PERFORMANCE WORK STATEMENT (PWS)

HOISTS AND CRANES ITR

(Inspection, Testing & Repair)

Kunsan Air Base (AB), Republic of Korea (ROK)

Part 1 General Information

1. General: This is a non-personnel services contract to provide inspections, Semi-annual Safety & Operation testing, Annual Load testing, repairs, and emergency services for all Hoists and Cranes at Kunsan AB. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1. Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform safety inspection and load test for Hoists and Cranes as defined in this PWS except for those items specified as Government furnished property and services. The Contractor shall perform to the standards in this contract.

1.2. Background: United States Air Force (USAF) Kunsan AB is facing a multi-million-dollar transformation program that will upgrade 100+ existing facilities. During and post-transformation, the infrastructure of the installation has the potential for growth and thusly, the requirement of ITR service. There are approximately 655 facilities on Kunsan AB of which 19 (29 Hoist and Cranes) facilities requires annual load test, semiannual safety and operation inspection test, and repairs (TE #1 for Base Year of the contract and TE #2 for 1st Option Year through 4th Option Year of the contract). Notification will be provided to the Contractor in a timely manner, if allowable, when such increases or decreases occur. The Contractor shall perform to the terms and conditions of this contract to complete ITR services provided. Air Force Instruction (AFI) 91-203, AIR FORCE CONSILIDATED OCCUPATIONAL INSTRUCTION is responsible for the safety of customer’s facilities and personnel, including of all hazards and deficiencies in their workplaces. To conform to the instruction, 8 Civil Engineer Squadron (CES) has been maintaining all hoists and cranes as real properties which were installed and operated at individual building where critical mission is performed.

1.3. Scope: The Contractor shall provide non-personal service(s). The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform services as described in the PWS and associated contract documents, except for those items specified in Part 3 Government Property and Services. The Contractor shall perform to the standards and acceptable quality levels identified in this PWS and associated contract documents.

1.4. Objectives: The Contractor shall ensure all work accomplished in the performance of this PWS meets all applicable United States Forces Korea (USFK), Korean National, Provincial, Municipal, and Local laws, regulation, and directives to include, but not limited to, the publication in Para 5.3.1. The intent is to establish work requirements that are performance-based and results-oriented. The Contractor shall determine the best and most cost-effective ways to fulfill this contract. The objective is for the Contractor to maintain a satisfactory facility condition and present a clean, neat, and professional sanitation appearance in buildings at Kunsan AB, ROK. This will allow units to maintain their OPTEMPO, morale, and quality of life.

1.5. Period of Performance: The period of performance shall be for one (1) Base Year of 12-months and four (4) 12-months option years. The Period of Performance to be Determined.

1.6. Quality Control:

1.6.1 Quality Control Plan (QCP): Quality control is the responsibility of the Contractor. The Contractor shall develop and maintain a QCP to ensure services are performed in accordance with (IAW) this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's QCP is how it assures that the work provided complies with the requirements of the contract.

The Contractor’s Proposed QCP shall be submitted to the Contracting Officer (KO) through the Contracting Officer’s Representative (COR) for review within ten (10) workdays after date of contract award (Deliverable:

DS#01)

The Government will review and either notify the Contractor in writing of acceptance of the plan or return their comments to the Contractor within ten (10) workdays. If the Government has provided comments, the Contractor shall then have three (3) workdays to submit a Final QCP. After receipt of the Final QCP, the Contractor may receive the Contracting Officer’s acceptance in writing. Any proposed changes to the accepted QCP are required to be resubmitted for acceptance by the Contracting Officer no later than thirty (30) days prior to the anticipated change and before implementation by the Contractor. The timeline noted above will apply for review and acceptance for proposed changes. At a minimum, the QCP must include and answer the following to be acceptable:

A chart showing the organizational structure and lines of authority, the names, qualifications, duties, responsibilities, and classification of each member of the Contractor's Quality Control Team.

How will the Contractor monitor work to ensure that performance complies with all deliverables (etc.

timelines, deadlines, and goals)?

How will the Contractor monitor work to ensure that performance complies with all specifications and requirements of the contract, including clauses?

How will the Contractor monitor and ensure staff qualifications remain current and valid including DOCPER processes/approvals throughout contract performance?

How will the Contractor ensure all keys issued will remain controlled items (Paragraph 1.7 Key Control)?

