The U.S. Army Contracting Command (ACC) in Warren, MI proposes to release an Indefinite Delivery Indefinite Quantity (IDIQ), Multiple Award Task Order Contract (MATOC) Solicitation W911PT-19-R-0003 with a 5 year ordering period for a broad range of minor construction projects to support real property sustainment, restoration, modernization, repair and minor construction of buildings, structures and other real property at Watervliet Arsenal (WVA) in Watervliet, NY. The Government intends to award approximately seven (7) contracts to small businesses, as this is a 100% small business set-aside. This is an estimate only. The Government reserves the right to vary the number of awards depending on the number of responsive quotations submitted. The Government also reserves the right to utilize On/Off Ramps approximately two-and-one-half (2.5) years into the MATOC ordering period to maintain an optimal mix of prime contractors. These tasks are typical projects performed in a variety of trades including carpentry, road repair, roofing, excavation, interior electrical, exterior electrical, heating, ventilating, and air conditioning (HVAC), fire protection, telecommunications, steam fitting, plumbing, sheet metal, painting, demolition, concrete masonry and welding.
SOLICITATION FORMATTING: This solicitation utilizes a combination of both Construction Contract Format and the Uniform Contract Format. The Construction Contract Format references numerical sections and is used throughout this solicitation. Please note that some sections will reference both the alphabetical Uniform Contract Format letter, as well as the equivalent Construction Contract Format number. This has been added to provide additional clarity as sections are referenced.
SITE VISIT: A site visit will be held on 11 FEBRUARY 2019 at 9:30 AM local time, Watervliet, NY. Participants will meet at Bldg. 10, Watervliet Arsenal. Although not required, attendance is highly encouraged to afford offerors the opportunity to get familiarized with all aspects of this project. In order to gain access to the arsenal, site visit attendees must fill out and submit a Visitor Request Form (Attachment 0004) by email to erik.j.pakosz.civ@mail.mil and tyler.j.wonsowicz.civ@mail.mil. Visitor request forms must be submitted 48 hours prior to your arrival.
FILL-INS: Please note this solicitation contains fill-ins, so please be careful to read and complete each clause and provision.
PRICING MATRIX (Attachment 0001): Submit your completed Attachment 0001 with your proposal. Complete Attachment 0001 in accordance with the instructions included within the attachment. Submit the attachment in Microsoft Excel format. Do NOT enter any proposed prices into Section B of the RFP.
PAST PERFORMANCE QUESTIONNAIRE (Attachment 0002):
For each contract submitted by the offeror, the offeror shall send a copy of the past performance questionnaire directly to the appropriate Procurement Contracting Officer (PCO) and/or Contracting Officer Representative (COR) or other appropriate technical and contracting individuals. The offeror shall request these individuals complete the questionnaire and forward it electronically, directly to the Government at tyler.j.wonsowicz.civ@mail.mil as soon as possible and PRIOR TO THE RFP CLOSING DATE (see page 4 “RFP Closing Date Narrative”) with the subject heading “PAST PERFORMANCE INFORMATION FOR [Offeror name]”.
TYPE OF CONTRACT AND PAYMENT SCHEDULE: The task orders awarded against this IDIQ MATOC will be Firm-Fixed-Price (FFP). Each ordering period the task orders are awarded against will be 12 months long, totaling 60 months (5 years). The statement-of-work is included in this document in Section C.
INCONSISTENCIES: This Executive Summary has been prepared as an aid for potential offeror(s). We have made every attempt to accurately reflect the requirements and information contained in the balance of this solicitation. However, if you find any inconsistency between this executive summary and the solicitation, the solicitation takes precedence.
ON/OFF RAMPS: At any point during the MA IDIQ ordering period, ACC-WRN reserves the right to Off-Ramp a MA IDIQ prime contractor via Termination for the Convenience of the Government, mutual agreement between the Government and the contractor, based on a determination of non-responsibility or non-responsiveness. To maintain an optimal mix of prime contractors, ACC-WRN may conduct an Open Season approximately two-and one-half (2- 1/2) years into the MA IDIQ performance period during which new contractors may be added, via On-Ramping.

