RFIs 1 Feb thru 8 Feb 23

Question #48: The RFI is not clear, and clarification is needed. If the Key Personnel being proposed is an employee of the Offeror, is it needed to include a LOI and Exhibit B on each? Not all worked on the projects being submitted on Exhibit A. Please advise.

*If any key person is a current employee (whether they worked on the project in Exhibit A or not), neither a Letter of Intent nor Exhibit B are required.

*If any key person is NOT a current employee (whether they worked on the project in Exhibit A or not), both a Letter of Intent AND Exhibit B are required.

*Resumes are required for all Key Personnel. This is mentioned in both the Part I Technical (3.2.5) and Part II Past Performance (3.3.12) proposal submission requirements.

*To avoid duplication of effort, please submit the Resumes and Letters of Intent for Key Personnel with Vol 2 Part I Technical proposal. Ensure the Resumes address both the Technical and Past Performance factors as stated in the RFP.

*Exhibit B submitted for Key Personnel/Predecessor Company/Subcontractor/Teaming Partners are to be submitted as part of Vol 2 Part II Past Performance Submission.

*NOTE: Exhibit B is titled “Subcontractor Information and Consent Form”. However, in Vol 2 Part II 3.3.12, Exhibit is called “Subcontractor/Team/Key Personnel Information and Consent Form”. Further,

3.3.12 states that Exhibit B OR a Letter of Intent is required for Key Personnel that are not a current employee. It should read “Exhibit B AND a Letter of Intent”.

*Despite the inconsistencies for the title of Exhibit B, it is to be used for any subcontractor, teeming partner, predecessor company or key personnel that are not currently employed.

Question #49: 1. Reference: Section 00110 - 3.2.3. Offerors are cautioned to read FAR Clause 52.219- 14, Limitations on Subcontracting. The contracts resulting from this solicitation are not intended for management firms or construction firms who self-perform only administrative or management functions.

Please clarify if you are requiring a certain % of work to be self-performed by the General contractor.

See page 58 of RFP, for Limitations on Subcontracting full clause.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for—

“(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 85 percent subcontract amount that cannot be exceeded; or

(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor's 75 percent subcontract amount that cannot be exceeded.

Question #50: Exhibit D references B456, but the spec document also references B399. Please confirm we are only to price work in B456 and not in B399?

Any mention of B399 in the specs, or anywhere in the RFP, is a typo and shall be disregarded.

Replacement plans/specs have been provided the electrical work.

Question #51: Section 00110 para 2.1.1 states, “In addition contractors shall submit a single copy of the following information in a sealed envelope with their name on the outside. This information is sought pursuant to FAR 9.105-1 and will be opened and utilized only if the contractor is selected for award.” Is this referring to the information requested in paragraph 3.1.6.2? Please advise.

Yes. Reference RFI Q&A #02.

Question #52: Amendment 02, Response to Question #38 states, “This one copy should be submitted with volume 1. Will be 1 original and 3 copies, for each proposal submission.” Please clarify if this information should be included in the Volume 1 binder/file, or should it be physically separated from Volume 1 in a separate envelope inside the proposal envelope?

The copy of the of the “documentation of adequate financial resources” is part of Volume 1 submission, however, is to be in a separate sealed envelope. There will be 1 original and 3 copies. Therefore, it will not physically be in Volume 1 binder/file.

Question #53: Section 00110 para 3.1.6.2 states, “One original and three copies in a single sealed envelope (one for each proposal copy) of documentation of adequate financial resources: Provide letters of reference from financial institution(s) concerning credit worthiness and from bonding companies indicating capability to bond to the maximum task order value for this solicitation.” Please confirm this information is not to be included on the electronic CD copy.

No. This does not need to be provided on a CD

Question #54: Page 154 of the Amendment 2 RFP, Detailed Price Proposal, does not include Division 02 where we would normally place costs for Demolition. Where should we place these costs? Or, can it be added?

Please add it to Division 01 general requirements pricing.

Question #55: Page 154 of the Amendment 2 RFP, Detailed Price Proposal, only includes spaces for “Materials/Equipment” and “Labor”. There is no place for us to include “Other” costs that could include dump fees, testing, closeouts, etc. Where should those costs be placed? Or, can a column for “Other” be added?

Please incorporate “other costs” into Materials/Equipment column as necessary.

Question #56: Amendment #2, Q&A #30 states that only the 2 pages are required for the pricing. Can we include our own CSI breakdown in addition to these 2 pages to assist with explanation/evaluation of our pricing?

There is no page maximum, however only those two pages, the MATOC Prototypical Task Order Form (page 151) and the Detailed Price Proposal (Page 153) is required. An additional CSI breakdown submitted to explain the pricing further is allowable, as it falls in line with instruction in Section 00110 -

3.1.6.1 “Offerors shall provide all price/cost information necessary to provide a meaningful basis for Government's analysis and examination of price/cost for the project set forth in Section 00120 of this solicitation.”

Question #57: Section 00110 Vol 2 Part I - 3.2.1 States: “The Government intends to use Exhibit A Part 1 information in the evaluation of experience for Subfactor 1. A reiteration of the information provided in Exhibit A is neither required nor desired. Offeror should reference this information by providing a short summation of their relevant experience to meet the submission requirements of this subfactor.”

To clarify:

The 5 projects discussed in Volume 2 Part I (Technical Submission), Subfactor 1 Experience and Capability, are not the same documents to be submitted as Volume 2 Part II (Past Performance Submission) Exhibit A Part 1. They are to be the same projects, and they are to be discussed differently (technical vs. past performance) and evaluated according to the instructions in Section 00110 and 00120.

Question #58: Can you clarify that Exhibit A Part 1 and 2, and Exhibit B – are to be placed in Volume 2, Part II – and nowhere else?

YES. Exhibit A Parts 1 and 2 and Exhibit B are part of Vol 2 part II. These are not to be submitted in Vol 2 part I.
