PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

FOR

Servicing of Waste Water Tanks and Systems

1.0. General:

1.1 Scope: The Contractor shall provide all personnel, equipment, tools, materials, supervision, quality control and other items and non-personal services necessary to perform, plan, schedule, coordinate and assure effective performance in the servicing of waste water tanks and systems. Servicing will include pumping approximately 3 grease pits, approximately 24 septic tanks, approximately 13 holding tanks, approximately 30 porta-pots, approximately 2 mobile trailer units, approximately 9 Telecommunications (TCC) manholes, miscellaneous and emergency pumping services, rental/purchasing of additional porta-pots, and clearing waste water lines at Letterkenny Army Depot as described herein; as defined in this PWS, except as specified in Paragraph 3.0 as Government Furnished. The Contractor shall perform to the standards in this contract.

1.2 Background: LEAD does not have the means for the pumping of holding/sewage/grease tanks and port-a-pots located across the Depot.

1.3 Period of Performance (PoP): The Period of Performance shall be one Base Year of 12 months and four 12-month option years. The Period of Performance reads as follows:

1.3.1 Base Year: 1 February 2018 to 31 January 2019

1.3.2 Option Year One: 1 February 2019 to 31 January 2020

1.3.3 Option Year Two: 1 February 2020 to 31 January 2021

1.3.4 Option Year Three: 1 February 2021 to 31 January 2022

1.3.5 Option Year Four: 1 February 2022 to 31 January 2023

1.4 General Information:

1.4.1 Quality Control (QC): The Contractor is responsible for contract performance quality control and shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The Contractor shall be required to establish an inspection system that develops and implements procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QC program is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the Contractor shall develop QC procedures that address the areas identified in Technical Exhibit 1, Performance Requirements Summary. After acceptance of the QC Plan, the Contractor shall obtain the KO’s (KO) acceptance in writing of any proposed changes to its QC system. The program will be submitted to the KO/COR by email within 60 days of contract award.

1.4.1.1. The plan will include but not be limited to:

1.4.1.1.1. An inspection system covering the services stated in applicable sections 5.0 – 5.8 of the PWS and Section 2.0, Definitions. It must specify areas to be inspected on either a scheduled or unscheduled basis, how often inspections will be accomplished and the title of the individuals who will perform the inspections.

1.4.1.1.2. The methods for identifying deficiencies in the quality of services performed before the level of performance is unacceptable.

1.4.1.1.3. A file of all inspections conducted by the Contractor and the corrective actions taken. This documentation will be made available to the Government during the term of the contract.

1.4.1.2. Contractor’s Sole Responsibility: The Contractor is solely responsible for the quality of all contract deliverables and shall perform services and develop products by referring to their QAQC to assure service and product quality.

1.4.1.3. The Government will monitor the Contractor's performance. The Government reserves the option to implement whatever surveillance plan it considers appropriate, and to modify that plan as applicable. Government personnel will record all surveillance observations. The Contracting Officer's Representative (COR) will maintain a file of all inspection results. Government surveillance of tasks not listed in the performance requirements summary or by methods other than those listed in the performance requirements summary may occur during the performance period of this contract. Such surveillance will be done according to standard inspection procedures or other contract provisions. If the services are found to be defective in workmanship or otherwise not in conformity with the specifications and requirements, the Government will have the right to reject such service and the work will then be performed in an efficient and workmanlike manner without additional cost to the Government. Reoccurring incidences of unsatisfactory performance of any required service may result in appropriate action by the KO in accordance with the Inspection of Services clause(s). Quality control under this section will apply to all task orders awarded under this contract. The verbiage of the task order may require additional quality control requirements above and beyond those mentioned in the base contract.

1.4.1.4. Government inspection personnel will monitor the Contractor's performance by physical inspection, review of reports/documentation and validated customer complaints.

