INSTRUCTIONS TO OFFERORS
INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS
A. GENERAL INFORMATION
This solicitation is for a firm-fixed price contract for general support services for the US Army Corps of Engineers (USACE), Transatlantic Afghanistan (TAA) District. The contractor shall perform the work to maintain, repair, generator and custodial/grounds maintenance services at all of the USACE facilities at the Bagram, Kandahar, New Kabul Compound (Kabul Resident Office), Marmal, and Qargha.
In accordance with Federal Acquisition Regulation (FAR) Part 15, award will be made on the basis of the lowest evaluated price of proposals satisfying the requirements of the technical evaluation factors set forth in the solicitation. The offeror that submits the lowest complete and reasonably priced proposal that is also found technically acceptable by the evaluators will be selected for contract award. To be considered technically acceptable, an offeror’s proposal must be rated “acceptable” under all technical factors. This is an LPTA evaluation process.
The Primary NAICS code is 561210.
B. PROPOSAL REQUIREMENTS, CONTENT, AND FORMAT
The government will not reimburse any costs incurred or associated with preparation and submission of any responses to this solicitation. Oral explanations or instructions to offerors are not binding. Any information given to an offeror which impacts the solicitation and/or offer will be given in the form of a written amendment to the solicitation. Any and all amendments to the solicitation will be issued electronically via email. It is the offeror’s responsibility to acknowledge any and all amendments in its proposal submission.
Offerors should not modify the terms and conditions of the solicitation in either the technical or price proposal or add conditions or qualifications to their offers. Should an offeror include terms and conditions that conflict with the terms and conditions of the solicitation, that offeror may be determined to be ineligible for award. Any questions related to specific terms and conditions contained within the solicitation should be resolved prior to submission of an offer. Notwithstanding the above, the offeror must clearly describe in its price proposal any modifications to the contractual and/or technical terms and conditions of the solicitation contained in its offer.
References to “confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the government as part of the offeror’s technical proposal. Offerors that include information in their proposals they do not want disclosed to the public for any purpose, or used by the government except for evaluation purposes, must clearly mark their proposals in accordance with the instructions at FAR clause 52.215-1, Instructions to Offerors-Competitive Acquisition, paragraph (e), Restriction on Disclosure and Use of Data.
Use of the words “will”, “shall”, or “must” indicates a mandatory requirement for which failure to comply, at the time and date for submission of proposals, shall result in the offeror’s proposal being disqualified from consideration for award, unless the government elects to initiate discussions with some or all of the offerors, thereby providing a means by which appropriate corrections by the offeror(s) involved can be made. Failure to comply with non-pricing or pricing requirements that are annotated with the words “should” or “may” can result in a lowering of an offeror’s non-pricing ratings, and may have a significant effect upon an offeror being selected for the contract award. Time periods, if stated as a number of days, are calendar days unless otherwise specified.
1. INSTALLATION ACCESS
In accordance with CENTCOM Clause 5152.225-5916, Mandatory Eligibility for Installation Access, the government will determine an offeror non-responsible as a result of an offeror’s base access ineligibility.
The government reserves the right to make this determination at the time of receipt of proposals and prior to the start of evaluations. In this instance, the non-responsible offeror’s proposal will not be evaluated.
The government also reserves the right to determine an offeror non-responsible at any time after receipt of proposals if an offeror becomes ineligible for installation access. A determination that an offeror is non-responsible will result in the removal of the offeror’s proposal from the competition. No debriefing will be provided for those offerors found non-responsible as a result of their base access ineligibility as the determination may be made in advance of the offeror’s technical proposal being reviewed or completed.
System for Award Management (SAM): Offerors must have and must maintain an active registration in the SAM database at www.sam.gov to be eligible for a Government contract award. If the Offeror is a Joint Venture (JV), the JV entity must have valid SAM registration in the SAM database representing the JV as one business/firm/entity. If at the time of award an Offeror is not actively and successfully registered in the SAM data base, the Government reserves the right to award to the next prospective Offeror.
2. REQUIRED REGISTRATIONS
Failure to have an active and completed registration in any one of the following databases may determine an offeror ineligible for award and removed from competition. A successful offeror with incomplete or expired registrations at the time of award may not be eligible for a contract. In such instances, the government will award to the next successful offeror who is eligible for award.
Information contained within an offeror’s registration must be current and valid. The responsibility of maintaining current information contained in an offeror’s registration rests solely on the offeror.

Unsuccessful offerors will be notified in accordance with FAR Subpart 15.5. An unsuccessful offeror may request a preaward debriefing or a delayed debriefing after award by submitting a written request to the contracting officer within three (3) days after receipt of the notice excluding the offeror from the competition and award. Offerors are entitled to no more than one debriefing for each proposal. No debriefing will be provided for those offerors found non-responsible as a result of their base access ineligibility as the determination may be made in advance of the offeror’s technical proposal being reviewed.
