About this file

This is a Schedule C Bidder Response form for Request For Proposal No. 260000001094 issued by the Michigan Department of Health and Human Services (MDHHS) for the WIC Infant Formula Rebate Program. The RFP seeks a contractor to manage the rebate program for infant formula products distributed through Michigan's WIC (Women, Infants, and Children) program. Bidders must demonstrate compliance with multiple specifications and requirements outlined in Schedule A, including product specifications, formula supply requirements and procedures, quality assurance programs, transition plans, data retention and retrieval functionality, timeframes, acceptance criteria, contractor representation, organizational structure, pricing terms, payment methods, risk management protocols, and work plan deliverables. All evaluation responses operate on a PASS/FAIL basis, with any section receiving a FAIL determination resulting in the proposal being ineligible for award consideration. Proposals that receive PASS determinations for all required sections advance to the pricing evaluation stage outlined in Schedule B.

Bidders are required to submit their nationally published wholesale price lists effective on the day of bid opening for each type and form of infant formula in their product line as part of their proposal response. The evaluation process follows a two-step procedure, with Step 1 addressing pass/fail compliance requirements and Step 2 evaluating pricing submissions from Schedule B. Bidders must affirm agreement to the Standard Contract Terms and comply with federal regulations under the Federal Food, Drug, and Cosmetic Act (21 USC 301 et seq) and CFR 246, which governs WIC program requirements. The contract involves rebate calculations, payment procedures, error handling, and vendor question worksheets related to risk management provisions.
