PERFORMANCE WORK STATEMENT
Cold Storage Trailers Joint Base Lewis-McChord, Washington 16 October 2024
PART 1
GENERAL INFORMATION
1. General: This is a non-personal services contract to provide two (2) 16’ cold storage trailers for perishable food storage purposes. The trailers will be static for the entirety of the required need. Under no circumstances will the Government assign tasks to, or pre-pare work schedules for, individual Contractor employees. It shall be the responsibility of the Contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the Con-tractor believes that any actions constitute, or are perceived to constitute personal ser-vices, it shall be the Contractor's responsibility to notify the Contracting Officer (KO) im-mediately.
1.1. Description of Services: The Contractor shall provide all personnel, equipment, tools, materials, supervision and all other items necessary for the delivery, mobilization and pick-up of the 16’ cold storage trailers. The Contractor shall also provide any re-quired maintenance during the duration of the lease/contract.
1.2. Scope: The Contractor shall provide services as outlined in Part 5 - Specific Tasks of this Performance Work Statement (PWS).
1.3. Period of Performance: The anticipated Period of Performance shall be for a 5-month period. The Period of Performance shall be as follows:
01 November 2024 – 28 February 2025
1.4. Type of Contract: The Government will award a Firm Fixed-Price (FFP) contract.
1.5. Place of Performance: All work to be performed against this contract will be per-formed on JBLM-Main, Washington.
1.6. Recognized Federal Holidays: New Year's Day; Martin Luther King Jr.'s Birthday;
President's Day; Memorial Day; Juneteenth; Independence Day; Labor Day; Columbus Day; Veteran's Day; Thanksgiving Day; Christmas Day
1.7. Hours of Operation: The Contractor is responsible for providing services between the hours of 7:00AM-4:00PM (Local) Monday through Friday except federal holidays or when the Government facility is closed due to local or national emergencies, administra-tive closings, or similar Government-directed facility closings.

1.8 Quality Control / Quality Assurance
1.8.1. Quality Control: The Contractor shall develop and maintain an effective Quality Control Plan (QCP) to ensure services are performed in accordance with this PWS.
The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's QCP is the means by which the Contractor is assured that the work complies with the requirements of the contract. At a minimum, the Contractor shall develop QCP procedures addressing the areas identified in the Performance Requirements Summary (PRS), Technical Exhibit 1.
1.8.2. Quality Assurance: The Government will evaluate the Contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP).
This plan is primarily focused on what the Government will do to ensure the Contractor has performed in accordance with the performance standards. It defines how the per-formance standards will be applied, the frequency of surveillance, and the minimum ac-ceptable defect rates. The contract’s appointed Contracting Officer's Representative (COR) and/or Quality Assurance Evaluator (QAE) will perform on-site inspections to verify the Contractor's services meet the minimum standards of the contract require-ments throughout the contract’s performance period.
1.8.3. Government Remedies: In the event that the Contractor fails to perform satis-factory services or fails to correct non-conforming services, the KO shall seek remedy in accordance with the contract clauses.
1.9. Security Requirements
1.9.1. Access and General Protection/Security Policy and Procedures: Contractor and all associated sub-contractor employees shall provide all information required for background checks to meet installation access requirements to be accomplished by in-stallation Provost Marshal Office, Director of Emergency Services or Security Office.
Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as di-rected by DOD, HQDA and/or local policy. In addition to the changes otherwise author-ized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes.
For Contractors not eligible for a Common Access Card (CAC), but require access to a DoD facility or installation, the Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Infor-mation Center Interstate Identification Index (NCIC-III) and Terrorist Screening Data-base (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by a Government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.9.2 Operations Security (OPSEC): OPSEC denies adversaries sensitive infor-mation, critical information, or essential elements of friendly information. This infor-mation requires special protection from disclosure that could compromise or cause a threat to our National Security, an Army organization, activity, family member, DA civil-ian, or DOD Contractor. OPSEC is everyone’s responsibility who encounters the infor-mation. Information that is described below must be controlled, and if the information is in digital or hardcopy format, it needs to be destroyed at contract completion. Control includes not disclosing the information to personnel who do not have the need to have this information; if digital, do not post in a manner open to the public and if hard copy, secure in a locked area (office, trailers, vehicle, etc.). Examples which may be deemed sensitive include but are not limited to information related to the following:

1.10. Post Award Conference / Periodic Progress Meetings: The Contractor shall attend any post award conference convened by the contracting activity in accordance with the Federal Acquisition Regulation (FAR) Subpart 42.5. The KO, COR, and other Government personnel (as appropriate) shall meet periodically with the Contractor to re-view the Contractor's performance. At these meetings the KO will apprise the Contrac-tor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of any issues being experienced. Appropriate action will be taken to resolve any outstanding issues that have been identified. The Contractor’s par-ticipation at these meetings shall be at no additional cost to the Government.
1.11. Contracting Officer’s Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the functions identified in the letter of appointment issued to the COR and the Contractor. The COR is not authorized to change any of the terms and conditions of the resulting contract.
1.12. Key Personnel: The Contractor's Contract Manager is considered key personnel by the Government. The Contractor shall provide a Contract Manager who shall be re-sponsible for the performance of the work, as well as an Alternate Contract Manager who shall act for the Contractor if the primary is absent. The designated Contract Man-ager shall have full authority to act for the Contractor on all contract matters relating to the daily operation of this contract. The Contract Manager shall be available during nor-mal hours of operation in accordance with PWS paragraph 1.8.
1.13. Identification of Contractor Employees: All Contractor personnel accessing the installation when their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

DEFINITIONS & ACRONYMS
2. DEFINITIONS & ACRONYMS
2.1. DEFINITIONS:
2.1.1. Contracting Officer's Representative (COR): An employee of the U.S. Govern-ment appointed by the Contracting Officer to administer the contract. Such appointment will be in writing and will state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding impli-cations. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.2. Contracting Officer (KO): A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government. NOTE: The KO is the only individual who can legally bind the Govern-ment.
2.1.3. Deliverable: Anything that can be physically delivered but may include non‐man-ufactured things such as meeting minutes or reports.
2.1.4. Non-Personal Service: Personnel rendering the services are not subject, either by the contract's terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.
2.1.5. Physical Security: Actions that prevent the loss or damage of Government property.
2.1.6. Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of Contractor perfor-mance.
2.1.7. Quality Assurance: The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.8. Quality Control: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.9. Sub-contractor: One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the sub-contractor.

PART 3
GOVERNMENT FURNISHED ITEMS & SERVICES
3.1. Services: None.
3.2. Facilities: None.
3.3. Utilities: The Government will furnish utilities as currently installed on JBLM. The Contractor shall not change or modify any utility system or component without prior COR review and KO written approval. The Contractor shall not connect any Contractor furnished property, equipment, or system without prior COR review.
3.4. Equipment: None.
3.5. Materials: None.
PART 4
CONTRACTOR FURNISHED ITEMS & SERVICES
4.1. General Information: The Contractor shall furnish all supplies, equipment, facili-ties and services required to perform work under this contract that are not listed under Part 3 of this PWS.
4.2. Materials: The Contractor shall provide all materials and supplies necessary to meet the requirements of this PWS.
4.3. Equipment: The Contractor shall provide all equipment necessary to meet the re-quirements of this PWS.
PART 5
SPECIFIC TASKS
5.1. Basic Services: The Contractor shall provide all personnel, equipment, tools, ma-terials, supervision and all other items necessary for the delivery, setup and pick-up of two (2) 16’ cold storage trailers. The Contractor shall also provide any required mainte-nance during the duration of the lease/contract.
5.2. Cold Storage Trailers Requirements: The 16’ cold storage trailers shall meet the following specifications:
Interior Dimensions (Approx.): 15.8’ L x 6’ W x 6.8’ H Power Supply: Standard 110V/20A (w/ 50’-100’ extension cord) Temperature Range: 0 to +40 degrees
5.2.1. Equipment Condition: The cold storage trailers furnished under this contact shall be in safe and operational condition. The trailers shall comply with all federal and state safety regulations and codes applicable to the equipment.
5.3. Cold Storage Trailers Delivery: The Contractor shall deliver the cold storage trail-ers to the designated area as determined by the COR on the period of performance start date.
5.3.1 Pre-Inspection Requirements: At the time of delivery, the Contractor shall com-plete a joint pre-inspection with the COR to verify that the cold storage trailers are in satisfactory condition and is operational in accordance with the contract requirements.
A pre-inspection report shall be provided to the COR immediately following the com-plete of the pre-inspection. The COR is not authorized to sign any electronic device used by the Contractor.
5.4. Cold Storage Trailers Pick-Up: The Contractor shall pick-up the refrigerator trail-ers at the period of performance end date or prior to as determined by the Government.
The Contractor shall remove the refrigerator trailers within 24 hours of notification.
Should the equipment remain in place beyond 24 hours of Government notification to remove, the Government is not liable for additional rental costs, usage theft, loss, dam-age, replacement costs.
5.4.1. Post-Inspection Requirements: The Contractor shall complete a joint post-inspection with the COR to verify the cold storage trailers are returned in as-deliv-ered condition with only standard wear and tear. A post-inspection report shall be pro-vided to the COR following the completion of the post-inspection. The COR is not au-thorized to sign any electronic device used by the Contractor.
5.5. Cold Storage Trailers Maintenance: The Contractor shall provide all mainte-nance for the trailers provided under the lease agreement/contract. The Contractor shall have a company representative on call to respond to maintenance requests. The Contractor’s representative shall have access to telephone and email. The Contractor shall respond to a maintenance request within four (4) hours of receiving the notifica-tion.
5.6. DELIVERABLES