1. Background and Objectives
a. The purpose of this plan is to provide guidance and procedures for assuring impartial, equitable, and comprehensive evaluation of the competing offerors for the award of a Lowest Price Technically Acceptable (LPTA) firm fixed price contract for Custodial, Janitorial and Ground Maintenance Services at Bagram Air Field, Qargha, Marmal, Kabul Area office (KAO) at New Kabul Compound, and Kandahar Air Field (KAF).
b. In accordance with Department of Defense Source Selection Procedures, this plan has been prepared to assure that the evaluation is fair to all offerors by using only predetermined evaluation factors that have been clearly delineated to all offerors in the Request for Quotation (RFQ). The plan provides for control of the evaluation to assure the security and integrity of the procurement.
c. The offeror shall confine submissions to essential matters, sufficient to define the proposal and provide an adequate basis for evaluation. Offerors are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of each proposal.
2. Basis for Award
a. The Government will award a firm fixed price contract to the responsible Offeror whose proposal represents the best value to the Government as a result of an LPTA evaluation.
b. Subject to the provisions contained herein, award will be made to one (1) offeror who is deemed responsible in accordance with the FAR; who conforms to the solicitation requirements; and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, meets the technically acceptable standard for the non-price factors and provides the lowest evaluated price.
c. To be considered technically acceptable, no technical factor in the proposal may be rated as
“unacceptable”. The failure of a proposal to meet all of the requirements under any factor will result in a technically unacceptable rating and precluded from award. There may be contained within the evaluation factors certain mandatory or minimum requirements to be met for evaluation. There are also contained within the described factors certain documents for submission. Failure to satisfy any mandatory or minimum requirement may result in a determination that an offer is unacceptable. A final determination that an offer is unacceptable means that an award to the offeror involved cannot be made.
d. Proposals shall be submitted in two (2) separate volumes, consisting of Cost/Price information and a Technical Proposal. Offerors are permitted to provide ONLY ONE Proposal for consideration; if more than ONE Proposal is received, the offerors’ responses may be determined unacceptable and will not be evaluated or considered for award.
e. The Cost/Price information shall consist of the total cost/price for the base and option period. In
Technical Proposals, offerors shall demonstrate a clear understanding of all features involved in solving the problems and meeting the requirements presented in the PWS.
f. The Government intends to evaluate proposals and reserves the right to award a contract without discussions. Therefore, the offeror's initial proposal should contain the offeror's best terms from a Technical and Cost/Price standpoint. Unclear proposals may not result in questions for clarifications.
Proposals with an omission or unclear proposals may be judged to mean the contractor does not fully understand the requirements or understand what it takes to meet or exceed the requirements, regardless of the proposed cost/price. In that case, the offeror may be found unacceptable and ineligible for award. At the discretion of the Contracting Officer, the Government reserves the right to make award with or without discussions or exchanges.
g. There are three evaluation factors: (1) Past Performance (2) Management Plan (3) Key Personnel and Price.
F. Evaluation Factors
FACTOR 1 - PAST PERFORMANCE
Past performance refers to the quality of recent and relevant project experience from the project owner/customer’s perspective.
The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
FACTOR 1 SUBMISSION REQUIREMENTS:
The offeror is required to submit the following information for purposes of the past performance evaluation:
The firm shall complete and provide Attachment C the Past Performance Form on at least three (3) projects, but no more than five (5) prior projects. The submission of each Past Performance Form shall not exceed five (5) pages. NOTE: Offerors if you exceed over five (5) pages it will not be reviewed.
The Offeror shall provide clear and adequate information in response to the past performance elements identified on Attachment C. If any firm has multiple functions or divisions, it shall limit the project examples to those performed by the division, unit, or joint venture submitting the offer. Additional Past Performance Forms may be submitted for consideration on any other member of a Joint Venture.
The Offeror should ensure that correct phone numbers and email addresses are provided for the client point of contact on all Attachment C forms. Offerors may submit Attachment C forms previously filled out by clients (and used in previous proposal submissions) for the projects submitted under Factor 1.
However, offerors shall not incorporate these Attachment C forms by reference into their proposals.
As eighty percent (80%) of work associated with this project is required to be self-performed by the prime and not the sub-contractor, no sub-contractor past performance will be accepted. Additionally, on at least one project, offerors must demonstrate past performance that is 80% self performed activities related to custodial, grounds, operation and maintenance services, generator repair, or HVAC repairs, where they performed as the prime.
Past performance shall demonstrate recent and relevant experience on same or similar projects to that of the solicitation requirements. For purposes of this solicitation:
Recent is defined as: Projects that have been successfully completed within five (5) years preceding the proposal due date. Additionally, an offeror may provide past performance information on a contract that has a base period, with additional follow on option periods, so long as the base period is complete, even if option periods are still ongoing.
Relevant is defined as: service contracts where the offeror has provided two or more of the following types of services to the customer: generator repair; operations and maintenance (including but not limited to HVAC repair); grounds maintenance; interior cleaning.
Same or similar is defined as projects having the following:
Size: A contract value of at least $100,000. All submitted project experience must meet the size requirement. If the offeror performed as a subcontractor, the portion of work performed by the offeror must meet the size requirement.
Scope: generator repair; operations and maintenance (including but not limited to HVAC repair);
grounds maintenance; interior cleaning for customers in Afghanistan.
