ADDENDUM TO FAR PROVISION 52.212-2

EVALUATION - COMMERCIAL ITEMS

1. Basis for Contract Award: The Government (USG) intends to award a single, Time and Materials / Firm-Fixed Price hybrid, contract, utilizing procedures from FAR parts 12 and

13. The evaluation factors include Technical and Price. The Technical Factor will be rated as “Acceptable” or “Unacceptable”. To be eligible for award, Quoter shall have an “Acceptable” rating for each of the two technical sub-factors. If either sub-factor is determined “Unacceptable”, the overall rating for the Technical Factor will be “Unacceptable”. The USG will not rate or rank quotes, but will select the quote that provides the best overall value to the USG based on the lowest total evaluated price of those quotes deemed technically acceptable.

2. The USG intends to evaluate quotes and award a purchase order without discussions.

Therefore, a Quoter’s initial quote should contain the best terms for technical and price.

However, the USG reserves the right to conduct Discussions if determined necessary by the Contracting Officer.

3. The USG shall not make assumptions concerning a Contractor’s intent, capabilities, or facilities. Clear identification is the sole responsibility of the Contractor. Quotes shall be evaluated only on their content. Assumptions, preconceived ideas, and personal knowledge or opinions for these factors not supported by material in the quote shall not be considered or used as a basis for evaluation.

4. EVALUATION FACTORS:

The following two factors, and sub-factors as applicable, will be evaluated.

Factor 1: Technical Technical Sub-Factor 1: HVAC License Technical Sub-Factor 2: Experience

Factor 2: Price

FACTOR 1: TECHNICAL

The Technical Factor will be evaluated on an “Acceptable”/”Unacceptable” basis.

In order for a quote to be rated as “Acceptable” for the Technical factor, each sub-factor identified must receive an “Acceptable” rating. Only those quotes which receive an “Acceptable” on both Technical sub-factors will be further evaluated under Factor 2: Price. If an “Unacceptable” rating is received at any stage of the evaluation, the quote will not move on to the next stage of review and shall be considered “Unacceptable”.

TECHNICAL SUB-FACTOR 1: HVAC LICENSE

An “Acceptable” rating for Sub-factor 1 will be given to quotes that include the applicable certifications for each proposed employee and subcontractor, and the copies show the name of the technician, date of certification issuance, type of issuance (e.g. Type I and II, or Type IV), and name of the EPA-approved Section 608 Technician Certification Program.

An “Unacceptable” rating for Sub-factor 1 will be given to quotes that did not include the applicable certifications for each proposed employee and/or subcontractor, or the copies provided did not show all the necessary information, to include name of the technician, date of certification issuance, type of issuance (e.g.

Type I and II, or Type IV), and name of the EPA-approved Section 608 Technician Certification Program.

TECHNICAL SUB-FACTOR 2: EXPERIENCE

An “Acceptable” rating for Sub-factor 2 will be given to quotes: 1) that include a minimum of three projects that are of similar scope and scale, occurring in the last three years preceding the date of the solicitation; AND 2) that include the corresponding references associated with each project, to include the company name, contact name, title, and phone number or email address of the person that can attest to the Quoter’s successful project performance; AND 3) who have successfully completed – in terms of quality, schedule, and cost control - at least two of the three projects of similar scope and scale, as affirmed by the references provided.

An “Unacceptable” rating for Sub-factor 2 will be given to quotes: 1) that do not include a minimum of three projects that are of similar scope and scale, occurring within the last three years preceding the date of the solicitation; OR 2) that do not include the corresponding references associated with each project, to include the company name, contact name, title, and phone number or email address of the person that can attest to the Quoter’s project performance; OR 3) who have not successfully completed – in terms of quality, schedule, and cost control – at least two of the three projects of similar scope and scale, as affirmed by the references provided.

FACTOR 2: PRICE

The Price Factor will be evaluated by calculating the Total Evaluated Price for Preventive Maintenance services and Repair services. Total Evaluated Price is calculated by adding the following: 1) the total proposed price for the base year preventive maintenance services and repair services; 2) the total proposed price for the option year 1 preventive maintenance services and repair services; and 3) the total proposed price for the option year 2 preventive maintenance services and repair services. See descriptions below to learn how total proposed prices for each year will be calculated.

Total Proposed Cost of Preventive Maintenance Services (CLIN 0001, 1001, 2001) Calculation

The total preventive maintenance cost for the base year is calculated as described in this paragraph. Step 1: the proposed hourly labor rate per category will be multiplied by the total number of hours proposed per labor category to perform one preventive maintenance visit. Step 2: the subtotal resulting from Step 1 will then be multiplied by two (because two preventive maintenance visits are needed per year) to produce the subtotal annual preventive maintenance cost per labor category. Step 3: the subtotal annual preventive maintenance cost for each respective labor category will then be added together to calculate the total preventive maintenance cost for the period of performance.

Total Proposed Cost of Repair Services (CLIN 0002, 1002, 2002) Calculation

Since the specific repair services needed and time to successfully complete the repair services cannot be accurately predicted, the Government will use the Quoter’s proposed cost to execute one hour of service repairs as the basis for evaluation. The hourly labor rate proposed for each respective labor category will be summed to result in the total labor cost for one hour of repair services.

Total Cost for Base Year Preventive Maintenance Services and Repair Services Calculation

The total preventive maintenance cost for the base year will then be added to the total labor cost for one hour of base year repair services. The resulting total is the total cost for base year preventive maintenance services and repair services.

This same process described in the paragraph immediately above will be followed to calculate the total proposed cost of Option Year 1 Preventive Maintenance and Repair Services, but will use the prices and hours proposed for CLINs 1001 and 1002.

This same process described in the first paragraph of this section will be followed to calculate the total proposed cost of Option Year 2 Preventive Maintenance and Repair Services, but will use the prices and hours proposed for CLINs 2001 and 2002.

Total Evaluated Price Calculation

The Government will then add the total cost for base year preventive maintenance services and repair services (i.e. sum of CLIN 0001 and 0002) to the total cost for Option Year 1 preventive maintenance services and repair services (i.e. sum of CLINs 1001 and 1002), and will also add the total cost of Option Year 2 preventive maintenance services and repair services (i.e. sum of CLINs 2001 and 2002). To more clearly explain, the Government will sum all of the following CLINs to obtain the total evaluated price of preventive maintenance and repairs services for the base year, Option Year 1, and Option Year 2: 0001, 0002, 1001, 1002, 2001, and 2002.

Price Analysis shall be used to determine price reasonableness. The FAR requires that contracts be awarded at prices that are determined fair and reasonable. The Government will evaluate price reasonableness in accordance with FAR 13.106-3. Additional analysis techniques may be used as determined necessary by the Procuring Contracting Officer. These methods of evaluation may include the use of information/input from sources such as (but not limited

to) other Government agencies and personnel. The Government reserves the right to require the submission of any other than cost or pricing data necessary to validate the reasonableness of a quote.

As part of the cost/price evaluation, quotes may be reviewed to identify any significant unbalanced pricing. In accordance with FAR 15.404-1(g)(2), i.e.

Unbalanced Pricing, a quote may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government.

The Government may determine that a quote is “Unacceptable” if the Option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the Option(s).
