About this file
This document is a Bidder Questions and Answers response issued by the Michigan Department of Health and Human Services for RFP 260000001094, concerning the Michigan Women, Infants, and Children (WIC) Infant Formula Rebate Program. The RFP seeks a manufacturer to serve as the sole rebate-eligible infant formula provider for Michigan's WIC program. Bid submissions were originally due on April 6, 2026, with a public bid opening scheduled for April 8, 2026, at 11:30 AM Eastern Time following the submission deadline at 9:30 AM. The State anticipates posting responses to bidder questions by March 17, 2026, providing over 13 business days for bidders to prepare proposals. The contract term is five years with no renewal options. The awarded contract will consist of the Contract Cover Page, Authorized Signatures, Standard Contract Terms, Schedule A (Statement of Work), and Schedule B (Pricing), with an anticipated effective date upon full execution.
Award determination will be made using a two-step evaluation process wherein only proposals receiving a PASS rating in Step 1—based on submission of completed Schedule C (Bidder Response) and Bidder Wholesale Price List/Catalog—advance to Step 2 for pricing evaluation. The contract will be awarded to the manufacturer providing the lowest total monthly net cost in accordance with Federal WIC Regulations, with no other preferences applicable. Pricing for the contract is governed by Schedule B, the Bid Pricing Sheet, which bidders must submit with nationally published wholesale price lists effective on bid opening day. The State will notify all bidders of the award recommendation through posting on SIGMA Vendor Self Service (VSS) under the title "Notice of Intent to Award RFP 260000001094 WIC Infant Formula Rebate Program." Complete submitted proposals are available only through Freedom of Information Act (FOIA) requests to MDHHS-FOIA@michigan.gov. The State will contact authorized vendors at least 90 days prior to contract implementation to ensure adequate ordering time for new contract formulas.

Please provide additional data to substantiate the numbers listed here, and additional context as to why the numbers do not align with the total infants shown on the bid sheet. |

For a formula that reconstitutes to 98 fluid ounces, the distribution would be as follows for a fully formula fed infant: |
Month 0: 9 cans Months 1-3: 8 cans each month Month 4: 10 cans Month 5: 9 cans Months 6-11: 7 cans each month
40.
Schedule A - Statement of Work - Section 1.1.12
28
Price increase timing is confidential and proprietary. Requiring sixty (60) days advance notice would be a disadvantage to the Contractor. Please revise this section to allow for notification at the same time as other customers or at least 30 days prior to any change in the wholesale prices.
The section will remain as stated.
41.
Schedule A - Statement of Work - Section 1.3. B.2
28
Please confirm that the State would substitute an appropriate alternate brand of the Contractor’s product line prior to issuing a non-contract brand. If not confirmed, please list all the reasons why the state will not substitute an appropriate alternate brand of the contracted infant formula prior to issuing a non-contract brand.
The language provided in Schedule A, Statement of Work, Section 1.3.B. will remain as stated.
42.
Schedule A – Statement of Work, 1. General Requirements, 1.3 Formula Supply and Safety Requirements and Procedures, B. Guarantee Supply and Safety of Infant Formula
28
Provided the contractor can provide sufficient quantities of available forms to support WIC demand, there should be no reason to issue non-contract brand formulas and ask the contracted manufacturer to provide a rebate.
The language provided in Schedule A, Statement of Work, Section 1.3.B. provides a comprehensive review of various scenarios impacting sufficient quantities of infant formula.
43.
Schedule A - Statement of Work - Section 1.3. B.2
29
Please confirm the State will notify the Contractor whenever submitting an application for a USDA waiver that may impact the Contractor.

44.
Schedule A – Statement of Work, 1. General Requirements, 1.3 Formula Supply and Safety Requirements and Procedures, B. Guarantee Supply and Safety of Infant Formula, d., e.
29
Please combine section d. and e. and clarify that they apply to Supply Chain Disruptions and Shortages. Please revise to state that contractor will use best efforts to provide information as appropriate, subject to direction from FDA. Infant formula manufacturers take direction from the FDA on appropriate and timely communications and actions with regards to recalls and shortages.

45.
Schedule A - Statement of Work - Section 1.3. B.3
30

46.
Schedule A – Statement of Work, 1. General Requirements, 1.3 Formula Supply and Safety Requirements and Procedures, B. Guarantee Supply and Safety of Infant Formula, 3.
30
Please alter this language to reflect that in Emergency Situations affecting clean water supply, the State would supply contracted/rebated ready to feed formula first. And only after depleting the contracted/rebated ready to feed, the State would utilize non-contract brands ready to feed formulas, however the State would not seek a rebate on these competitive formulas.
If this contract language is not altered, and if the response to the above question indicates that the State would be seeking rebates for competitive products in the event of an Emergency Situation, this provision could have a material impact on the way a manufacturer views and evaluates the liabilities and costs associated with this contract. Please explain why it is appropriate for the contractor to pay for competitive products in situations of emergencies, including clean water supply issues and natural disasters that are outside the contractor’s control.
The section will remain as stated.
47.
Schedule A - Statement of Work - Section 1.3.B.4.a & b

48.
Schedule A – Statement of Work, 1. General Requirements, 1.3 Formula Supply and Safety Requirements and Procedures, B. Guarantee Supply and Safety of Infant Formula, 4.
31
Please strike this section. In the event the contractor has ample supply of contract infant formulas, regardless of form, there is no need to issue competitive formula and ask the contractor to pay a rebate. Can the State please explore more cost-effective options in conjunction with other agencies (i.e. nursery water) as this would impact on the entire community, not just WIC participants.
This section will remain as stated.
49.

31
Should a contract transition occur, please provide detail as to how the State will manage the transition:

Please provide any additional details regarding the transition process if a different contract brand formula will be issued under the new contract.
Please refer to response to question 23.
50.
Schedule A – Statement of Work, 1. General Requirements, 1.5 Transition
31
If there is a change in the manufacturer, please confirm each of the State Agencies will contact their authorized vendors to notify them of such change? We request the State Agencies agree to notify their authorized vendors 90 days prior to the start date of the contract to ensure adequate time for vendors to place orders for the new contract formulas?
Yes, the State will contact our authorized vendors at least 90 days prior to implementation of the new contract.
51.
Schedule A - Statement of Work - Section 2.3

60.
Schedule A - Statement of Work - Section: 5.2.B.2 Product Changes
37
A. On what basis would the State deny an infant formula that was reformulated? Since manufacturers are not making product solely for the State, to allow the State to have sole right to make final determination of what constitutes an acceptable replacement is not practical. Manufacturing a product formulated for and distributed only in the State could dramatically affect a manufacturer’s ability to execute the requirements of this contract. Please remove this section.
B. If not removed, please provide the reasons that the State feels that this provision is in the best interest of the Department, the State, WIC infant participants and the Contractor.
As stated in the Code of Federal Regulations, the State agency may choose to approve for issuance some, none, or all of the winning bidder's other infant formula(s)(7 C.F.R. § 246.16a(c)(9)). See also 7 CFR 246.10(d)(2)(ii).
For example, if the contractor reformulated a State-authorized formula that the State did not feel was nutritionally equivalent to its previous version, the State may choose not to authorize the reformulated product.
Refer to 5.2.B.4 for language regarding the Primary Contract Brand Infant Formula.