1.4.2. Quality Assurance (QA): The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) (defect rate(s)).

1.4.2.1. Inspection: Each phase of the services rendered is subject to Government inspection during the Contractor's operation and/or after the completion of the task. Any defective or unaccomplished work will be brought to the attention of the Contractor by the Contracting Officer or his authorized representative. The Contractor must re-perform when possible all defective work before payment is submitted.

1.4.2.2. The Contractor shall be allowed twenty-four (24) hours from time of notification to correct the deficiency (customer complaint) without deduction. If the Contractor does not respond within the time limit or does not re-perform the service satisfactorily, these discrepancies will be considered as omitted or unsatisfactorily performed.

1.4.2.3. The Contractor's invoice will be reduced by 5% of the final service invoice price for every 5 days the task is not complete for any or all areas that work was not properly re-performed. This may also be reason for default. This will be monitored by the COR or Contracting Officer. Deductions to invoiced amounts due to lack of contract compliance on behalf of the Contractor shall require approval by the KO. Invoiced amounts for services that have not been rendered or have been rendered but are not in compliance with the standards set forth within this PWS will not be paid.

1.4.2.4. Interference with Government Operation: The Contractor and the Contractor’s employees shall perform all work in such a manner as to avoid interference with regularly scheduled government operational activities.

1.4.2.5. Service Cooperation: The Contractor shall cooperate fully with the COR to accomplish work in support of the Depot and its assigned mission. In order to fulfill the intent of the contract, the Contractor must be flexible in meeting changing requirements and priorities. The Government reserves the right to reprioritize the work to be done under the contract in order to meet changing needs and requirements, so long as such changes are within the services to be provided by the Contractor. Any such changes will be performed at no additional cost for the services rendered.

1.4.2.6. Losses or Damages Caused by the Contractor: The Contractor agrees to save harmless the Government from any claims for damage to property, bodily injury, or death resulting from activities of the Contractor, his agents, servants, and employees. The Contractor shall be held accountable and liable to the Government for any damages to, but not limited to government facilities, fixtures, furnishings, equipment, telephone pedestals, electrical apparatus or grounds caused by the Contractor or his employees. The Contractor shall verbally notify the KO or COR immediately following any occurrences. The Contractor shall submit to the Contracting Officer or COR within twenty-four (24) hours following occurrences of any such damage, loss or injury, a complete report of the incident.

1.4.2.7. Accident Prevention: In order to provide safety controls for protection to the life and health of employees and other persons; for prevention of damage to property, materials, supplies, and equipment; and to avoid work interruptions in the performance of this contract, the Contractor shall comply with all pertinent provisions of the Army's safety regulations and shall also take or cause to be taken such additional measures as the Contracting Officer may determine to be reasonably necessary for the purpose.

1.4.2.7.1. The Contractor shall report serious accidents and incidents incurred while performing work under this contract immediately by the most expeditious means possible, but not more than one hour following the accident or incident to the Directorate of Emergency Services, the Safety Office, COR and Contracting Officer. Serious accidents and incidents include, but are not limited to, those defined in AR 385-10 and AR 190-40 respectively or referenced in other applicable directives. Examples are as follows: One or more lives lost, one or more persons critically injured, three or more persons hospitalized due to one incident, property damage estimated to exceed $2,000, fire causing major damage to structures, equipment, or vehicles, and HAZMAT, hazardous substances, and HAZWASTE incidents. Immediately after a job-connected injury, the Contractor shall prepare a record of the incident/accident and forward it by email to the COR. The COR will forward the incident/accident report to the Command Safety Office. If more information is required the Command Safety office will coordinate with the COR for the required information. If the Contracting Officer notifies the Contractor of any noncompliance with foregoing provisions and the action to be taken, the Contractor shall, after receipt of notice, immediately correct the deficiencies. Such notice when delivered to the Contractor or his representative at the site of work will be deemed sufficient for this purpose. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping payment on work performed under this contract until satisfactory corrective action has been taken.