Ordering Limitations: The maximum order for a single item is $6,000,000.00 or $10,000,000.00 for a combination of items. The overall contract maximum for this requirement is $55.17M.
Contractual Minimum: In accordance with FAR Part 16.504(a)(2), the contractual minimum of this IDIQ MATOC is $3,000.00; CDRL A001: Safety Plan, listed under Exhibit A, will be submitted in order to receive the contractual minimum.

Section 00 10 00 - Solicitation
STATEMENT OF WORK
DESCRIPTION/SPECS/WORK STATEMENT
1. OBJECTIVE. This Multiple Award Task Order Contract (MATOC) will be used to execute a broad range of maintenance, repair, and minor construction projects at Watervliet Arsenal (WVA). This contract is intended to provide rapid response to remediation of real property (i.e. maintenance/repair/minor construction situations relating, but not limited to, the civil, mechanical, plumbing, structural, electrical, Heating Ventilation and Air Conditioning (HVAC), instrumentation, security and safety areas of Government and civil facilities) as well as new minor construction.
2. DESCRIPTION.
2.1. The contractor shall provide, upon receipt of an individual task order, all labor, materials, supplies, parts (to include system components), plant, supervision, equipment, and related services, (except when specified as Government furnished), to repair, construct, install, maintain military or civil real property facilities, structures, and equipment within WVA. Each task order will contain the required specifications, statement of work, drawings, attachments, and exhibits in order to successfully complete the task.
2.2. The work shall be conducted by the contractor in accordance with the contract and all applicable federal, state, and local laws, regulations, codes, or directives.
2.3. The contractor shall complete all work and services under this contract in accordance with schedules established in each task order. Submittal dates will be included in the task order. These dates identify when deliverables are due, types and numbers of deliverables and dates and places for review meetings shall be established by each task order.
2.4. The primary goal of this Indefinite Delivery Indefinite Quantity (IDIQ) MATOC is to meet the expedient acquisition of facilities engineering requirements, therefore contractor responsiveness is paramount. Once the Contracting Officer notifies the contractor of an existing requirement, the contractor shall expeditiously prepare the proposal. Upon notification of a routine task order requirement, the contractor shall respond to the Government within 5 business days as follows: (1) By visiting the proposed work site, accompanied by the Contracting Officer or Contracting Officer Representative (COR); or (2) By establishing verbal contact with the Contracting Officer or COR to further define the scope of the requirement. In the event of an emergency task order requirement, the contractor’s shortened response time shall be included in the Task Order Request. The contractor, or its designated representative who is able to make decisions and obligate the contractor, must be readily available to communicate with the Contracting Officer. For each task order requiring design, the contractor shall identify and provide qualifications for each design professional and supporting service provider that will be utilized for the design. Proposal may be rejected if qualifications are not acceptable. A two stage (technical then price) selection procedure may be utilized for a task order requiring design.
3. DEFINITIONS.
3.1. The following terms apply to this contract (the list is not all inclusive).
3.1.1. Site Survey. An inspection of a facility to evaluate areas which need remediation.
3.1.2. Feasibility Study. A study undertaken to determine the cost effectiveness of a proposed facility remedial action.
3.1.3. Work Plan. A detailed package consisting of single line diagrams, engineering calculations, criteria, manufacturers' data sheets, specifications, budget estimates, and other suitable details to remediate a facility.
3.1.4. Facility Remedial Project (FRP). A project undertaken to correct a situation identified from a site survey, feasibility study, or other sources.
3.1.5. Remediation Action. The action taken to implement a work plan (e.g., repair, renovation, new construction).
4. WORK AREAS
4.1. Commencing upon issuance of each individual task order, the work areas and contractor efforts may include a variety of trades such as civil, structural, HVAC, electrical, mechanical and architectural, incorporating general construction work such as demolition, earth work, grading, storm drainage, building construction, dam, concrete, paving, roadway, wet utilities, and fencing. Projects may include design for Design-Build execution.
4.2. Overall Responsibility. The contractor shall be responsible for all work as specified in each task order.
4.2.1. Codes and Standards. All codes and standard requirements shall be based on the latest edition of codes applicable at the time the task order is issued.