How will the Contractor inventory and track maintenance of all Government Provided Equipment / Materials?

How will the Contractor identify, investigate, and correct any non-conforming performance and prevent similar deficiencies in the future?

How will the Contractor file and save all Quality Control related documents for the life of the contract?

1.6.1.1 An Analysis of Quality Control and Timeliness of Submittals (i.e. deliverables) shall be provided to the COR within thirty (30) days upon completion of each option period or Task Order.

1.6.1.2 The Contractor shall inform the COR of issues or potential issues that might affect the performance within eight (8) working hours of identifying those issues. Verbal reports shall be followed up by written reports within two

(2) workdays.

1.6.2 Quality Assurance: The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the acceptable quality levels (performance thresholds).

1.7 Recognized Holidays: The following provides information on recognized holidays for the purpose of the PWS.

If submittal of any documentation (e.g., deliverables, submittals, etc.) deadlines fall on a holiday, the closest workday prior to the holiday will apply as the deadline for submittal.

1.6.3.1 U.S. Holidays: Work shall be performed on U.S. holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer. When a U.S holiday occurs on a Saturday or a Sunday, the holiday is observed on the preceding Friday or following Monday, respectively.

1.6.3.2 Host Nation Holidays: Work shall not be performed on local Host Nation holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer.

1.6.4 Operating Hours: The Government facility office hours, facility operating hours, and the Contractor support hour requirements often coincide, however, they may differ. Please refer to the following:

1.6.4.1 Government Facility Office Hours: The Government facility office hours are 7:00 am – 4:30 pm. except U.S. Holidays identified in paragraph 1.5.3.1 above or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.

1.6.4.2 Government Facility Operating Hours: The Government facility operating hours occur between the hours of 7:00 am – 4:30 pm, Monday through Friday. The Government facility is open for operations during the recognized U.S. Holidays identified in paragraph 1.5.3.2 above. The Government facility may close due to local or national emergencies, administrative closings, or similar Government directed facility closings and will be communicated by the Contracting Officer to the Contractor.

1.6.4.3 Contractor Support Hours: The Contractor shall provide support between the hours of 7:00 am – 6:00 pm.

The Contractor shall always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. For other than firm fixed price contracts, the Contractor will not be reimbursed when the Government facility is closed for the above reasons.

1.6.4.3.1 Contractor Work Plan: (If applicable) The Contractor shall prepare and maintain a Work Plan. The plan, as a minimum, shall identify regularly scheduled work (to include location, work to be completed, timeline, etc. The Contractor’s proposed Work Plan shall be submitted to the Contracting Officer via the COR for review within three

(3) workdays after date of site survey. The Government will review and either accept or return their comments to the Contractor within three (3) workdays. The Contractor shall then have three (3) workdays to submit a Final Work Plan.

Any proposed change to the accepted Final Work Plan is required to be resubmitted via the COR for review and acceptance by the Contracting Officer at a minimum thirty (30) days prior to implementation. The timeline noted above shall apply for review and acceptance for proposed changes.

1.6.5 Training Holidays: PACAF has historically granted military personnel training holidays as compensation for time that they spent in field training. These are typically combined with regular holiday leave schedules (for example, Christmas half days or days on/day off schedules). Training holidays may affect access to military operated facilities.

If scheduled work or access to facilities is required, coordination with occupants will be necessary or the work in affected facilities shall be rescheduled after the training holiday. However, announced training holidays or exodus of military personnel may provide the Contractor with an opportunity for unrestricted access to facilities and areas. The Contractor shall take full advantage of such opportunities by planning maintenance or actions that are better accomplished when such areas are vacant.

1.8. Place of Performance: Place of performance for this contract shall be Kunsan Air Base. The work under this contract will be performed at facilities listed in TE #1 for Base Year of the contract and TE #2 for 1st Option Year through 4th Option Year of the contract.

1.9. Environmental Requirement: Contractor shall ensure all workers are familiar with the goals of the Kunsan AB Environmental Management System (EMS) as stated in the installation’s Environmental Policy Statement and have an awareness of EMS. The Environmental Policy Statement commits the installation 1) to compliance with the requirements of USFK regulation 201-1, Korea Environmental Governing Standards (KEGS) and other applicable legal and policy requirements, 2) for continued environmental improvement and pollution prevention, 3) to reduce risk from environmental impacts of base activities, and 4) understanding that everyone on the installation is responsible for complying with the environmental regulations. The Contractor's work under this contract shall conform with all operational controls identified in Kunsan AB EMS and provide monitoring and measurement information necessary for the Government to address environmental performance relative to the goals of the EMS.

