipated that the facilities of the West View Water Authority (Water Authority) located within the street rights of way or recorded easements, may require “adjustments” including, but not limited to, temporary interruption, disconnection, repair, replacement or relocation, to enable the installation of the sewer pipe and appurtenances.

The uncertain nature of the location, depth, condition, material and age of the Water Authority’s facilities potentially encountered preclude development of a comprehensive scope of work.

The Water Authority’s policies require that their own personnel or subcontracted forces perform any required adjustments on their distribution facilities. For adjustments required in conjunction with the sewer construction work, the Water Authority requires full reimbursement on a time and materials basis.

This item provides a means for the Contractor to reimburse the Water Authority for these adjustments. Upon completion of the work by the Water Authority’s forces, they will provide an invoice to the Contractor based on time and materials required. The Contractor shall be required to reimburse the Water Authority in a timely manner for their work performed. Upon providing proof of payment to the Water Authority, the Contractor shall be entitled for reimbursement of that payment under this item. The Contractor shall be aware that Water Authority may require an agreement and/or deposit in advance of their work as assurance of receiving payment.

Utilization of this item shall be in conjunction with the Water Authority’s field representative(s) and the Contracting Officer, and the Contractor. A minimum of 30 working days in advance of proposed excavation work, the Contractor shall identify the Water Authority’s facilities that may conflict with the proposed sewer installation and require adjustments.

Due to the interrelated nature of the relocations, the Contracting Officer may authorize the Contractor to assist the Water Authority forces by providing excavation, disposal, backfill and restoration. The Water Authority does not have restrictions on those work items, and the Contractor will be reimbursed in accordance with applicable bid items.

Under certain circumstances, the Water Authority may elect to replace portions of their facilities at their own expense. In these cases, there shall be no reimbursement due to the Contractor under this item by the Government. Similarly, if the Water Authority’s facilities encountered in the work area are found to be leaking during excavation for the sewer pipe installation, then work should be suspended immediately and the Water Authority notified under guidelines for reporting a waterline leak emergency.

The Contractor shall be aware that use of this item requires substantial

Section 32 30 10.10 Page 6 coordination and advance planning as well as cooperation with the Water Authority and/or their subcontractors. The Water Company’s need to maintain service to their customers may require the Contractor to adjust or delay their work to coincide with the Water Company’s ability to arrange for the necessary adjustments to clear the trench zone for excavation. These aspects shall be considered as incidental to the work and no additional compensation shall be warranted.

The contractor shall coordinate a meeting soon after the Pre-Construction Conference to include the utility company and Government so an open line of communication can be developed and the primary points of contact for all parties can be established. Among the criteria to be discussed will be what work the utility company may elect to replace at their own expense while the trench is excavated for the storm sewer pipe and how the Contractor will be reimbursed by the utility company for this feature of work.

3.10 4” TO 6” PVC SDR 26 SEWER REPAIR

At selected locations on the project, it is anticipated that residential sewer service laterals within the street right of way may require temporary interruption, disconnection and/or replacement to enable the installation of the new sewer pipe and appurtenances. Individual Items of work are included in the bid to perform repairs to the existing sewer laterals 4” to 6”. All sewer pipe shall be laid to the lines and grade to match existing sewer laterals. Approved transition couplings from PVC to concrete or VCP are incidental to this item.