4.2.2. Documentation. The contractor shall implement, maintain, and control a system for identification, preparation, reproduction, distribution, and maintenance of all documentation, dates and information necessary for its internal management as well as for Government management of the individual projects and the total program.
4.2.3. Presentations and Meetings. Times and locations of presentations and meetings shall be identified in each individual task order via Contract Data Requirement Lists (CDRL) / Data Item Descriptions (DIDs).
4.2.4. Safety and Health Program. Site activities performed in conjunction with this program may pose safety hazards which require specialized expertise to effectively address and eliminate. The contractor shall be responsible for preparing and implementing an effective safety and health program, to include a generic site safety and health plan. This plan shall be capable of being adapted by means of a supplement to the main plan as required by each individual task order.
4.2.5. Quality Control Program. The contractor shall develop, implement, and document a quality control plan for the program. This quality control plan shall be submitted to the Contracting Officer for approval within 30 calendar days, or an agreed to shorter period, after contract award. This plan shall be capable of being adapted by means of a supplement to the main plan as required by each individual task order.
4.2.6. Permits. The contractor shall identify and obtain all permits from federal, state, local, or installation agencies as required by task order.
5. APPROVALS, RESPONSIBILITIES, QUALIFICATIONS FOR LABOR CATEGORIES\
5.1. Contractor Personnel: Contractor personnel performing work hereunder are employees of the contractor and are under its sole administrative control and supervision. Accordingly, the contractor shall select, assign, and provide direction to its employees performing work under all individual task orders awarded hereunder. The Government will not exercise any supervision or control over the contractor's employees in their performance.
5.2. Contractor Personnel Qualifications: The contractor shall utilize employees capable of achieving the requirements and meeting the minimum qualifications in accordance with each individual task order and aligning to each wage determination for Watervliet, NY (Albany County). All contractor personnel assigned to perform work hereunder shall meet the minimum qualifications and prevailing labor rates in accordance with the Service Contract Act (SCA) Wage Determination for Albany County, New York.
5.3. The Quality Control Site Officer and Safety Site Officer cannot be the same person.
6. SUBMITTED SURVEYS, STUDIES, PROPOSALS, AND WORK PLANS. All surveys, studies, proposals, and work plans submitted to the Contracting Officer will become the property of the Government.
7. ENVIRONMENTAL PROTECTION. The contractor shall perform all work in such a manner as to minimize the pollution of air, water, or land and to control noise and dust within reasonable limits and in accordance with federal, state, and local environmental laws.
8. ASBESTOS AND LEAD-BASED PAINT. When work is in areas suspected of containing asbestos or lead-based paint, the contractor shall notify the Contracting Officer immediately. If asbestos or lead-based paint are encountered during the course of a project, work shall cease immediately and the Contracting Officer shall be notified.
9. SITE SECURITY. The contractor shall provide site security (fencing, lighting, or guard services) as required by each task order. However, at a minimum, the contractor shall maintain the site and all other contractor-controlled areas in such a manner as to minimize the risk of theft, vandalism, injury, or accident. The contractor shall comply with site security regulations.
10. ACCIDENT REPORTS. The contractor shall comply with accident reporting requirements as outlined in the most current version of the U.S. Army Corps of Engineers, Safety and Health Requirements Manual EM 385- 1-1, which will be furnished by the Contracting Officer upon request. All accident reports shall be submitted to the Contracting Officer within the time limits prescribed.
11. PUBLIC AFFAIRS. The contractor shall not publicly disclose any data generated or reviewed under this contract. The contractor shall refer all requests for information concerning site conditions to the Contracting Officer for comment.
12. TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
12.1. This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the contract clause entitled "Default (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
12.1.1. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
12.1.2. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the contractor.
12.2. The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The contractor's progress schedule must reflect these anticipated adverse weather delays in all weather-dependent activities.

12.3. Throughout the contract the contractor will record on the daily report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the contractor's scheduled work day.
The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph (b), above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the contract clause entitled "Default (Fixed Price Construction)".