Where environmental training is required for Contractor employees to complete contract tasks, the Contractor shall provide proof of completion of training to the KO when requested.

1.9.1. Air Emission

Dust Control: The Contractor shall take appropriate measures to minimize the generation of dust as a result of their works, operations and activities IAW KEGS Section 2-3.l during and after construction until the site is reclaimed.

These measures shall include regular and effective treatment of gravel roads and working areas, use of dust extractors on drilling equipment, wet drilling equipment and operation, water sprays on aggregate crushing and screening operation etc. Dump trucks to be used in the transportation of materials are to be fitted with tarpaulins to prevent dust or other material spilling during transportation.

Ozone Depleting Substance (ODS) Control: The Contractor is prohibited from installing any new equipment using Class I & II ODS. The Contractor shall not intentionally release any Class I or Class II ODS refrigerant while maintaining, servicing, repairing, or disposing of appliances, industrial process refrigeration units, air conditioning units, or motor vehicle air conditioners. The Contractor shall collect refrigerant from all potential sources, including, but not limited to, air conditioners, refrigerators, freezers, and chillers, found remaining in the work areas prior to commencing removal or demolition. If collection is not possible, all equipment containing chemical refrigerants will be appropriately moved and placed into segregated storage areas for either re-use or recycling.

Volatile Organic Compound Control: The Contractor shall use low concentration volatile organic compound (VOC) materials where possible to reduce/minimize VOC emissions and maintain fossil fuel burning equipment to reduce nitrogen oxides emissions to not increase ambient ozone levels.

1.9.2. Storm water Pollution Prevention Measures

The Contractor shall ensure all workers are familiar with the applicable Storm water Pollution Prevention Best Management Practices in KEGS Section 4-3.f (1) and Table 4-8. Hazardous materials must be stored indoors, in non-rusty drums or under a man-made cover sufficient to provide protection from sun, wind, and precipitation events and painting clean-up materials (thinners, reinstates) must be captured. Oil leaks or spills from all equipment and vehicles must be captured using drip pans. Spill response pads and booms must be available where hazardous materials, including fuel, are stored, used, and transferred. Sediment, trash, litter, wash water and any solid objects must be kept out of the storm water sewers. The Contractors will implement Air Force Civil Engineer Support Agency (AFCESA) ETL 03-1, Storm Water Construction Standards, specifically Sections 7, 8, 9 & 10, excluding CONUS requirements in 8.5, 8.5.1, 8.5.2.

1.9.3. Erosion and Sediment Control

The Contractor is required to submit an erosion control plan to 8 CES/CEIE for approval prior to any site work. The erosion control plan is required to implement erosion control IAW the KEGS, the Kunsan AB Storm Water Pollution Prevention Plan, and the Kunsan AB Integrated Natural Resources Management Plan, including site stabilization in accordance with KEGS Section 13-3, j. Key elements to address are the control of dust, prevention of sediment leaving the site and on roads, vegetation cover and slope stabilization. Some examples of control methods include silt fences, terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels and sedimentation basins. Any temporary measures shall be removed after the area has been stabilized. 8 CES/CEIE will inspect construction sites to ensure the approved erosion control measures are implemented, adequate and effective.

1.9.4. Waste Management and Disposal

Disposal of Hazardous Waste: The Contractors are prohibited by 10 U.S. Code 2692 from storage, treatment, or disposal of any Contractor owned hazardous waste (HW) on the installation. The Contractors shall manage HW generated on the installation IAW KEGS Chapter 6. The Contractors may seek approval from the HW Program Manager, 8 CES/CEIE, for HW accumulation at a hazardous waste accumulation point (HWAP) on the installation if the waste will be or has been generated on-site in connection with a contract activity. When the Contractor obtains approval for a HWAP on the installation, he/she shall: be responsible for ensuring compliance with all US Air Force, KEGS, and host nation HW laws and regulations. Ensure HW are managed and transported IAW the KEGS and local requirements to a certified disposal facility. Ensure proper labeling, handling, segregation, collection, and accumulation of HW IAW Hazardous Waste Management Plan of Kunsan AB. Ensure all personnel are properly trained for handling the HW they generate. Provide proper documentation for HW disposal to the installation Environmental Office.

