1. This Request for Proposal (RFP) is issued to fulfill the U.S. Government's requirements for the BLU-109 Penetrator Bomb Bodies, CNU-

417/E Container and MHU-212B/E Pallet. This RFP is restricted to the United States and its outlying areas, or Canada, as authorized by

10 U.S.C. 2304(c)(3) and Federal Acquisition Regulation (FAR) 6.302-3(b)(1)(iv)(A) and (B). The applicable Justification and Approval was signed on 4 April 2019.

2. The following items may be procured under this solicitation:

CLIN ITEM NSN Part Number_________________________________________________________

0002 BLU-109C/B 1325-01-585-5698 200827956

0003 BLU-109/B 1325-01-335-8828 8463170-110

0004 BLU-109A/B 1325-01-368-3474 8463170-150

0005 CNU-417/E 8140-01-252-7060 8463244

0006 MHU-212B/E 8140-01-590-4731 3728AS200

*Note: CLIN 0001 will be used for First Article Test (FAT).

The CNU-417/E Container is used for the storage and transportation of the BLU-109/B and the BLU-109C/B; the MHU-212B/E Pallet is used for the storage and transportation of the BLU-109A/B.

3. The U.S. Government intends to award up to two Firm Fixed Priced (FFP), Indefinite Delivery Indefinite Quantity (IDIQ) contracts to the offeror(s) whose proposal(s) represents the best value to the U.S. Government, non-price and price factors considered. However, the

U.S. Government reserves the right to make a single award if it is determined to be in the best interest of the U.S. Government. The offeror shall be able to manufacture and deliver all Contract Line Item Numbers (CLINs) as identified in paragraph number two above.

4. The total minimum guaranteed quantity (MGQ) of 3,000 BLU-109 Empty Case Assemblies (which can be comprised of any combination of the three BLU-109 configurations) is anticipated to be divided on a 50%/50% basis with associated containers and pallets divided in the same manner. If a single award is made, the MGQ of 3,000 BLU-109 Empty Case Assemblies will be awarded to the single awardee.

5. If two IDIQ contract awards are made, the future requirements will be competed between the IDIQ contract awardees following the fair opportunity process described in FAR 16.505(B)(1). Ordering procedures and selection criteria for Delivery Order competitions are identified in Section H. Both contracts will allow for award of any empty case assembly configuration and shipping container. The U.S.

Government will reserve the right to divide future requirements on any basis and combination as determined to be in the best interest of the U.S. Government, and will reserve the right to award future requirements to a single contractor if determined to be in the best interest of the U.S. Government considering price and other factors such as contractor performance and capacity.

6. The resultant contract(s) will consist of five Ordering Periods to award FY20-24 requirements. The Ordering Periods are defined as follows:

Ordering Period 1: Date of Award through 365 Days After Award (DAA)

Ordering Period 2: 366 DAA to 730 DAA

Ordering Period 3: 731 DAA to 1,095 DAA

Ordering Period 4: 1,096 DAA to 1,460 DAA

Ordering Period 5: 1,461 DAA to 1,825 DAA

7. The total maximum quantities for all contracts awarded as a result of this RFP are as follows:

BLU-109C/B: 31,500 EA

BLU-109/B: 2,500 EA

BLU-109A/B: 5,000 EA

CNU-417/E: 15,750 EA

MHU-212B/E: 2,500 EA

8. Best value tradeoff procedures in accordance with FAR 15.101-1 will be utilized to select the offeror(s) that provide the overall best value to the U.S. Government. This best value source selection process will include an evaluation of the following four factors:

2 77

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

(1) Technical Ability, (2) Past Performance, (3) Price, and (4) Small Business Participation. Section L provides specific instructions to offerors regarding preparation and submittal of proposals. Evaluation of the proposals will be in accordance with the criteria stated in Section M. Award(s) will be made to the offeror(s) whose proposal(s) are determined to provide the best value to the U.S. Government based upon Section M criteria; therefore; award(s) may be made to other than the lowest priced offeror(s), or other than the highest rated offeror(s) for the non-price factors.

9. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of the proposal. The U.S.

Government will not make assumptions concerning an offerors intent, capabilities, facilities or experience. The submission of CLEAR, ACCURATE, and COMPLETE information is the sole responsibility of the Offeror. Please ensure all fill-ins are completed, if applicable. If fill-ins are not applicable, please indicate N/A. If the Offeror fails to include the information requested in Section

L in its proposal, the Offerors proposal may be rejected by the U.S. Government and no longer considered for award.

10. The U.S. Government intends to award the contract(s) resulting from this RFP with discussions. However, the U.S. Government reserves the right to not conduct discussions if determined not necessary by the Contracting Officer. The Offeror's shall ensure its initial proposals contain the best terms and that proposals are complete, including all fill-ins and blanks.

11. Price Matrix - The offeror shall submit a completed Price Matrix at Attachment 0001 in Section J. The pricing submitted in the

Price Matrix shall be fully executable by the Government at the unit prices and quantity range limits identified per Ordering Period in the Price Matrix. Prices are for FOB Destination to McAlester Ammunition Plant (MCAAP), McAlester, OK. Separately priced First Article

Test (FAT) CLINS shall also be completed for each item and Limited FAT CLINS for the BLU-109/B and BLU-109A/B.

12. FAT shall be completed 210 days after issuance of the Delivery Order. FAT Reports are required to be submitted for U.S. Government disposition 240 days after issuance of the Delivery Order. Approval of the FAT Reports will be required before production can commence. Additionally, FAT for the MHU-212 Pallet will also include U.S. Government testing with contractor samples, as described in Section J, Attachment 0008

- Quality Requirements SOW, QA005 - First Article Test (Government Testing) and clause 52.209-4, First Article Approve - Government

Testing (ALT 1). FAT samples for the MHU-212/E Pallet are due within 210 days after award of the Delivery Order. In the event the U.S.

Government determines a Limited First Article Test (LFAT) is sufficient for the BLU-109/B and/or the BLU-109A/B, the parts that will require a LFAT to be performed are listed at Attachment 0013 in Section J.

If there is a lapse in production greater than 90 days or a production process change, change in place of performance, or material substitution, the Government may require the contractor to perform an additional FAT at the contractor's expense (reference Section J, Attachment 0008 - Quality Requirements SOW, and QA006 - First Article Test (Contractor Testing)).

Offerors are required to propose separate prices for FAT for each item and Limited FAT prices for the BLU-109/B and BLU-109A/B Empty

Case Assemblies for each ordering period. Limited FAT costs provided at Attachment 0001 - Price Matrix, should be based on a Limited

FAT on the parts listed at Attachment 0013 in Section J.

13. Deliveries shall commence 365 days after issuance of the Delivery Order. All quantities awarded shall be delivered within 12 months of the start of production. The subsequent delivery orders will be issued with or without FAT. If the Delivery Order is issued with FAT, the delivery schedule requirements will be as stated above following the same FAT requirements. If the Delivery Order is issued without FAT, monthly deliveries will continue at the same rate and immediately after the delivery schedule in place for the earlier items.

14. This solicitation will utilize the Acquisition Source Selection Interactive Support Tool (ASSIST) during the source selection evaluation process. A separate tool, the ASSIST2Industry, will be used in conjunction with ASSIST to accomplish all exchanges if applicable with Offerors after receipt of proposals pursuant to Federal Acquisition Regulation (FAR) 15.306. ASSIST2Industry provides the ability for the Government to issue, and the Offerors to receive and respond to, all Evaluation Notices (ENs) in a secure online environment. Refer to Attachment 0009 for further information on ASSIST. However, the Government reserves the right to work outside of
