About this file
This is a Vendor Preference Certificate issued by the State of West Virginia's Purchasing Division to allow qualifying vendors to request residency-based or veteran-based preferences at the time of bid submission. The certificate applies to all contracts except construction projects and is used to evaluate vendor eligibility for preference consideration in accordance with West Virginia Code 5A-3-37. The document outlines seven categories of preference eligibility, with vendors required to certify their qualification status and submit the completed certificate with their bid. Bidders must disclose any changes to their qualification status during the contract term and authorize the Department of Revenue to verify business tax compliance with the Purchasing Division.
The preference structure provides tiered discounts applied to bid costs: 2.5 percent for resident vendors with four years continuous West Virginia presence or headquarters location, 2.5 percent for vendors meeting employment requirements of 75 percent West Virginia residents over a two-year period, 2.5 percent for nonresident vendors with qualified affiliates or subsidiaries meeting similar employment standards, five percent for vendors meeting multiple criteria simultaneously, and 3.5 percent for veterans meeting residency and employment requirements. An additional preference category exists for nonresident small, women- and minority-owned businesses certified by the Purchasing Division. Bidders certifying false information face penalties up to five percent of the bid amount, payable to the contracting agency or deductible from contract balances, with authority for bid rejection at the discretion of the Secretary of Revenue.