Disposal of Electric Light Fixtures, Ballasts, and Polychlorinated biphenyls (PCB) Transformers: The Contractor shall segregate the light bulbs and ballasts by brand and type. Florescent lights containing mercury shall be disposed of in accordance with the KEGS. Removed PCB containing equipment shall be turned in to the Kunsan AB Hazardous Waste Storage Area (Bldg. 843). The Contractor shall comply with UN Standards for Performance Oriented Packaging (POP) and any additional requirements established by DLA. For example, PCB Transformers shall be set on a drip pan large enough to hold 125% of the remaining liquid and crated by processed wood packaging materials IAW DoD Directive 4140.1. Disposal of PCB items shall only be conducted through the servicing DLA IAW DOD 4160.21-M. Disposal of PCBs within Korea requires coordination with and concurrence of appropriate Korean authorities.

Natural Resources: The Contractor shall perform all work and take such steps required to minimize interference with or disturbances to flora and fauna. Protected species, which include the Narrow-mouthed Frog and the Korean Golden Frog, are present on Kunsan AB. If trees and bushes interfere with the construction work and need to be relocated or removed, consult with the installation Environmental office for proper clearance prior to relocating or removing.

Conflicts: In case of a conflict or discrepancy between environmental regulations or laws and the contract specifications, the Contractor shall immediately submit the matter in writing to the KO for a determination. Without such determination any actions taken shall be at the Contractor’s own risk and expense.

1.10. Safety Requirement: The Contractor shall comply with EM 385-1-1, US Army Corps of Engineers Safety and Health Requirements Manual, Revised Version dated Sep 08. English versions are available for reference in the 8th CES, Operation Support Office (CEOS), and Building 702. The Contractor shall be responsible for ensuring that all work performed under this contract is accomplished in a safe manner. The Contractor shall ensure that all employees are instructed on accident prevention and safety. Special emphasis shall be placed on the safe operation of equipment and safe working conditions. Training shall be conducted for all employees by the Contractor on appropriate safety measures and on the employee's obligation to obey all existing base safety regulations.

1.11. Security Requirements: The following information is provided on security related matters.

1.7.1 Security Program: Contractor personnel performing work under this contract must have a Kunsan AB Installation Pass if selected after the time of the proposal submission and must maintain the level of security required for the life of the contract. The security requirements are IAW with the Department Of Defense Contract Security Classification Specification (DD Form 254), which is currently accessible at the following link:

1.7.3 Installation Access: Access to U.S. installations and controlled areas is limited to personnel who meet security criteria and are authorized by Host Nation law to work in that country. Failure to submit required information/data and obtain required documentation or clearances in accordance with Air Force Federal Acquisition Regulation Supplement (AFFARS) 5353.242-9000 (AFFARS 5353.242-9000) Contractor Access to Air Force Installations, United States Forces Korea (USFK) Regulation 190-7 (USFK Reg 190-7) Installation Access Control (English/Hangul), will be grounds for denying access to U.S. installations and controlled areas. The Contractor shall ensure that any subcontractors used in performance of this contract complies with these requirements and that all employees, of both the Contractor and any subcontractor utilized by the Contractor, are made aware of and comply with these requirements. Should anything in this paragraph conflict with (AFFARS 5353.242-9000) and (USFK) Regulation 190-7, the regulation takes precedent.

The Contractor shall be aware of and comply with the requirements associated with Installation Access Control. The Government is not liable for any costs associated with performance delays due solely to a firm’s failure to comply with Installation Access Control System (IACS) processing requirements.

The Contractor shall return installation passes to the issuing IACS office when the contract is completed or when a Contractor employee no longer requires access.

1.7.3.1 In addition, the Contractor shall provide the Contracting Officer, via the COR, an Initial Installation Pass Log within three (3) days after contract award. The log must at a minimum contain the following information Contract Number, Job Site, Contract Period, Access Dates and Hours, Number of Persons: Name, ROK ID Number, Job Title, Access Hours, Vehicle “License Plate Number”. The log shall be updated as employees are added or removed. The Updated Installation Pass Log shall be current and available at any time upon request by the Government and submitted to the COR within five (5) days after any changes to the log. 1.7.3.2 The Contractor shall collect the installation access passes the same day employment of an individual has expired or has been terminated and shall return them to the issuing office within three (3) work days.

