SUMMARY OF SCOPE OF WORK

Work under this requirement consists of a construction, removal, replacement, and repairs associated with roadway and airfield projects at Ft. Riley, KS, including removal, replacement and repair of existing subgrade, utilities, shoulders, curbs, gutters, sidewalks, and other real property common to roadway and airfield pavements. Work may also include minor “new construction”, to include construction of new roads, new sidewalks, or new parking lots, or seeding operations based on the seeding season outlined in the KDOT Standard Specifications Section 904 Table

904-1 (https://www.ksdot.gov/bureaus/burConsMain/specprov/2015specprov.asp) . Work will be provided under multiple firm-fixed-price task orders issued as provided in the parent IDC contract. Each task order may involve a variety of construction trades. The Contractor shall provide all materials, labor, equipment, tools, transportation, and ancillary items necessary to complete each project from conception to completion.

GENERAL INFORMATION

1.0 GENERAL DESCRIPTION OF WORK

General. This is a construction contract to provide non-personal services for removal, replacement, and repairs associated with roadway and airfield projects at Ft. Riley, KS.

Objectives. Contractor to furnish construction and related services to the Government in a professional and collaborative environment to sustain mission requirements. Construction services and finished products to be delivered on schedule, safely, and compliant with regulatory codes and standards.

Description of Work. Successful implementation of this contract requires the Contractor to make available and execute the following services, as associated with road maintenance:

removal, replacement, and repairs associated with roadway and airfield projects.

removal, replacement and repair of existing subgrade, utilities, shoulders, curbs, gutters, sidewalks, and other real property common to roadway and airfield pavements.

minor “new construction”, to include construction of new roads, new sidewalks, or new parking lots.

seeding operations based on the seeding season outlined in the KDOT Standard

Specifications Section 904 Table 904-1.

The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and non-personal services necessary to perform work on paving infrastructure as per this contract and incidental tasks related to successful implementation. The

Government shall not exercise any supervision or control over the subcontractors performing the construction herein. Such construction subcontractors shall be accountable solely to the

Contractor who, in turn is responsible to the Government.

1.1 GOVERNMENT SECURITY REQUIREMENTS

The Offeror(s) must ensure that ALL mail sent to the Mission and Installation Contracting

Command (MICC-FRKS), Fort Riley, KS, either pre-contract or post-contract award, has a return mailing address on the outside of the envelope, package, box, etc. ANY MAIL addressed to

MICC-FRKS, including but not limited to bids, modifications to bids, proposals, revised proposals, bonds, correspondence, etc., will be REJECTED by MICC-FRKS facility located at 1792 12th

Street, Fort Riley, KS. 66442, if it does not contain a return mailing address. There will be no exceptions.

This is an Invitation for Bids (IFB) in accordance with FAR part 14 and does not commit the

Government to pay, as a direct charge, any costs incurred in the preparation and submission of a bid.

1.6 PRE-BID CONFERENCE

The Government intends to hold the pre-bid conference. The date, location, and time will be announced by Amendment. The offeror must submit, via e-mail, the firm’s name, address, point of contact, telephone number, and number of personnel planning to attend to the following no later than two (2) working days prior to the conference:

1.7 SITE VISIT INFORMATION

All vendors are highly encouraged to attend the Site Visit which is scheduled for 12 July 2023 at

09:00 AM CST. Location: 1792 12th Street, Fort Riley, KS. 66442.

After the initial briefing at the Project Office, a site tour will be offered. The location and other details concerning the site visit are listed in FAR Clause 52.236.27 of this solicitation. See the clause for all the details to include the Point of Contact information.

1.8 ACCURACY IN PROPOSALS

Bids must set forth full, accurate, and complete information as required by this IFB, (including attachments). The penalty for making false statements is prescribed in 18 U.S.C. 1001.

Bidders must allow sufficient time to complete security screening to gain admittance to Fort

Riley, KS. The Government will not be responsible for bids delivered to any location or to anyone other than those designated to receive bids on its behalf. Bidders are responsible for ensuring bids are submitted so as to reach the location designated for receipt of bids.

1.10 BID CONTENT

Contract shall be awarded to the responsive/responsible prospective contractor considering only price. Before award, to be determined responsive, a prospective contractor must furnish the following information with their bid:

a. TAB A: Cover Sheet. Coversheet shall be on company letterhead and must contain your UEI, CAGE code, Tax ID, and authorized representative(s) who can obligate your company contractually, sign the bid, and sign, other contract actions; include telephone number with area code and complete email address(es) for each authorized representative. Failure to provide all of the above requirements shall render your bid nonresponsive.

b. TAB B: Signed and completed SF 1442 along with any amendments. The SF1442 shall be submitted fully completed. The Contractor shall acknowledge any amendments to the IFB in accordance with the instructions on the SF1442. All bidders are cautioned to complete blocks

20a-20c with an original signature in block 20b. Failure to provide all the above requirements shall render your bid nonresponsive.

c. TAB C: CLIN Price and Total Contract Amount. The Bidders shall provide pages 3 through 5 of the solicitation pricing each CLIN individually and include an OVERALL contract price with their bid. The OVERALL price shall equal the total of all CLINS when combined.

d. TAB D: Letter from Bonding Company. Letter must indicate the bidder’s ability to obtain performance and payment bonds. Failure to provide this letter shall render your bid as nonresponsive.

e. TAB E: Bid Bond Guarantee. Per FAR 52.228-1, failure to provide a bid bond guarantee per

FAR 52.228-1 shall render your bid nonresponsive.

1.12 JOINT VENTURE PROPOSAL REQUIREMENTS

Contractors proposing Joint Venture (JV) and/or Teaming Agreements (TA) shall submit a copy of the JV and/or TA with the specified Subcontractor to include the Subcontractor’s proposal.

The KO will validate with the SBA that the JV/TA Subcontractor is determined eligible for award under the size standard assigned to the contract.

1.13 WAGE DETERMINATION

Construction Wage Rates are applicable to this contract as shown in Section 00800.

1.14 BASIS OF AWARD / AWARD INFORMATION

As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) single award contract. This contract is an Indefinite Delivery/Indefinite Quantity with a Base plus four

1-year option periods.

In accordance to FAR 14.408-1(a), The contracting officer shall make a contract award:

(1) by written or electronic notice,

(2) within the time for acceptance specified in the bid or an extension (see 14.404-1(d)), and

(3) to that responsible bidder whose bid, conforming to the invitation, will be most advantageous to the Government, considering only price and the price-related factors (see 14.201-8) included in the invitation.

Award shall not be made until all required approvals have been obtained and the award otherwise conforms with 14.103-2.

1.15 DEVIATIONS AND EXCEPTIONS

Deviations and exceptions to the terms and conditions of the solicitation in either the technical or price proposal are neither encouraged nor desired. Should the offer include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the offer may be determined “unacceptable” and thus ineligible for award. Should the Offeror have any questions related to specific terms and conditions, these must be resolved prior to submission of the bid.

1.14 DISCLOSURE OF MAGITUDE

In Accordance with FAR 36-204 and DFARS 236.204, the Construction Cost magnitude for this project is between $25,000,000.00 and $100,000,000.00 which includes all design, non-design, and construction cost for the total contract award. Offerors are under no obligation to approach the maximum cost magnitude given above.

1.17 PLACE OF PERFORMANCE

The work to be placed under this contract is expected to be performed at Fort Riley, Kansas, 66442.

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance

Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the

Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than end of Period of Performance. The time stated for completion shall include final cleanup of the premises.

*The Contracting Officer shall specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)

(a) To be determined at the Task Order Level

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the

Termination clause.

52.214-18 PREPARATION OF BIDS--CONSTRUCTION (APR 1984)

(a) Bids must be (1) submitted on the forms furnished by the Government or on copies of those forms, and (2) manually signed. The person signing a bid must initial each erasure or change appearing on any bid form.

(b) The bid form may require bidders to submit bid prices for one or more items on various bases, including--

(1) Lump sum bidding;

(2) Alternate prices;

(3) Units of construction; or

(4) Any combination of subparagraphs (1) through (3) above.

(c) If the solicitation requires bidding on all items, failure to do so will disqualify the bid. If bidding on all items is not required, bidders should insert the words "no bid" in the space provided for any item on which no price is submitted.

(d) Alternate bids will not be considered unless this solicitation authorizes their submission.

52.216-18 ORDERING. (AUG 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 1 JUL 2023 through 30 JUN 2028.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when--

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either--

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the

Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2501.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor -

(1) Any order for a single item in excess of $2,000,000.00;

(2) Any order for a combination of items in excess of $2,500,000.00; or

(3) A series of orders from the same ordering office within 7 calendar days that together call for quantities exceeding the limitation in paragraph (b) (1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal

Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the

Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 calendar days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 INDEFINITE QUANTITY. (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".