12.4. ENVIRONMENTAL LITIGATION:
12.4.1. If the performance of all or any part of the work is suspended, delayed, or interrupted due to an order of a court of competent jurisdiction as a result of environmental litigation, as defined below, the Contracting Officer, at the request of the contractor, shall determine whether the order is due in any part to the acts or omissions of the contractor or a subcontractor at any tier not required by the terms of this contract. If it is determined that the order is not due in any part to acts or omissions of the contractor or a subcontractor at any tier other than as required by the terms of this contract, such suspension, delay, or interruption shall be considered as if ordered by the Contracting Officer in the administration of this contract under the terms of the "Suspension of Work" clause of this contract. The period of such suspension, delay or interruption shall be considered unreasonable, and an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) as provided in that clause, subject to all the provisions thereof.
12.5. The term "environmental litigation", as used herein, means a lawsuit alleging that the work will have an adverse effect on the environment or that the Government has not duly considered, either substantively or procedurally, the effect of the work on the environment.
13. IDENTIFICATION OF EMPLOYEES:
13.1. WORK IN SECURE AREA: In the event that work is required in a secure area, the contractor shall obtain and submit through the COR to the WVA Physical Security Office fingerprints of all persons employed on the project in order to receive clearance to work in the area. Refer to applicable security clauses for additional specific requirements and procedures for obtaining employee identifications.
13.2. Clothing worn by all contractor employees shall comply with applicable health and safety provisions and shall not include any portion of past or present military uniforms. Official contractor logos and uniforms are permissible.
14. LANGUAGE: For each work group which employs individuals who do not speak English, the contractor will provide a bilingual onsite supervisor who is fluent in the English language and in the language of the workers.
15. CONTRACTING OFFICER REPRESENTATIVE: All technical matters relating to each individual task order, shall be communicated directly to the COR. The COR will be appointed by the Contracting Officer in writing and identified in each individual task order.
16. UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT PERSONNEL: The contractor shall not accept any instructions issued by any person employed by U.S. Government or otherwise, other than the Contracting Officer. No changes in the scope of work within each individual task order or within the scope of this contract, shall be made, except by a modification executed by the Contracting Officer only. The contractor is responsible to ensure all contractor personnel are knowledgeable and cognizant of the Contracting Officer’s authority. Work performed by contractor personnel outside of the scope of each individual task order, without authorization of the Contracting Officer, shall be the responsibility of the contractor.
17. ORDERING PROCEDURES FOR TASK ORDERS:
17.1. The fair opportunity provisions within FAR 16.505(b) will apply to all task orders issued against this contract throughout the five-year ordering period, unless an exception exists in accordance with FAR 16.505(b)(2).
17.2. The labor categories and their respective ceiling prices proposed within this contract’s Pricing Matrix (Attachment 0001) will be made a material part of the awarded IDIQ MATOC and shall be used to propose labor rates at the task order level. Additional labor categories that are not listed in the Pricing Matrix (Attachment 0001) may be added at the task order level as long as the rates proposed for said labor categories are commensurate with the pricing methodology used by the contractor to establish the labor rates for the labor categories contained within this contract’s Pricing Matrix (Attachment 0001).
17.3. The Government will establish evaluation criterion, tailored to the individual requirement, for all task orders solicited against this contract.
17.4. Task Orders issued against this contract will be awarded on a bilateral basis.
17.5. It should be realized by the contractor that unforeseen circumstances may prohibit the Government from issuing an individual task order even after the receipt of the contractor's bid or proposal; or after the task order proposals have been opened. If such circumstances arise, the Government is not obligated to reimburse the contractor for any costs incurred in the preparation of the task order bid/proposal, site visit for the contractor/subcontractors and related expenses.
18. COMMENCEMENT OF MOBILIZATION/WORK:
18.1. The contractor shall not commence any mobilization or familiarization until the Notice to Proceed has been issued by the Contracting Officer.
18.2. WITHIN 10 CALENDAR DAYS UPON NOTIFICATION OF AWARD OF THE TASK ORDER
THE CONTRACTOR SHALL: Submit Performance and Payment Bonds to the Contracting Officer.
