About this file

This document is an amendment to a request for proposal for the M782 Multi-Option Fuze for Artillery program. The amendment provides answers to questions from offerors, extends the response deadline to August 23, 2021 at noon, revises drawings and specifications, and adds contract clauses. The U.S. Army is seeking proposals to produce M782 fuzes, for which it will furnish monolithic microwave integrated circuits. Offerors must have an active security clearance and facility security officer contact information to receive the classified technical data package. The amendment defines requirements for program reviews, integrated product team meetings, hazard classification testing, and engineering exceptions. It also addresses flow down of acceptance inspection requirements to subcontractors and application of statistical process control techniques.

*** End of Narrative A0000 ***

The purpose of Amendment 0002 to Request for Proposal (RFP) W52P1J-21-R-0005 is to do the following:

1. Provide answers to the following questions that have been received by the U.S. Government (continued from Amendment 0001):

Question 12 - We would like to request a proposal submission extension to 50 calendar days after the unclassified and classified portions of the TDP are provided to contractors. This will provide enough time for us to review the TDP and work with our supply base to obtain accurate quotes.

Answer 12 The RFP closing date and time has been revised from July 23, 2021 at 12:00 P.M. Central Time to August 23, 2021 at 12:00

P.M. Central Time (noon).

Offerors may continue to submit questions via email to the Contract Specialist, Mr. George Lingris (George.R.Lingris.civ@mail.mil).

Questions received after 12:00 P.M Central Time on August 5, 2021 may not be answered.

Question 13 - Attachment 0010 states that qty 1 MMIC will be provided for every fuze that is ordered on this contract. Will the

Government be providing contractors with spare parts to cover production attrition? If so, can the Government define the additional quantity that will be provided?

Answer 13 - The U.S. Government will provide spare parts. Quantity requested must be submitted by the contractor to the U.S.

Government within the timeframe specified in the RFP. Any unused quantities shall be returned to the U.S. Government upon request.

Question 14 - There is a requirement in CDRL A019 for the contractor to supply Hazard Classification test report submittal but we did not see a corresponding requirement in the SOW. Can the USG clarify the statement of work?

Answer 14 - Contract Data Requirements List (CDRL) A019 is only needed as required. The item has an existing FHC and any alternate shipping configurations would be the contractors responsibility. The following has been added to Section C:

"HAZARD CLASSIFICATION. The contractor shall obtain a hazard classification from the Department of Transportation prior to shipment of any energetic material ammunition and explosives if U.S. Government hazard classification does not already exist. The contractor shall provide hazard classification test data report when applicable. (DI-MISC-80508B, Data Item Number A019)."

Question 15 - Will the USG incorporate the 52.209-3 ALT II Clause into the contract?

Answer 15 - Clause 52.209-3 has been removed from this solicitation. Clause 52.209-3 Alt I & II have been added.

Question 16 - Is AIE (MSE) (CDRL A009) and Statistical Process Control Plans (CDRL A008) required for the following subtier assemblies which contain classification of characteristics within sub tier specifications: S&A and Battery as well as their subsequent piece parts? We estimate that these would add up to approximately 740 listed characteristics.

Answer 16 - Per RFP Section E. Para 8(e)(4):

(4) AIE Flow Down. The contractor shall flow down AIE requirements to sub-contractors at any tier who are performing acceptance inspections.

Per RFP Section E, Para 5, Part I, Para (e):

The Contractor shall review all process and operation parameters for possible application of SPC techniques. This review shall include processes and operations under the control of the prime contractor and those under the control of subcontractor or vendor facilities. A written justification shall be included in the detailed plan for each process and operation parameter that controls or influences characteristics identified as critical, special, or major which have been deemed impractical for the application of SPC techniques.

Question 17 - Is AIE (MSE) (CDRL A009) and Statistical Process Control Plans (CDRL A008) required for the following multiprogram subtier assemblies which contain classification of characteristics within sub tier specifications: M100 Electric detonator, M100

Electric Detonator packaging, Ammo Can, Booster Pellet, Booster Pellet packaging, M55 stab detonator, M55 Stab detonator packaging?

We estimate that these would add up to approximately 100 listed characteristics.

Answer 17 - See Answer 16.

2. Add Clause 52.232-13, Notice of Progress Payments to this solicitation.

This solicitation contains Clause 52.232-16, Progress Payments. The U.S. Government will provide progress payments for material only, provided the awardee has an adequate accounting system and meets all other requirements for progress payments. Further details will be discussed after contract award.

All other terms and conditions remain unchanged.

I-1 CHANGED 52.209-3 FIRST ARTICLE APPROVAL --CONTRACTOR TESTING (SEP 1989) -- ALTERNATE SEP/1989

I (JAN 1997) AND ALTERNATE II (SEP 1989)

(a) The Contractor shall test in accordance with the TDP, Section B CLIN 0001, and all other contract attachments and requirements. At least 15 calendar days before the beginning of first article tests, the Contractor shall notify the Contracting Officer, in writing, of the time and location of the testing so that the Government may witness the tests.

(b) The Contractor shall submit the first article test report as specified in CDRL A011. Within 30 calendar days after the Government receives the test report, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall repeat any or all first article tests. After each request for additional tests, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall then conduct the tests and deliver another report to the

Government under the terms and conditions and within the time specified by the Government. The Government shall take action on this report within the time specified in paragraph (b) above. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule, or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article report on time, or the Contracting Officer disapproves any first article, the

Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, and if the approved first article is not consumed or destroyed in testing, the Contractor may deliver the approved first article as part of the contract quantity if it meets all contract requirements for acceptance.

(f) If the Government does not act within the time specified in paragraph (b) or (c) above, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) Before first article approval, the Contracting Officer may, by written authorization, authorize the Contractor to acquire specific materials or components or to commence production to the extent essential to meet the delivery schedules. Until first article approval is granted, only costs for the first article and costs incurred under this authorization are allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government. If first article tests reveal deviations from contract requirements, the Contractor shall, at the location designated by the Government, make the required changes or replace all items produced under this contract at no change in the contract price.

(h) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. The offeror/contractor may request a waiver.

(i) The Contractor shall produce both the first article and the production quantity at the same facility.
