About this file
This is a Vendor Preference Certificate issued by the State of West Virginia's Purchasing Division in accordance with West Virginia Code 5A-3-37. The certificate allows qualifying vendors to request preference based on residency status at the time of bid submission. The preference is applied as an evaluation method to the cost bid only and does not apply to construction contracts. Vendors may apply for preference under multiple categories including individual resident vendors, partnerships, associations or corporations with continuous West Virginia headquarters for four years preceding certification, nonresident vendors with in-state affiliates or subsidiaries employing minimum state residents, resident vendors certifying 75 percent employee residency during contract performance, veterans meeting specified residency requirements, and certified small, women- and minority-owned businesses. The certificate requires bidders to certify under penalty of law that all information provided is true and accurate and to notify the Purchasing Division immediately in writing of any changes occurring during the contract term.
The vendor preference structure provides tiered benefits ranging from 2.5 percent to 5 percent cost reductions for bidders meeting various residency and employment criteria, with an additional 3.5 percent preference available for veteran-owned businesses. Bidders applying for preference must disclose reasonably requested information to the Purchasing Division and authorize the Department of Revenue to verify business tax compliance. The Purchasing Division retains authority to determine preference eligibility, and the Secretary of Revenue may impose penalties not exceeding 5 percent of the bid amount if a preference-receiving bidder fails to maintain required qualifications during contract performance, with penalties paid to the contracting agency or deducted from unpaid contract balances.
