About this file

This is a Purchasing Affidavit form required by the State of West Virginia Purchasing Division under W. Va. Code 5A-3-10a. The form serves as a mandatory certification document that must be completed by vendors or prospective vendors seeking to enter into contracts with the state or any of its political subdivisions. The affidavit requires the vendor's authorized signatory to affirm under penalty of law for false swearing that neither the vendor nor any related party owes a debt greater than one thousand dollars in the aggregate to the state or its political subdivisions, and that neither party is in employer default as defined by state law.

The affidavit defines key terms including "debt" as any assessment, premium, penalty, fine, tax, or other amount owed due to judgment, violation, or default; "employer default" as an outstanding balance to workers' compensation funds, policy default, or failure to maintain mandatory coverage; and "related party" as any individual, corporation, partnership, or entity with ownership or contractual relationship to the vendor that will receive or control a portion of benefit or profit representing five percent or more of the total contract amount. The form includes an exception allowing vendors who have contested taxes, workers' compensation premiums, or fees and have not reached final judgment, or who are in compliance with an established payment plan, to proceed with contracting. The affidavit must be notarized and includes signature blocks for the vendor's authorized representative, notary public, and required commission expiration dates.
