10.Page 6 of the PWS 1.4.10 Sexual Harassment and Sexual Assault Training Plan. The Government discusses what the contractor’s training plan should address and provide. It lists programs and personnel that is not available to civilian contractors to include SAPR program, Special Victims counsel, SARC. These are available for the military personnel but not contractors. Could the government find alternative requirements that would be applicable for contractors? Like the SHARP training?
The requirements for Sexual Harrasment and Sexual Assualt Training mirror the SHARP training for Government civilian and military personnel. The Contractor's Sexual Harassment and Sexual Assault Training Plan shall address requirements IAW PWS 1.4.10. However, 29 CFR 1910 is but 1926 is applicable to construction and 1960 outlines basic program elements for federal employees. Subparagraph 1.10.2 requires reporting of employee injuries all the way to ASC and reserves the right to investigate. Is this a correct reading of this requirement? What is the Government going to do with this information?
Yes, the requirement of reporting employee injuries to HQ ASC and Gov’t right to investigate is correct. The Government will use the information to review or investigate as necessary.

19.The United States Court of Appeals for the Federal Circuit, case 21-1556, filed 03/03/22, Mitchco International, Inc. vs United States, Kentucky Office of Vocational Rehabilitation, Southern Foodservice Management, Inc. is an appeal of a court of federal claims decision in a post-award bid protest that outlines a challenge by Mitchco. The background data of this appeal provides evidence that KOVR’s contract under the solicitation was terminated by the Government for cause on June 4, 2021. Would not this fact go to a responsibility determination as to KOVR’s failure to perform/poor performance by a contractor that has previously performed the exact work being solicited and acquired? Will this fact disqualify the KOVR from award?
This question is not pertinent to the Request for Proposal and offerors providing an proposal.
20.PWS at paragraph 4.1.1 requires that the contractor shall clean and sanitize all food service equipment and surfaces… IAW Tri-Service Food Code (TB Med 530). The technical definition at PWS 7.2.2 Technical Definitions is silent on food service equipment. Could the Government identify what equipment it expects the contractor to clean and sanitize?
Please see updated Attachment O - PWS at section 4.1.1.1.
21.PWS at paragraph 4.1.3 requires contractors to furnish and maintain expendable cleaning and sanitary supplies with typical supply list at Attachment E. Will the contractor be required to supply any single use items such as carry out containers, plates, cups or contingency use (dishwasher mechanical failure) paper products?
The Government will supply paper products.
22.The data in Attachment C and Attachment F are crucial to proper costing and bid. Without going through a whole lot of math, let us demonstrate our confusion and need to be clear on correct dining facility information. We have several questions regarding these attachments. Keeping in mind, we must be in complete compliance with the Tri-Service Food Code.
a. The design capacity is the same (500) for all DFAC’s is this correct?
Yes the design capacity is the same (500) for all DFAC's.
b. Attachment C and Attachment F have different building sizes for CLIN X004. Building 4061 in Attachment C establishes the square footage as 18,521 sq. ft. while Attachment F provide a size as 16,033 sq. ft. The Attachment F provides data establishing 89 tables and 355 chairs. The serving area configuration is 2 regular serving lines, 2 short order lines, 1 deli line and 5 self service lines. What is the correct configuration?
See updated Attachment F - FCKY DFA Workload Data Capabilities and Attachment C - FCKY Building Plan
c.The remaining buildings have a different configuration (but are exactly the same configuration) with:

-design capacity at 500 -square footage at 16,587 -tables at 41 -chairs at 225 Attachment C provides a differing set of building sizes. The question is which is correct? It appears that building sizes are about 21 percent understated (difference between Attachment C and F). This amounts to approximately 18 million square feet that needs to be cleaned. (99 million square feet during the life of the contract). This will affect the TEP and the LPTA evaluation. Could the Government confirm what it wants us to bid on?

Please bid to attachment F. See updated Attachment F - FCKY DFA Workload Data Capabilities.
d. The number of serving lines are different in each building. Could the Government confirm the number of serving lines it wants to be cleaned?
See updated Attachment F- FCKY DFA Workload Data Capabilities for lines in each Building
e. Are the meal hours correct? This data affects the cleaning schedule and the timing of that schedule ensures compliance with the Tri-Service Food Code.
Yes, meals hours are correct but subject to change, See PWS Section 1.6.1 and Attachment F- FCKY DFA Workload Data Capabilities
23.The PWS at Paragraph 2.9 states “If available, the Government will provide office space for the Contractor to utilize during the performance of this contract.” Will the Government provide office and warehouse space?
Office space is provided within Bldg 5210 for Contractor administrative duties.
24.Currently warehouse space is provided to receive all the supplies that we purchase, and we transport them to the various locations via our boxed trucks. Will this space continue to be provided as part of the new contract?
Yes, the space will continue to be provided as part new contract.
25.Information provided on Attachment H Staffing Matrix requests staffing for a breakfast and lunch meal. However, information on Attachment F Workload Data provide for brunch and super at different meal hours. Please clarify the government’s hours of operation for building 2991.
Breakfast and lunch hours do not change they remain the same if there is dinner or not.
26.The government is requesting five (5) past performance references within the past three (3) years. Due to the pandemic, labor disruptions and associated service delays; the three year requirement may unfairly and artificially restrict competition, and conflict with the spirit and intent of the Competition in Contracting Act IAW FAR part 6. Accordingly, we believe it will be in the best interest of the government if the requirement for Volume III Past Performance would be changed to five examples within the last five years.
Offerors are requested to provide information on "up to" 5 previous Government contracts whose effort is recent and relevant to the effort required by this solicitation. If the offeror has not had 5 Government contracts within the last 3 years from the date of the solicitation, information on recent and relevant

subcontracts and/or commercial contracts may be submitted.

27.Request the government clarify the offer is not required to provide staffing for Headcount Cashiering, Serving, Salad Preparation. These functions, while typically performed by Dining Facility Attendants, are not identified in the PWS
