RFP states “Offerors shall include a copy of the completed SF1449, with an original signature of a corporate officer authorized to negotiate for the company. It also states “Offerors shall include acknowledged and original signed copies of amendments to the solicitation, if applicable. There is a discrepancy between the requirement for ‘copy’ of completed forms, and ‘original’ signatures. An ‘Original’ signature implies a wet signature. With this being an electronic CD submission, will the Government please clarify the original signature statement? Also please indicate if the Government would like the documents stamped as “original” in lieu of a wet signature.
In accordance with FAR 4.502 (d), “Agencies may accept electronic signatures and records in connection with Government contracts”. Electronic signatures are an acceptable means of an “original signature”.
The RFP requires that the successor contractor offer all current incumbent employees first right of refusal employment (FAR 52.222-17). The incumbent has an unfair competitive advantage. The individual incumbent employee seniority is only known by the incumbent contractor. The government requires that the contractor report these positions annually (in response to CLIN 0001 requirements). The government requires that the contractor provide supporting detail to support annual wage price adjustment under the contract (FAR 52.222-55). We respectfully request that the government provide all bidders the position with matching seniority for each current position. Since the government requires that we offer employment to these employees, this is a reasonable request and this information is available to the government and not protected under FOIA.
In accordance with the Addendum to 52.212-1, paragraph D.2.b.(6)(c)(2)a., “the staffing chart shall also include the total productive hours and the proposed staffing levels based on FTEs of 1597 productive hours for the base ordering period and 1817 productive hours for ordering periods 2-5 (see Attachment 4 – Staffing Chart)”. This statement ensures all offerors (to include the incumbent in the event they choose to propose) to use the productive hours as calculated by the Government in accordance with the Exhibit H – Collective Bargaining Agreement.