18.3. WITHIN 5 BUSINESS DAYS OF ACCEPTANCE OF PERFORMANCE AND PAYMENT
BONDS THE CONTRACTOR SHALL: Meet with the COR to establish the agenda for the pre-construction conference.
19. PRE-CONSTRUCTION CONFERENCE:
19.1. Individual Task Order Conference: When determined appropriate by the COR, a conference will be conducted by the COR to acquaint the contractor with Government policies and procedures that are to be observed during the period of performance of the work and to develop a mutual understanding relative to the administration of the contract.

20. SCHEDULING WORK:
20.1. Before commencement of work under any task order, the contractor shall confer with the COR and agree on a sequence of procedures; means of access to premises and building; space for storage of materials, fixtures and equipment (excluding computers); delivery of materials and use of approach;
use of corridors, stairways, elevators; means of communications; location of partitions, eating spaces, and restrooms for contractor's employees.
20.2. When work is performed in occupied areas, furniture and portable office equipment in the immediate area shall be moved by the contractor and replaced to its original position. If the work required by the task order will not allow for replacing furniture and portable office equipment in its original location, the contractor shall place those items in new locations as assigned by the COR.
Delivery of materials and equipment shall be made with a minimum of interference to Government operations and personnel.
20.3. When detours or street closures are required either during regular duty hours or non-duty hours, the contractor shall notify the COR and the Contracting Officer, in writing, at least ten (10) calendar days in advance of the occurrence, describing the circumstances and requesting approval. Upon receipt of the written notice, the COR will coordinate with Base Security/Police and the Contracting Officer will provide approval to commence work. One lane of traffic shall be maintained at all times unless otherwise approved in writing by the Contracting Officer. The contractor shall be responsible for providing all necessary traffic control, such as street blockages, traffic cones, flagmen, as required for each task order at no additional cost to the Government. The final street repair shall be completed within 14 calendar days after the start of any street demolition for utility crossings or other purposes. Any part of the street returned to services prior to final repair shall be maintained smooth with hot-mix cold-lay surface course. The contractor’s proposed traffic control methods shall comply with the most current Uniform Traffic Control Device Manual and shall be submitted to the Contracting Officer for final approval.
20.4. At the end of each working day, the contractor shall notify the COR of the locations of work to be accomplished the following work day via daily inspection logs.
20.5. Unless otherwise indicated by special project phasing instructions, the contractor shall be prepared to pursue the contracted work during the contract normal working period of 7:00 A.M. - 4:00 P.M., Eastern Standard Time (EST), Monday through Friday, exclusive of recognized federal holidays outlined hereunder. Also, if a federal holiday falls on a Saturday, WVA will be closed on the Friday before, and if a federal holiday falls on a Sunday, WVA will be closed on the following Monday. If the 4th of July holiday falls on a Friday, WVA will be closed that Friday. The contractor will not be allowed to work during federal holidays, which are:
20.5.1. New Year’s Day - 1 January

20.5.3. President’s Day - 3rd Monday in February
20.5.4. Memorial Day - Last Monday in May
20.5.5. Independence Day - 4 July

20.5.9. Thanksgiving Day - 4th Thursday in November
20.5.10. Christmas Day - 25 December
20.6. If the contractor determines that work is required prior to or after normal working hours, then the contractor shall submit a written request to the Contracting Officer or their designee, through the Contracting Officer’s Representative (COR) for approval, no later than 72 hours prior to the work to be performed. All weekend requests shall be submitted to the Contracting Officer for approval no later than 72 hours prior to the weekend work that is to be performed. Should the contractor be required to perform work during other than normal hours, including Saturdays, Sundays and Government legal holidays, due to contractor and subcontractor delay, in order to maintain contract completion dates, the Government shall not be held liable for additional costs, unless other than normally working hours were agreed to in the individual task order.
20.7. Work which requires tapping into existing electrical, sewer, water, storm sewer, air lines, controls, alarms, telephone wires, shall be performed in a manner which causes minimum interference with Government operations.
20.8. Where possible, and as coordinated with the COR , interruptions to utility services in other than family housing areas, shall occur during a weekend or during other than regular working hours and shall be coordinated with the Contracting Officer.
