6.1.5. For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
6.1.6. Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
7. Wage Determination. Construction Wage Rates are applicable to this project and are incorporated by reference. See the Wage Determination that is referenced in the Table of Contents. The current Wage Determination is also available from the SAM website.
8. Quote Preparation Expenses and Pre-Contract Costs. This RFQ does not commit the Government to pay costs incurred in preparation and submission of offers or for any other costs incurred prior to award of a formal contract.
9. Clauses and Provisions. Clauses and provisions from the RFO FAR, Defense FAR Supplement, and Army FAR Supplement are incorporated with this solicitation by reference and in full text.
Those incorporated by reference have the same force and effect as if they were given in full text.
10. Offerors Qualifications. To establish a offeror's responsibility, the Government may request the apparent low offerors to submit a statement regarding their experience in performing comparable work, business and technical organization, financial and bonding resources, and available plant /equipment to be used in performing the work. The contracting officer may also review other government systems of record (e.g. CPARS, FAPIIS, etc.).
11. This program is intended to encourage interested parties to seek resolution of their concerns with the NG as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and with the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from filing.
An agency protest may be filed with either the Contracting Officer or the NG Agency's Protest Decision Authority, but not both, and in accordance with NG protest procedures.
11.1. To be timely, the protests must be filed within the periods specified at RFO FAR 33.104, Protests to the Agency. To file a protest under the NG Agency Protest Program, the protest must request resolution under that program and sent to:

SECTION 00 22 16 - QUOTE EVALUATION AND BASIS FOR AWARD
1. GENERAL INFORMATION
1.1. This solicitation is for a single firm-fixed-price purchase order. The Government intends to award a single purchase order to the responsible Small Business quoter whose quotation conforms to all solicitation requirements and is determined to represent the best value to the Government, considering Technical Acceptability, Past Performance, and Price.
1.2. The selection process will be conducted in accordance with RFO FAR Parts 12 and 36, as applicable. Quotations will be evaluated using the streamlined commercial acquisition and comparative evaluation procedures of RFO FAR Part 12.201. The Government will not use formal source selection procedures under RFO FAR Part 15, except as necessary for price analysis as required by RFO FAR 12.204(a).
1.3. Quotations shall be evaluated solely on the basis of the factors and criteria stated in this solicitation. Failure to comply with solicitation requirements may raise questions regarding a quoter's technical capability, past performance, and/or pricing and may be grounds for elimination from further consideration. Failure to provide all information requested may adversely affect the Government's evaluation. A quotation that merely restates or promises compliance with the solicitation, without sufficient supporting detail, may be rejected or determined unacceptable.
1.4. The Contracting Officer will begin the evaluation process by conducting a compliance review of all timely received quotations to ensure responsiveness to the solicitation. Failure to provide a complete quotation submission package may result in the quotation being removed from further consideration for award. Failure to address any factor (Technical, Past Performance, or Price) shall be grounds for elimination from further evaluation and consideration for award.
1.5. Technical Acceptability will be evaluated on an acceptable/unacceptable basis. Only quotations rated Acceptable under the Technical factor will be eligible for further consideration.
1.6. Past Performance will be evaluated on an acceptable/neutral/unacceptable basis for all technically acceptable quotations. A quotation assigned a rating of Unacceptable for Past Performance will be ineligible for award. A quotation assigned a rating of Neutral for Past Performance will remain eligible for award.
1.7. Price will be evaluated for fairness and reasonableness.
1.8. Among quotations determined technically acceptable, the Government will comparatively evaluate Past Performance and Price pursuant to RFO FAR 12.203(c)(2) to determine which quotation represents the best value to the Government. In making that determination, the Government may select other than the lowest-priced quotation where the Government determines that a higher-priced quotation provides additional performance confidence or reduced performance risk that justifies the associated price premium.
1.9. The Government intends to evaluate quotations and make award without exchanges with quoters. However, the Government reserves the right to communicate with one or more quoters if the Contracting Officer determines such communication to be necessary or advantageous to the Government.
