1. Offerors must insert a price on all numbered items of the CLIN pricing schedule. Prices include both design and construction. Failure to do so may result in the offer being unacceptable. Additions will be subject to verification by the Government. In case of variation between the lump-sum (L.S.) prices and the total amount, the lump-sum prices will be considered the price. In case of variation between the unit prices and the extensions, the unit prices will be considered the price submitted. Offerors must provide a cost breakdown of each lump sum price (management, labor hours, materials and other direct charges). The Government reserves the right to exercise the options from contract award to within 90 days after issuance of Notice to Proceed for CLINs 0015-0020 and within 180 days after issuance ofNotice to Proceed for CLINs 0013-0014. See FAR 52.217-5 Evaluation of Options.

2. The offeror agrees to perform the work required at the prices specified above in strict accordance with the terms of this scope of work, if this offer is accepted by the Government in writing within 60 calendar days after the date offers are due.

3. The Offeror shall submit pricing data on the latest Pricing Schedule as published in the solicitation or the latest amendment thereto. In lieu of indicating additions/deductions to line items, all Offerors should state their revised prices for each item.

4. Offerors must insert a price on all numbered items of the Pricing Schedule. Failure to do so will disqualify the Offer.

5. All quantities are estimated except where the unit is given as Job. If a modification to a proposal is submitted and provides for a lump-sum adjustment to the total estimated cost, the application of the Job adjustment to each unit price and/or lump-sum price, in the Pricing Schedule must be stated or, ifit is not stated, the Offeror agrees that the lump-sum adjustment shall be applied on the prorated basis to every item in the Bidding Schedule.

6. All the extensions of the unit prices shown (if applicable) will be subject to verification by the Government.

In case of variation between the unit price and the extension, the unit price will be considered to be the offer.

7. The Offeror shall propose total contract duration in number of calendar days after the notice to Proceed (NTP) is received by the Contractor, whether via electronic means or hard copy, whichever is the earliest method of delivery. The total number of proposed calendar days for construction through completion, ready for turnover shall not exceed the days shown at, SCR: 52.211-10 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK. The proposed duration shall become the required contract duration. The Government may issue the NTP via e-mail or Facsimile (FAX) or by other means.

Day number 1 is the day after the date of the receipt of the NTP.

This construction project includes constructing three (3) 50,000 gal (each) welded horizontal steel above-ground fuel storage tanks complete with railings and associated necessary appurtenances, two commercial truck unloading stands with equipment canopies, two re-fueler loading stands with optional equipment canopies, enclosed Electrical Control House and Open Shelter Filter house, Fuel Operations Facility (building) with fuel testing laboratory, Re-fueler Vehicle Parking with cement concrete parking, secondary containment, and R-11 maintenance building. Additionally, the project includes constructing a Military Service Station (MSS) consisting of 8,000 gallons of diesel storage with two dispensing nozzles, 8,000 gallons of Motor Gas (MOGAS) storage with two dispensing nozzles, equipment, optional MSS dispensing area canopy, MSS Control Building, and secondary containment for tanks, offloading and dispensing. Site preparation will include extension of utility systems to site, preparation of site for above listed improvements, local streets and roads to support the above listed improvements, construction of site drainage retention and storm drainage systems; and construction of site security fencing and gates.

The project includes a base bid and eight (8) bid options for additional items.

The fuels storage complex site is located southwest of the intersection of 46th Street North and Mingo Road on the Tulsa Air National Guard Base, Tulsa County, Oklahoma.

1.10 PROPOSAL FORMAT

See Section 00 22 11 for Proposal requirements.

1.11 JOINT VENTURE PROPOSAL REQUIREMENTS

When proposing as a joint venture, all members of the joint venture shall sign the SF 1442 and the bid bond unless a written agreement by the joint venture is furnished with the proposal designating one firm with the authority to bind the other member(s) of the joint venture. In addition, a copy of the joint venture agreement shall be submitted with the proposal. Failure to comply with the foregoing requirements may eliminate the proposal from further consideration. If this is an 8(a) or HubZone joint venture, the offeror shall ensure that it complies with the applicable requirements of 13 CFR Part 124 and 13 CFR Part 126, respectively.