20.9. When interruption of utility services is required, either during regular duty hours or non-duty hours, the contractor shall notify the COR and request written approval from the Contracting Officer, at least fourteen (14) calendar days in advance of the occurrence, describing the circumstances. The contractor shall be required to shut off and restore service unless otherwise directed by the Contracting Officer.
21. ENVIRONMENTAL PROTECTION:
21.1. Refrigerants shall not be discharged into the environment. The handling and management of all refrigerants and associated equipment shall be in accordance with all federal, state, and Army regulations.
21.2. Removal of refrigerants from existing refrigeration equipment shall be performed by trained and certified personnel utilizing recovery equipment that is approved by and registered with the EPA, and in accordance with applicable military specifications. A record of personnel training should be maintained during the life of the contract and consistent with contract terms.
21.3. Only EPA approved refrigerants and certified equipment shall be installed in all refrigeration and air conditioning equipment. A copy of the appropriate registration/certification must be provided though the COR before installing any new refrigeration equipment.
21.4. Any recovered refrigerant that is a Class I or Class II Ozone Depleting Substance (ODS) shall be turned in to WVA Environmental Division Air program through the COR. All recovered ODS shall be returned to the Army ODS reserve by WVA. Recovered ODS cannot be traded or sold. A tracking log for ODS recovered shall be provided.
21.5. All products and containers containing Class I or II ODS shall be labeled in a prominent and conspicuous place. The warning label shall include: WARNING: Contains [or Manufactured with, if applicable] [insert name of substance], a substance which harms public health and environment by destroying ozone in the upper atmosphere.
21.6. All refrigerants shall be properly removed from any refrigeration and air-conditioning equipment prior to disposal. The contractor shall provide evidence that all ODS refrigerants have been properly removed before disposal of the equipment.
21.7. The disposal of ODS containing equipment shall be processed through DRMO consistent with applicable regulations. Equipment disposal record shall be completed and provided through the
COR.
21.8. If recovered non-ODS refrigerants are shipped off-base, the contractor shall provide the names and addresses of the facilities to which the recovered refrigerant was sent.
21.9. The procurement or use of solvents that are Class I or Class II ODS is prohibited.
21.9.1. Contractor shall discharge gaseous contaminants so that they will be sufficiently diluted with fresh air to reduce their toxicity to an acceptable level.
21.9.2. Dilution is not an acceptable method for disposal of any contaminant. The following alternative language can be considered: "Contractor shall not discharge gaseous contaminants into the environment."
21.9.3. Liquid contaminants may, subject to local utility standards, be diluted with water to a level of quality acceptable in the local sewer system, or shall be disposed of in an approved vessel at approved sites.
21.10. All scrap, debris, non-hazardous class 1, 2 or 3 waste and any asbestos-containing materials resulting from operations under this contract shall be collected and removed off-site at contractor expense to a disposal site approved by WVA Environmental personnel. Removal shall be coordinated with the COR. Contractor shall provide WVA Environmental personnel with the disposal facility (landfill) name, EPA I.D#, transporter information and any other necessary information to properly transport and dispose of waste. Contractor shall be responsible for preparing all paperwork necessary for acceptance of materials into disposal facility (landfill) and provide WVA Environmental with all copies. WVA Environmental will sign all shipping documents used for waste disposition. Contractor must maintain compliance with all laws and regulations governing waste collection, storage and disposition.
21.11. Any hazardous waste, to include any fluorescent light tubes, mercury-containing light ballasts, thermostats and oxygen depleting substances that may be generated as a result from operations under this contract shall be collected in containers provided by WVA Environmental. Contractor shall turn over all full waste containers immediately to WVA Environmental for proper storage and disposition. Contractor shall be responsible for complying with all laws and regulations governing waste collection for hazardous waste.
21.12. Burning of Materials and Debris. No materials or debris shall be burned on Government property.
21.13. Covered Chutes. All chutes for contaminants, refuse, shall be covered or designed so as to fully confine the material to prevent the dissemination of dust.
21.14. The contractor shall coordinate all activities which may require environmental documentation or state environmental permits with the Installation Environmental and Natural Resources office prior to start of work.
