SECTION L - INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

L.1 GENERAL INSTRUCTIONS:

L.1.1 This section contains general proposal submission instructions. Specific proposal instructions are addressed at L.2.

a. The U.S. Government intends to award with discussions (see FAR 52.215-1 Alt I). However, the U.S. Government reserves the right to not open discussions. The U.S. Government does, however, intend to have each offeror do an oral presentation for the Technical Ability factor and subfactors. The U.S. Government reserves the right to contact Offerors for clarification, as described in FAR 15.306(a) and

FAR 52.215-1, without opening discussions. In the event the U.S. Government determines discussions are necessary, the PCO shall establish a competitive range comprised of the most highly rated proposals. Only those Offerors within the competitive range will be included in discussions and considered for award.

b. If discussions are conducted, offerors within the competitive range will be asked to respond to all Evaluation Notices (ENs).

Responses to ENs will be in narrative form along with the affected slides / proposal pages with the necessary changes. Oral presentations, as referred to in paragraph L.1.4, will not be repeated. Once all ENs have been answered, and the Contracting Officer determines it's appropriate to close discussions, the Contracting Officer will request Final Proposal Revisions (FPRs) in the form of updated PowerPoint slides for the Technical Ability factor and subfactors, and additional slides will be allowed if the U.S. Government determines it be necessary. If FPRs are requested by the Contracting Officer, offerors may revise any portion of the proposal if they choose and include them in the FPR.

c. Each Offeror shall provide the information as required by this solicitation (including all attachments and exhibits) in the proper format as described at Paragraph L.3. Proposals that do not contain all of the information requested in the solicitation risk being determined unacceptable by the U.S. Government. The U.S. Government will not assume the Offeror possesses any capability, understanding, or commitment not specified in the proposal, or presented in the oral presentations.

d. Proposals shall be specific, complete and address each of the designated requirements listed below. The proposal must not merely repeat the solicitation requirements, but rather must provide in the written proposal or during the oral presentation, evidence explaining how contract requirements will be met by the Offeror.

e. Assumptions, preconceived ideas and personal knowledge or opinions for these factors not supported by material provided in the written proposal or during the oral presentation will not be considered or used as a basis for evaluation. However, Government reports and relevant personal knowledge may be used for the Past Performance factor evaluation.

f. Offerors are responsible for confirming with the Contracting Officer and/or Contract Specialist to ensure that the proposal submitted has, in fact, been received by the Contracting Officer and/or Contract Specialist. This must be done by the date/time set forth in the solicitation for receipt of offers.

L.1.2 All questions concerning this procurement, either technical or contractual must be submitted in writing to the Contracting Officer and/or Contract Specialist. No direct discussion between the technical representative and a prospective Offeror will be conducted.

Questions shall be sent to the following point of contacts:

E-mail: stephanie.m.migawa.civ@army.mil

E-mail: elizabeth.m.miller174.civ@army.mil and kelly.k.clifton.civ@army.mil

L.1.3 The complete proposal, including the Technical Ability factor and subfactors PowerPoint slides, shall be electronically submitted to the Contracting Officer and their representative no later than the due date and time specified in the solicitation, to include any subsequent amendments. Proposals submitted by mail or hand-carried will not be evaluated. Proposals shall be submitted electronically to stephanie.m.migawa.civ@army.mil, elizabeth.m.miller174.civ@army.mil and kelly.k.clifton.civ@army.mil. Electronic mail proposal submissions shall not exceed a size limit of 10MB (multiple emails may be utilized to complete the proposal submission). It is highly recommended that the Offeror request a Return Receipt or other form of acknowledgement to verify that the proposal submission was received. Due to file size restrictions, proposals may also be submitted through DoD SAFE, https://safe.apps.mil . A link will need to be requested from the POCs listed above in order to upload to the DoD SAFE site. Cloud services and third party drop boxes are not acceptable for proposal submission.

L.1.4 Technical Ability Factor (PowerPoint Slides and Oral Presentations):

a. In lieu of a written proposal for the Technical Ability factor, offerors will be required to provide up to 30 PowerPoint slides for the Offerors Technical Ability proposal submission (with the initial written proposals for the Past Performance Factor, Price Factor and Small Business Participation Factor), and after the solicitation closes, the offerors will give oral presentations, which shall consist of the Technical Ability factor and subfactors: Manufacturing Capability, Quality, and Testing and Inspection.

the conclusion of each offeror's oral presentation of the Technical Ability factor and subfactors, the U.S. Government personnel will briefly caucus for up to an hour to ascertain if any clarifications of the offeror's presentation are required.

d. If the U.S. Government determines there is a need for clarifications, all clarifications will be provided in writing to the offeror. The offeror will be provided up to an hour to respond verbally, as well as in writing, with the appropriate answers that directly address the questions asked by the U.S. Government.

f. It is recommended that the offerors key personnel, who will perform or personally direct the work being described, conduct their relevant portions of the presentations. Key personnel include project managers, task leaders, and other in-house staff of the offeror.

Subcontractors can be utilized as presenters at the offerors discretion. The names of presenters shall be listed on the Title Slide for each Technical Ability subfactor. Offerors are permitted to have up to two nonpresenters in the room during the presentation.

g. If there are any inconsistencies between the slides and oral presentations, the U.S. Government will attempt to address those issues during the clarification period held after the oral presentation. However, the U.S. Government reserves the right, as noted above, to conduct discussions to resolve any inconsistencies. Offerors shall ensure that all key factual information (such as dates, quantities, product numbers, etc.) are included in the slides to reduce the chances that information will be missed during the oral presentation.

h. The oral presentation will be evaluated for purposes of award decision. The oral presentation and the same-day clarifications will not constitute discussions, as defined in FAR 15.306(d), nor will it obligate the U.S. Government to conduct discussions or to solicit or entertain any proposal revisions.

i. Process and Facilities:

- The Contracting Officer will schedule the oral presentations and will notify each offeror of the date, time and location of its oral presentation after the U.S. Government receives the proposals in response to this RFP. L.5.1 Use of Acquisition Source Selection Interactive Support Tool (ASSIST)

Except for the oral presentation for the Technical Ability factor and subfactors, all exchanges (clarifications, communications, and discussions) with Offerors are accomplished through the release of ENs. The U.S. Government will issue written ENs as part of all exchanges. ENs may be issued via Acquisition Source Selection Interactive Support Tool (ASSIST). However, the U.S. Government reserves the right to obtain clarifications; have communications; and/or hold discussions with Offerors outside of ASSIST if it is determined to be in the best interest of the U.S. Government.

ASSIST will be used during the Source Selection evaluation process. If discussions are conducted with Offeror(s) in the competitive range, the U.S. Government intends to use ASSIST to conduct discussions. ASSIST will allow Offeror(s) to receive and respond to ENs securely on-line. ENs may be in the form of weaknesses, uncertainties, or deficiencies.
