SUMMARY OF WORK
PART 1 GENERAL
1.1 Description
This design-build project involves the design and construction of two pre-engineered metal building systems consisting of a large open area for warehouse/storage operations and multiple separated smaller administrative office locations inside the building. The large warehouse building is approximately 156 x 61 meters and the transfer warehouse is 100 x 30 meters.
Both facilities areas require HVAC, power, fire protection and life safety provisions, communication (data & telephone), and utilities. The base bid includes each facility to be entirely independent of the public grid, to include primary utilities and distribution between both warehouses in the form a septic holding tank, domestic water tank storage, fire water storage tank including fire water booster pumps, as well as a generator with fuel tank. Both warehouses require conduit and cable trays installed as part of this project for a future digital tracking system. The Base Bid items are to include the following:
1) Mobilization and Demobilization

3) Construct Large Logistics Warehouse
4) Large Logistics Warehouse Domestic Water Storage Tank(s), Pump House(s) and any connections to the Facility
5) Large Logistics Warehouse Prime Power Generator System and connections to the Facility

7) Transfer Warehouse Domestic Water Storage Tank(s), Pump House(s) and any connections to the Facility
8) Transfer Warehouse Prime Power Generator System and connections to the Facility
9) Construct Support Facilities
The Options are as follows:
1) Operations and Maintenance (O&M) for First Year
2) Operations and Maintenance (O&M) for Second Year
3) Operations and Maintenance (O&M) for Third Year
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor as identified in FAR 52.217-7 Option for Increased Quantity--Separately priced Line Item (MAR 1989). The Period of Performance will begin upon the issuance of the modification to exercise the option(s).
At the beneficial occupancy date (BOD), if the these facilities will not be connected to commercial electricity, sewer and water, and communications provisions in the contract Base Bid and Options section allow for a complete and usable facility upon completion by the contractor. Facilities future utility services should plan to the 1.5 meter line of the facility for utility tie-ins.

1.1.1 Large Warehouse
Large warehouse to include, six (6) overhead doors (sized to 5m x 5m) electrically operated with manual capability. The warehouse will be divided into three areas by chain-link fencing with a personnel entrance and swing gate entrance (chain-link). HVAC throughout (split units for small office spaces), power per each of three areas: 400/230V, 50 Hertz, water supply (wall hydrant) per area, fire alarm/suppression throughout, non-Slip Floor, fully reinforced concrete in all areas, and material handling equipment charging station. The small separated administrative offices include, but are not limited to; open offices, storage, kitchen, bathroom, mechanical/electrical/ communications rooms with doors/windows to meet safety requirements.
1.1.1.1 Other Requirements
Site improvements to include parking lot and outside concrete ramp for forklift loading/unloading are included in this scope of work. Interior design, to include furniture, is not included this scope of work.
1.1.2 Transfer Warehouse
The smaller transfer warehouse includes, three (3) overhead doors (sized to 5m x 5m) electrically operated with manual capability HVAC throughout (split units for small office spaces), power: 400/230V, 50 Hertz, water supply (wall hydrant), fire suppression throughout, non-Slip Floor, fully reinforced concrete in all areas, and material handling equipment charging station. The small separated administrative offices include, but are not limited to: open Offices, storage, kitchen, bathroom, mechanical/electrical/communications rooms and doors/windows to meet safety requirements.
1.1.2.1 Other Requirements
Site improvements to include parking lot and outside concrete ramp for forklift loading/unloading are included in this scope of work. This facility will be constructed next to the perimeter wall of the base and have part of the perimeter wall re-constructed to act as the ramp and entrance into the facility. This design is required to unload vehicles without having the vehicle enter the Subhan Military Complex.
1.2 Topographical Survey, Geotechnical and Commercial Utilities
Investigations The contractor shall perform topographical survey and geotechnical investigation to support the design of the facilities and site.
Also, the contractor shall investigate the existing commercial utilities closest to the site, which is electrical, domestic water, sewer, and fire protection water, to determine available capacity, location, and requirements for warehouses utilities tie-ins.
1.2.1 Project Site Location
The two warehouses locations are located on Subhan Military Complex, approximately 14Km south of Downtown Kuwait City. The Subhan Military Complex is located on the southwest corner of Highway 40 and Mohamad Bin Hamada Al Ajmi/ 207 Road and just east of the Kuwait International Airport. The first warehouses location for the Transfer Warehouse is 29 degrees 14' 14.7"N/ 48 degrees 02' 4.1"E. The second warehouse location for the Large Warehouse is 29 degrees 14' 14.7"N/ 48 degrees 02' 24.1"E.

