About this file
This is a Vendor Preference Certificate form issued by the State of West Virginia's Purchasing Division to allow qualifying vendors to request preference consideration based on residency status in accordance with West Virginia Code 5A-3-37. The certificate does not apply to construction contracts and serves as an evaluation method that applies only to the cost bid submitted. Bidders may apply for preference at the time of bid submission, and the Purchasing Division makes the final determination of vendor preference eligibility. The form does not specify particular products, services, project quantities, response dates, due dates, site visits, bidders' conferences, or award dates, as it is a general certification document applicable across multiple contract opportunities.
The certificate establishes multiple preference categories and corresponding percentage discounts applied to bids. Bidders may qualify for 2.5% preference based on four years of continuous residency or principal place of business in West Virginia; an additional 2.5% preference if employing at least 75% West Virginia residents over the contract term; a combined 5% preference if meeting both previous requirements; a 3.5% preference for veteran-owned resident businesses; or preference as a certified small, women- and minority-owned business. Bidders must certify under penalty of law that all information provided is true and accurate and agree to notify the Purchasing Division immediately of any changes during the contract term. The form also authorizes the Department of Revenue to disclose business tax verification information to the Director of Purchasing. Non-compliance with preference requirements may result in bid rejection or penalties up to 5% of the bid amount, payable to the contracting agency or deducted from contract balances.
