(a) The Government will award a fixed price IDIQ resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The Government intends to award a single IDIQ on the basis of the lowest priced, technically acceptable quote meeting or exceeding the acceptability standards for all the below listed technical and past performance factors/subfactors. Each technical factor below has a submission requirement that must be included with the quote.

FACTOR 1 - Technical Evaluation Factors

Evaluation Criteria

Submission Requirement

Technical Sub-Factor 1- To be considered acceptable for this subfactor, the prospective offeror must demonstrate specific experience providing food service worker management expertise through a written management plan clearly describing the following management areas: 1) How the company plans to conduct effective recruiting to meet the full-time equivalent (FTE) at the minimum requirements outlined in the solicitation 2) How the company oversees worker timekeeping and hours worked to ensure employees are not working more than 40 hours a workweek or exceeding the amount of hours provided via task orders

3) procedures for responding to an unexpected loss of a contracted worker; to include communication with the Government and re-hiring procedures.

Offerors shall submit a management plan tailored to the solicitation requirement that clearly describes the three management areas identified under this sub-factor criteria. The management plan shall not exceed 5 pages maximum and be submitted as either a Microsoft work or PDF file type. Additional management areas or content may be included up to the page limit, but only the three management areas outlined in this sub-factor criteria will be evaluated for acceptability. Management plan may be submitted in contractor formatting.

Technical Sub-Factor 2- To be considered acceptable for this subfactor, the prospective offeror must provide proof that they acknowledge that contractor employees will be expected to work weekends and/or holidays based on scheduling at the Government's discretion.

The offeror shall provide a company memo or other similar document certifying that they are able to provide contractor employees that are able to work weekends and/or holidays based on scheduling at the Government's discretion.

FACTOR 2 - Past Performance Evaluation Factor

Evaluation Criteria Submission Requirements

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

Addendum to Evaluation - Commercial Product and Commercial Services

ADDENDUM TO 52.212-2

(a) Offerors are hereby advised that the Randolph-Sheppard Act (20 U.S.C. 107) applies to this solicitation. In addition to the evaluation criteria listed in FAR provision 52.212-2, if the State Licensing Agency (SLA) submits a quote, the source selection will be carried out in accordance with 20 U.S.C. (S) 107, 34 CFR (S) 395.33, and other relevant laws and regulations as applicable.

The Government will award a contract resulting from this solicitation to the responsible offeror, whose offer conforming to the solicitation, is the best value to the Government, price and other factors considered in accordance with FAR Parts 12 and 13, or to the SLA under the RSA priority as other than best value in accordance with 34 CFR (S) 395.33.

The priority for award to the SLA is applied after initial evaluation using the factors identified in the solicitation-refer to the Application of the SLA Priority section of this Addendum.

Evaluation Criteria

The Government evaluation process is as follows:

Step 1- The Government will conduct a compliance review to determine if each Offeror met the submission requirements outlined in the solicitation. Missing or incomplete submission requirements may make the offer non-compliant and ineligible for award. The Government will review each complete quote for acceptability on technical and past performance factors/subfactors, as well as price, in accordance with FAR provision 52.212-2 included in the solicitation. If the Contracting Officer determines that communications with one or more offerors are required, they will complete those communications and re-review all revised quotes received. The Government will also identify if a SLA offeror has submitted a quote. If a SLA offeror has submitted a complete quote that is deemed to be acceptable on all non-price factors and determined to have a reasonable price, the Government will move to step two. If an SLA offeror has not submitted a quote or their quote is determined to be incomplete and/or unacceptable, then the Government will move to step three directly.

Note: The Contracting Officer will consult with the Secretary of Education if they do not intend to award the contract to the SLA. If the SLA is dissatisfied with an action taken relative to its quote, the SLA may file a complaint with the Secretary of Education under the provisions of 34 CFR

(S) 395.37.

Step 2- The Contracting Officer will follow the procedures outlined in 34 CFR (S) 395.33(b) for award to the SLA without further consideration to other offerors.

Step 3- The Government will make the LPTA best value decision based on the offer who has submitted the lowest priced quote with an overall acceptable rating on all non-price factors.

(End of 52.212-2 Addendum)

Offerors are not required to submit any additional documentation in support of this evaluation criterion.

To be considered acceptable for this subfactor, The prospective offeror must have evidence of successful past performance that demonstrates performance relevant to providing food service worker support to dining facilities which meet or exceed the requirement in the solicitation within the last three (3) years of date of solicitation closing.

Past performance information shall be obtained from established systems such as the Contractor Performance Assessment Reporting System (CPARS), Electronic Subcontract Reporting System (eSRS), or other databases. Past performance information may also be obtained from other sources available to the Government, such as the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, Fee Determining Officials.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered "acceptable."
