About this file

This document is an addendum to FAR 52.212-2 outlining the evaluation criteria and basis of award for a commercial items solicitation. The Government will award one Firm Fixed Price contract for the complete scope of work specified in the Performance Work Statement, with quotes covering fewer items or services deemed ineligible. Evaluation will occur without interchanges unless deemed necessary by the Contracting Officer, and offerors should submit their best terms initially.

Quotes will be evaluated on two primary factors: (1) Technical, rated as acceptable or unacceptable, which includes Sub-Factor 1 (Technical Capability) requiring demonstration of adequate staffing, skill sets, resources, and ability to meet all PWS-specified production requirements, deliverables, timelines, and performance standards, and Sub-Factor 2 (Local Source Eligibility/SOFA Compliance) requiring verification of ROK licensing and authorization to perform as a local Korean contractor; and (2) Past Performance, also rated acceptable or unacceptable, based on recent and relevant experience in shower trailer service within the past five years, with unknown performance records considered acceptable. A third factor addresses price reasonableness. Offerors without relevant past performance records will receive a neutral rating treated as acceptable, while those demonstrating an inability to perform successfully will be rated unacceptable.

Addendum to FAR 52.212-2 Evaluation – Commercial Items

Basis of Award: This source selection follows the procedures outlined in the Federal Acquisition Regulation. Offers will be evaluated based on criteria outlined in ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS -COMMERCIAL ITEMS. The Government will base the award decision on price and other factors. Noncompliance with the Request for Quote (RFQ) requirements may hinder the Government's ability to properly assess the quote, potentially leading to its elimination from further consideration for contract award.

Award for the Entirety of the Work: The Government intends to award one Firm Fixed Price (FFP) contract based on the complete specifications in the Performance Work Statement (PWS). Quotes that include fewer items or work than those listed in the specifications will be deemed ineligible for award. The Government plans to evaluate and award the contract without interchanges with contractors. Therefore, contractors should submit their quote best terms in their initial, considering both price and technical aspects. However, the Government reserves the right to conduct interchanges in if quote deemed necessary by the Contracting Officer.

Evaluation Criteria: Quotes will be evaluated based on two factors and will be applied in accordance with the Performance Work Statement (PWS):

FACTOR I - TECHNICAL: The quote shall be evaluated to determine the offeror's ability and technical approach to satisfactorily accomplish the quote Government's intent and achieve the desired quality end-products. A demonstration of an adequate understanding and approach to meeting the quote requirements will be deemed technically acceptable. If an offeror fails to meet the minimum requirements outlined in one of the two (2) subfactors below, the subfactor, and overall quote will be rated "unacceptable" and will not be eligible for award

Sub-Factor 1: Technical Capability: The Contractor shall demonstrate the capability to perform all required tasks in accordance with the Performance Work Statement (PWS), including meeting the specified period of performance, required number of deliverables or products, and the type and scope of services identified. The Contractor shall provide a clear and detailed statement describing its ability to meet these requirements.

The technical approach shall demonstrate the Contractor’s ability to successfully perform all requirements identified in the Performance Work Statement (PWS). The approach shall clearly show how the Contractor will meet the specific tasks, deliverables, service levels, and timelines prescribed in the PWS. At a minimum, the technical approach shall demonstrate the ability to:

a. Execute each PWS task using staffing levels, skill sets, and technical resources that directly align with the workload, complexity, and operational tempo described in the PWS.

b. Meet all PWS‑specified production or service output requirements, including the required number of products, deliverables, or service actions, and maintain compliance with all performance standards, metrics, and quality thresholds identified in the PWS.

c. Perform the exact type of service required under the contract, showing a clear understanding of the PWS’s functional requirements, technical processes, dependencies, and performance constraints.

d. Sustain performance throughout the contract period of performance by employing infrastructure, tools, systems, and management processes that directly support the PWS’s operational demands, reporting requirements, and continuity expectations.

The technical approach shall provide sufficient detail to allow the Government to assess the Contractor’s ability to meet each PWS requirement, demonstrating feasibility, reliability, and a clear understanding of the scope and performance expectations.

Sub-Factor 2: Local Source Eligibility (SOFA Compliance): The Offeror shall demonstrate compliance with ROK licensing requirements and eligibility to perform as a local Korean contractor, in accordance with the US-ROK SOFA. Offerors must provide verification of authorization and capacity to perform as a local source.

FACTOR II - PAST PERFORMANCE: Past performance shall be evaluated on an acceptable/unacceptable basis. Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided.

The offeror shall provide recent and relevant past performance in shower trailer service in criminal litigation. Recent past performance is within the last five (5) years from the issuance date of this solicitation. Relevant past performance are those that are the “same or similar” services based on size, scope, complexity, and contract type.

The past performance will be evaluated for all offeror’s quotes by the Contract Specialist/ Contracting Officer in the following manner:

a. Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.

b. References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.

c. The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability / unacceptability, a neutral rating shall be considered “acceptable.”