1.3 OPERATION AND MAINTENANCE
The Contractor shall provide provide all facility component warranties, and where applicable and under contract to exercise options will provide option years for facility O&M Services.
1.4 Designs Approval by Kuwait Ministries
The Contractor shall obtain approval from the KMOD ministries required before construction.

PART 1 GENERAL
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00.12 10 SUBMITTAL PROCEDURES FOR

1.2 CONTRACTOR ACCESS AND USE OF PREMISES
1.2.1 Activity Regulations
Ensure that Contractor personnel employed on the project site become familiar with and obey activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas, and hard toed or steeled toed boots. Do not enter any restricted areas unless required to do so and until cleared for such entry. Mark Contractor equipment for identification.
1.2.1.1 Subcontractors and Personnel Contacts
Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.2.1.2 No Smoking Policy
Smoking is prohibited within and outside of all buildings, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines.
1.2.2 Working Hours
Regular working hours will be from 0700 to 1700 daily. The Government fully expects the Contractor to apply for work beyond normal working hours to complete the work in the time allocated. The work week will be Saturday through Thursday, excluding the following Government holidays:

1.2.3 Work Outside Regular Hours
Work outside regular working hours requires Contracting Officer approval.
Make application 15 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work must be lighted in a manner approved by the Contracting Officer.
1.2.4 Utility Cutovers and Interruptions
a. Make utility cutovers and interruptions after normal working hours or as directed by the Contracting Officer.
b. Ensure that new utility lines are complete, except for the connection, before interrupting existing service.
c. Interruption to water, sanitary sewer, storm sewer, telephone service, electric service, air conditioning, heating, fire alarm, andcompressed air are considered utility cutovers pursuant to the paragraph WORK OUTSIDE REGULAR HOURS. Such interruptions are further limited to two
(2) hours. This time limit includes time for deactivation and reactivation. Any additional time will require written approval of the Contracting Officer.
1.3 SECURITY REQUIREMENTS
1.3.1 Requirements
All contractor, subcontractor, or vendor personnel and vehicles at any tier
SECTION 01 14 00 Page 3 working at any location on the project are subject to a thorough search upon entering, departing, or at any time deemed necessary by KMOD Personnel. The Contractor shall be responsible for compliance with all laws, regulations and policies of the Government of Kuwait. The Government reserves the right to deny access or to require the contractor to remove any personnel or equipment deemed to be a threat to security. Work through the Contracting Officer to assure that security regulations are followed.
1.3.2 Security Area
All work under this contract will be confined to the Contractor's staging/laydown area(s), and the project areas. Minimum requirements for Contractor entry and operations are described below.
1.3.2.1 Identification of Employees in the Development Area
The Contractor is responsible for coordinating the demographics of his workforce to account for Kuwait's laws regarding so-called "countries of concern." Subsequently, each individual shall go through Screening Process before the issuance of entry badge. Employees shall wear identification badges prominently displayed at all times while in the Project Areas.
Failure to wear a properly displayed identification badge may be considered grounds for removal of the employee from the sites. Conduct random inspections to assure that identification badges are properly displayed. In addition to identification badges, all contractor labor personnel shall wear coveralls of a distinct color for the contractor's personnel and for each subcontractor's personnel. The coveralls shall have markings on the back clearly identifying the company for whom the employee works.
1.3.2.2 Identification of Vehicles and Equipment in the Project Areas
All Contractor vehicles and equipment entering the project areas must be listed on the Access List. Provide a list of all vehicles that require access to the project areas. This access list includes the type of equipment, make and model, registration number, company name of owner.
Plan vehicle and equipment requirements such that the access list will contain all those vehicles and equipment that will need access to the project areas for completion of the particular work item being performed.
All Contractor vehicles and equipment will be subject to a thorough inspection by security personnel, including, as a minimum, a detailed inspection of the vehicle's interior and undercarriage. No vehicle may be left unattended in the project areas at any time.
1.3.3 Escorted Access Passes
On occasion that an individual vendor or subcontractor manager, materials delivery vehicle etc., requires access to project areas, whose name or vehicle does not appear on the current employee or vehicle access list, those person may be allowed escorted access with KMOD approval. Contractor shall be solely responsible to obtain such permission..
1.3.4 Contractor Security Manager
Appoint an individual to act as Security Manager throughout the duration of this contract. The Security Manager's primary function is to coordinate all issues relative to access work site, to establish and maintain employee and vehicle access lists, to coordinate the entry of escorted visitors and materials to the Security Areas, and to generally represent the contractor's interest in dealing with the Contracting Officer and the