1.7.3.3 Upon termination or cancellation of this contract, the Contractor shall collect all outstanding installation access passes and return them to the issuing office within five (5) days.

1.7.3.5 AT Level I Training: All contractor employees, including subcontractor employees, requiring access to Army installations, facilities, and controlled-access areas shall complete AT Level I awareness training within thirty

(30) calendar days after the contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within thirty (30) calendar days after completion of training by all employees and subcontractor personnel. 1.7.4 Background Checks: Contractor shall provide personnel (laborers/workers etc..) names and ROK I.D.

numbers to COR/Security Manager to initialize the background check process.

1.7.5 Physical Security: The Contractor shall safeguard all Government equipment, information, and property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured IAW the Army Physical Security Program (AR 190-13).

1.7.6 Operations Security (OPSEC) Requirements: Contractor personnel shall adhere to facility security policies and restrictions. The Contractor shall immediately report suspicious activities to security personnel. Government issued access badges shall not be worn outside designated facilities where visible to the public.

1.9 Post Award Conference/Periodic Progress Meetings: The Contractor shall attend the post award conference convened by the contracting activity or contract administration office IAW FAR Subpart 42.5. The KO and COR/ACOR will meet quarterly with the Contractor to review the Contractor's performance. Written minutes of meetings will be recorded by the Government and signed by both the Program Manager and the KO. The written minutes will be distributed within five (5) workdays after the meeting. If the Contractor does not concur with any portion of the minutes, recorded by the Government, the non-concurrence shall be provided in writing to the KO within two (2) calendar days following receipt of the minutes. 1.9.1 The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Contract Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours.

1.14. Qualification Requirement:

1.14.1 Contractor: The Contractor shall maintain the respective qualifications throughout the life of the contract.

1.14.1.1. Business Registration: The Contractor shall possess and maintain a current and valid Business Registration (사업자등록증) which include the following kind of business: Manufacture of Hoist and Crane (호이스트 그레인 제조업) or Maintenance and Repair for Hoists & Cranes (호이스트 크레인 유지보수업) issued by Nation Tax Service, ROK (국세청).

1.14.1.2. Prior Experience: The Contractor shall have a minimum of two (2) years experiences in hoists and cranes inspection, test, maintenance, and repair services within the last eight (8) years.

1.14.2. Key Personnel: The following personnel are considered key personnel by the Government; Contract Manager (CM), Technician, and Certified Inspector. To verify the qualification of key personnel his/her licenses shall be submitted as part of the contract proposal.

1.14.2.1. Contract Manager (CM): The CM shall have full responsibility to act for the Contractor on all contract matters relating to daily operations of this contract. The CM shall be available between at 0800 - 1700, from Monday thru Friday except when the Government facility is closed for administrative reasons. Personnel working on this contract shall have the ability to understand English as exemplified in their written and verbal skills in the performance of the functional duties as outlined in the contract requirements. If the Government, at its sole discretion, determines that the language (or Technical) skills of a contractor employee does not meet language (or technical) proficiency skills required of the position, the Government reserves the right to require the Contractor to provide a new contract employee that does possess the required language (or technical) proficiency skills required of the position, at no additional cost to the Government.

1.14.2.1.1. Prior Experience: The CM shall have a minimum of two (2) years of experiences as a Contract Manager in any service contracts within the last eight (8) years.

1.14.2.1.2. Availability: The CM shall be available to meet the COR within one (1) hour during normal duty hours from Monday through Friday to meet with the COR to discuss work related issues. After normal duty hours, the CM shall be available within two (2) hours, 24 hours a day, and seven days a week for emergency purposes. The CM shall be available by cell phone and shall provide their cell phone number to the KO and COR.

1.14.2.2. Hoists and Cranes Repair Technician(s): The Contractor or his/her sub-Contractor shall have licenses of

Industrial Craftsman Electricity License (전기기능사 자격증) issued by the Human Resources Development

Service of Korea (한국산업인력공단) ROK Government.