1.10. Enforceability of the Quotation. The quotation must set forth full, accurate, and complete information as required by this solicitation. By submission of the quotation, the quoter agrees that all resources, key personnel, and other elements identified in the quotation will be utilized for the duration of the contract, and any substitutions shall require prior Contracting Officer approval.
2. EVALUATION FACTORS FOR AWARD
2.1. The evaluation factors are:
(1) Technical Acceptability;
(2) Past Performance; and
(3) Price.
2.2. Technical Acceptability is a threshold requirement. Only quotations rated technically acceptable will be eligible for further consideration.
2.3. Among quotations determined technically acceptable, the Government will comparatively evaluate Past Performance and Price to determine which quotation represents the best value to the Government.
2.4. FACTOR 1: TECHNICAL ACCEPTABILITY
2.4.1. Technical Acceptability will be evaluated on an acceptable/unacceptable basis.
2.4.2. To receive a rating of Acceptable, the quotation shall demonstrate compliance with the statement of work, specifications, drawings, and applicable rules and regulations.
2.4.3. Technical drawings submitted with the quotation will be evaluated to determine whether the quoter demonstrates an adequate understanding of the requirement and the capability to successfully perform the work. Drawings shall be clear, concise, and presented in a professional manner.
2.4.4. Technical drawings are limited to ten (10) pages. Pages in excess of the stated limitation will not be reviewed or considered in the evaluation.
2.4.5. Prior to providing technical drawings to the technical evaluator, the Contracting Officer may redact company-identifying information to support a fair and impartial review. Quoters are therefore encouraged to minimize company-identifying information, such as logos, watermarks, and headers, within their technical drawings.
2.5. FACTOR 2: PAST PERFORMANCE
2.5.1. Past Performance will be evaluated for each technically acceptable quoter using information reasonably available to the Government, including SPRS, CPARS, FAPIIS, prior Government experience, and other relevant sources. Past Performance will be evaluated on an acceptable /neutral/unacceptable basis.
2.5.2. To receive a rating of Acceptable, the available past performance information must demonstrate a record of satisfactory or better performance, a general record of integrity and business ethics, and no significant indicators of performance risk to the Government.
2.5.3. A rating of Unacceptable may be assigned where the available past performance information demonstrates significant performance concerns or unacceptable risk to the Government, including, but not limited to, a record of unsatisfactory performance, default or termination for cause, fraud, lack of integrity or business ethics, or other adverse information that causes the Government to conclude the quoter is not a suitable candidate for award. A quotation assigned a rating of Unacceptable for Past Performance will be ineligible for award.
2.5.4. If no relevant past performance record is available, or if the Government is unable to obtain sufficient past performance information to make a meaningful assessment, the quoter may be assigned a rating of neutral. A neutral rating is neither favorable nor unfavorable and does not render the quotation ineligible for award.
2.5.5. In the Government's comparative evaluation of technically acceptable quotations, the Government may determine that a higher-priced quotation with a more favorable past performance record represents a better value where the additional performance confidence or reduced performance risk is determined to justify the associated price premium.
2.6. FACTOR 3: PRICE
2.6.1. Price will be evaluated for fairness and reasonableness.
2.6.2. The Government may evaluate price reasonableness using comparison of competitive quotations, comparison to the Government estimate, market research, historical pricing, and/or any other reasonable basis permitted under the RFO FAR.
2.6.3. A quotation may be rejected if the quoted price is determined to be unreasonable.
3. AWARD AND POST-AWARD NOTIFICATIONS
3.1. Award. A written award or acceptance of quotation furnished to the successful quoter within the time for acceptance specified in the quotation will result in award. A binding contract is formed when the quoter accepts the Government's purchase order, either by written acceptance of the purchase order or by substantial performance of the purchase order. The Contracting Officer may request written acceptance of the purchase order.
3.2. Explanations to Unsuccessful Quoters. In accordance with RFO FAR 12.301(b), upon request, the Government will provide a brief explanation of the award decision explaining why the unsuccessful quoter was not selected. If an award notice was not required to be posted to the Governmentwide point of entry, the Government may also provide the information that otherwise would have been included in the award notice, as applicable.
