This is not a cost reimbursable contract.
Historical data is not available as this is a new system.
Attachment 4 Technical Exhibits page 131 of 154 provides a list of subcontract requirements. Some of these costs are recorded as "No Data". Are these items considered cost reimbursable ODCs?
If not will the Government please provide the missing data? What other vendor/subcontract agreements are in place?
This is not a cost reimbursable contract. No data is listed for the Perimeter Brush Hogging requirement as this was previously done using government furnished Property (GFP).
The intent of the Government is to no longer provide GFP for grounds maintenance that is not on the current GFP list.
Site visit: During the site visit it was noted that currently-provided GFP would no longer be available to the incumbent or incoming contractor on day one of this new contract. Assuming this statement is accurate, will the Government then provide a list of all GFP that will become the responsibility of the contractor (and no longer provided by the Government)?
Please refer to the GFP List attached in TE
1.16. This would begin on Pg J-48 of the
Technical Exhibits. The GFP list provided is the most recent GFP listing.
Site Visit: During the site visit it was identified that various support contracts were in place with vendors such as Honeywell, Siemens, Air Gas and others. Does the government consider these subcontracts / service contracts a cost reimbursable ODC? If not, will the Government provide a list of the existing vendors/subcontracts/service contracts and the current annual costs? In the absences of this information, will the government provide a “plug” number?
This is not a cost reimbursable contract.
Offerors will have to establish their own subcontracts. See Technical Exhibit 5.0. TE

Site Visit: There have been recent upgrades to the facility in fire prevention, fire protection, EBI, DDC, chillers, etc. Are any of these upgrades under original equipment manufacturer warranty and/or service contract? Are there are any associated costs related to these warranties or service contracts that directly impact the costs of this contract? If so, what are these costs?
The Honeywell EBI upgrade will have a manufactures warranty after Government Acceptance. All other service or repair costs are not available. The cost is primarily determined upon what is required to be done.
Site Visit: Will the Government provide the square footage anticipated for ground maintenance?
Specifically the square footage of grass and clear zones? Square footage for roadways? Square footage for sidewalks and walkways?
These specifications are listed on the drawings that were provided by the Government at the MICC on site visit day.
These drawings were available for review however no Offerors chose to review them.
Appoximately 7 acres of grass, approximately 2300 feet of sidewalks appromimately 6 feet wide, approximately 37632 square foot of parking outside peremiter fence, perimeter road is approximately 1/2 mile by 10 foot.
Brush cutting area is 25 foot from perimeter road to the wood line. There is approximately 10 acres of area within the fence and an overal total approximate 25 acres to included wooded grounds outside the fenced perimeter belonging to the CDTF. Area along FLW 20 to be maintained is approximately 1/4 mile x 30 feet aong FLW 20 to wood line.
(52.245 2 Government Property Installation Operations Services) & Section J, Technical Exhibit 1.16 Page: 23, 31 The government includes the full text of FAR Clause 52.245-2. Furthermore, the government identifies Section J, Technical Exhibit 1.16 as the government furnished property included within the scope of this FAR Clause. This list of government property found at Section J, Technical Exhibit 1.16 also includes government furnished equipment that, in our opinion, is not to be included in the definition of government furnished property subject to replacement by the contractor if the property is no longer usable.
Our interpretation of this clause would exclude equipment that the offeror is managing and maintaining in accordance with manufacturer recommendations and/or local and industry best practice that reaches its end of service life, provided that the contractor has not lost the equipment, damaged the equipment, and can document that the equipment has been properly maintained in accordance with the agreed contract.
For example, if a Minicams, identified in Section J, Technical Exhibit 1.16 becomes BER (beyond economic repair), then our expectation is that the government, not the offeror would be responsible for replacing this equipment, or taking this equipment out of the contract as it would be no longer a serviceable item.
Q-Can you please clarify the intent of this language with regards the equipment list contained in Section J, Technical Exhibit 1.16?
The GFP equipment listed in Section J, Technical Exhibit 1.16 shall be maintained by the contractor. The Government will replace an item if it is beyond repair and is still required, such as a MINICAMS.
Section L.3.(3).b.(2) TAB B1 -Management, Organization, Staffing.
The requirements for key personnel state ‘Key Personnel include the Project Manager, the Deputy Project Manager, and then subordinate supervisors for critical technical functions including Air Monitoring;
Protective Clothing and Equipment; Plant and Facility Maintenance; and toxic area support operations.
Qualifications will be evaluated to ensure the ability of the contractor to produce candidates who meet or exceed position requirements outlined in the PWS.’.
The implication of this statement is that the actual resume of an actual individual is not necessarily the element being evaluated, but that the resume is being evaluated as an example of the offeror’s ability to produce candidates.
Q-Can the government clarify the intent of the requirement here, is it the ability of the offeror to produce candidates, or the qualifications of individuals ACTUALLY committed to this project following award?
The Government will review and evaluate to ensure the ability of the contractor to produce candidates who meet position qualification requirements outlined in the PWS. Also see the requirement at 5152.204-4001 Key Personnel requirements (MAR 2009) (LOCAL CLAUSE), and PWS 4.2.1. Key Personnel.
Section 2.2.17, 4.6.1; 4.8.1.10 Page: 31, 90, 94 The PWS language identifies the requirement to use OEM parts and having certified on OEM systems technicians to program.
Q-Can the Government please clarify if their intent is for offerors to use OEMs? Does the Government have the IP rights necessary for non-OEM contractors to perform these functions?
1. Section 2.2.17 lists the CDTF
MAINTENANCE MANUALS
(PLANT/APPURTENANCES) there is no language about OEM.
2. Section 4.6.1.1 Just states that all repair parts shall be OEM.
3. Section 4.8.1.10. Outlines the EBI DDC system programmer qualifications. The Government does not have IP rights for this system because Honeywell has sole proprietorship of the EBI system.
Section: L.3.(3).a. Volume I-RFP Document and Price Proposal Page: 8, W911S720R0001_SF3_mod_document_12-20- 2019. Section: 252.215-7009 PROPOSAL ADEQUACY CHECKLIST (JAN 2014) including reference to FAR 15.408 and Table 15-2 Page: 24-30 Q- IAW DFARS 215.408(4), 252.215-7009 for a proposal adequacy checklist is only prescribed for when the solicitation requires the submission of certified cost or pricing data. Given the Firm Fixed Price (FFP) and competitive nature of this solicitation, certified cost or pricing data would not be required. Further, the Solicitation does not require the submission of certified cost or pricing data. Therefore, will the Government consider removing the requirement for a Proposal Adequacy Checklist?
The solicitation will require submission of certified cost or pricing data or other than certified cost or pricing data if only one offer is received. Currently the Government has a reasonable expectation to receive more than one offer. This requirement is removed from the solicitation. NOTE: ALSO SEE DFARS 252.215-7008 Only One Offer (July 2019)

The referenced sections and clauses imply the resulting award will be a CAS-covered contract.
However, IAW 49 CFR 9903.201-1 (b)(15) firm fixed price contracts awarded on the basis of adequate price competition without the submission of certified cost or pricing data are exempt from CAS requirements. Understanding this solicitation will result in a firm fixed price contract awarded as stated directly above, can the Government clarify its intent and basis for including these CAS-related FAR clauses in the solicitation or are the referenced sections and clauses implying the resulting award being a CAS-covered contract in error?