1.12 DEVIATIONS AND EXCEPTIONS

Deviations and exceptions to the terms and conditions of the solicitation are neither encouraged nor desired. Should the offer include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the offer may be determined “unacceptable” and thus be ineligible for the award. Should the offeror have any questions related to specific terms and conditions, these must be resolved prior to submission of the offer.

Notwithstanding the above, if deviations and exceptions are included with the offer, the offeror shall list and describe in detail the deviations and/or exceptions. All deviations and exceptions shall be fully supported with the Offeror’s rationale and shall fully explain the impact, if any, on the performance and/or specific requirements of the RFP.

1.13 GENERAL INSTRUCTIONS

1.13.1 Offers will be evaluated using the criteria under Section 00 22 11, Proposal Submission Requirements, Evaluation Criteria, and Basis for Award and compliance with the RFP technical requirements. Noncompliance with the RFP requirements will raise serious questions regarding an offeror’s technical ability to perform the services and may be grounds to eliminate the proposal from further consideration for contract award.

1.13.2 The Offer. The submission of the documentation specified under Section 00 22 11, Proposal Submission Requirements, Evaluation Criteria, and Basis for Award, will constitute the offeror’s acceptance of the terms and conditions of the RFP, concurrence with the plans and specifications, and the proposed contract type.

1.13.3 It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, in accordance with FAR Part 15.306, the Government reserves the right to hold discussions if necessary. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency in accordance with (IAW) FAR Part 15.306(c)(2).

1.13.4 In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the contracting officer (KO) in writing with supporting rationale. 52.215-22 LIMITATIONS ON PASS-THROUGH CHARGES--IDENTIFICA TION OF SUBCONTRACT

EFFORT (OCT 2009)

(a) Defmitions. Added value, excessive pass-through charge, subcontract, and subcontractor, as used in this provision, are defined in the clause of this solicitation entitled "Limitations on Pass-Through Charges" (FAR 52.215-23).

(b) General. The offeror's proposal shall exclude excessive pass-through charges.

PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION CRITERIA, AND

BASIS OF AWARD

1.0 OVERVIEW.

This is a competitive best value Lowest Price Technically Acceptable (LPTA) solicitation for a construction contract for the FY20 Fuels Storage Complex located at Tulsa Air National Guard, Tulsa County, Oklahoma.

1.1 WHO CAN SUBMIT

1.1.1 All firms registered in the System for Award Management are authorized to submit proposals.

1.1.2 Organization Conflicts of Interest (OCI) Disclosure: The Offeror shall provide a disclosure statement with its proposal which concisely describes all the relevant facts concerning the past or present organizational conflicts of interest relating to work on this project. In the same statement, and if applicable, the Offeror shall provide information to assure the Government that the conflicts of interest have been mitigated and/or neutralized to the maximum extent possible. If a conflict of interest is discovered after award of this contract, the Contracting Office will make a decision whether to terminate the contract.

2.0 BASIS OF AWARD.

Award will be made to the acceptable proposal meeting or exceeding the technical acceptability standards for non-cost factors and is the lowest price of all acceptable proposals and is found fair and reasonable by the Contracting Officer. Tradeoffs are not permitted. Proposals are evaluated for acceptability but not ranked using non-cost/price factors. The Government will not award a contract to a Firm whose proposal contains a deficiency, as defined in FAR 15.001. The Government reserves the right to reject any offer if the offer is not in the best interest of the Government.

3.0 PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS.

3.1 REQUIREMENTS FOR SEPARATE PRICE AND TECHNICAL PROPOSALS.

3.1.1 Each offeror must submit both a price proposal and a technical proposal. The price proposal and the technical proposal must be submitted as separate volumes.

Ensure that the outside of each separate volume is clearly marked to indicate its contents; and the identity of the offeror. Additionally, clearly identify the “original” price proposal and the “original” technical proposal on the outside cover.

3.1.2 Both the price proposal and the technical proposal must be received by the closing date and time set for receipt of proposals.

