1. The U.S. Army Contracting Command – New Jersey has three (3) new construction requirements in support of the U.S. Army’s 99th Readiness Division. These projects are all located w ithin the 99th RD’s A04 Region: CSS 90242 – Clean Exterior Building Surface and Clean Window s at the Barnes Building located at 495 Summer Street in Boston, MA 02210 (MA004); CSS 89231 – Repair Loading Dock Doors at the Barnes Building located at 495 Summer Street in Boston, MA 02210 (MA004) ; and CSS 94754 – Replace Chiller Piping and Valves Barnes Building located at 495 Summer Street in Boston, MA 02210 (MA004).

2. The North American Industry Classif ication System (NAICS) Code for this project is 236220 – Commercial & Instituitional Building Construction, w ith a size standard of $45M.

1. On behalf of the 99th Readiness Division (RD) the U.S. Army Contracting Command – New Jersey has three (3) new Construction requirements for the following projects:

CSS 90242 – Clean Exterior Building Surface and Clean Windows at the Barnes Building located at 495 Summer Street in Boston, MA 02210 (MA004) o Description of Services: The Contractor shall provide all plant, labor, equipment, tools, materials, supervision, and transportation to accomplish the following work which consist of but is not limited to:

Testing and certifying of all fall arrest roof anchors, clean exterior building surface and clean windows, inside and out.

CSS 89231 – Repair Loading Dock Doors at the Barnes Building located at 495 Summer Street in Boston, MA 02210 (MA004) o Description of Services: The Contractor shall provide all plant, labor, equipment, tools, materials, supervision, and transportation to accomplish the following work which consists of but is not limited to the replacement of double doors with a motorized coiling door, installation of an entrance door and the installation of an electrical sub-panel.

CSS 94754 – Replace Chiller Piping and Valves Barnes Building located at 495 Summer Street in Boston, MA 02210 (MA004) o Description of Services: The Contractor shall provide all plant, labor, equipment, tools, materials, supervision, and transportation to accomplish the following work which consist of but is not limited to:

The replacement of steel piping on supply and return line of chiller units and the replacement of existing Pneumatic and manual valves and actuators.

All removal and installation requirements outlined within each SOW shall be performed. The North American Industry Classification System (NAICS) code that apply to the principal nature of these acquisitions: 236220 – Commercial & Institutional Building Construction – Size Standard of $45M.

2. Period of Performance. If the required Period of Performance is not sufficient to complete all the required work and/or receive the proper materials, please propose the delivery schedule your company will be able to meet and provide a detailed explanation. The current delivery schedule is mandatory, unless a proposed revision to the Delivery Schedule is accepted otherwise. Performance start dates will be staggered depending on award:

5. Basis for Award/Evaluation Criteria:

Award will be made to the Offeror(s) who is deemed responsible and responsive in accordance with Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposed price is considered lowest. The Government intends to award a contract without discussions (except for clarifications) but reserves the right to hold discussions if it is in the best interest of the Government.

Minimum Acceptability: If an Offeror takes exception to any of the terms and conditions of the solicitation, the offer may not be considered for award. All Offerors are urged to ensure that their initial proposals are submitted with the most favorable terms in order to reflect their best possible potential.

Each offeror must submit a technical capability proposal which addresses how the offeror will meet the requirements of the Statement of Work to include meeting the proposed schedule outlined in the solicitation. Failure to provide this information will render your proposal unacceptable. If subcontractors are being utilized, the subcontractor(s) name and information must be included in the proposal and the percentage of total subcontracting. The subcontractor tasks should be identified on the Contractor Cost Breakdown Form. Failure to provide this information could result in your proposal being considered nonresponsive and ineligible for award.

Price: Price is lowest priced offer. Award may not be made to the lowest offeror if the capability statement is considered unacceptable.

The Government will award single or multiple task orders resulting from this Solicitation to the responsible, responsive offeror, whose proposal meets the specifications and requirements defined by the Specification of Work, and whose price is lowest. The Government intends to award without discussions, but reserves the right to have discussions if in the best interest of the Government.

(e)BOND REQUIREMENTS: The contractor MUST furnish the required Performance and Payment Bonds within 10 Calendar Days after award for each (or all) of the projects awarded. Submittal of bonds shall be via email with pencil draft over raised seal for proof of corporation seal.

Bid Guarantee IAW FAR 52.228-1, must be submitted with your proposal submission to be eligible for award. Failure to provide a bid guarantee will render your proposal unacceptable.

6. When completing a proposal for submittal:

• The Offeror shall provide the name, title, address, email address and telephone number of the company point of contact regarding business decisions made with respect to the proposal and who can contractually obligate the company. Additionally, provide CAGE Code and Unqiue Entity Identifier (UEI) Number.

• The Offeror shall submit a price for each Firm Fixed Price Contract Line Item Number. Offeror is required to submit a signed SF-1442.

• The Offeror shall provide proof of valid Certificate of Insurance in accordance with FAR Clause 52.228-5 “Insurance – Work on a Government Installation.”

In accordance with FAR 22.406-5 and FAR 52.222-11(d)(1), if subcontracting, please ensure an SF 1413 is completed, signed, and acknowledged within 14 days after Contract Award/(s). Should separate Awards occur, an SF 1413 should be filled according to each requirement. A blank SF-1413 has been attached.

• The Offeror shall provide a Labor and Material Breakout of proposal within the excel attachment titled, Contractor Cost Breakdown Form. A separate Contract Cost Breakdown Form should be provided for each separate requirement. Section 00 70 00 - Conditions of the Contract

ACC LOCAL CLAUSES

52.228-4000 REQUIRED INSURANCE OCT/2010

In accordance with FAR 28.307-2, the Contractor is required to provide and maintain the kinds and minimum amounts of insurance stated below:

(a) Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers. (See 28.305(c) for treatment of contracts subject to the Defense Base Act.)

(b) General liability.

(1) The contracting officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

(2) Property damage liability insurance shall be required only in special circumstances as determined by the agency.

(c) Automobile liability. The contracting officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

(d) Aircraft public and passenger liability. When aircraft are used in connection with performing the contract, the contracting officer shall require aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

(e) Vessel liability. When contract performance involves use of vessels, the contracting officer shall require, as determined by the agency, vessel collision liability and protection and indemnity liability insurance.

LEVEL I ANTI-TERRORISM AWARENESS TRAINING REQUIREMENTS FOR CONTRACTOR

EMPLOYEES (OCT 2010)

(a) All contractor employees requiring access to any Federally-controlled facility and logical access to Federally controlled information systems except for “national security systems” as defined by 44 U.S.C. 3542(b)(2), should be certified in Level I Anti-Terrorism Training. The contractor is responsible for ensuring that the training has been satisfactorily completed and that valid certificates of completion have been submitted to the Contracting Officers Representative (COR) with a copy furnished to the Contracting Officer. The Certificates are valid for one year, therefore, training shall be completed every year for the duration of the contract.

(b) The term Federally-controlled facility is defined as:

(1) Federally-owned buildings or leased space, whether for single or multi-tenant occupancy, and its grounds and approaches, all or any portion of which is under the jurisdiction, custody or control of a department or agency;

(2) Federally-controlled commercial space shared with non-government tenants. For example, if a department or agency leased the 10th floor of a commercial building, the Directive applies to the 10th floor only;

(3) Government-owned, contractor-operated facilities, including laboratories engaged in national defense research and production activities; and

(4) Facilities under a management and operating contract, such as for the operation, maintenance, or support of a Government-owned or Government-controlled research, development, special production, or testing establishment.

(c) The term “Federally-controlled information system” means an information system (44 U.S.C. 3502(8)) used or operated by a Federal agency, or a contractor or other organization on behalf of the agency (44 U.S.C. 3544(a)).

(d) The term "contractor employee" includes employees, agents, students or student interns, or representatives and all employees, agents or representatives of all subcontractors and suppliers.

52.203-2 CERTIFICATE OF INDEPENDENT PRICE DETERMINATION (APR 1985)

(a) The offeror certifies that --

(1) The prices in this offer have been arrived at independently, without, for the purpose of restricting competition, any consultation, communication, or agreement with any other offeror or competitor relating to –

(i) Those prices,

(ii) The intention to submit an offer, or

(iii) The methods of factors used to calculate the prices offered:

(2) The prices in this offer have not been and will not be knowingly disclosed by the offeror, directly or indirectly, to any other offeror or competitor before bid opening (in the case of a sealed bid solicitation) or contract award (in the case of a negotiated solicitation) unless otherwise required by law; and

(3) No attempt has been made or will be made by the offeror to induce any other concern to submit or not to submit an offer for the purpose of restricting competition.

(b) Each signature on the offer is considered to be a certification by the signatory that the signatory --

(1) Is the person in the offeror's organization responsible for determining the prices offered in this bid or proposal, and that the signatory has not participated and will not participate in any action contrary to subparagraphs (a)(1) through (a)(3) of this provision; or

52.203-3 GRATUITIES (APR 1984)

(a) The right of the Contractor to proceed may be terminated by written notice if, after notice and hearing, the agency head or a designee determines that the Contractor, its agent, or another representative--

(1) Offered or gave a gratuity (e.g., an entertainment or gift) to an officer, official, or employee of the Government;

and

(2) Intended, by the gratuity, to obtain a contract or favorable treatment under a contract.

(b) The facts supporting this determination may be reviewed by any court having lawful jurisdiction.

(c) If this contract is terminated under paragraph (a) of this clause, the Government is entitled--

(1) To pursue the same remedies as in a breach of the contract; and

(2) In addition to any other damages provided by law, to exemplary damages of not less than 3 nor more than 10 times the cost incurred by the Contractor in giving gratuities to the person concerned, as determined by the agency head or a designee. (This subparagraph (c)(2) is applicable only if this contract uses money appropriated to the Department of Defense.)

(d) The rights and remedies of the Government provided in this clause shall not be exclusive and are in addition to any other rights and remedies provided by law or under this contract.

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 236220.

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
