Payment will be processed according to West Virginia state procedures on an F.O.B. destination basis. The vendor bears the risk of loss during delivery and is responsible for shipping costs. Late deliveries must be reported in writing, and delays that could cause harm to the agency may result in contract cancellation or the agency procuring the vehicle from a third party at the vendor's expense. Unacceptable items will be returned at vendor expense with no restocking charge, and vendors must either replace items or provide full credit or refund at the agency's discretion. Vendor default includes failure to provide items according to specifications, failure to comply with applicable laws and requirements, and failure to remedy deficient performance upon request.