Kuwait security officer. This individual must be capable of clearly communicating orally and in writing with Security personnel. The ability to communicate in English as well and Arabic/Modern Standard Arabic and coordinate access with KMOD security personnel is required.The ability to communicate in other languages than English will be beneficial as well. The Security Manager will be subject to the approval of the KMOD and can be removed from the position at any time at the request of the KMOD. The Security Manager will work at the Contractor's office. At the start of construction the Security Manager, the Contracting Officer and KMOD Officer must meet to discuss all details of the security requirements, to reach an understanding of the Security Manager's duties and other operational relationships.
1.3.5 Access to Operational Areas
Contractor personnel are expressly prohibited from entering the Project Area without authorization. Coordinate necessary access through the Contracting Officer and approved by the Security Officer a minimum of 14 days before access is required.

SUPPLEMENTARY REQUIREMENTS

1.2 DESIGNER OF RECORD QUALIFICATIONS
The following shall serve as minimum requirements for Registered Designers, including engineers and architects acting as Designer(s) of Record (DOR).
The Designer(s) of Record shall have responsibility for the preparation and issuing of documents and services pertaining to that specific discipline.
All design work shall be performed or supervised by the appropriate Designer of Record.
Each Registered Designer and/or Design Firm performing design work shall have at minimum one person with a bachelor's degree or equivalent college degree in the applicable discipline, and each shall hold a current professional registration in any of the 50 States of the United States of America, or equivalent recognized international body. Acceptance of equivalency of a university's degree for professional registration and each professional registration shall be at the sole discretion of the Contracting Officer. Proof of degrees and licensing shall be provided.
At a minimum each design discipline shall have at least one person with a minimum of five (5) years of experience in the applicable field designing projects of similar scope, complexity and magnitude, or as otherwise specified in the Contract Documents.
1.3 MEETING MINUTES
The Contractor shall be responsible for the preparation of minutes of all meetings specified in the contract documents. Unless otherwise specified, SECTION 01 15 00.12 10 Page 2 these minutes shall be prepared within two (2) working days after meeting and signed by both the Contractor and Contracting Officer. Contractor shall provide signed copies to all attendees.
1.4 UNSCHEDULED WORK STOPPAGES
The Contractor shall anticipate unscheduled removal from the work site an average of 10 hours per month per installation. If the total quantity of delays varies above or below the stated quantity, an equitable adjustment under Contract Clause 52.243-4 CHANGES shall be made upon written demand of either party. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date if, in the judgment of the Contracting Officer, a delay is justified.
1.5 DIGGING PERMITS
1.5.1 Requirements for Digging Permits
Prior to the start of any work activity which requires excavation within the current project site, the Contractor shall obtain a digging permit.
1.5.2 Not Used
1.5.3 Preparation of Requests for Digging Permits
Prior to submitting a request for a Digging Permit, the Contractor shall carefully review the area to be excavated to determine the location of existing utilities and other obstructions. The Contractor will review available drawings and will conduct a visual inspection of the site. The Contractor will utilize underground utility detecting devices such as metal and cable detectors to determine the location of existing utilities. All utility lines found shall be clearly flagged or marked and the location of the utility shall be shown on the drawing to be submitted with the request for Digging Permit.