22. CONSTRUCTION SITE MAINTENANCE: The contractor shall store all supplies and equipment at the location designated by the COR so as to preclude mechanical and climatic damage. The site shall be maintained in a neat and orderly manner in accordance with WVA regulations. Vehicles shall only be parked in areas designated by the COR.
23. NOISE CONTROL: The contractor shall comply with all applicable federal, state and local laws as well as WVA regulations and policies relative to noise control.
24. GOVERNMENT EQUIPMENT ON THE SITE: The contractor shall cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss; move and store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications. Equipment temporarily removed shall be protected, cleaned and replaced equal to its condition prior to starting work. Security for equipment or materials that is to be reused and is removed for temporary storage shall be the sole responsibility of the contractor.
25. TOILET FACILITIES: Contractor's personnel will be permitted to use toilet facilities as designated by the COR. Contractor personnel shall ensure facility cleanliness is maintained at all times. On those sites where no toilet facilities are available, the contractor shall provide their own portable chemical latrines at no additional cost to the Government.
26. SAFETY AND HEALTH:
26.1. This section is applicable to all work covered by this contract.
26.2. Definition of Hazardous Materials: Refer to hazardous and toxic materials/substances included in
Subparts H and Z of 29 CFR 1910, and to others as additionally defined in Fed. Std. 313. Those most commonly encountered include asbestos, polychlorinated biphenyls (PCBs), explosives, radioactive material, lead, and lead based paint, but may include others.
26.3. Asbestos
26.3.1. Asbestos-containing material (ACM) demolition may be required under this contract.
26.3.2. THE CONTRACTOR IS WARNED THAT EXPOSURE TO AIRBORNE ASBESTOS HAS
BEEN ASSOCIATED WITH FOUR DISEASES: LUNG CANCER, CERTAIN
GASTROINTESTINAL CANCERS, PLEURAL OR PERITONEAL MESOTHELIOMA AND
ASBESTOSIS. Studies indicate there are significantly increased health dangers to persons exposed to asbestos who smoke, and further, to family members and other persons who become indirectly exposed as a result of the exposed worker bringing asbestos-laden work clothing home to be laundered.
26.3.3. The contractor is advised that friable or non-friable asbestos-containing material may be encountered in area(s) where contract work is to be performed. Friable asbestos-containing material means any material that contains more than one percent asbestos by weight that hand pressure can crumble, pulverize or reduce to powder when dry. Non-friable asbestos-containing materials are materials in which asbestos fibers are bound by a matrix material, saturate, impregnant or coating. However, excessive fiber concentrations may be produced during uncontrolled abrading, sanding, drilling, cutting, machining, removal, demolition or other similar activities.
26.3.4. Care shall be taken to avoid releasing, or causing to be released, asbestos fibers into the atmosphere where they may be inhaled or ingested. The Occupational Safety and Health Administration (OSHA) has set standards at 29 CFR 1910.1002 and 29 CFR 1926.58 for exposure to airborne concentrations of asbestos fibers, methods of compliance, medical surveillance, housekeeping procedures and other measures that shall be taken when working with or around asbestos-containing materials. The Environmental Protection Agency (EPA) has established standards at 49 CFR 61.140-156 for the control of asbestos emissions to the environment and the handling and disposal of asbestos wastes.
26.3.5. Use of friable asbestos-containing materials is not permitted by current criteria and shall not be used in new construction or modification projects (ETL 1110-1-118, 27 May 1983). Plans and specifications for all new construction and modification projects will be reviewed to ensure that the use of friable asbestos-containing materials is not specified.
26.3.6. Maintenance, modification, or demolition activities where exposure to asbestos dust may occur from previously installed friable or non-friable asbestos-containing material shall be identified. All precautions, to include proper work practices, medical surveillance, respiratory protection, industrial hygiene, and environmental protection requirements of OSHA, EPA (40 CFR 61.140-
156) and DA Circular 40-83-4, as applicable, shall be strictly adhered to.
26.4. Lead-Based Paint: The contractor shall report any findings of suspected lead or lead-based paint to the COR before starting work. Lead-based paint removal and disposal may be required under this contract.
