SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
L.1 GENERAL PROPOSAL INFORMATION
The offeror shall submit its proposal, subject to FAR 52.215-1, “Instructions to Offerors - Competitive Acquisitions”, in the format set forth below. All information necessary for the review and evaluation of a proposal shall be contained in the proposal volumes set forth below. Section M of the solicitation sets forth the evaluation criteria and delineates the factors and subfactors evaluated and their relative order of importance. It is an offeror’s responsibility to submit a well-written proposal, with adequate detail, which clearly demonstrates an understanding of and the ability to comply with the solicitation requirements to allow for a meaningful evaluation. The Government does not assume the duty to search for data to cure problems it finds in proposals.
L.1.1 The offeror shall submit its proposal in five separate volumes as set forth below.
The offeror shall submit its proposal in the formats and quantities set forth in this section. All proposals shall be in English (American Standard) and shall be in US dollars. The offeror shall submit its proposal via the Federal Business Opportunities (FBO) website at https://www.fbo.gov.
Volume Number Title Quantity
Cover Letter 1 Volume I Past Performance 1 Volume II Mission Capability 1 Volume III Cost/Price 1 Volume IV Small Business Participation 1 Volume V Proposal Terms and Conditions 1
Proposals shall not include citations for, or linkages to, websites.
L.1.2 Proposal Instructions. Proposals shall include an electronic cover letter (letter of transmittal) that identifies all enclosures being transmitted in the message. The offeror should use extreme care and attention to ensure it includes all required items in its proposal. The offeror’s electronic submission shall include all supplemental documentation, such as any collateral material (i.e. brochures and catalogs), in the English language. The Government may reject any offers submitted that contain exceptions to solicitation terms and conditions.
L.1.3 Notice Regarding Electronic Proposals
L.1.3.1 Offerors must submit electronic copies of the offer in accordance with clause 52.204-4016, "TACOM-Warren Electronic Contracting". Unless otherwise specified in the solicitation, all offers are submitted via the FBO electronic response system.
L.1.3.2 Upon submission of offers, FBO will send an email to the email address on file for the user confirming the electronic submission. This email should be maintained in offeror’s records and proof of date/time of the electronic submission.
L.1.3.3 Offerors are cautioned that an offer is not considered received until the final submission via FBO and a time stamped email confirmation is generated. NOTE: These actions are not instantaneous. As such, offerors should begin the file upload well in advance of the solicitation closing date and time to ensure that the entire proposal is submitted in time to be considered for award.
L.1.3.4 Given the volume of data and information to be submitted by offerors in response to this solicitation, and the inherent limitations of server bandwidth, offerors may be required to submit proposals in multiple uploads; it is critical that all offerors carefully and completely identify the parts and attachments of the proposal so that the Government may quickly and easily distribute the proposal volumes. It is important to note that up to five files can be uploaded at one time. The combined size of the five files cannot exceed 10Mb. Break your attachments into smaller files or use the upload utility multiple times if your files exceed the 10Mb size limit.
Offerors shall name all files to indicate the volume and part number. For example, ‘Volume II Mission Capability Factor part 1 of 4’. Contractor format is acceptable.
Filenames must not contain single quotations, spaces, pound (#), or percent signs (%).
L.1.4 Lateness: This solicitation incorporates the lateness rules for submitted proposals outlined in FAR 52.215-1 "Instructions to Offerors-Competitive Acquisition."
L.1.5 Electronic Copies: Offerors must submit electronic copies and any supplemental information (such as spreadsheets, backup data, and technical information) using the following:
(i) Files in Microsoft Office formats. Spreadsheets must be sent in a file format that includes all formulae, macro and format information. Print image is not acceptable.
(ii) Files in Adobe PDF (Portable Document Format).
(iii) Files in HTML (Hypertext Markup Language): HTML documents must not contain active links to live Internet sites or pages. All linked information must be contained within the electronic offer and be accessible offline.
L.1.6 If any portion of a proposal electronically received by the contracting officer is unreadable, the contracting officer shall immediately notify the offeror and permit the offeror to resubmit the unreadable portion of the proposal. After consultation with the offeror, the contracting officer will prescribe and document the method and time for resubmission. For the purpose of determining timeliness under FAR 15.208(a), the Government will consider a re-submission as if it were received at the date and time of the original unreadable submission, provided the offeror complies with the time and format requirements for resubmission prescribed by the contracting officer. Offerors shall make every effort to ensure that the offer is virus-free. Offers (or portions thereof) submitted which reflect the presence of a virus, or which are otherwise rendered unreadable by damage in electronic transit, shall be treated as "unreadable" as described above.
L.2 ALL OR NONE
Offerors must submit proposals responsive to all requirements identified in this solicitation. Proposals submitted for less than all the requirements called for by this solicitation may be rejected or ineligible for award.
