SECTION M - EVALUATION FACTORS FOR AWARD
It is the responsibility of the offeror to provide complete and thorough explanations for each factor/sub-factor as required by Section
L for each CLIN included in its proposal. Each factor/sub-factor is required with the initial proposal, and the U.S. Government is not obligated to make another request for the required information. Performance or capabilities proposed that exceed mandatory minimum requirements may be incorporated into the contract IAW FAR 15.306(d)(4).
M.1. BASIS FOR AWARD:
M.1.a.The U.S. Government will evaluate proposals submitted in accordance with this section and will make a determination considering the following factors: Technical, Past Performance, Price, and Small Business Participation. Best Value Tradeoff
Processes in accordance with FAR 15.101-1 Alt 1 will be utilized to select the successful offeror(s). Award will be made to the offeror(s) that provides the best value to the U.S. Government considering the evaluation criteria stated herein.
M.1.b. The U.S. Government anticipates awarding up to two IDIQ contracts per each CLIN Group as a result of this solicitation. The offeror(s) whose proposal provides the best value to the U.S. Government, considering both price and non-price factors will be awarded an IDIQ contract. However, the U.S. Government reserves the right to make one award if its determined to be in the best interest of the Government.
M.1.c. The U.S. Government intends to include a small business reserve for CLIN Group 1, which includes the 20mm Cartridge family.
This reserve is intended to ensure a minimum of one small business award is made for this group. Award will be made to at least one small business for this CLIN Group as long as there is a small business that is determined to be within the competitive range. If there is more than one small business in the competitive range, the first award will be made to the small business that offers the best value to the U.S. Government. The second award can be made to a small business or large business; award would be determined by who offers the best value to the U.S. Government.
M.1.d. The U.S. Government will evaluate each proposal strictly in accordance with Section M.
M.1.e. Subsequent delivery orders for each group will be competed between all of the contractors that have been awarded an IDIQ contract for that CLIN Group. It is the U.S. Governments intent to award IDIQs to up to two independent offerors per group in order to reduce the risk of a single point of failure, enhance competition, and allow flexibility in executing delivery orders.
M.1.1. Discussions:
M.1.1.a. The U.S. Government intends to award the resultant contract(s) with discussions. The Contracting Officer may contact
Offerors for clarification, as described in FAR 15.306(a) and FAR 52.215-1, Alt 1 without opening discussions. However, the U.S.
Government reserves the right to not conduct discussions if determined not necessary by the Contracting Officer.
M.1.1.b. If the Contracting Officer determines discussions are necessary, they will be held in accordance with FAR 15.306.
M.1.2. Other Evaluation Considerations:
M.1.2.a. Proposals that are unreasonable in terms of technical or schedule commitments or contain unbalanced prices, may be considered an indication of a lack of understanding of the complexity and risk in the contract requirements and may be determined unacceptable.
M.1.2.b. Pursuant to FAR 9.103, contracts will only be awarded to offerors that the Contracting Officer determines to be responsible. Separate from the Best Value source selection criteria, offerors must be able to demonstrate that they meet the standards of responsibility set forth in FAR 9.104. To assist in the Contracting Officers determination of Contractor
Responsibility, the U.S. Government may conduct a pre-award survey IAW DFARS 223.370 on any offerors considered for award.
M.1.2.c. If information pertaining to one factor is included in the wrong factor it will not be evaluated. For example, if technical information is included in the price factor, it will not be evaluated.
M.1.3 Order of Importance:
M.1.3.a. Technical is the most important factor and is more important than the other factors when combined. Price is the next most important factor. Past Performance is more important than Small Business Participation. The evaluation factors other than price, when combined, are significantly more important than price.
M.1.3.b. Although price is not the most important factor, it could become a controlling factor if proposals under the non-price factors are determined to be relatively equal. The U.S. Government reserves the right to make an award to other than the offeror who submits the lowest overall evaluated price, using a Best Value trade-off analysis method of procurement.
12 17
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
M.1.3.c. The U.S. Government will evaluate the technical proposal to determine if the offeror demonstrates a clear understanding and ability to comply with the requirements of this solicitation. The U.S. Government will also evaluate the Offerors ability to meet the requirements schedule, based on production rates, facilities, and availability.
M.1.3.d. The Technical sub-factors will each receive a rating by the technical evaluation team that will aid in determining the final overall technical rating. These evaluations will be consolidated into one overall technical rating. The following combined
Technical/Risk Rating definitions will be utilized in the evaluation of the Technical Factor and Sub-factors:
Outstanding (Blue): Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Good (Purple): Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Acceptable (Green): Proposal meets requirements and indicates an adequate approach and understanding of the requirements and risk of unsuccessful performance is no worse than moderate.
Marginal (Yellow): Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable (Red): Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
M.1.3.e. The following definitions apply to the evaluation of the Offerors Technical factor (and sub-factors) as follows:
i. Risk is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an
Offerors proposed approach to achieving the technical factor or sub-factor may involve risk of disruption of schedule, increased cost or degradation of performance, the need for increased U.S. Government oversight, and the likelihood of unsuccessful contract performance.
ii. Uncertainty is any aspect of a non-cost/price factor proposal for which the intent of the offer is unclear (e.g. more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).
iii. Deficiency is a material failure of a proposal to meet a U.S. Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
iv. Weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance.
v. Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance. See
FAR 15.001.
vi. Strength is an aspect of an Offerors proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the U.S. Government during contract performance.
M.1.3.f. An offeror who receives an Unacceptable rating in Technical, Small Business, No Confidence in Past Performance, or its proposal prices cannot be determined fair and reasonable, will not be considered for award.
M.2. Technical:
M.2.1. The Technical factor is comprised of five sub-factors: (a) Technical Approach, (b) Safety, (c) Environmental, (d) Security, and
(e) Program Management. Technical Approach is the most important sub-factor. Safety, Environmental, Security, and Program Management are equally important.
M.2.2. The U.S. Government will evaluate the technical proposal to determine if the offeror demonstrates a clear understanding and ability to comply with the requirements of this solicitation. Overall, the proposal shall demonstrate an in-depth understanding of the critical operations and support requirements of the demil process. If any Technical sub-factor is assigned a Red/Unacceptable rating, the overall Technical factor rating will be Red/Unacceptable.
M.2.3. Technical Approach Sub-factor (written proposal):
M.2.3.a. The U.S. Government will evaluate the detailed description of the offerors demilitarization and disposal process including facilitization, permitting, and operations for its capabilities and understanding of the critical operations and support requirements of the demil process. The place of performance for each CLIN is specified.