1.5.4 Existing Underground Utilities
Existing utilities may be present in the construction area which may not be shown, or are inaccurately shown, on the base as-built drawings and the contract drawings. The Contractor shall exercise utmost care in researching locations of existing utilities and reducing damage to existing utilities.
Any utilities damaged by the Contractor shall be promptly repaired by the Contractor. The Contracting Officer will review and approve any proposed repairs. Any damage to existing utilities will be immediately reported to the Contracting Officer.
1.5.5 Use of Underground Utility Detecting Device
Prior to any excavation, a metal and/or cable detecting device shall be used along the route of the excavation. All underground utilities discovered by this method will be flagged a minimum distance of 2 meters on each side of the location.
1.5.6 Hand Excavation
Hand excavation methods and special supervisory care shall be used between any flagged markers, in areas of known or suspected hazards, and in areas
SECTION 01 15 00.12 10 Page 3 known or suspected to have multiple and/or concentrated utility lines or connections.
1.6 HAUL ROUTES - SPECIAL REQUIREMENTS
The Contractor shall be responsible for coordinating with the Host Government use of any existing roads as haul routes. Construction, and routing of new haul roads, and/or upgrading of existing roads for the Contractor's use, is the sole responsibility of the Contractor. It shall be the Contractor's responsibility to obtain such local authorizations, permits and licenses necessary to establish his mobilization camp, quarry operations, batching operations and haul routes.
1.7 RESPONSIBILITY FOR PHYSICAL SECURITY
Prior to mobilization, the Contractor shall submit his proposed means of providing project security to prevent unauthorized access to equipment, facilities, materials and documents, and to safeguard them against sabotage, damage, and theft. The Contractor shall be responsible for physical security of all materials, supplies, and equipment of every description, including property which may be Government-furnished or owned, for all areas occupied jointly by the Contractor and the Government, as well as for all work performed.
1.8 CERTIFICATES OF COMPLIANCE
Any certificates required for demonstrating proof of compliance of materials with specification requirements shall be executed in accordance with Section 01 33 00.12 10 SUBMITTAL PROCEDURES FOR DESIGN-BUILD. Each certificate shall be signed by an official authorized to certify in behalf of the manufacturing company involved and shall contain the name and address of the Contractor, the project name and location, description and the quantity of the items involved, and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates shall contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification shall not be construed as relieving the Contractor from furnishing satisfactory material.
1.9 ACCIDENT PREVENTION
The Contractor shall comply with all applicable Host Country laws and with such additional measures as the Contracting Officer may find necessary in accordance with CONTRACT CLAUSE 52.236-13 entitled ACCIDENT PREVENTION (NOV 1991). Applicable provisions of the Corps of Engineers manual entitled Safety and Health Requirements Manual EM 385-1-1, will be applied to all work under this contract. The referenced manual may be obtained from the Contracting Officer's Representative at the jobsite or from the Middle East District at Winchester, Virginia.

The Corps of Engineers Health and Safety Manual, EM 385-1-1, section 11.C.05.a. states: "The GFCI device shall be calibrated to trip within the threshold values of 5 ma +/- 1 ma as specified in Underwriters Laboratory (UL) Standard 943." A variance from USACE has been granted allowing 10 ma, in lieu of 5 ma, for overseas activities that use 220 Volts(V)/50 hertz(hz) electrical power.

1.9.2 Temporary Power - Electrical Distribution Boxes
EM 385-1-1 section 11.A.01.a. states "All electrical wiring and equipment shall be a type listed by a nationally recognized testing laboratory for the specific application for which it is to be used." This includes temporary electrical distribution boxes. Locally manufactured electrical boxes will not be allowed. Only manufactured electrical distribution boxes that meet the European CE requirements, with 10 ma CE type GFCIs installed shall be allowed.
Contractors shall:
a. Make no modifications that might void any CE or manufacturer certification.
b. Test the installed systems to demonstrate that they operate properly and provide the 10 ma earth leakage protection.
c. Ensure GFCIs will have an integral push-to-test function. The testing shall be performed on a regular basis.
d. Check that proper grounding is checked regularly and flexible cords, connectors, and sockets inspected before each use.
1.10 LOCALLY AVAILABLE SERVICE FOR EQUIPMENT
All equipment furnished under this contract, regardless of country of manufacture or purchase, must have in-country service availability. In the event that the Contractor proposed to provide equipment for which in-country service is not available, the Contractor must provide written justification for the Contracting Officer's approval. This justification shall be submitted for each product or material for which a waiver is sought concurrently with the submittal required by the Technical Provisions. Submission of group or "blanket" waivers is unacceptable.
1.11 CONTRACTOR'S MOBILIZATION AREA
The Contractor will be permitted to use an area as directed by the Contracting Officer within the contract limits for operation of his construction equipment and plants, shops, warehouses, and offices. The Contractor shall not be authorized to have living accommodations for his work force on the site. The Contractor is responsible for obtaining any required additional mobilization area above that designated. On completion of the contract, all facilities shall be removed from the mobilization area by the Contractor and shall be disposed of in accordance with applicable Host Government Laws and Regulations. The site shall be cleared of construction debris and other materials and the area restored to its final grade. See Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES for additional requirements.
1.12 CONTRACTOR'S OFF BASE MOBILIZATION AREA
The Contractor shall provide, furnish, operate and maintain facilities for his batching operations (e.g. concrete, asphalt, etc.) major shops and living facilities for his workers in an area off base. The specific area must be located such that no new contractor facilities are within the "Inhabited Building Clear Zone" (approximately 1355 meters, radius) surrounding ammunition/explosives storage and/or handling areas. The

Contractor must submit his desired site location to the Contracting Officer for approval. All utilities will be the responsibility of the Contractor and shall be provided at no cost to the Government. On completion of the contract, all facilities shall be removed by the Contractor and shall be disposed of in the manner directed by the Contracting Officer. The site shall be cleared of construction debris and other materials and the area restored to its original condition. See Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES for additional requirements.
1.12.1 Facilities Within the Mobilization Site
All facilities within the Contractor's mobilization site shall be of substantial construction suitable for the local weather conditions.
Housing, messing and sanitary facilities shall meet the requirements of Corps of Engineers Safety and Health Requirements Manual EM 385-1-1. The Contractor shall provide all utilities required to make the site self-sufficient.
1.12.2 Special Requirements
The Contractor shall be responsible for coordinating with the Host Government use of any existing roads as haul routes. Construction, and routing of new haul roads, and/or upgrading of existing roads for the Contractor's use, is the sole responsibility of the Contractor. It shall be the Contractor's responsibility to obtain such local authorizations, permits and licenses necessary to establish his mobilization camp, quarry operations, batching operations and haul routes (See paragraphs entitled
"COMPLIANCE WITH HOST COUNTRY RULES AND CUSTOMS".
1.13 STANDARDIZATION
Where two or more items of the same type or class of equipment furnished in this project are required, the units shall be products of the same manufacturer and shall be interchangeable when of the same size, capacity, performance characteristics, and rating. The only exception to this requirement is where the items are interchangeable due to conformance with industry standards (valves, fittings, etc.), they need not be by the same manufacturer. This requirement applies to all manufactured items in the project which normally require repair or replacement during the life of the equipment.
1.14 ON-BASE PHOTOGRAPHY PROHIBITION
The Contractor shall not engage in any form of photography without prior written approval from the Contracting Officer.
1.15 PUBLIC RELEASE OF INFORMATION
1.15.1 Prohibition
There shall be no public release of information or photographs concerning any aspect of the materials or services relating to this bid, contract, purchase order, or other documents resulting therefrom without the prior written approval of the Contracting Officer.
1.15.2 Subcontract and Purchase Orders
The Contractor agrees to insert the substance of this clause in all purchase orders and subcontract agreements issued under this contract.

1.16 RESIDUAL CONSTRUCTION MATERIAL
All Contractor purchased materials and equipment intended for incorporation into the completed facilities and which are later determined excess to the actual construction requirements, will become the property of the Government. The residual materials and equipment shall be tagged (giving the area where like type material and equipment were installed), and stored in an orderly manner in a designated area as directed and approved by the Contracting Officer.
1.17 COMPLIANCE WITH HOST COUNTRY RULES AND CUSTOMS
The laws of Host Country may prohibit access to certain areas of the country which are under military control. The Contractor shall furnish the Contracting Officer the names of personnel, type, and amounts of equipment, dates and length of time required at the site, and the purpose of entering the host country. It is understood that areas to which rights of entry are provided by the Host Government are to be used only for work carried out under the contract and no destruction or damages shall be caused, except through normal usage, without concurrence of the Host Government.
1.17.1 Contractor's Responsibilities
The following items are the sole responsibility of the Contractor to investigate, estimate as to cost, and assume the risk, as normally encountered by Contractors. The Contractor shall be responsible for determining the effect of the following on his own cost of performance of the contract and for including sufficient amount in the contract price:
a. Official language and type of accounts required to satisfy the officials of the Local Government.
b. Entry and exit visas, residence permits, and residence laws applicable to aliens. This includes any special requirements of the Host Government, including those required by local Labor Offices, which the Contractor may have to fulfill before an application for a regular block of visas will be accepted.
c. Passports, health and immunization certificates, and quarantine clearance.
d. Compliance with local labor and insurance laws, including payment of employer's share of contribution, collecting balance from employee and paying into insurance funds.
e. Strikes, demonstrations and work stoppage.
f. Collection through withholding and payment to local Government, of any Host Country income tax on employees subject to tax.
g. Arranging to perform work in the Host Country, to import personnel, to employ non-indigenous labor, to receive payments and to remove such funds from the country.
h. Operating under local laws, practices, customs and controls, and with local unions, in connection with hiring and firing, mandatory wage scales, vacation pay, severance pay, overtime, holiday pay, 7th day of rest, legal notice or pay in lieu thereof for dismissal
SECTION 01 15 00.12 10 Page 7 of employees, slowdown and curtailed schedules during religious holidays and ratio of local labor employed in comparison to others.
i. Possibility of claims in local bureaus, litigation in local courts, or attachment of local bank accounts.
j. Compliance with workmen's compensation laws and contributions into funds. Provisions of necessary medical service for Contractor employees.
k. Special license required by the local Government for setting up and operating any manufacturing plant in the Host Country, e.g.
concrete batching, precast concrete, concrete blocks, etc.
l. Sales within the host country of Contractor-owned materials, and equipment.
m. Special licenses for physicians, mechanics, tradesmen, drivers, etc.
n. Identification and/or registration with local police of imported personnel.
o. Stamp tax on documents, payments and payrolls.
p. Base passes for permanent staff, day laborers, motor vehicles, etc.
q. Compliance with all customs and import rules, regulations and restrictions, including, but not limited to, local purchase requirements.
1.18 RADIO TRANSMITTER RESTRICTIONS
To preclude accidental actuation of sensitive electronic equipment, the Contractor shall not use radio transmitting equipment without prior approval of the Contracting Officer.
1.19 BASE HOT WORK PERMITS
1.19.1 Requirement for Hot Work Permits
Prior to the start of a work activity including hot work (welding, burning, etc.) or the operating of other flame producing devices, the Contractor shall obtain a Hot Work Permit.
1.19.2 Requests for Hot Work Permits
Requests for Hot Work Permits shall be submitted through the Contracting Officer to the Base Fire Department a minimum of 7 days prior to the start of the work activity covered by the permit. The request for a Hot Work Permit shall include a narrative description of the work to be accomplished, a list of equipment to be used, and a description of special safety precautions that the Contractor will put in place during the work to assure compliance with EM 385-1-1 and Base Fire Regulations.
1.19.3 Preparatory Inspections and Inspection of Equipment
During the Preparatory Inspection for any work activity including hot work, the Hot Work Permit shall be reviewed. During the Preparatory inspection, SECTION 01 15 00.12 10 Page 8 all hot equipment and safety equipment shall be checked to assure that it is in proper working order. Safety equipment required by the Hot Work Permit shall be checked at the beginning of each shift to assure that it is in proper working order.
1.20 CONTRACTOR TRANSPORTATION AND CUSTOMS CLEARANCE
All materials and equipment which are not to be incorporated into the project, such as office trailers, cranes, metal forms, etc., may be shipped free of duty, if the following actions are taken:
1.20.1 Shipments of Materials
All shipments of materials into the country for use in performance of work under this contract and supplies or services necessary for support of the Contractor's personnel shall be addressed to the shipping address furnished to the Contractor by the Contracting Officer. Address will be furnished upon request by the Contractor.
1.20.2 Contractor's Responsibilities
The Contractor shall be responsible for all customs clearance actions. All necessary arrangements, clearance procedures, and coordination with the Host Government customs, will be the sole responsibility of the Contractor. The Contractor shall submit to the Contracting Officer, with a cover letter, information copies of the shipping documents for the shipment(s) involved. As a minimum, the following shall be included as enclosures, with the cover letter to the Contracting Officer in three (3) copies:
a. Invoice. (Include a copy in Arabic)
b. Bill of Lading.
c. Certificate of Origin.
d. Statement on the cover letter as to Port of Customs Clearance, estimated arrival date, general description of the shipment, quantity and the name of the carrier.
e. Serial number or model number of shipment items.
1.20.3 Physical Handling of Materials
The Contractor shall be responsible for performance of all loading, unloading, transportation or other physical handling of materials as may be required, including all movement from carrier unloading site to delivery at the job site and all movement required at the customs area.
1.20.4 Certification
The U.S. Embassy, upon receipt of request of shipping documents, shall issue a letter to the Director of Customs certifying that the materials are being brought into Kuwait under the applicable agreement and should be allowed into Kuwait duty-free.

1.1 REFERENCES

1.2 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00.12 10 SUBMITTAL PROCEDURES FOR DESIGN-BUILD:
SD-01 Preconstruction Submittals Progress and Completion Pictures; G M/R
1.3 PROGRESS AND COMPLETION PICTURES
Photographically document site conditions prior to start of construction operations. Provide monthly, and within one month of the completion of work, digital photographs, JPEG file format showing the sequence and progress of work. Take a minimum of 20 digital photographs each week throughout the entire project from a minimum of ten views from points located by the Contracting Officer. Submit with the monthly invoice two sets of digital photographs, each set on a separate compact disc (CD) or data versatile disc (DVD), cumulative of all photos to date. Indicate photographs demonstrating environmental procedures. Provide photographs for each month in a separate monthly directory and name each file to indicate its location on the view location sketch. Also provide the view location sketch on the CD or DVD as a digital file. Include a date designator in file names. Cross reference submittals in the appropriate daily report. Photographs provided are for unrestricted use by the Government.
1.4 SUPERVISION
1.4.1 Minimum Communication Requirements
Have at least one qualified superintendent, or competent alternate, capable of reading, writing, and conversing fluently in the English language, on the job-site at all times during the performance of contract work. In addition, if a Quality Control (QC) representative is required on the contract, then that individual must also have fluent English communication skills.

