About this file
This document is a Vendor Preference Certificate issued by the State of West Virginia Purchasing Division under West Virginia Code 5A-3-37, which provides a framework for qualifying vendors to request preference considerations based on residency status and other criteria. The certificate does not apply to construction contracts and serves as an evaluation method applied only to cost bids at the time of bid submission. The Purchasing Division retains authority to determine vendor preference eligibility. Vendors may apply for preference by certifying their qualification under one of seven distinct categories, with preference percentages ranging from 2.5% to 5% depending on the criteria met. The preference categories encompass individual and business resident vendors meeting four-year West Virginia establishment requirements, non-resident vendors with significant state employment or affiliates, vendors certifying 75% employment of West Virginia residents during contract performance, veteran-owned businesses meeting residency requirements, and certified small women- and minority-owned businesses.
Vendors submitting the certificate must certify under penalty of law that all information is true and accurate, and must immediately notify the Purchasing Division in writing of any changes to their circumstances during the contract term. The Secretary of Revenue may reject bids or assess penalties up to 5% of the bid amount if a preference-receiving bidder fails to maintain qualification requirements. By submitting the certificate, bidders authorize disclosure of business tax compliance information by the Department of Revenue to the Director of Purchasing, excluding confidential tax details. Bidders must provide any reasonably requested information to verify preference eligibility and acknowledge that penalties may be paid to the contracting agency or deducted from unpaid contract balances.
