About this file

This is a Request for Proposal (RFP) #2023-RFP-0195 issued by Sacramento County's Registrar of Voters (ROV) for Vote by Mail Envelopes. The county requires printing of various election ballot envelope styles to support its approximately 900,000 registered voters and one million eligible voters. The contract will cover envelope printing for different election types, with potential quantities ranging from 5,000 to 900,000 envelopes per election type. The initial contract period is expected to be from July 2023 through June 2024, with the option to extend for four additional one-year terms. Proposals are due by June 13, 2023 at 3:30 pm, with the contract anticipated to be awarded by June 30, 2023.

The RFP includes a detailed pricing table with 14 different envelope categories, each with varying quantity options from 1,000 to 1,000,000 envelopes. Envelope specifications include different colors (pink, buff, green, blue, white, orchid), sizes (ranging from 5 ¾" x 9 ¼" to 10" x 13"), and specialized features like drill holes, windows, and multi-language printing. The county requires bar coding capabilities, compliance with postal standards, and the ability to print emergency orders with shorter turnaround times. Proposers must provide production samples, meet specific delivery timelines, and be prepared to handle various election types including scheduled, unscheduled, special, recall, incorporation, municipal, district, and landowner elections.

9. LIQUIDATED DAMAGES

It is agreed that time is of the essence in completing each portion of the contract. If Contractor fails to deliver the envelopes on or before the dates specified in this section, it is understood that the County will suffer damages. It being impractical and infeasible to determine the amount of actual damages, in light of the impossibility of predicting the effect of the particular delay on the public welfare, it is agreed that for each calendar day after the delivery dates specified in this section that the envelopes that have not been delivered, Contractor shall pay the County an amount equal to two percent (2%) of the amount of the contract for the specific election as fixed and agreed liquidated damages but not as a penalty.

Liquidated damages will not be charged for each calendar-day delay caused by the County. Likewise, provided that Contractor has within one day of delay notified the ROV, Contractor shall not be charged with liquidated damages or any excess costs when the delay in delivery is due to unforeseen causes beyond the control and without the fault of Contractor including but not restricted to a court order, acts of God, or acts of the public enemy.

CONTRACTOR hereby certifies that either:
