52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror, whose offer conforming to the solicitation, will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

1. Technical

2. Price

(b) Basis for Award & Evaluation:

This will be a Lowest Price Technically Acceptable (LPTA) procurement. The Government intends to evaluate quotations and award a contract without discussions with Offerors. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable quotation for each separately priced CLIN. Each CLIN will be evaluated for each technical subfactor.

The Government has the right to award to multiple offerors based on the technical acceptability of each proposed

CLIN.

(c) A written notice of award or acceptance of offers, mailed or otherwise furnished to the successful offerors within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offers specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

Technical acceptability will be based on an offer at the CLIN level that demonstrates the ability to comply with the specifications listed in the solicitation. The technical factor ratings reflect the acceptability or unacceptability of the offer and will be evaluated using the ratings below. Each offer shall contain the information required for evaluation in accordance with the evaluation criteria, the requirements listed in the Addendum to FAR 52.212-1, and criteria contained in the solicitation.