1.14.2.3. Certified Inspector: The Contractor or his/her sub-Contractor shall provide certified inspector for Semi-annual Safety Inspection and Annual Load Test. The certified inspector shall be designated by Notice 2009-7 of the

Ministry of Employment and Labor (고용노동부고시2009-7) under the OCCUPATIONAL SAFETY AND

HEALTH ACT (산업안전보건법) from the Republic of Korea Government. This publication can be downloaded at www.moel.go.kr. The contractor shall provide proof document for a proposed certified inspector who are current employ of public corporation or association that are appointed as Industrial Safety Health Business Consignment

Organization (산업안전보건업부 위탁기관) under the Notice 2009-7 issued by the Minister of Employment and

Labor (고용노동부장관) as part of technical proposal.

1.14.3. Before removing, replacing, or diverting any of the listed or specified key personnel, the Contractor shall:

(1) Notify the KO at least 14 calendar days in advance in writing.

(2) Submit justification (including proposed substitutions with resumes of equal qualifications stated in this section 1.6.5.1) in sufficient detail to permit evaluation of the impact on this contract; and

(3) Obtain the KO's written approval. Notwithstanding the foregoing, if the Contractor deems immediate removal or suspension of any member of its management team is necessary to fulfill its obligation to maintain satisfactory standards of employee competency, conduct, and integrity under the clause at 48 CFR 970.5203–3, Contractor's Organization, the Contractor may remove or suspend such person at once, although the Contractor shall notify the KO prior to or concurrently with such action.

1.14.4. The Contractor personnel shall be easily identified as a Contractor employee. This shall be accomplished by wearing appropriate badges which contain the company name and employee’s name. Such badges shall be furnished and controlled by the Contractor. The Contractor's employees shall not be authorized to enter Government facilities other than those requiring services under this contract. The CM shall ensure that all employees understand this policy and abide by it.

1.15. Post Award Conference/Periodic Progress Meetings: The Contractor shall attend the post award conference convened by the contracting activity or contract administration office IAW FAR Subpart 42.5. The KO and COR/ACOR will meet quarterly with the Contractor to review the Contractor's performance. Written minutes of meetings will be recorded by the Government and signed by both the Program Manager and the KO. The written minutes will be distributed within five (5) workdays after the meeting. If the Contractor does not concur with any portion of the minutes, recorded by the Government, the non-concurrence shall be provided in writing to the KO within two (2) calendar days following receipt of the minutes.

1.16. Base Passes: It is the Contractor’s responsibility to arrange for base passes and necessary vehicle decals required for entry onto this installation immediately upon award of the contract and must be accomplished prior to the first day of contract performing any work under this contract. The temporary base pass takes at least two (2) weeks to process and is issued for only three (3) months. The permanent base pass requires two (2) months to process. The Government will not be responsible for providing escorts for the Contractor.

1.17. Escort Privileges: The CM shall be authorized escort privileges for on base passes. The maximum number of individuals escorted shall not exceed two (2) persons per one (1) base pass. Individual base passes for the Contractor employees other than the CM shall not include escort privileges. It is the Contractor’s responsibility to ensure that the escorting official always has full control over all escorted individuals. Any individual found on the installation without a pass and unescorted will be removed from the installation and the escort official’s privilege shall be withdrawn. Any individual removed from this installation shall not be authorized further access to this installation.

1.18. Vehicle Passes: All Contractor vehicles used in the performance of work under this contract shall be registered on the installation. Contractor personnel operating a vehicle on this installation shall be aware of current driving policies and abide by these policies. Any Contractor committing traffic violations may result in the termination of further driving privileges on the installation.

PART 2 DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR: A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER (KO): A person with authority to enter, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR): An employee of the U.S. Government appointed by the KO for oversight of the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor if that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE: A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE: Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL: The Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY: Actions that prevent the loss or damage of Government property.

2.1.8. PERFPRMANCE REQUIREMENTS SUMMARY (PRS): The PRS identifies key performance indicators and standards that represent logical service outputs that will be evaluated by the Government to assure the Contractor is fulfilling the terms of the contract.

2.1.9. QUALITY ASSURANCE: The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.10. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of Contractor performance.

2.1.11. QUALITY CONTROL: All necessary measures taken by the Contractor to assure that the quality of a product or service shall meet contract requirements.