Complexity: a contract where the offeror provided two or more of the required services (HVAC repair, cleaning, etc….) to a customer located in multiple locations within Afghanistan.
FACTOR 1 EVALUATION AND DEFINITIONS:
The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements. The Offeror’s Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in the below table.
The first aspect of the past performance evaluation is to evaluate whether the offeror’s past performance is relevant or not relevant to the effort to be acquired. The criteria of what is recent and relevant can be found in the past performance submission requirements, above.
The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts.
To be considered “acceptable, the offeror must demonstrate that its past performance is recent and relevant on same or similar projects to that of the solicitation requirements.
PAST PERFORMANCE ACCEPTABLE/UNACCEPTABLE RATING METHOD
RATING DEFINITION
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
The evaluation team will assess an offeror’s past performance information and assign an “acceptable” or “unacceptable” rating based on the information available.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.
To be considered technically acceptable overall, an offeror’s proposal must be rated “acceptable” for all requirements that constitute the past performance factor. An “acceptable” rating will be assigned to a proposal that has satisfied all of the minimum requirements of this technical evaluation factor. An “unacceptable” rating will be assigned to a proposal that has not satisfied one or more requirements of the past performance evaluation factor.
In addition to its review of the information provided on Attachment C, the Government will evaluate the Offeror's past performance using the sources available to it including but not limited to any additional information received from references and CPARS. The government will review this past performance information and determine the quality and usefulness as it applies to performance confidence assessment.
The Contracting Officer may also rely on other sources available to the Government, such as the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, Fee Determining Officials. In addition to the above, the government may review any other sources of information for evaluating current and past performance. Other sources may include, but are not limited to: past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of joint ventures (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal; inquiries of owner representative(s); Federal Awardees Performance and Integrity Information System (FAPIIS); and Electronic Subcontract Reporting System (eSRS). While the government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror.
Offerors may be provided an opportunity to address any negative past performance information about which the Offeror has not previously had an opportunity to respond if such information is determined to present an impact on the rating to be assessed

Since it is anticipated that an offeror will require more than one plumber/HVAC technician/site supervisor/electrician/carpenter to perform the work required by this contract, offerors can anticipate providing multiple Attachment D forms for each key personnel position. A key personnel may serve in more than one capacity, so long as they meet the experience requirements for all positions (for example: an employee that has plumbing and carpentry experience can be proposed for both the carpenter and plumber position, so long as that employee has at least five (5) years experience (can be concurrent) as both a plumber and a carpenter).
The key personnel are:

The government will not consider the qualifications of any proposed key personnel who are not currently employed by the offeror without a letter of commitment.
FACTOR 3 RATING AND DEFINITIONS:
To be considered technically acceptable, an offeror’s proposal must be rated “acceptable” for all requirements that constitute the Key Personnel factor. An “acceptable” rating will be assigned to a proposal that has satisfied all of the minimum requirements of this technical evaluation factor. An “unacceptable” rating will be assigned to a proposal that has not satisfied one or more requirements of the evaluation factor.

RATING DESCRIPTION
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
VOLUME 2 - PRICE
The offeror must include a price for each CLIN (quantity, unit price, and total price), each year total price (base year and three twelve month option years), and a grand total price for all four (4) years. All options will be evaluated at the time of award. The six-month option to extend services will also be evaluated. A separate priced CLIN 3011 Bagram, 3012 Kabul, 3013 Qargha, 3014 Kandahar and 3015 Marmal.
The government will evaluate an offeror’s price proposal in order to identify risks to the government based upon demonstration that:
1. The offeror can successfully perform at the proposed price.
2. The proposal is complete. Completeness is the degree to which an offeror has priced all aspects of the work to be performed as defined by the proposal schedule. The Government will assess the extent to which the proposed prices comply with the content and format requirements set forth in this solicitation.
The completeness evaluation includes review of Proposal Schedules and Cost Breakdown Sheets.
Unreasonably high or low prices as determined by the Source Selection Authority (SSA), through the use of price analysis techniques under FAR 15.404-1(b), may be grounds for eliminating a proposal from the competitive range, if one is established. Completeness includes providing a complete bid (proposal) schedule and cost breakdown sheet. There is no page limitation for presentation of the pricing proposal.
3. The proposals are reasonable and balanced. Reasonableness has to do with whether an offeror’s proposed prices compare favorably against the Independent Government Estimate (IGE), as well as against the proposed prices submitted by the other offerors. For an offeror’s price proposal to be determined reasonable, it must represent a price that provides best value to the government when consideration is given to the IGE, prices in the market, and the technical and functional capabilities of the Offeror.
If deemed necessary, the supplemental price breakdown information will be used to assist the Government in performing the price evaluations described above.
Price will also be a factor in establishing the competitive range prior to discussions (if held) and in making the final determination for award.
Price proposals that are unreasonably high or low in price when compared to the Government estimate and market conditions evidenced by other competitive proposals received, may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the proposal being rated lower or considered unacceptable.
Please note: In accordance with Afghan law, Afghan firms will be paid in Afghan currency at the 3-day international transfer rate. Reference Clause 252.232-7014 and 5152.232-5900 for further information
