SUMMARY OF CHANGES
A. The purpose of this amendment is to change PWS paragraph 1.14.1.1, Business Block 14 (Description of Amendment/Modification):
Registration, to read "Manufacturing/Processing/Repairing of Machine/Equipment."
B. Section L has been revised to have the experience requirements match Section M with "2 years of experience in Hoists and Cranes over the last 8 years." See Bold Type in Section L.
C. Section M, Factor A Technical, Sub-Factor 2 has been changed to read "Business Registration, to read "Manufacturing/Processing/Repairing of Machine/Equipment."
D. A revised PWS is attached to this modification.
E. The closing date remains unchanged on 27 March 2024.
Instructions, Conditions, & Notices to Offerors or Quoters
Miscellaneous text in this section has been modified to:
1. CONTRACT AWARD
1.1. The Government intends to execute a single contract with Finn Fixed Price (FFP) CLINs and Requirements CLINs for FFP task orders for Hoist and Crane Services for 8th CES, Kunsan Air Base. A ward will be made using source selection procedures in accordance with Federal Acquisition Regulation (FAR) Part 12 "Acquisition of Commercial Items" and in conjunction with the policies and procedures prescribed in FAR 13 .5" as appropriate and the Department of Defense Source Selection Procedures and Army Source Selection Supplement. This acquisition will be conducted using the LPTA process; therefore, award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. In order to be considered for award, there must be an "acceptable" rating in every non- price factor/sub-factor. In other words, a rating of "unacceptable" for any factor or sub-factor will result in the entire offer being rated "unacceptable".
1.2. In accordance with FAR 15. 101-2 Lowest Priced Technically Acceptable source selection process, the Government reserves the right, based on the Government's best interests, to make a determination to: 1) award without discussions; 2) make a single award for this requirement; 3) Establish a competitive range in order to conduct discussions. The Government retains the right to limit the competitive range to the "most highly rated proposals" for the purpose of efficiency"; and/or 4) make no award if, upon evaluation, none of the proposals are deemed likely to meet the requirements.
2. SUBMISSION REQUIRMENT:
Offerors are required to submit the following information to by email to d.s.estes.civ@army.mil no later than by 1530 hours Local Time on RFP closing date. Award be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standard non-cost factors.
The Government intends to evaluate and make award without discussion with the offerors (other than minor clarifications), unless discussions are determined to be necessary. If discussions are determined to be necessary the Contracting Officer reserves the right to limit the competitive range for the purposes of efficiency.
FACTOR A-TECHNICAL
Subfactor 1 Contractor's Prior Experience: The offeror shall submit documentation demonstrating a from the issuance date of this solicitation inminimum of (2) years of experience in the last (8) years
Maintenance and Repair of Hoist and Crane. The offeror shall provide evidence of prior experience in the following format:
The title of the Project or Contract No. for the Commercial or Government requirement.

Complete POC of employer (including name, phone no, and e-mail) and validating POC.
Subfactor 2 Contractor's Business Registration/License: The offeror shall submit documentation that demonstrates a current and valid Business Registration issued by the ROK Government. In the case where a subcontractor(s) is used, the of submit documentation that demonstrates a subcontract agreement with the company or companies who possess required license permission.
Subfactor 3 Personnel Qualification: The offeror shall submit an individual (Personal) resume for each proposed titles listed below paragraph in paragraph (a) through (b): A resume for each personnel must clearly identify following format:

(a) Contract Manager (CM): The offeror shall submit a resume that demonstrates that proposed CM have a minimum of from the solicitation issuance date, in Hoist and Crane maintenance and repair two (2) years of experience in the last (8) years or similar scope of work.
(b) Technician (s): The Offeror shall submit resume that demonstrates that the proposed technicians are qualified personnel who have at least (2) years of experience in installation, maintenance and from the solicitation issuancerepair of Hoist and Crane within the past eight (8) years date.
FACTOR B - PAST PERFORMANCE
The offeror shall provide a list of contracts under which they have performed Hoist and Crane maintenance and repair or similar services to this RFP's requirement within the last from the issuance date of this solicitation. This data on recent contracts will be used by the Contracting Officer to evaluate past eight (8) years performance. The offerors shall present past performance for themselves whose effort on this contract will significantly influence performance of the proposed effort. The following information shall be included as applicable:

FACTOR C - PRICE
(a) The offeror shall provide complete CLINs/ELINS identified for base period plus four (4) options. Any underlying assumption including proposed escalation rates between the 1st and subsequent periods shall be explained. Proposed price will be reviewed to determine if the proposal is adequate, complete, and reasonable to assess that the offeror understands of the solicitation.
The price proposal shall set forth a summary of the total proposed price for the base year and each option years of the proposed price of each CLINS /ELINS in excel sheet.
If offeror does not propose any CLIN/ELINS, offeror shall state zero (0) in the CLIN/ELINS
(b) Proposed Prices - Proposed prices will be evaluated to determine if the estimate is complete, realistic, reasonable and balance and has no unbalanced to assess the offeror's understanding of the solicitation. Any inconsistency, whether real or apparent between proposed performance and price, must be clearly explained. For example, if unique and innovative approaches are the basis for an abnormally Iow estimate, the nature of these approaches and their impact must be completely documented.
Specific Price Proposal Instructions: Offerors shall provide a proposal to include:
(I) Schedule of Services (CLINS) and ELINS of the RFP for the base period and four (4) option years in excel sheet.
(2) Prices shall be in local currency (Korean Won). If there is no proposed price, offeror shall put zero "0" if the CLINS. If offeror does not put any amount, the offeror's proposal is incomplete. Incomplete proposal will not be accepted.
(3) Any escalation in option year pricing shall be identified.
(4) The offerors shall round all prices to the nearest whole Korean Won thereby eliminating the use of decimal points.
3. COMPLETION OF PROVISIONS/CLAUSES:
Offeror(s) shall fill out the following FAR or local clauses and submit as the final part of the price proposal.
(1) 52.212-3, Alt I, Offeror Representations and Certifications--Commercial Items Alternate I.
(April 2016
(2) 5152.204-4032, Representations and Certifications including POL Estimate.
(3) Offeror's status as a Korean contractor:
(a) An offeror that does not have a "Parent" will submit 2 documents to establish that the offeror is Korean Contractor: 1) Offeror's Certified Copy of Register, and 2) Offeror's Stock Change Certificate.
(b) An offeror that does have a "Parent" will submit 3 documents to establish that the offeror is a Korean Contractor: 1) Offeror's Certified Copy of Register, 2) Offeror's Stock Change Certificate, and 3) Parent's Certified Copy of Register.
Failure to submit the above requirements may be grounds for determining the proposal to be non-compliant not eligible to be considered for award.
4. Signed Solicitation and Amendments: Signed first page of the solicitation (SF1449) and each amendment (SF30) (if any amendment were issued)

5. General Instructions for Preparation of Proposal
(1) Offerors are required to submit proposals electronically in response to this solicitation in the following: FACTOR A Technical:

(3) POINT OF CONTACT: Offeror shall provide the Name(s), office/mobile telephone numbers, and e-mail address of person(s) authorized to conduct discussions/negotiations and to financially bind the company.
(4) Contract References to "Day": Unless otherwise stated herein, all references to 'day" shall be interpreted to mean 'calendar day'.
6. SITE VISIT and PRE-PROPOSAL CONFERENCE
(1) Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the price of contract performance extent that the information is reasonably obtainable.
In no event shall failure to inspect the site constitute gr for a claim after contract award.
(2) Offeror shall submit the following information to SSgt Darien B. Malkow-Dunham, darien.malkow-dunham@us.af.mil for temporary access. After sending E-mail, offerors shall confirm with SSgt Malkow-Dunham at 063-470-8789 (Commercial) whether your email has been delivered to his e-mail account.

7. PRE-AW ARD SURVEY
A pre-award survey may be conducted on all firms, to include joint venture partners and subcontractors indicating firm commitments to this acquisition, submitting proposals. The pre-award survey is to determine the prospective contractor's responsibility in accordance with FAR Part 9.104-1. Firms found not responsible during pre-award survey, will not be eligible for award.
Information may be requested as required by the Contracting Officer and the information shall be submitted within three working days of the request.
NOTE: The proposals are intended to be evaluated, and award made, without discussions with the offerors (other than minor clarifications) unless discussions are later determined to be necessary.

Evaluation Factors for Award
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The following factors shall be used to evaluate offers:
Award will be made to the responsible offeror submitting the Lowest Priced, Technically Acceptable (LPTA) offer that satisfies all terms and conditions of this solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/sub-factors. All non-price factors and sub-factors will be rated as either "acceptable" or "unacceptable". In order to be considered for award, there must be an "acceptable" rating in every non-price factor/sub-factor. In other words, a rating of "unacceptable" for any factor or subfactor will result in the entire offer being rated "unacceptable".

The following ratings will be used in evaluating all non-price factors and sub-factors except Past Performance
Each factor and sub factor will be rated either acceptable or unacceptable. A rating of unacceptable for any fa sub factor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements in one of the three sub-factors below, the sub-factor, and overall proposal will be rated "unacceptable" and will be eligible for award.
FACTOR A Technical Sub-factor 1 Contractor's Prior Experience: The contractor shall be evaluated on submitted documentation demonstrating a minimum of two (2) years of verifiable experience within the last eight
(8) years from the issuance date of the solicitation for Hoist and Crane.
The Offeror shall submit evidence of prior experience in the following format.
The title of the contract/project for the commercial or government requirement
A clear description of qualifying work experience
Length of contract/project (From year/month/date- To: year/month/date)
Value of contract/ project in KW for total amount
Complete Point of Contact of employees (including, name, phone no. and e-mail) and validating Purchase Order.
Subfactor 2 - Contractor's Business Registration/License: The Contractor shall possess and maintain a current and valid Business Registration which include the following kind of business: issued by Nation Tax Service, ROK.Manufacturing/Processing/Repairing of Machine/Equipment
Subfactor 3- Personnel Qualification: The offeror shall be evaluated on submitted individual (Personal) resumes for each position title listed in the paragraphs (a) and (b) below. A resume for each personnel must clearly identify in the following format:

(a). Contract Manager (CM): The offeror shall be evaluated on submitted resume that demonstrates that the proposed CM have a minimum of two (2) years of experience as a CM within the last eight (8) years from the solicitation issuance date, in Hoist and Crane maintenance and repair or similar scope of work.
(b). Technician(s). The Offeror shall be evaluated on their submitted resume that demonstrates that the proposed technician(s) has two (2) years of experiences within the past eight (8) years from the solicitation issuance date in installation, maintenance and repair of Hoist and Crane.
FACTOR B PAST PERFORMANCE
The offeror shall have recent and relevant past performance in Hoist and Crane services or similar services. Recent past performance is within the last eight (8) years as of the opening date of the solicitation. Relevant past performance are those that are the "same or similar" services based on size, scope, complexity, and contract type.
The past performance will be evaluated for all offeror's proposals by the Contract Specialist/Contracting Officer the following manner:
(1) Review of the detailed explanation submitted by offerors demonstrating the relevance of the reference the requirements of the solicitation.
(2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance. The offeror shall past performance information on past or current contracts (including Federal/local Government and private efforts that are the same or similar to the Government's requirement during the past eight (8) years. Offer authorized to provide information on problems encountered on the identified contracts and the offeror's corrective actions. The offeror shall describe its past performance on contract it has held which are of similar scope and magnitude to that which is detailed in the solicitation. A maximum of three (3) references will be evaluated.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on pa performance is not available or so sparse that no meaningful past performance rating can be reasonably assign offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability "unknown" shall be considered "acceptable."
Past Performance Evaluation Ratings
Rating Acceptable: Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.
Un-acceptable: Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
FACTOR D - PRICE
Price analysis will be conducted for each proposal to ensure completeness, realism, reasonableness, and balance IA W FAR 15 .404-l(b). The following applies to that evaluation.
(1) Completeness. The offeror shall complete the pricing information for all CLINs/Sub-CLINs identified for base period plus four (4) one options (total five (5) years). Any underlying assumptions including proposed escalation rates between the 1st and subsequent periods shall be clearly explained.
(2) Price Realism. Price analysis in conjunction with Technical Analysis will be used to perform a Price Realism Analysis to determine if the price is realistic for the work to be performed. The proposal will evaluated using price analysis techniques to determine whether the proposal reflects a thorough understanding of the PWS, and whether the price proposed is realistic for the work to be performed and is consistent with approaches described in the technical proposals. Price proposals, which are unrealistically will be deemed reflective of a failure to comprehend the complexity and risk of the proposed contractual requirement and may be grounds for rejection of the proposal.
(3) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to independent Government estimate, current market prices for same or similar services and/or when co among other technically acceptable offerors.
(4) Unbalanced Pricing. As part of the price evaluation, proposals will be reviewed to identify any unbalanced pricing. Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lac balance poses an unacceptable risk to the Government.
(5) Price is not scored. The Government will review the price proposal to determine the extent to which it reasonable, realistic, and consistent with the technical proposal. The lowest price for award purposes the combined total of the effective period of five (5) years from the date of award.
Price shall include CLINs, Sub-CLINs as listed on the Price Schedule including option periods. The Government intends evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
(6) FAR Clause 52.217-8 Option to Extend Services. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one half Offeror's final option period prices to the Offeror's total price. Thus, the Offeror's total price for the p of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option, and one-half 4th option. Offerors are required only to price the base and four (4) options.
Offerors shall not submit for the potential one-half year extension of services period. The Government may determine that an o unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate Government to exercise the option(s).
52.212-2 Evaluation-Commercial Products and Commercial Services. Nov 2021
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