2.1.12. SUBCONTRACTOR: One that enters a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

2.1.13. WORKDAY: The number of hours per day the Contractor provides services in accordance with the contract.

2.1.14. WORK WEEK: Monday through Friday, unless specified otherwise.

PART 3 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3. GOVERNMENT FURNISHED ITEMS AND SERVICES:

3.1 Services: None

3.3 Utilities: All reasonable quantities of water and electricity will be furnished at no charge to the Contractor for work performed on USFK installations. Coordination shall be made with the installation engineer for locations of water and electrical supply points. Temporary connections shall be made and removed at the Contractor’s own expense, regardless of distance or accessibility of existing service. All connections shall be made by experienced and licensed craftsmen and shall be coordinated with the COR. Costs for repair of utility systems, damaged by the Contractor, shall be paid for by the Contractor.

3.4 Equipment: None

3.5 Materials: None

PART 4 CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General: The Contractor shall furnish all parts and materials required to perform this contract. Equipment and materials used in the performance of this contract shall be recognized as standard in the trade, and in accordance with manufacturer’s specifications and condition of equipment. Replacement items shall be standard products from manufactures regularly engaged in the production of such supplies, parts, or materials. Items without technical specifications shall be of acceptable industrial grade, quality and require COR’s approval prior to replacement or repair.

PART 5 SPECIFIC TASK

5. SPECIFIC TASKS:

5.1. Initial Inspection (CLIN 0001): At the beginning of the contract (completed within 30 days after award in the base year only), the contractor shall perform a pre-inspection of all hoist and cranes listed in TE #1 for the base year only. If any hoist and cranes fail or have issues mentioned by the facility manager, the contractor will provide a deficiency report/cost estimation to the COR within 14 calendar days after completion of the pre-inspections in accordance with paragraph 5.4. and 5.4.1. then complete repairs in accordance with paragraphs 5.4.2. through 5.4.7.

If a hoist and crane pass the pre-inspection, the contractor can move forward with paragraph 5.2. and 5.3.

5.2. Semi-annual Safety & Operation Inspection Test (Two times a year/approximately every six months, CLIN 0002 and X004): Safety & Operation Inspection Test shall be performed semi-annually on all Hoists and Cranes listed in TE #1 for the base year. For 1st Option Year through 4th Option Year, the contractor will perform the semi-annual safety & operation inspection test on all Hoists and Cranes listed in TE #2. These inspections shall be completed by a certified inspector who shall be designated by Notice 2009-7 of the Ministry of Employment and

Labor (고용노동부고시2009-7) under the OCCUPATIONAL SAFETY AND HEALTH ACT (산업안전보건법) from the Republic of Korea Government. The contractor shall provide a written appointment document

(안전검사기관 지정서) issued by the Minister of Employment and Labor (고용노동부장관) as part of technical proposal. The Contractor shall accomplish an initial safety inspection of all hoists within 3 months from the contract start date. The Contractor shall provide inventory report to COR after the initial safety inspection. The Inventory report shall be referred as following TE #1. If the COR disapproves the report, the Contractor shall resubmit a new inventory report within two (2) weeks. Sequentially the Contractor shall provide safety inspection every six month from former test day. (Deliverable: DS#02)

5.3. Annual Load Test (CLIN 0003 and X005): Load Test shall be performed annually on all Hoists and Cranes listed in TE #1 for the base year. For 1st Option Year through 4th Option Year, the contractor will perform the load test on all Hoists and Cranes listed in TE #2. The test shall be completed by certified inspector who shall be designated by Notice 2009-7 of the Ministry of Employment and Labor (고용노동부고시2009-7) under the

OCCUPATIONAL SAFETY AND HEALTH ACT (산업안전보건법) from the Republic of Korea Government.

The contractor shall provide a written appointment document (안전검사기관 지정서) issued by the Minister of

Employment and Labor (고용노동부장관) as part of technical proposal. The Contractor shall accomplish an initial load test of all hoists within 45 calendar days after Notice to Proceed (NTP). The load test could be coincided with semi-annual safety inspections. (Deliverable: DS#03)

5.3.1. Applicable Regulation: The following regulations are applicable for Annual Load Test (CLIN X002)

(1) AIR FORCE INSTRUCTION (AFI) 91-203, Chapter 35.5 for hoists and Chapter 35.8 for Overhead, Gantry, and Underhung Cranes and Monorail systems. This publication can be accessed through the following website: www.e-publishing.af.mil.

(2) Notice 2016-43, 2016-29, and 2012-47 of the Ministry of Employ and Labor (고용노동부고시 2012-47, 2016- 29, and 2016-43). This publication can be accessed through the following website: www.moel.go.kr.

