About this file
This is a Vendor Preference Certificate issued by the State of West Virginia Purchasing Division in accordance with West Virginia Code 5A-3-37. The document establishes the framework for qualifying vendors to request preference consideration based on residency status and other criteria at the time of bid submission. The preference is applied solely as an evaluation method to the cost bid and does not apply to construction contracts. The State of West Virginia Purchasing Division retains authority to make final determinations regarding vendor preference eligibility.
The document outlines seven distinct preference categories with varying percentage benefits: 2.5% preference for resident vendors or partnerships/corporations with continuous West Virginia headquarters for four years; 2.5% preference for resident vendors employing 75% West Virginia residents throughout the contract term; 2.5% preference for nonresident vendors maintaining West Virginia operations with 75% state employee representation; 5% preference for vendors meeting multiple residency and employment criteria; 3.5% preference for veteran resident vendors meeting four-year residency requirements; 3.5% preference for veteran resident vendors with 75% state employee composition; and preference consideration for non-resident small, women- and minority-owned businesses certified by the Purchasing Division. Vendors must disclose reasonably requested information and authorize the Department of Revenue to verify business tax compliance. Bidders agree to notify the Purchasing Division immediately of any changes to their eligibility status during the contract term. Failure to maintain preference requirements may result in contract rescission or penalties up to 5% of the bid amount assessed against the vendor.