1.4.2 Superintendent Qualifications
The project superintendent must have a minimum of 10 years experience in construction with at least 5 of those years as a superintendent on projects similar in size and complexity. The individual must be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance. The individual must be capable of interpreting a critical path schedule and construction drawings. The qualification requirements for the alternate superintendent are the same as for the project superintendent. The Contracting Officer may request proof of the superintendent's qualifications at any point in the project if the performance of the superintendent is in question.
1.4.2.1 Duties
The project superintendent is primarily responsible for managing and coordinating day-to-day production and schedule adherence on the project.
The superintendent is required to attend partnering meetings, and quality control meetings. The superintendent or qualified alternative must be on-site at all times during the performance of this contract until the work is completed and accepted.
1.4.3 Non-Compliance Actions
The Project Superintendent is subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion. Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to such stop orders is acceptable as the subject of claim for extension of time for excess costs or damages by the Contractor.
1.5 PRECONSTRUCTION CONFERENCE
After award of the contract but prior to commencement of any work at the site, meet with the Contracting Officer to discuss and develop a mutual understanding relative to the administration of the value engineering and safety program, preparation of the schedule of prices or earned value report, shop drawings, and other submittals, scheduling programming, execution, prosecution of the work, and clear expectations of the "Interim DD Form 1354" Submittal. Major subcontractors who will engage in the work must also attend.
1.6 PARTNERING
To most effectively accomplish this contract, the Government requires the formation of a cohesive partnership within the Project Team whose members are from the Government, the Contractor and their Subcontractors. Key personnel from the Supported Command, the End User (who will occupy the facility), the Government Design and Construction team and Subject Matter Experts, the Installation, the Contractor and Subcontractors, and the Designer of Record will be invited to participate in the Partnering process. The Partnership will draw on the strength of each organization in an effort to achieve a project that is without any safety mishaps, conforms to the Contract, and stays within budget and on schedule.
The Contracting Officer will provide Information on the Partnering Process and a list of key and optional personnel who should attend the Partnering meeting.

1.6.1 Informal Partnering
The Contracting Officer will organize the Partnering Sessions with key personnel of the project team, including Contractor personnel and Government personnel.
The Initial Partnering session should be a part of the Pre-Construction Meeting. Partnering sessions will be held at a location agreed to by the Contracting Officer and the Contractor (typically a conference room provided by the Resident Engineer office or the Contractor). The Initial Informal Partnering Session will be conducted and facilitated using electronic media (a video and accompanying forms) provided by the Contracting Officer. The Partners will determine the frequency of the follow-on sessions, at no more than 3 to six month intervals.
1.7 ELECTRONIC MAIL (E-MAIL) ADDRESS
Establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments as text files, pdf files, and other similar formats. Within 10 days after contract award, provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence. The Contracting Officer may also use email to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes or terrorist threats.
Multiple email addresses are not allowed.
It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). Promptly notify the Contracting Officer, in writing, of any changes to this email address.

COST-LOADED NETWORK ANALYSIS SCHEDULES (NAS) FOR DESIGN-BUILD
PART 1 GENERAL
1.1 DESCRIPTION
The Contractor is responsible for scheduling all design, procurement, Contractor quality control and construction, acceptance testing and training. A single schedule shall logically incorporate all design and construction for the entire project. Unless otherwise indicated, the contractor may begin construction when design is signed, stamped and submitted to the Government via the Contractor's quality control organization. If Government approval is required for any portion of a final signed and sealed design package prior to construction, that review time shall be included in the schedule. The schedule shall also include times for procurement, Contractor quality control and construction, acceptance testing and training. Refer to Specification Section 01 33 00.12 10 SUBMITTAL PROCEDURES FOR DESIGN-BUILD to determine if any items require Government approval prior to construction. If any are required, include that submittal review time in the schedule.
The schedule is a tool to manage the project, both for Contractor and Government activities. It will also be used to report progress and evaluate time extensions. The Project NAS must be cost-loaded and will provide the basis for progress payments.
