Question Number Document Document Reference Questions/Comments Answer/Response Date Received Date Posted 1 Solicitation Section L.4.1 Solicitation Section L.4.1 states that, for the Past Performance Factor, “The contracts provided (up to two (2)) can be any combination of minor or major construction projects as identified in L.4.1.2.” Section L.4.1.2 “Relevant Past Performance will consider the extent to which the submitted contract efforts are relevant to the statement of work paragraph 4.1 work areas and are comparable in scope and magnitude of effort and complexity to the following statement of work requirements:
i. minor construction projects for either Government or U.S. non‐residential buildings with a contract value between $50,000 to $100,000; or
ii. major construction projects for either Government or U.S. non‐residential buildings with a contract value greater than $100,000.
Our question is whether the Government’s evaluation of this factor will (a) consider proposals demonstrating recent and relevant past performance for BOTH minor and major construction projects more favorably than proposals presenting past performance for just 2 minor construction projects or 2 major construction projects.
Offerors can submit any combination of recent and relevant contracts (up to two) that fit the criteria listed at L.4.1(i) and (ii). Any combination of relevant past performance regardless of size will be evaluated the same.

2 Solicitation Section L.4.1 The 2nd paragraph of Section L.4.1 of the Solicitation discusses use of broad ordering instruments (e.g., IDIQ contracts, basic ordering agreements, etc.) for past performance.
IT would be greatly appreciated if you could clarify whether the Government will allow use of a broad ordering instrument with multiple task orders performed under it as a single “contract” for the purpose of evaluating past performance for the Solicitation.
The Government will not allow use of a broad ordering instrument with multiple task orders performed under it as a single contract. However, the offeror can provide a task order (which equates to 1 contract) that references the scope in the broader instrument. The offeror may supply the scope from the broader instrument with his task order for evaluation purposes.

3 Solicitation N/A I see an advertisement out for construction at the Watervliet Arsenal in New York. Would you be able to tell me if there is a specific bid opportunity for asphalt paving (Division 32) and if so could you provide the full request for proposals?
This is a solicitation for a Multiple Award Task Order Contract (MATOC) that will compete various Task Orders for various construction opportunities at Watervliet Arsenal. The Government will not be releasing the interested vendor information for this solicitation. All vendors will be evaluated in accordance with sections L & M of the Solicitation.

5 Solicitation Section L.5.1 In Section L5.1 you are referencing Fill‐ins for Sections A through K, I reviewed the SF1442 and those sections are not on there, are these additional attachments and if so can they be uploaded to the FBO site so we can get access to them.
Section L.5.1 has been amended as well as the the corresponding section in Attachment 0003.

6 Solicitation Section L.4.1 Section L.4.1 states that the contracts provided can be any combination of minor or major construction projects. Further section L.4.1.2 states that major construction projects with a contract value greater than $100,000.
Could you please clarify if the major construction projects should be under $1 million or $5 million.
Major construction projects are defined in L.4.1.2 as any construction project over $100,000.00.

9 Solicitation Section L.4.1.5 Solicitation Section L.4.1.5 requests that Past Performance Questionnaires (PPQs) be submitted using Solicitation Attachment 0002. It takes time for clients (including Federal Government clients) who provide past performance information for the Government for new procurements like the Watervliet MATOC. The format of this PPQ form (Attachment 0002) is slightly different than most other PPQ forms used by Department of Defense and other Federal Agencies. Can our clients submit a PPQ form previously submitted for other Department of Defense (DoD) proposals in lieu of Attachment 0002?
In accordance with L.4.1.5 Attachment 0002 will be the only Past Performance Questionnaire that is evaluated.

10 Solicitation Section L.4.1.5 Solicitation Section L.4.1.5 requests Offeror’s clients directly submit PPQs to the Contracting Officer for the Watervliet MATOC. We respectfully request that Offerors be allowed to provide PPQs previously submitted for other DoD procurements with our proposal for this solicitation instead of asking clients to submit the PPQs themselves.
Allowing Offerors to with certainty the PPQs are submitted and ensure the Government has more complete information to evaluate proposals.
In accordance with L.4.1.5 Attachment 0002 will be the only Past Performance Questionnaire that is evaluated.

11 Solicitation Section L.2.2.1.1 What is meant in Solicitation Section L.2.2.1.1 by the end of the sentence “Each page of the proposal shall be numbered, and each paragraph of the proposal shall have a reference number.”?
Each page of the offeror's proposal is to be numbered and each paragraph should have its own section number.

15 Solicitation SOW Section 2.1 Referencing the SOW 2.1, each task order will contain the required specifications, statement of work, drawings, attachments, and exhibits in order to successfully complete the task. Who furnishes this as part of the Task Order delivery – Govt or Contractor? Will there be any design‐build work solicited, or will it be plans and specs based on the solicited task order RFP requirements issued by the Government?

New subcontracting rules are spelled out in 52.219‐14 (DEV) allows for subcontracting to a similarly situated entity, and lays out the percentages that should be completed as self performed.

No, that was not noted at the site visit. It was noted that a pool of contractors will be chosen, and directly solicited. All parties will have fair opportunity to bid. All parties can watch the FBO website for additional opportunities, if desired.

The ordering procedure for each task order is detailed on Page 11, Paragraph 17 of the RFP. Specifically, Paragraph 17.2 states "The labor categories and their respective ceiling prices proposed within this contract’s Pricing Matrix (Attachment 0001) will be made a material part of the awarded IDIQ MATOC and shall be used to propose labor rates at the task order level. Additional labor categories that are not listed in the Pricing Matrix (Attachment 0001) may be added at the task order level as long as the rates proposed for said labor categories are commensurate with the pricing methodology used by the contractor to establish the labor rates for the labor categories contained within this contract’s Pricing Matrix (Attachment 0001).

30 Solicitation Attachment 0001 Are the hours for each classification listed on Attachment 0001 the maximum allotted for that trade that will allotted to each task order?
Per Section L.4.2.2.1.1 of the RFP, for evaluation purposes only, the Government has provided estimated labor hours for each labor category for each period. Therefore, the hours listed on Attachment 0001 are the estimated hours for that corresponding labor category on the respective "Ordering Period" worksheet. They are not maximum allotted hours.

31 Solicitation Attachment 0001 How do we account for general condition and overhead costs in the pricing data? Indirect labor costs such as labor overhead and G&A should be included in the offeror's proposed "Other Indirect Labor ($ per hour)" for each labor category.

32 Solicitation Attachment 0001 On the pricing matrix, should all equipment, tools, & misc. items be included in the labor rates?
Any costs for equipment, tools, & miscellaneous items that an offeror treats as an indirect cost should be included in "Other Indirect Labor ($ per hour)" or the Material "Indirect Rate (to include material handling, overhead, G&A, etc.)".
For purposes of the MATOC base award evaluation, the Government is not requesting offerors to propose costs for equipment, tools, & misc. items that an offeror will treat as a direct cost on future task orders. Future task orders will be competed amongst the MATOC base contract awardees, and direct costs for equipment, tools, & Misc. items required for an individual task order may be proposed by each offeror at the task order level.

33 Solicitation Attachment 0001 There is not a section for straight time vs. overtime; should we factor in overtime & double time rates in the labor rates
Per RFP Paragraph 17.2, "The labor categories and their respective ceiling prices proposed within this contract’s Pricing Matrix (Attachment 0001) will be made a material part of the awarded IDIQ MATOC and shall be used to propose labor rates at the task order level." Since Attachment 0001 calculates the offeror's ceiling rate for each labor category, overtime and double time should be factored into the offeror's proposed labor rates.
In addition, regarding uncompensated overtime (if proposed), please review section "L.4.2.2.4. ‐ Identification of Uncompensated Overtime:" of the solicitation, "State whether uncompensated overtime is being proposed. If it is being proposed, also provide the information required in FAR 52.237‐10 ‐‐ Identification of Uncompensated Overtime, to include a copy of its policy addressing uncompensated overtime. In accordance with FAR 37.115‐2(a), the use of uncompensated overtime is not encouraged."

35 Solicitation N/A Regarding the pricing, is the direct and fringes supposed to reflect subcontracted or burdened prime rates? Do the rates become the ceiling rates as described in the solicitation under L.4.2.2.1.2? How are the proposed rates to be evaluated?
Direct labor and fringe are mandated by the Davis Bacon Act. Regardless if the employee works directly for your organization or a subcontractor, they must receive the prescribed minimum direct labor and fringe dollars per hour. The labor rates in Attachment 0001 represent the maximum RATE you may propose during the task order competitions if you are awarded a base contract. Refer to Paragraph 17.2 of the RFP which states "The labor categories and their respective ceiling prices proposed within this contract’s Pricing Matrix (Attachment 0001) will be made a material part of the awarded IDIQ MATOC and shall be used to propose labor rates at the task order level. Additional labor categories that are not listed in the Pricing Matrix (Attachment 0001) may be added at the task order level as long as the rates proposed for said labor categories are commensurate with the pricing methodology used by the contractor to establish the labor rates for the labor categories contained within this contract’s Pricing Matrix (Attachment 0001)."

36 Solicitation L.4.1.3 Please clarify the difference between (e) Delivery or Performance Schedule and (k) Contract Period of Performance listed in L.4.1.3 of the solicitation.
Delivery or Performance Schedule is the schedule that corresponds to each individual task order and any deliveries that are required of that task order and the Contract Period of Performance is the amount of time that the contract is valid under which task orders may be placed.

37 Solicitation Attachment 0001 Attachment_0001 Pricing Matrix: Some of the Davis Bacon occupational codes are repeated on the matrix. Using occupational code LABO0190‐001 as an example, it appears twice on the matrix with differing amounts of estimated hours. Under LABO0190‐001 there are multiple groups listed with varying rates of pay. Without additional detail there is no way for us to know what group should be associated with each labor hour estimate.
Please provide additional detail for each of the occupational codes repeated on the matrix.
While the "Occupational Code or Position Description" in Column C may be the same for some of the labor categories, the "Direct Labor Category Description" in Column A is different for those categories. By looking at the "Occupational Code or Position Description" in Column C and the "Direct Labor Category Description" in Column A, offerors should be able to determine which labor category, Group (if applicable), and Zone (if applicable) is associated with which rate