3.1.3 No dollar amounts from the price proposal are to be included in the technical proposal.

3.1.4 All information intended to be evaluated as part of the Technical Proposal must be submitted as part of the Technical Proposal (Volume 1). Do not merely cross-reference similar material in the Price Proposal, or vice versa. Also, do not include links to websites in lieu of incorporating information into your proposal.

3.1.5 Deviations, Exception and Assumptions

3.3.1 Submit only the hard-copy paper documents and the electronic files specifically authorized and/or required elsewhere in this section. Do not submit excess information, to include audio-visual materials, electronic media, etc. All pages should be numbered.

3.3.2 Use only 8.5” by 11” inch paper for submissions, unless another paper size is specifically authorized elsewhere in this section for a particular submission. Do not use larger paper sizes (e.g., 11” x 14” or 11” x 17” sheets) unless specifically authorized in this section for a particular submission. Do not use a font size smaller than 10, an unusual font style such as script, or condensed print for any submission. All page margins must be at least 1 inch wide, but may include headers and footers.

3.3.3 “Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the Offeror’s technical proposal. Offerors that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must be clearly marked in accordance with the instructions at FAR 52.215-1, “Instructions to Offerors—Competitive Acquisition”, paragraph (e), “Restriction on disclosure and use of data.”

3.3.4 For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages. Where authorized, fold-out pages (11" x 14" or 11" x 17") will count as one page. Table of Contents, proposal cover letters, and tabs between proposal information do not count toward any page limitations in the proposal.

3.3.5 Proposal revisions shall be submitted as page replacements with revised text readily identifiable, e.g., bold face print or underlining. The source of the revision, e.g., Error, Omission, or Clarification, or amendment shall be included and be annotated for each revision. Proposal replacement pages shall be numbered, shall be clearly marked “REVISED”, shall show the date of revision, shall be submitted in appropriate number of copies (e.g., if two (2) copies of the original page was required, then two (2) copies of the revised page will also be required, and shall be a different color than the original pages they are to replace).

3.4 SPECIFIC INSTRUCTIONS FOR THE TECHNICAL PROPOSAL – FACTORS 1 – 4

3.4.1 Number of Sets of the Technical Proposal. Submit one (1) electronic copy of the Technical Proposal. Submission shall contain the entire proposal in .pdf format using Adobe Acrobat software to print to a .pdf file; do NOT scan the document(s) into a .pdf file. The text portion of the complete proposal shall be contained as a searchable single .pdf file. Sections of the proposal shall be bookmarked (linked to the index) in logical order with bookmarks clearly identifying the contents of each section.

3.4.2 Format and Contents of the Technical Proposal and List of Tabs The proposal shall be organized using the tabs specified in Section 4.0.

3.4.3 Page Limitations. The maximum number of pages for the Technical Proposal is 24 pages single sided or 12 pages double sided. The Organizational Chart and Summary Schedule can be up to 11” x 17”. The Table of Contents, Cover Sheets, Section Tabs, and the Past Performance Questionnaires (PPQs) will also not count against the page count. Each page shall be sequentially numbered for that section.

5.0 VOLUME 1 – TECHNICAL PROPOSAL.

Submit detailed responses to the evaluation factors under each of the tabs as follows.

5.1 VOLUME 1 – TAB A: FACTOR 1 – Experience on Similar Contracts.

This factor will evaluate the offeror for its experience in successful completion of design/bid/build projects of similar scope, magnitude and complexity completed in the USA within the past five years. Projects completed over five years ago may be submitted to demonstrate ability, but they will carry little weight in the evaluation and will not be used to meet the standard for acceptability.

5.1.1 Submission Requirements. For this factor, the offeror should submit three (3) examples of construction projects which best illustrate the experience of the construction contractor on projects of similar function, scope, complexity, and dollar value as the requirements for this solicitation. Each project summary should consist of a maximum two page narrative of the example project, discussing the project and providing specifics as noted herein. No more than three (3) projects may be submitted.

If more than three (3) projects are submitted, only the first three (3) listed in the proposal will be evaluated. Each project cited must have a construction dollar value greater than $10 million and have been completed in the USA within five (5) years from the date that the proposal for this solicitation is due. Indefinite-Delivery, Indefinite Quantity (IDIQ) Contracts, where numerous Task Orders are summed to meet the minimum construction dollar value identified herein, are not acceptable. Only those projects for which the offeror was the prime contractor or was a Subcontractor with a large percentage (50% or more) of the related work shall be submitted. All projects submitted must have been completed by the office that will be performing the work. The summaries should include project types that are similar to the Fuels Storage Complex at Tulsa ANG, Oklahoma. Similar project types are:

5.1.1.1 Fuels Storage Complex, to include above-ground fuel storage tanks, truck unloading stands, refueler loading stands, equipment canopies, administrative, control, and maintenance facilities, and military service station.

5.1.1.2 The Government requires that project examples submitted be of completed projects (i.e. construction complete). Projects still under construction will not be evaluated.

5.1.1.3 Each project summary must include the following for each project: a description/scope; picture/photo; firms on the proposed team that performed this project, construction contract award amount; final construction cost; location; date when the project was started; original contract finish date and actual finish date. Narratives of each project must include a brief overview of each project and its relevance to this solicitation. All summaries should contain the name, address, telephone number, and e-mail address of a representative of the owner (as well as one alternate individual not affiliated with your firm) familiar with your firm’s experience on the project that can verify the experience cited.

5.1.2 Standard for Acceptability. Evaluation will be based on the project summaries provided in the offeror’s proposal. To be rated acceptable, at least two of the project examples submitted must be similar in function, scope, complexity, and dollar value to this solicitation and clearly demonstrate the offeror’s abilities to execute the projects successfully while maintaining cost and schedule. Characteristics, such as size, complexity, dollar value, the number and types of trades employed, may be indicative of similarity. Projects that do not meet the similarity criterion identified above will be rated unacceptable for this factor. Projects that appear to have been performed by a Contractor’s office other than the regional office that will be performing the work will not be rated. Projects that are less than 75% complete will be not be rated. Projects cited which indicate the offeror was not the prime contractor or a subcontractor with more than 50% or more of the fuel related work will not count as one of the two required projects. Omission of requested information may result in an unacceptable rating.

5.2 VOLUME 1 – TAB B: FACTOR 2 – Past Performance.

This factor will evaluate each offeror’s demonstrated recent and relevant record of performance in completion of those projects identified in Tab A. The past performance is an indicator of the likelihood of the successful completion of the project by the offeror.

5.2.1 Submission Requirements. Submit information on the recent and relevant contracts identified in Factor 1, demonstrating your capability to perform the proposed effort in accordance with the RFP. The information submitted shall be in accordance with the following instructions:

5.2.1.1 The Past Performance Questionnaire (PPQ) included in the solicitation (Attachment 1) is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal. Ensure correct phone numbers and email addresses are provided for the client point of contact. Complete Past

Performance Questionnaires should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contact and client information for the respective project(s).

Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government point of contract, CPT Jason Floyd via email at Jason.L.Floyd@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. Also include performance recognition documents received within the last five (5) years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition. The Past Performance Questionnaire (PPQ) will not be included in the page count. Format for Past Performance Questionnaire (PPQ) has been provided at the end of Section 00 22 11 titled: NAVFAC/USACE Past Performance Questionnaire (PPQ).

5.2.1.2 In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may be include, but are not limited to, CCASS, ACASS, past performance information retrieved through the Past performance Information retrieval System (PPIRS), including Contractor Performance Assessment Reporting Systems (CPARS), using all CAGE/DUNS number of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owners representatives(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.

5.2.1.3 While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the Offeror.

5.2.1.4 “Confidential” projects cannot be submitted unless all of the information required for evaluation purposes as specified herein can nonetheless be provided to the Government as part of the Offeror(s) technical proposal. Offeror(s) that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must be clearly marked in accordance with the instructions at FAR 52.215-1, “Instructions to Offeror(s)— Competitive Acquisition,” paragraph (e), “Restriction on disclosure and use of data.”

5.2.1.5 Past performance information pertaining to a proposed subcontractor cannot be…
