The contractor shall develop and implement procedures to identify, prevent, and ensure non-performance and continual repeat of defective service does not occur. As a minimum, the contractor shall develop quality control procedures addressing the areas identified in paragraph 2, Service Summary.
2.2. Quality Assurance. The government will inspect and evaluate the contractor’s performance to ensure services are received in accordance with requirements set forth in this contract. The COR will use the contractor’s work schedule or modified version thereof, to record validation results. Results of the validation then become the official Air Force record of the Contractor’s performance. When a performance threshold has not been met or contractor performance has not been accomplished, the COR will initiate and provide the CO a Contract Discrepancy Report (CDR) for issuance to the contractor. The contractor shall respond to the CDR IAW instructions provided and return it to the CO within 10 calendar days of receipt.
2.2.1. Deductions for Nonconforming Service. The Government's basis for evaluating the validity of nonconforming service and associated defects by the contractor shall be determined by the Performance Objectives and associated Performance Thresholds outlined in the above table under paragraph 2.0, Services Summary.
2.2.1.1. Should nonconforming service(s) be identified by the COR, re-performance by the contractor shall be the preferred and initial method to correct associated performance deficiencies. When re-performance by the contractor does not correct the deficiency, or is not possible, and resultantly exceeds the prescribed Performance Thresholds of the Service Summary, the Government shall seek an equitable price reduction for acceptance of nonconforming services IAW FAR Clause 52.212-4(a) Contract Terms and Conditions -- Commercial Items; Inspection/Acceptance and FAR Clause 52.246.4 – Inspection of Services—Fixed Price.
2.2.1.2. Calculations for price reductions resulting from nonconforming services by the contractor will be applied as follows: Price reductions for nonconforming services are cumulative on a monthly basis, with each deduction amounting to 10% of the daily cost of the pertinent line item funding. For example, should the Contractor receive three (3) defects in a month for basic restroom/locker room cleaning services in a given category per activity, the Contractor shall receive a deduction amounting to 30% of one day’s cleaning cost for the pertinent line item of services deemed unsatisfactory after initial re-performance.
Additionally, the maximum amount of price reductions by Government shall be limited to one defect per building, per day, per service summary item, in accordance with the routine cleaning schedule provided by the Contractor. If a building falls under more than one CLIN/cleaning level, reductions shall be applied to each applicable CLIN.
2.2.1.3. For nonconforming services that the Contractor is unable to correct, and are resultantly determined by the COR to exceed the prescribed Performance Thresholds of the Service Summary, respective defects shall be documented and compiled by the COR on a monthly basis, and brought to the attention of the Contracting Officer. The Contracting Officer shall evaluate documented defects, validate accordingly, and calculate associated price reductions for monthly invoicing.