L.3 SEPARATE PROPOSAL SUBMISSION
Offerors may not submit alternate proposals. An offeror is defined as an entity competing independently that does not share a common parent, does not have a parent/subsidiary relationship with any other offeror, and is not affiliated with any other offeror (as defined in Federal Acquisition Regulation (FAR) 19.101).
L.4 EVALUATION FACTORS
Proposals shall address the following four factors:
(a) Past Performance
(b) Mission Capability
(c) Cost/Price
(d) Small Business Participation
L.4.1 Volume I – Past Performance Factor
L.4.1.1 For the Past Performance factor, provide information for a total of up to three recent and relevant contracts performed by the offeror. These may include foreign, federal, state, local municipality, and private industry contracts.
Individual task orders, delivery orders and work directives issued against broader contract instruments (BPAs, IDIQ Contracts, Requirements Contracts, etc.) are each considered a “contract” for purposes of the three-contract limitation. Offerors shall not identify broader contract instruments as a recent and relevant contract. Instead, offerors shall identify individual task orders, delivery orders and work directives most reflective of recent and relevant Past Performance.
L.4.1.1.1 Recent contracts are those performed within three (3) years of the date of issuance of this solicitation. In its evaluation under the Past Performance factor, the Government will only consider corporate past performance under prior contract(s). The Government will not consider the past performance of individuals or key personnel. A single contract may be applicable to multiple Section C Performance Work Statement (PWS) activities listed under L.4.1.1.2 (a-d) below.
L.4.1.1.2 Relevant past performance includes the following PWS activities:
a) Training and mentoring on maintenance, supply chain management, and warehouse support (PWS Section 3.1).
b) Contractor Logistics Support (CLS) for vehicles and ground equipment, to include maintenance support, warehousing, and supply chain management (PWS Section 3.2).
c) Performance of a service contract in Southwest Asia that required simultaneous deployment and management of at least 50 individuals over a period of performance of at least one year. For this solicitation, 'management' includes utilization of SPOT, JPAS, CVS, LOAs, AKO and CRC in the planning and deployment of personnel.
L.4.1.1.3 Past Performance Relevance Matrix. A Past Performance Relevance Matrix is provided as Attachment 0014. The offeror shall complete this matrix and include the matrix in Volume I.
L.4.1.1.4 Past Performance Questionnaire. A Past Performance Questionnaire is provided as Attachment 0015. For each of the up to three recent and relevant contracts, the offeror shall send a copy of the past performance questionnaire directly to the appropriate PCO and, if applicable, Contracting Officer's Representative (COR) or other appropriate technical and contracting individuals. The offeror shall request these individuals complete the questionnaire and forward it electronically directly to the Contract Specialist, Guadalupe Garcia, listed on the front page of the SF33 block # 10 as soon as possible, but no later than the solicitation closing date (See Block #9 of the SF33 cover page to this solicitation) with the subject heading “NMS PAST PERFORMANCE INFORMATION FOR [offeror name].”
L.4.1.1.5 Corporate Entities. If any contract listed in support of the Past Performance factor submission was performed by a corporate entity or division other than the corporate entity or division that will perform work under this solicitation, please identify it, and indicate which entity will perform this effort. The proposal shall provide sufficient information to demonstrate that the cited past performance can be considered predictive of the offeror's performance under the contemplated contract.
L.4.1.1.6 Predecessor Companies. The Government may consider recent and relevant performance as part of a predecessor company in its evaluation under the Past Performance Factor. . If submitting past performance of a predecessor entity, the offeror must provide the required information for those recent and relevant contracts of that predecessor company. The offeror must also briefly document the history of the evolution of the offering company from the predecessor company and provide information needed to demonstrate the corporate experience is attributable to the named offeror.
L.4.1.1.7 Contacting References. The Government may contact any of the references that the offeror provides and may contact other third parties for performance information. In addition, the Government reserves the right to use this information in its evaluation of an offeror’s proposal.
L.4.1.1.8 Past Performance Information. The Government does not assume the duty to search for data to cure problems it finds in proposals. The burden of providing thorough and complete past performance information remains with the offeror. The Government may also evaluate the offeror based on other internal Government or private source information. In this regard, the Government may utilize the Contract Performance and Rating System (CPARS), the Past Performance Information Retrieval System (PPIRS) and any other available internal Government sources to search for recent and relevant offeror performance and ratings. While the Government may elect to consider data obtained from external sources other than the proposal, the burden of providing thorough and complete past performance information rests with the offeror.
In addition to submitting the Relevance Matrix (Attachment 0014), the offeror shall submit the following information for each contract provided under the Past Performance Factor:
(1) Section 1 – Contract Identification. This section shall include the following information in the following format.

This narrative description should not exceed three pages per contract submission.

L.4.3.6.7.1 Offerors that propose rates which differ from a current FPRS or FPRA must provide rationale for the difference i.e. management challenge or ceiling rates. In addition, offerors that do not apply indirect rates to plug numbers (Material) need to provide rationale if that differ from the offeror’s current disclosure statement. NOTE:
