About this file

This document is a compilation of Full Text Clauses and contract terms applicable to commercial items acquisitions under the Federal Acquisition Regulation (FAR). The document is not a solicitation but rather a template of standard contract clauses that contracting officers incorporate by reference into commercial item contracts.

The clauses cover mandatory compliance requirements across multiple regulatory areas including ethics and conduct, small business utilization and subcontracting, employment and labor standards, equal opportunity and non-discrimination, environmental compliance, foreign purchasing restrictions, payment procedures, and trafficking in persons prohibitions. Key mandatory clauses applicable to all commercial items cover prohibitions on Kaspersky Lab products, telecommunications and video surveillance equipment, inverted domestic corporations, and require contractor compliance with specified FAR provisions. Additionally, the document includes service-specific clauses such as Service Contract Labor Standards (FAR 52.222-41) and Fair Labor Standards Act requirements (FAR 52.222-44) that apply when the contract involves commercial services. The document presents checkbox options for contracting officers to indicate which optional clauses apply to specific acquisitions, including clauses related to small business set-asides, HUBZone preferences, women-owned small business concerns, service-disabled veteran-owned small business set-asides, energy efficiency requirements, and Buy American preferences under free trade agreements. Notably, the clauses address child labor prohibitions, with exemptions for acquisitions of products from specified countries above certain dollar thresholds ($50,000 for Israel, $83,099 for Mexico, and $182,000 for designated developed nations). The template also establishes that contractors are not required to flow down most FAR clauses to subcontractors for commercial products and services, with limited exceptions for ethics, prohibited entities, small business utilization, equal opportunity, and labor-related requirements.