(3) Manufacturer’s guide. The Contractor shall search and apply the instructions when it is required.

*When any conflicts between aforementioned standards, The Contractor shall comply stricter standard than others.

5.3.2. Schedule: The Contractor shall coordinate schedule with each building facility manager as listed on TE #1 for Base Year of the contract and TE #2 for 1st Option Year through 4th Option Year of the contract. and the Contractor shall provide the COR with the work schedule for approval no later than two (2) weeks prior to the performance work. If the COR disapprove the schedule, the Contractor shall resubmit new schedule within one (1) week.

5.3.3. Access & Liaison: Government will not provide any escort, access to destination. During the inspection, the Contractor shall provide escort, access, and liaison with facility managers from beginning to completion.

5.3.4. Labelling: After each hoist and cranes has been tested, the Contractor shall affix a label with written the month, year, and “PASS/FAIL” of the inspection in English. The label shall be issued/confirmed by the certified inspector. The label location shall be just in easily visible location.

5.3.5. Failed Cranes: If any cranes fail the safety inspection, the Contractor shall report failure of the crane for facility manager and COR immediately. And the Contractor shall provide visible warning sign around the crane and shall provide breaker lockout only for the cranes. Breaker lockout shall follow the National Electrical Code.

5.3.6. Written Test Result Certificate: After all hoists and cranes has been tested for safety inspection, the

Contractor shall provide safety test results (안전검사결과서) which is made of format from Attachment #3, Notice

2016-44 of the Ministry of Employment and Labor (고용노동부고시 제2016-44호, 별지 제3호서식) in TE #2 and shall be written in English after completion of each safety test.

5.4. Contractor Acquired Parts (CLIN X006): The Contractor shall submit deficiency report/cost estimation to the COR within 14 calendar days after completion of all the safety inspections. Deficiency report could be written based on the Written Test Result Certificates as paragraph 5.3.6. Also, the Contractor shall provide cost estimation to repair/replace for all deficiencies that were founded during the safety inspection. The cost estimation shall include detailed cost information for manufacturer, model or part number, materials, labor, and equipment.

5.4.1. The Contractor, after a Notice To Proceed (NTP) from the COR, shall complete all repairs and inspection/testing that were in the cost estimation based on the information provided in paragraph 5.4.

5.4.2. Repairs (Applicable to CLIN X007): The repairs performed will be done so by a hoist and crane repair technician. The contractor shall provide a written appointment document (안전검사기관 지정서) issued by the

Minister of Employment and Labor (고용노동부장관) as part of technical proposal to the COR. If the Contractor utilizes a subcontractor, the COR should be provided with their ROK ID card (Front and Back side).

5.4.3. Unscheduled repair/replace of parts shall be performed under this paragraph as requirement portion through the issuance of Task Order.

5.4.4. All repair work shall be in accordance with commercial practices using parts specified by the part manufacturer or items of equal or better quality. The contractor shall keep records of all material warranties.

5.4.5. All unscheduled repair/replace of parts shall have a 180-calendar day warranty.

5.4.6. Performance period of unscheduled repair/replace of part will be decided by the COR under each Deliver Order.

5.4.7. After repairs are completed, the Contractor shall accomplish a safety & operation test and load test of all hoists and cranes from those facilities listed in TE #1 for Base Year of the contract and TE #2 for 1st Option Year through 4th Option Year of the contract. The Contractor shall provide inspection report to COR of all findings, positive or negative remarks, immediately after the inspections.

5.5. Emergency Site Visit (CLIN X005): When any deficiency reported to Government, COR request Emergency Site Visit to the Contractor. The Contractor shall respond to the Government’s call and provide emergency procedure within 2 hours. The Contractor shall provide emergency shutdown, safety label, warning sign, and breaker lockout in accordance with paragraph 5.3.3. and 5.3.5. Also, the Contractor shall provide Deficiency Report/Cost estimation to troubleshoot in accordance with paragraph 5.3.7.

PART 6 PERFORMANCE REQUIREMENT SUMMARY (PRS)

The Contractor service requirements are summarized into performance objectives as below table that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These minimums do not relieve the Contractor from performing 100% of all work requirements. Failure to do so could result in an issuance of unacceptable inspection ratings and/or a Contract Discrepancy Report (CDR). These thresholds are critical to mission success. Work must be accomplished according to the terms, conditions, and specifications stated in the contract.