27. SAFETY ASSURANCE
27.1. Pre-construction Safety Meeting: Representatives of the contractor shall meet with the COR prior to the start of repair, alteration or construction activities for the purpose of reviewing the contractor's safety and health programs and discussing implementation of all safety and health provisions pertinent to the work to be performed under the contract.
27.1.1. This meeting shall be held in conjunction with the pre-construction conference. The level of detail for the safety meeting is dependent upon the nature of the work and the potential inherent hazards.
27.1.2. The contractor's on-site representative(s) shall attend this meeting. The contractor shall be prepared to discuss, in detail, the measures he/she intends to take in order to control any unsafe or unhealthy conditions associated with the work to be performed under the contract.
27.2. Compliance with Regulations: All work, including the handling of hazardous materials or the disturbance or dismantling of structures containing hazardous materials shall comply with Department of Labor, OSHA requirements found in 29 CFR 1910 and 29 CFR 1926, project identified national standards, military manuals, instructions, pamphlets, standards and handbooks, and with USACE Safety Manual EM 385-1-1. All work shall comply with the most current federal, state and local regulations at time of each individual task order award.
27.3. Work involving the disturbance or dismantling of asbestos, asbestos-containing materials or lead-based paint; the demolition of structures containing asbestos or lead-based paint; or the disposal and removal of asbestos or lead-based paint, shall be reported to the Contracting Officer and the COR before starting work.
27.4. Contractor Responsibility:
27.4.1. The contractor shall assume full responsibility and liability for compliance with all applicable regulations pertaining to the health and safety of personnel during the execution of work, and shall not hold the Government liable for any action on its part or that of its employees or subcontractors, which results in illness, injury or death.
27.4.2. The contractor shall furnish to the COR a complete accident prevention plan, including a hazard analysis of all operations to be performed by construction trade. The hazard analysis shall be updated and submitted to the COR on an ongoing basis as required per each individual task order.
The hazard analysis plan and accident prevention plan documentation shall be provided to the COR for submission to the Installation Occupational Safety and Health Office, for approval prior to start of contractual operations.
27.4.3. All temporary construction electrical systems shall be equipped with ground fault circuit interrupter (GFCI) protection.
27.4.4. Contractor shall have a hearing conservation program in force when the noise level is 85dBA or greater.
27.4.5. Contractor shall have a hazardous communication (HAZCOM) program in force and have his personnel trained in the HAZCOM program. Contractor shall maintain up-to-date material safety data sheet (MSDS) files on site in addition to having on site a written copy of the firm's HAZCOM program.
27.4.6. The contractor shall report any accidents and injuries occurring on WVA to the Contracting Officer and COR within 24 hours. Emergencies, deaths, and major accidents shall be reported to telephone number 911, Contracting Officer and COR immediately.
27.5. Inspections, Tests, and Reports: The required inspections, tests, and reports made by the contractor, subcontractors, specially trained technicians, equipment manufacturers, and others as required by each individual task order, shall be furnished in accordance with the terms of each individual task
27.6. Materials and Equipment: Special facilities, devices, equipment, clothing, and similar items (such as hard hats, breathing apparatus, traffic barriers) used by the contractor in the execution of work shall comply with the applicable regulations. Materials and equipment shall be provided at no additional cost to the Government.
27.7. All companies who conduct business within the state of New York must, in accordance with New York Worker Compensation laws, have an approved company safety policy and an Accident Presentation Plan. The plan shall be submitted to the COR.
27.8. Information Only (FIO) in accordance with SUBMITTAL PROCEDURES. In addition to meeting the TWCC requirements; the plan must also include the requirements of USACE Safety Manual EM 385-1-1.
27.9. All holes, pits, trenches, and manway openings that are to be left open shall be surrounded with a 48 inch high mesh fence with highly visible orange plastic coating. The fence shall be so anchored as to prevent sagging and located a minimum of 3 feet from the opening so as to prevent an individual, should he or she fall across the fencing, from falling into the opening. Holes shall also be covered, when not being worked in, with three quarter inch plywood or a metal grating that will prevent small children from entering the hole.
27.10. Confined Space Entry, reference 29 CFR 1910.146 and all OSHA standards apply to this contract.
